Orissa Electrical/Mechanical/Telecommunication (Departmental and Professional Examination) Engineering Service Rules, 1957Published vide Notification No. 1457-3EL-4E-1/58-E, dated 13th June 1958, Orissa Gazette Part 3, page 651, dated 27.6.1958No. 1457-3EL-IVE-1/58-E. - In exercise of the powers conferred by the proviso to Article 309 of the Constitution of the session of the rules published with the notification of the Government of Orissa in the Works Department No. 3E-IVE 16/54-31, dated the 11th August, 1954, on the subject, the Governor of Orissa Electrical/Mechanical Engineering Service, namely:Chapter-I Preliminary

1.

(a)These rules may be called the Orissa Electrical/Mechanical Telecommunication (Departmental and Professional Examinations) Engineering Service Rules, 1957.
(b)They shall come into force at once.

2. Definitions.

- In these rules, unless there is anything repugnant in the subject or context ;
(a)"Board of Examiners" shall mean the present Board of Examiners who make arrangements for examinations consisting of the Member, Board of Revenue as the Chairman, Secretary to the Board of Revenue as Secretary to the Board and the Legal Remembrancer, the Inspector General of Police and the Chief Engineer, Electricity as its Member;
(b)[ "Assistant Engineer" shall mean assistant Electrical Engineer or Assistant Mechanical Engineer or Assistant Tele-Communication Engineer, as the case may be;] [Substituted by O.G.E. No. 19142, dated 13.6.1977.]
(c)"Executive Engineer" shall mean Executive Engineer, Electrical or Executive Engineer, Mechanical or Executive Engineer; Telecommunication as the case may be;
(d)"Engineer" shall mean an Assistant Engineer, Electrical or an Assistant Engineer Telecommunication or an Executive Engineer, Electrical or an Executive Engineer, Mechanical or an Executive Engineer, Tele Communication;
(e)"Chapter" shall mean a chapter in these rules;
(f)"Chief Engineer" shall mean Chief Engineer, Electricity, for the State of Orissa;
(g)"Examinations"shall mean Departmental and Professional Examinations laid down In Chapters III and IV; and
(h)"Schedule" shall mean Schedule annexed to these rules.
Chapter-II General

3.

An Engineer shall pass the examinations within two years of the date of appointment.

4.

(1)Subject to the provisions of Rule 8, an Engineer who does not pass the examinations within the period laid down in Rule 3 shall not be eligible to draw any annual increment of pay that may fall due.
(2)The provisions of Sub-rule (1) shall ordinarily cease to operate when an Engineer passes the examinations.
(3)An Engineer on passing the examinations shall be placed in the same position with regard to future increments as if he had passed the examinations in ordinary course :Provided that an Engineer shall not be entitled to any arrear of pay in respect of the increment withheld for not passing the examinations.

5.

The passing of the examinations shall be optional for an Engineer who has been appointed on contract basis and whose term of contract on first appointment does not exceed three years.

6.

An Engineer whose services have been borrowed by the State Government from any other Government or Firm shall not be required to pass the examinations without the consent of his appointing authority.

7.

An Engineer who has once passed the Examinations shall not be required to pass it again on re-appointment after break of service or on reemployment after retirement.

8.

An Engineer shall not be eligible for promotion before he passes all the examinations ;Provided that if an Engineer has not passed the examinations, but was considered fit to be promoted, he shall be required to pass the examinations within one year of the date of his promotion failing which he shall be liable to be reverted ;Provided further that if an Engineer is unable to pass the examinations within the specified period due to the exigencies of public services or illness or other circumstances beyond his control, the State Government may notwithstanding anything contained in Rules 3, and 4, grant an extension of time for such period as they may usual annual in which event he may be entitled to draw his consider necessary increasement, if he passes the examinations within the extended period granted.

Engineers who are recruited to posts under the Chief Engineer from other branches of the Public Service under the State Government where the system of examination is not in force or where the subjects for examination are substantially difference shall be required to pass the examinations laid down in Chapters III and IV after joining a post under the Chief Engineer :Provided that, the State Government may in special cases exempt such Engineer from passing such examinations.

An Engineer who entered service prior to the date of coming into force of these rules and has not passed the examinations on or before that date shall be required to pass the examination within such period as the State Government may by general or special order direct, failing which his further increment shall be stopped till he passed the examinations."]

Whenever the Government in the Administrative Department, is satisfied that the operation of any of the rules causes under hardship in particular case it may dispense with or relax the requirements of that rule to such extent and subject to such conditions as it may consider necessary for dealing with the case in a just and equitable.]Chapter-III Departmental Examination

12.

In this Chapter unless the context otherwise requires "examination" shall mean Departmental Examination.

13.

The examination shall be held under the direct control and supervision of the Board of Examiners constituted for the purpose in the months of April and October each year.

14.

(1)The Examinations shall consist of the subjects set forth in Schedule I.
(2)Engineers who have passed in Oriya in the Matriculation or such other highest examinations shall be exempted from passing in the Oriya, on the production of a certificate to that effect.

15.

The State Government may for reasons to be recorded in writing exempt an Engineer from passing the examination fully or in part for any of the following grounds namely :
(a)[ If he has acquired sufficient knowledge and practical experience in Electrical or Mechanical or Telecommunication engineering subject, or] [Substituted vide O.G.E. No. 19142, dated 13.6.1977.]
(b)If he has been in service under another Government or Firm prior to his appointment and he had passed the examination under that Government or firm provided that the subjects of examinations were substantially the same as mentioned in these rules.
Chapter-IV

16.

