The Gandhi Pathagar Rules, 1994Published vide Notification Orissa Gazette Part 3-A. OG No. 44/4.11.1994-Notification No. 10067-12-SC-53/94-SC/14.10.1994No. 10067-XII-SC-53/94-SC. - With a view to extending library services to the Block level, for dissemination of knowledge and information and furthering the cause of book-promotion in general and providing scope for Gandhian studies in particular, the State Government do hereby formulate, in the year of commemoration of the 125th Birth Anniversary of Mahatma Gandhi, the following rules, namely :

1. Short title and commencement.

(1)These rules shall be called the Gandhi Pathagar Rules, 1994 (mentioned hereinafter as the rules).
(2)The rules shall be deemed to have come into force with effect from the second day of October, 1994.

2. Definitions.

- In these rules, unless the context indicates otherwise-
(a)"Chairman" means the Chairman of the Managing Committee of the Gandhi Pathagar;
(b)"Committee" means the Managing Committee of the Gandhi Pathaghar;
(c)"Executive Board" means the Executive Board of the Managing Committee of the Gandhi Pathagar;
(d)"Member-Convenor" means the Member-Convenor of the Managing Committee of the Gandhi Pathagar;
(e)"Member-Director" means the Member-Director of the Managing Committee of the Gandhi Pathagar; and
(f)"Vice-Chairman" means the Vice-Chairman of the Managing Committee of the Gandhi Pathagar.

3. Gandhi Pathagar.

(1)There shall be a Gandhi Pathagar located at each Block headquarters.
(2)The Gandhi Pathagar shall function under the over-all supervision of the Panchayat Samiti, as the Block Level Library and Information Centre-cum-Reading Room. It shall also include Sections for Gandhian Studies, for children and for neoliterates.
(3)Promotion of library services, Book-promotion, Gandhian Studies and other ancillary activities shall comprise the objects of the Gandhi Pathagar.

4. Managing Committee.

(1)The Managing Committee of the Gandhi Pathagar shall comprise the following members, namely :
(a) Chairman of the Panchayat Samiti Chairman
(b) Vice-Chairman of the Panchayat Samiti Vice-Chairman
(c) Block Development Officer Member-Director
(d) Principal of the College (if any) situated at the Blockheadquarters Member
(e) Sub-divisional Information and Public Relations Officer Do
(f) Headmaster/Headmistress of the High School situated at theBlock headquarters Do
(g) Youth Coordinator, Nehru Yuvak Kendra Member
(h) A representative of the District Mass Education Officer Do
(i) Two representatives from among voluntary culturalorganisations (if any) functioning at the Block headquarters, tobe nominated by the District Collector-cum-Chairman, DistrictCouncil of Culture Do
(j) An Extension Officer of the Block to be nominated, from timeto time, by the Block Development Officer Member-Convenor
(k) Such other members as may be nominated by the DistrictCollector-cum-Chairman, District Council of Culture Members
(2)The term of the members specified at Clauses (i) and (k) of Sub-rule (1) shall be three years. Existence of vacancies in the Committee shall not invalidate the proceedings or decisions of the Committee.
(3)The Committee shall meet from time to time to review the functioning of the Gandhi Pathagar and to take remedial action wherever necessary. The Chairman, and in his absence the Vice-Chairman, shall preside at the meetings. The presence of four members shall constitute the quorum.
(4)The Executive Board under the Committee shall comprise the Chairman, the Vice-Chairman, the Member-Director and the Member-Convenor. The Executive Board shall be competent to take any action that may be required to be taken urgently, provided that the Member-Convenor shall place the matter before the next meeting of the Committee for ratification.

5. Assistance for development.

(1)The State Culture Department shall include the Gandhi Pathagars of all the Blocks.for provision of books as per the existing Scheme of Book Assistance of the Raja Rammohun Roy Library Foundation, which is operated through the said Department.
(2)Endeavour shall be made, inter alia, by the State Culture Department to obtain grants and assistance under other schemes of the Raja Rammohun Roy Library Foundation and other Government and non-Government organisations.
(3)Endeavour shall also be made to obtain grants and assistance from various sources for operating the sections for the children and the neoliterates.
(4)The Committee shall be competent to receive donations in shape of books, furniture and equipment, etc. from organisations and individuals.
(5)The Member-Convenor shall maintain the records in respect of all grants, assistance and donations from various sources.

6. Records and Registers.

(1)The Member-Convenor, assisted by the Library Assistant, shall maintain the records and registers as required in the guide-lines of the Raja Rammohun Roy Library Foundation and the State Government.
(2)The records and registers shall be verified periodically by the Member-Director.
(3)The member-Director shall be responsible to make exhaustive verification of stock and store once a year and to initiate remedial action wherever required.

7. Audit and inspection.

(1)The assets and accounts of the Gandhi Pathagar shall be audited by the Local Fund Audit and by the auditors of the State Culture Department in the prescribed manner.
(2)Authorities which provide grants and other assistance shall have the right to inspect the Pathagar and audit the accounts in respect of the said grants and assistance.

8. General.

(1)A provision of these rules may be amended by the State Government in the Culture Department, after consultation with the Panchayati Raj Department.
(2)If any doubt arises relating to any of the provisions of these rules, the said doubt may be clarified by the State Government in the Culture Department.
(3)The Gandhi Pathagar may, subject to the prior approval of the State Government in the Culture Department, may get affiliated to any Organisation for the furtherance of its objects.
