Section 86 in Jharkhand Juvenile Justice (Care and Protection of Children) Rules, 2017

86. Special Juvenile Police Unit.

(1)The State Government shall constitute a Special Juvenile Police Unit in each district and city to co-ordinate all functions of police related to children.
(2)The Central Government shall constitute a Special Juvenile Police Unit for the Railway Protection Force and state government shall constitute SJPU for Government Railway Police at every railway station as per requirement and where a SJPU cannot be set up, at least one Railway Protection Force or Government Railway Police Officer shall be designated as the Child Welfare Police Officer.
(3)Police Officers with apptitute and sensitivity must be selected at Child Welfare Police Officer not exceeding 45 years of age.
(4)The Child Welfare Police Officers and other police officers of the SJPU shall be given, appropriate training and orientation to deal with matters concerning children.
(5)The transfer and posting of the designated Child Welfare Police Officers may be within the SJPUs of other police stations or the district unit. If they are transferred outside the district as far as possible should be placed with SJPU.
(6)The police officer interacting with children shall be as far as possible in plain clothes and not in uniform and for dealing with girl child, woman police personnel shall be engaged. In case where women police personnel is not available a lady from the government or non government agency.
(7)The Child Welfare Police Officer or any other police officer shall speak in polite and soft manner and shall maintain dignity and self-esteem of the child.
(8)Where questions that may lead to discomfort of the child are to be asked, such questions shall be asked in tactful manner.
(9)When an FIR is registered for offence against a child, a copy of the FIR shall be handed over to the complainant or child victim and subsequent to the completion of investigation, copy of report of investigation and other relevant documents shall be handed over to the complainant or any person authorised to act on his behalf.
(10)No accused or suspected accused shall be brought in contact with the child and where the victim and the person in conflict with law are both children, they shall not be brought in contact with each other.
(11)The SJPU shall have a list of :
(i)the Board and Child Welfare Committee in its due jurisdiction, their place of sitting, hours of sitting, names and contact details of Principal Magistrate and members of the Board, names and contact details of Chairperson and members of the Committee and the procedures to be followed before the Board and the Committee; and
(ii)contact details of the Child Care Institutions and fit facilities in its due jurisdiction.
(12)The names and contact details of the SJPU or Child Welfare Police Officer shall be placed at a conspicuous part at the police stations, Child Care Institutions, Committees, Boards and the Children's Courts
(13)The SJPU shall work in close co-ordination with the District Child Protection Unit, the Board and the Committee in the matters concerning the welfare of children within its jurisdiction.
(14)The SJPU may coordinate with the District Legal Services Authority to provide legal aid to children.
(15)The SJPU shall meet on quarterly basis and report of such meetings shall be forwarded to Nodel Officer appointed under these rules and copy of such report also be sent to the concerned District Child Protection Unit, CID and State Child Protection Society.
(16)The SJPU shall coordinate with the District Legal Services Authority to provide legal aid to children. There shall be atleast two para legal volunteers attached to every police station who shall assist the children who come before the CWPO.
(17)The SJPU shall take cognizance of adult perpetrators of crimes against children and ensure that they are, without delay, apprehended and booked under the appropriate provisions of the law and for this purpose the district level units shall maintain liaison with other units of police stations.
(18)A Nodal Officer from police not below the rank of Inspector General of Police shall be designated to coordinate and upgrade the role of police on all issues pertaining to care and protection of children under the Act and the rules.
(19)A separate cadre shall be created for SJPU. The separate cadre can deal with cases related to children and women and the necessary action and guidelines in this regard shall be issued by Home department.
(20)SJPU officer at the district level shall be responsible for making all the police stations child friendly as per the procedures of which shall be laid down by the Home Department.
(21)The Officer heading the SJPU should not be transferred before 3 years expect in case of promotion.
(22)The CWPOs will be paid advance from District Child protection Unit in case of conducting rescue operation or for repatriation of the child to the family.
(23)Provision for each thanna to meet the child immediate expense will also be provided from Juvenile Justice Fund
(24)The Nodal Officer shall hold quarterly review of SJPU shall issue necessary directions for their effective functioning.
