In exercise of the powers conferred by section 38 of the Bureau of Indian Standards Act, 1986 (63 of 1986), the Executive Committee of the Bureau of Indian Standards, with the previous approval of the Central Government, hereby makes the following regulations, namely:1. Short title and commencement.-(1) These regulations may be called The Bureau Of Indian Standards (Certification) Regulations, 1988.
2. Definitions.-In these regulations, unless the context otherwise requires,
3. Manner of applying for license.-(1) Every application for the grant of a license shall be made to-the Bureau in Form I.
4. Grant of license.-(1) If the Bureau, after a preliminary inquiry, is satisfied that the applicant '[having regard to requisite skill, equipment, systems, resources, previous performance and antecedents relevant to the issuance of the license] is fit to use the Standard Mark, the Bureau shall grant a license in Form II authorising the use of the Standard Mark in respect of the article or class of articles manufactured by the applicant or in respect of the process employed in any manufacture or work, subject to such terms and conditions as specified in these regulations. The Bureau shall intimate the applicant about grant of license.3
[(1-A) Where the application for a license is made by a person, who has been convicted under section 33 of the Act, he shall not be eligible to apply for a period of six months from the date of such conviction. The period of disqualification shall be determined by the Bureau having regard to the facts and circumstances of each case and it shall not exceed a period of one year.]5. Conditions of a license.-(1) The Standard Mark shall be applied in such manner as it may be easily visible as a distinct mark on the articles or the covering or on test certificates relating to articles which cannot be labelled or covered. The Standard Mark shall be applied to only such types, grades, classes, varieties, sizes of the article for which the license has been granted. The licensee shall get the fascimile of the Standard Mark proposed to be used by him, approved from the Bureau.
6. Fees.-(1) Every application for the grant of a license shall be accompanied by a fee of [rupees one thousand] [Substituted by Notification No. G.S.R. 531(E), dated 30.7.2002 (w.e.f. 6.1.1988)] and every application for renewal of a license shall be accompanied by a fee of [rupees five hundred] [ Substituted by Notification No. BIS/EC/REG/6, dated 27.9.1994, for " three hundred rupees" .]. No such fee or part thereof shall, in any circumstance, be refunded.

FORM II(See regulation 4)BUREAU OF INDIAN STANDARDSLICENSE FOR THE USE OF STANDARD MARK LICENSE NO. CM/L1. By virtue of the powers conferred on it by the Bureau of Indian Standards Act, 1986 (63 of 1986), the Bureau hereby grant.to ................................(hereinafter called "the licensee") this license to use Standard Mark set out in the first column of the First Schedule hereto, upon or in respect of the article/process set out in the second column of the said Schedule which is manufactured in accordance with/confo.-ms to the related Indian Standard referred to in the third column of the said Schedule as from time to time amended or revised.
2. This license carries the rights and obligations stipulated in the regulations made under the above mentioned Act. In pursuance of his obligations, the licensee shall pay in due manner and time the scheduled Marking Fee set out in the Second Schedule hereto andmaintain to the satisfaction of the Bureau the Scheme of Testing and Inspection a copy of which is attached hereto.
3. This license shall be valid from to and may be renewed as prescribed in the regulations.Signed, sealed and dated this .........................day of.......................two thousand.................
