The Maharashtra Electricity Consumption of Electrical Energy (Restriction) Order, 1974Published vide Notification G. O., I. & L. D , No. ASC. 1974/191-Elec. 3, dated 1st October, 1974 (M. G., Part 4-B, page 1143)Whereas, there is shortage of electrical energy in the State of Maharashtra and this shortage is likely to continue for some time;Now, therefore, in exercise of the powers conferred by sections 6A and 6B of the Bombay Electricity (Special Powers) Act, 1946 (Bombay XX of 1946), the Government of Maharashtra hereby makes the following Order, namely:-

1.

(1)This Order may be called the Maharashtra Electricity Consumption of Electrical Energy (Restriction) Order, 1974.

(2)It extends to the whole of the State of Maharashtra.

(3)it shall come into force on the 1st day of October, 1974.

In this Order,-(a)"Act" means the Bombay Electricity (Special Powers) Act, 1946:(b)"basic consumption" means,-save as otherwise provided in this clause,-(i)in respect of electrical energy consumed for the purpose of cotton textile industry, the actual consumption of electrical energy recorded for the month of December, 1973,(ii)in respect of electrical energy consumed for any other industrial purpose and in respect of electrical energy consumed by essential consumers, the actual consumption of electrical energy recorded for the month of January, 1974, and(iii)in respect of electrical energy consumed for any other purpose (whether commercial or domestic), the actual consumption of electrical energy recorded for the month of October, 1973 :Provided that, where a consumer using electrical energy for any of the purpose referred to in sub-clause (i) or (ii) was, due to strike, lock-out, fire, flood or breakdown of any equipment, not able to use such energy throughout the basic month, and such consumer produces before the licensee.-(a)a certificate from the Commissioner of Labour or any officer duly authorised by him certifying the occurrence of a strike or lock-out,(b)a certificate from such authorities as may be specified in that behalf by the State Government certifying the occurrence of fire or Hood, or(c)a certificate from such firm of architects or engineers or such other authority as may be specified by the State Government in that behalf certifying the breakdown of equipment specified in the certificate,then the basic consumption means the average of the electrical energy consumed during the three months immediately preceding the basic month;

(2)Where the connections are sanctioned on or after the 1st day of January, 1974 but before the 1st day of May, 1974 for cotton textile industry or where the connections are sanctioned on or after the 1st day of February, 1974 but before the 1st day of May, 1974 for any other industrial purpose or where the connections are sanctioned on or after the 1st day of November, 1973 but before the 1st day of May, 1974 for any commercial or domestic purpose, the actual energy consumed in the six months from and inclusive of the month in which the connections were sanctioned;

(3)Where the connections are sanctioned to a consumer or after the 1st day of May, 1974 for the cotton textile industry or any other industrial purpose,-

(a)

(i)two units per day per KW of connected load, if the industry is operating on one shift basis,

(ii)four units per day per KW of connected load, if the industry is operating on two shift basis,

(iii)six units per day per KW of connected load, if the industry is operating on three shift basis, and

(iv)nine units per day per KW of connected load, if the industry is operating on a continuous process basis;

(b)the actual consumption in the month of September, 1974 whichever is higher,

if such consumer claiming to operate on more than one shift basis produces a certificate before the licensee to that effect from an officer of the State Factory Inspectorate duly authorised by the State Government in this behalf and a consumer claiming to operate on a continuous process basis produces a certificate to that effect before the licensee from an officer to the Directorate of Industries duly authorised by the State Government in this behalf;

(4)[ Where the connections are sanctioned on or after the 1st day of May, 1974 for commercial or domestic purposes,-Domestic purposes.-

(i)one unit per day per KW of connected load; or

(ii)the actual consumption in the month of September, 1974; or

(iii)the average monthly consumption of the consumer during six billing months immediately preceding the month of June, 1979, whichever is higher :

Provided that, the State Government or such Officer as the State Government may authorise in this behalf may, in the case of any consumer or class of such consumers by order in writing, fix any other basic consumption regard being had to the special circumstances of the case recorded in such order;Commercial purposes.-

(A)Four units per day per KW of connected load for all commercial consumers except residential hotels; or

(B)Six units per day per KW of connected load for residential hotels; or

(C)The actual consumption in the month of September, 1947; or

(D)The average monthly consumption of the consumer during six billing months immediately preceding the month of June, 1979, whichever is higher :

Provided that, the State Government or such Officer as the State Government may authorise in this behalf may in case of any consumer or class of such consumers by order in writing fix any other basic consumption regard being had to the special circumstances of the case recorded in such order.] [Substituted by G. (c)"basic month" means the month with reference to which the basic consumption provided by sub-clause (b);

(d)"essential consumers" means the consumers specified in Schedule 'A' hereto annexed and such other consumers as the State Government may by an order in writing declare from time to time to be essential consumers;

(e)"industries operating on a continuous process basis" means the industries specified in Schedule 'B' hereto annexed and such other industries as the State Government may by an order in writing declare from time to time be industries on a continuous process basis;

(f)"licensee" means any of the licensees specified in Schedule 'C' hereto annexed;

(g)"seasonal industries" means the industries specified in Schedule 'D' hereto annexed and such other industries as the State Government may by an order in writing declare from time to time to be seasonal industries;

(h)"service industries" means the industries specified in Schedule 'E' hereto annexed and such other industries as the State Government may by an order in writing declare from time to time to be service industries.

