The Orissa Pharmacists (Special Examination) Rules, 1962Published vide Notification No. 19377-H., dated 18th August, 1962, Orissa Gazette Extraordinary No. 414/21.8.1962Notification No. 19377-H., dated 18th August, 1962. - In exercise of the powers conferred by Section 46 read with the proviso to Sub-section (1) of Section 32 of the Pharmacy Act, 1948 (VIII of 1948) the State Government do hereby make the following rules, namely :

1.

(1)These rules may be called the Orissa Pharmacists (Special Examination) Rules, 1962.
(2)They shall come into force at once.

2.

In these rules unless the context otherwise requires-
(a)"Act" means the Pharmacy Act, 1948 (VIII of 1948);
(b)"Council" means the Orissa Pharmacy Council;
(c)"Committee" means the Special Examination Committee constituted under Rule 2 of these rules;
(d)"Form" means a Form appended to these rules;
(e)"President" means the President of the Committee;
(f)"Secretary" means the Secretary of the Committee;
(g)"section" means section of the Act.

There shall be constituted a Committee called the Special Examination Committee to conduct in accordance with these rules examination which shall be equivalent to a Matriculation Examination consisting of the following, namely :
(1) Principal, Shriram Chandra Bhanj Medical College ... President
(2) Dr. K. N. Ojha, Professor of Pharmacology of Shriram ChandraBhanj Medical College ... Secretary
(3) Dr. J. K. Mohanty, Professor of Pharmacology, Burla MedicalCollege, Sambalpur ... Member
(4) Dr. P. K. Kar, Assistant Professor of Pharmacology, ShriramChandra Bhanj Medical College ... Member
(5) Shri V. L. Narsinha Rao, Lecturer in Pharmacology, ShriramChandra Bhanj Medical College ... Member.

The Pharmacists (Compounders and Dispensers) who have not passed Matriculation or an equivalent examination but have passed the Compoundership Examination under the State Government shall be eligible to be registered under the Act if they pass the special prescribed examination under these rules.

5.

The syllabus for the Special Examination shall be as follows :
(a)A paper on translation of a simple passage from Oriya to English of High School Certificate Examination standard.
(b)Simple Arithmetic of High School Certificate Examination standard.

6.

(1)The application for admission to the examination shall be submitted to the Secretary in Form I within such time before such examination as may be notified by the Secretary and shall be accompanied by-
(a)The Original Compounder's pass certificate;
(b)A declaration by the candidate that he has attained the age of 18 years before commencing the work as a compounder;
(c)An examination fee of Rs. 20;
(d)Two copies of passport size photos of the candidate, one of which shall be attested by M.L.A. of the constituency by any of the following authorities under official seals ;
(1)the Chairman of the Municipality concerned if the applicant resides in an urban area;
(2)the Chairman of Zilla Parishad or Panchayat Samiti concerned if the applicant resides in rural area;
(3)a Gazetted Officer of the State Government;
(4)a Member of the Orissa Medical Council or Pharmacy Council.
(2)The attested copy of the photos shall be retained by the Secretary of the Committee for identification of the candidate in the examination hall. The Secretary shall issue admit card to each candidate, qualified to sit for the examination in Form II, on which the other copy of the photo shall be fixed.

7.

The examination shall be held at the following places :
(1)S.C.B. Medical College, Cuttack
(2)Burla Medical College, Burla
(3)Headquarters Hospital, Berhampur
(4)Headquarters Hospital, Puri
(5)Headquarters Hospital, Balasore
(6)Headquarters Hospital, Koraput
(7)Headquarters Hospital, Phulbani
(8)Headquarters Hospital, Keonjhar
(9)Headquarters Hospital, Dhenkanal
(10)Headquarters Hospital, Bhawanipatna
(11)Headquarters Hospital, Bolangir
(12)Headquarters Hospital, Sundargarh
(13)Headquarters Hospital, Baripada.

8.

The candidates shall have the option of answering the paper on Arithmetic in Oriya though the questions shall be set in English.

9.

(1)Time allotted for both the papers shall be two hours.
(2)Full marks and minimum pass marks for each subject shall be as follows :

(2) Arithmetic 100 30

10.

After the results of the special examination are completed the President shall issue to successful candidates pass certificate in Form III. He shall advise them to apply to the Orissa Pharmacy Council for registration immediately with the requisite fee explaining the dangers the delay may involve.

11.

