The Schedule of Rate for Forest Produce in Orissa Rules, 1977Published vide Notification No. 30957-FFAH-dated 14th November 1977, Orissa Gazette, Extraordinary No. 1539, dated 24.11.1977Notification No. 30957-FFAH-dated the 14th November 1977. - In exercise of the powers conferred by Clause (d) of Section 36 of the Orissa Forest Act, 1972 (Act 14 of 1972), the State Government do hereby make the following Rules for payment to be made by the inhabitants of towns and villages in the vicinity of protected forests to take trees, timber or other forest produce for their own use and for trade.Preliminary

1. Short Title Extent and Commencement.

(1)These rules may be called The "Schedule of Rate (for Forest Produce in Orissa) Rules, 1977".

(2)They shall extend to the whole of the State of Orissa.

(3)They shall come into force in the date of their publication in the Official Gazette.

2. Definitions.

- In these rules unless the context otherwise requires-

(i)"Act" means the Orissa Forest Act, 1972;

(ii)"Bahangi load" [or "Bhar load" or "Kawar load"] [Inserted vide Orissa Gazette Extraordinary No. 242/24.2.1978.] means materials carried with the help of a pole resting on the shoulder with material at either end [* * *] [Deleted vide Orissa Gazette Extraordinary No. 1181/21.8.1978.]

(iii)"Cart load" means materials carried in a cart drawn by bullock(s) or buffalo(es) [* * *] [Deleted vide Orissa Gazette Extraordinary No. 1181/21.8.1978.]

[(iii-a) "Guttia load or Sagar load" means materials carried in a cart drawn by a bullock or a buffalo [* * *] [Inserted vide Orissa Gazette Extraordinary No. 242/24.2.1978.](iii-b) "Builock or Buffalo load" means materials carried with the help of a bullock of a buffalo [* * *] [Deleted vide Orissa Gazette Extraordinary No. 1181/21.8.1978.] ]

(iv)"Firewood" means billets of wood [* * *] [Deleted vide Orissa Gazette Extraordinary No. 242/24.2.1978.] not fit for any purpose other than firewood;

(v)"Forest produce for own" use means forest produce removed from the protected forests for the personal consumption in the village or town, as the case may be, and not for sale or barter;

(vi)"Form" means the form appended to these rules;

(vii)"Head load" means materials carried on head not weighing more than twenty kilograms;

(viii)"Inhabitant" means a person owning land and/or house in the village or town, as the case may be, and living in the said village or town for not less than six months in the year;

(ix)"Permit" means a permit issued by an authority competent to issue the same under these rules;

(x)"Reserved trees" means trees which have been declared as reserved under Clause (a) of Section 34 of the Act;

(xi)"Schedule" means the Schedules attached to these rules;

(xii)"Vicinity" means the area within which inhabitants of a village or town used to exercise the right of taking forest produce at concessional rates immediately before enforcement of these rules;

(xiii)All words and expressions used in these rules but not defined therein have the same meaning as are respectively assigned to them in the Act.

Notes - Legislative changes-(a) In Sub-rule (ii) of Rule 2, the words or Bhar load or Kawar load have been inserted after the words Bahangi load, vide Orissa Gazette, Extraordinary No. 242, dated 24.2.1978; and the words "with a total weight not exceeding forty kilograms" after the words "rat either end" have been deleted vide Orissa Gazette, Extraordinary No. 1181, dated 21.8.1978.

(b)In Sub-rule (iii) the words "with weight not exceeding four quintals in case of bullock-cart or six quintals in case of buffalo-cart" after the words or buffalo (es), have been deleted vide Orissa Gazette, Extraordinary No. 1181, dated 21.8.1968.

(c)Sub-rules (iii-a) and (iii-b) have been inserted vide Orissa Gazette, Extraordinary No. 242, dated 24.2.1978.

(d)In Sub-rule (iii-a) as so inserted the words "with weights not exceeding three quintals" and in Sub-rule (iii-b) with weight exceeding two quintals" have been deleted, vide Orissa Gazette, Extraordinary No. 1181, dated 21.8.1971.

(e)In Clause (iv) after the words "billet of wood" the words less than one metre in length" existed which have been deleted vide Orissa Gazette, Extraordinary No. 242, dated 24.2.1978.

3. Classification of Trees.

- For the purpose of Schedule of Rates the various species of trees are classified as Special Class, Class I, Class II and Class III as mentioned in the Schedule I.

4. Rules for Measurement of Timber and Pole.

(1)Timber and pole will be measured in multiples of ten centimetres in length and lengths below ten centimetres will be ignored for calculation of length of timber and pole.

(2)In measuring girth of timber and pole traction of one centimetre will be ignored.Explanation - For the purpose of this rule, timber means round timber which has not been squared or sawn in any way and whose birth at the out end is ninety centimetres or more and pole means timber whose girth at the butt end is less than ninety centimetres.Notes - In Explanation to Sub-rule (2) of Rule 4 the words "the rule" have been substituted for the word these rules vide Orissa Gazette, Extraordinary No. 242, dated 24-2-1978".

5. Authorisation for Issue of Permit.

- The State Government, may order, from time to time, the value up to which various categories of Forest Officers will be authorised to issue permit under these rules and until such an order is made the orders in. force prior to the commencement of these rules on the subject shall continue.

6. No Permit for Departmental Plantations.

- No permit shall be issued for sale of materials [from plantations] [Substituted vide Orissa Gazette Extraordinary No. 242/24.2.1978.] raised by the Department.Notes - In Rule 6 the words "from plantations" have been substituted for the words "for plantations vide Orissa Gazette, Extraordinary No. 242, dated 24-2-1978."

7. No Permit for Trade.

- No permit shall be issued for removal of timber, charcoal, firewood and bamboos for trade purposes : provided that such permit shall be necessary to be obtained for collecting and removing any other forest produce for trade purposes in respect of any area not covered by any subsisting lease for the same produce.

8. Issue of Permit.

- A permit shall be issued in the form appended to these rules to the inhabitants of towns and villages in the vicinity of protected forests for removal of timber, bamboos, firewood and charcoal for their own use, and of other forest produce for trade purposes on payment as mentioned in Schedule II :Provided that no permit is necessary for removal of forest produce other than timber, bamboos, firewood, charcoal for their own use.

9. Repeal and Savings.

- All rules and orders to the extent that they are repugnant to the provisions of these rules are hereby repealed:Provided that in respect of any forest produce not covered under Schedule II the rate as applicable to such produce, immediately before coming into force of these rules shall prevail revised.Form[Rule 8]