No consumer receiving supply of electrical energy from any of the licensees and consuming or using electrical energy for any of the purposes specified in column 1 of Schedule 'F' hereto annexed shall consume or use during any month electrical energy in excess of the ceiling specified opposite thereto in column 2 of that Schedule (hereinafter referred to as "the monthly ceiling").

No consumer shall use electrical energy for purposes of neon signs and display lighting except between the hours of 7.00 p.m. and 11.00 p.m.

(1)The State Government hereby authorises all the licensees for the purposes of sub-clause (ii) of clause (b) of section 6B of the Act both as regards discontinuance and recommencement of the supply of the electrical energy to consumers, except in case of consumers specified in Schedule B'.

(2)In exercising the authority specified in sub-clause (1), the State Government hereby directs that the licensees shall observe the following procedure for recommencing electric supply, namely :

(a)Industrial Consumers. - (i) If a consumer consumes electrical energy in any month not exceeding seven days' average consumption of the monthly ceiling, then without disconnecting the supply of electrical energy, the consumer may be allowed to adjust the excess consumption not later than the end of the next succeeding month.

(ii)If any such consumer consumes electrical energy in any month in excess of seven days' average consumption of the monthly ceiling, the consumer shall be disconnected for such number of days as in excess of seven days' average consumption and he shall be reconnected thereafter subject to the condition that the balance of excess consumption of seven days is adjusted in the next succeeding month.

(b)Commercial or domestic consumers. - (i) If a consumer consumes electrical energy in any month not exceeding fifteen days' average consumption of the monthly ceiling, the consumer should be disconnected for three days, and he shall be reconnected thereafter, subject to the condition that the balance of the excess consumption over three days is adjusted in the next succeeding month; and

(ii)If any such consumer consumes electrical energy in excess of 15 days' average consumption or more of monthly ceiling, the consumer shall be disconnected for five days, and he shall be reconnected thereafter, subject to the condition that the balance of excess consumption over five days is adjusted in the next succeeding month;

(c)The adjustments provided in sub-clauses (a) and (b) shall not be permitted for more than two consecutive months.

6. Nothing in this order shall apply to consumption of electrical energy for purposes of -

(i)Railway traction;

(ii)Public Water Supply;

(iii)Lifts and Water Pumps;

(iv)Agricultural Pumps;

(v)Water Works and Irrigation Projects executed by Government of local authorities;

(vi)Coal Mines;

(vii)Trombay Fertilizer Plant;

(viii)Flour Mills (small, that is, Chakkies).

	(ii) In the case of consumers whose monthly basic consumptionexceeds 120 units.	80 per cent, of the basic consumption per basic month.

Provided that, direct export oriented and defence oriented industries shall be entitled to a rebate on the basis of their Export or Defence production or of both in relation to the total production as indicated in the table below :-

Any fraction of the percentage of production shall be adjusted to the nearest whole number.The rebate may be claimed by a consumer only on his producing before the licensees a certificate in this behalf from the officer of the Directorate of Industries duly authorised by the State Government in this behalf.Nothing in this proviso shall apply to essential consumers and service industries.

(b)	Consumption of electrical energy for commercialpurposes -
	(i) In the case of consumers whose monthly basicconsumption of electrical energy for lights, fans and powers isnot less than 50 units and does not exceed 62 units.	50 units per basic month.
	(ii) In the case of consumers whose monthlybasic consumption of electrical energy for lights, fans and powerexceeds 62 units.	75 per cent, of basic consumption per basic month.
(c)	Consumption of electrical energy in premisesused for residential purposes, including premises in theresidential colonies attached to High Tension consumers -
	(i) In the case of consumers whose monthly basicconsumption of electrical energy is not less than 25 units anddoes not exceed 31 units.	25 units per basic month.
	(ii) In the case of consumers whose monthlybasic consumption of electrical energy exceed 31 units.	75 per cent. of the basic consumption per basic month.
(d)	Consumption of electrical energy by essentialconsumers -
	(i) Part I thereof	96 per cent.
	(ii) Part II thereof	94 per cent.
(e)	Consumption of electrical energy by serviceindustries -
	(i) Part I thereof	96 per cent.
	(ii) Part II thereof	94 per cent.
(f)	Consumption of electrical energy by operating ona continuous process basis.	88 per cent.
(g)	Consumption of electrical energy by consumersincluding Government, local authorities or corporations owned orcontrolled by Government for purposes other than those referredto in clauses (a), (b), (c), (d), (e) and (f) -
	(i) In the case of consumers whose monthly basicconsumption of lights, fans and power is not less than 50 unitsand does not exceed 62 units.	50 units per basic month.
	(ii) In the case of consumers whose monthlybasic consumption of electrical energy for lights, fans and powerexceeds 62 units.	75 per cent, of the basic consumption per basic month.
(h)	Seasonal Industries.	Consumption equivalent to the consumption recorded in thecorresponding billing month of the last preceding years subjectto a ceiling of 80 per cent.
(i)	Street lights -
	Towns having a population of one lakh or more.	67 per cent
	Towns having population less than one lakh.	75 per cent.
	Explanation.- For the purposes of clause(i) of this Schedule, "population" means the populationas ascertained at the last preceding census of which the relevantfigures, whether provisional or final, have been published.
(j)	Touring Cinemas.	15 units per day inclusive of lighting load.