In this Chapter unless the context otherwise requires "Examination" shall mean professional examination.

17.

Notwithstanding anything contained in Rule 3 an Engineer shall pass the examination within three years from the date of his appointment.

18.

The examination shall ordinarily be held by the Departmental Committee constituted for the purpose in the months of June and December each year.

(1)The Departmental Committee aforesaid shall be convenced by the Chief Engineer, Electricity, Orissa and shall consist of -
(a) Chief Engineer, Electricity, Orissa President
(b) One Superintending Engineer, Mechanical Member
(c) Electrical Inspector Member
(d) [] [Inserted vide O.G.E. No. 19142, dated 13.6.1977.] One Superintending Engineer, Telecommunication Member.
The mechanical Engineers who entered service prior to the date of issue of these amendments and have not passed the examinations on or before the date shall be required to pass the Examination within such a period as the State Government may be general or special order direct failing which their further increments shall be stopped till they pass the Examinations.
(2)The examination shall be both written and viva, The written examination shall consist of subjects set forth in Schedule II. The viva voce tests shall be common to the Electrical, Mechanical, Tele Communication Engineers.
(3)The Examinations shall be such as to test; (a) the knowledge of the Engineer regarding the locality here he has been employed; as to
(i)the method and cost of Engineering construction;
(ii)the dealings with contractors and management of labour;
(iii)tariff making and
(iv)ability to design and estimate; and
(b)the Engineer acquittance with official rules contained in publications mentioned in Schedule II and his knowledge of the accounts of a subdivision or of Division as the case may be.
(4)The president shall submit the report of the Departmental Committee with his observations and recommendations to the State Government who shall decide as to which Engineer shall be deemed to pass the test and shall publish their names in the Official gazette.]

20.

In the case of a first appointment an Engineer shall be employed in such a manner -
(a)as to afford him to gain experience of work necessary to enable him to pass the examination. He shall personally compile for one month the accounts of a sub-division including the checking of measurement books, preparation of bills, contract's ledgers and other sub-divisional registers and posting of day books. Thereafter he shall spend a period of at least fifteen days in a Divisional Office where with the assistance of the Accountant he shall compile the divisional accounts of at least one month.
(b)No Engineer shall be permitted to appear for the examination until he has undergone the training prescribed in Sub-rule (a) aforesaid and in addition, has been satisfactorily reported to by the Executive Engineer and the Superintending Engineer under whom he is serving with regard to his physical energy and efficiency in practical work and his capacity to manage his subordinates.
Note - A special report on the above points shall be submitted to the Chief Engineer when an Engineer applies for permission to appear in the examination.

LanguageConsequent on the decisions t6 introduce Oriya as the Regional Language for official purposes in the State and in consideration of the fact that the knowledge of Oriya of many of the existing Government servants serving at different levels of administration is not adequate for transacting official business at their respective levels when called upon to use the language in lieu of English for all official purpose, it has become necessary to modify the existing rules and syllabus prescribed for the Departmental Examination in Oriya Government have, therefore after careful consideration, been pleased to make the following rules in supersession of all existing rules for the Departmental Examination of officers in Oriya (Revenue Department Resolution No. 760 Exam XXVII - 16/54, dated the 15th February 1955).Rules for the Departmental Examination in Oriya ApplicableElectrical, Mechanical Engineers

1. This rule will apply to officers of all Departments who are required to pass the Departmental Examination in Oriya [standard.]

2. There will be two standards of the Examination-Higher and Lower, but only one set of papers. A pass in either standard will be determined according to the number or percentage of marks obtained in each branch (or paper) of the examination. The Departments concerned will determine whether their officers are required to pass by the Higher or the Lower Standard.

3. The following are the tests prescribed for the examination :

(a)Translation - Reading current, (Cursive) handwriting in Oriya. A document or documents of the description of office paper, selected and lithographed by the Board of Examiner will be transliterated into ROMAN character.
(b)Translation from Oriya to English - The paper will contain passages both from the prescribed text - books and from unseen official documents.
The following text-books are prescribed :
(i)Matriculation Oriya Prose Selections (Current edition)
(c)Translation from English to Oriya - Passage will be set from official documents or from judgements and from books or newspapers.
(d)Viva voce examination in Oriya - (i) The examinee will be tested in conversation with the common people, in such a manner as to satisfy the examiner of his power to made himself understood by them and to explain himself with clearness and propriety in Oriya. The text books may furnish topics for conversation.
(ii)The examinee will be made to translate orally to the examiner, a passage from one of the text books the passage to be translated being first read out by him.
(iii)An ordinary piece of narrative prose which may include a petition, the deposition of a witness, will be handed over to the examinee and after being allowed to read it, he will be required forthwith to give a fluent oral translation of it.
Note - In the oral translation it is essential that the candidate should show his ability to give what to an ordinary villager would be an intelligent person of the piece set; literal accuracy need not be insisted on but a substantially correct rendering of all points shall be required. It is not necessary that each candidates should translate the same piece, just as it is not necessary that the viva voce examination of each should involve the same conversation.

4. The maximum and pass marks for either standard to each branch of the examination and the time allowed for the paper are given below :

Note - (1) Candidates who secured marks for Lower Standard in 'Translation' will not be required to pass by the Higher Standard in that branch in order to pass completely by that standard in the subject.
(2)Candidates, must pass in all the branches to secure a standard. Failure in one of the branches will be treated as failure in the subject.
(3)A pass by the Lower Standard is prescribed.