The paper or papers shall be set by paper-setters appointed by the Committee.

12.

The Examiners shall be appointed by Committee. The number of Examiners to be appointed for the examination will be determined by the Committee on the basis of the number of candidates that will apply for the examination.

13.

A fee of Rs. 15 shall be paid to each paper-setter for setting a paper.

14.

(i)The scale of remuneration to the Examiners shall be for examining each answer paper in translation or Arithmetic Rs. 0.50 nP.
(ii)The remuneration of Presiding Officers will be at Rs. 20 each.
(iii)The remuneration of invigilators who may be appointed at the written examinations will be Rs. 3 each per day.

15.

The written examinations will commence at the time and dates fixed by the Committee and will be held in the order stated in the rules, if not otherwise determined by the Secretary for special reasons.

16.

The Secretary (or in his absence an officer deputed by him) shall ordinarily be the Presiding Officer responsible for the proper conduct of each examination.

17.

No candidate suffering from any form of contagious sickness, will be allowed to present himself for the examination. Candidates suffering from an illness or disease which would render their presence in any way prejudicial to the general body of students under examination will not be allowed into the examination hall and will be expelled if found in the hall.

18.

No candidate shall be admitted to examination under any pretext later than five minutes from the commencement of the examination.

19.

Precisely five minutes before the time fixed for giving out the question papers, a warning bell will be rung as a signal for all candidates to take their seats. After the warning bell has been rung any outsider found loitering in the hall or in or near the entrance to the hall will be expelled.

20.

Any violation of the following rules by a candidate will render him liable to expulsion from the examination at which the violation is committed.

21.

Candidates, before they enter the examination hall, must leave outside any books notes or papers they may have with them except the admit card allowing them to sit for the examinations which the candidates must bring with them to each examination. When required the candidate will be liable to show their admit cards to the Presiding Officer or to any other officer deputed by him to do the duties on his behalf or to the invigilators. Candidates must provide their own pen holders and pens. No umbrellas, sticks, etc. may be taken to the examination hall.

22.

A seat with a number corresponding to that on his admit card, will be allotted to each candidate and he must be in his seat at least five minutes before the time fixed for the commencement of examination.

23.

Every candidate shall write legibly on the cover page of his answer book his roll number and his name and address. He shall write his answers on one side of the paper only leaving a quarter margin, and use the blank side for casual notes if necessary. All works must be done in the books provided and no leaves shall be torn out. The books must be given up. They cannot be replaced. But an additional book may be given if required for the answers.

24.

Any candidate attempting to render the identification of his answer paper or papers on any subject of any examination impossible or difficult by giving a false number or by intentionally omitting to state his number as required by the preceding rule will have his name removed from the list of candidates for the examination.

25.

Candidates are forbidden from noting answers (or anything else) on the question paper or any other sheet of paper and from taking from the examination hall any papers other than the question paper given out to them.

26.

Candidates will be required to sign their names then directed to do so under the order of the Presiding Officer. They are to comply with any reasonable request made by the Presiding Officer, his representatives or the invigilators to facilitate the conduct of the examination in conformity with the spirit of the prescribed rules and standing orders.

27.

Except with the permission of the Presiding Officer or an officer deputed by him to do the duties on his behalf or of the invigilators no candidate will be allowed to leave his seat of the examination hall without finally giving his answer paper.

28.

Any candidate detected in helping another or attempting to obtain unfair assistance, in answering a question in any subject of an examination shall be expelled from the examination and his name shall be removed from the list of candidates for the examination. No communication whatsoever between candidates while under examination will be allowed. Candidates are not permitted to have in their possession, while in the examination hall, any book, memorandum, pocket book, notes or papers whatsoever even if these are in no way connected with the subject under examination) except the question paper, the admit card and the books provided by the Committee for writing out the answers and a sheet of blotting paper. Candidates disregarding this caution are liable to the same penalty as those using unfair means.

29.

Candidates shall give up their answer books not later than the time appointed for the closure of the examination. Having completed his papers the candidate must hand them over to the Presiding Officer, or to one of his representatives or to an invigilator before leaving the examination hall. The completed answer papers must on no account be left on the desk.

30.

In any case of dispute not provided for in these rules a reference shall be made to the Presiding Officer and his decision will be final.

31.

A candidate failing to appear at the appointed time and place on the date fixed in the programme for his written examination shall not be allowed to appear later in the course of such examination.

32.
