Rajpatra (Asadharan), dated 25-4-1998In exercise of the powers conferred by Section 13 of the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994), the State Government hereby makes the following rules, namely :-

Chapter I
Preliminary

1. Short title.

- These rules may be called the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Rules, 1998.

2. Definitions.

- In these rules, unless the context otherwise requires :-
(a)"Act" means the Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994);
(b)"Schedule" means the Schedule appended to these rules;
(c)"Section" means a section of the Act.

Chapter II
Maintenance of Roster, Submission of Half Yearly Report and Appointment of Liaison Officer

3. Maintenance of Roster.

- There shall he maintained a Roster as required by clause (iii) of sub-section (2) of Section 4 of the Act in the manner specified below :-
(1)Separate 100 point roster for each categories of post at the stage of direct recruitment shall be maintained for State, Division and District level. These rosters shall be maintained by each appointing authority according to Schedules I, II and III as may be relevant for each level of appointment.
(2)Separate roster shall also be maintained in the form as specified in Schedules I, II and III, as the case may be, for those temporary posts likely to be continued for more than two months. Each appointing authority shall keep a register in his office in which categorywise details of the appointments made for each year shall be shown.
(3)The name of the person appointed shall be entered in the column against the point specified for that class and unfilled point of roster shall be kept vacant and such vacancy shall be filled by appointing a person of that category only.
(4)[ The roster maintained under sub-rules (1), (2) and (3), shall be kept in custody of the incharge establishment officer and in the event of his transfer or change in work distribution, the charge of the maintained roster/rosters shall be handed over and taken over accordingly by the concerned officers.] [Inserted by Notification No. F. 6-1-2002-R.C.-1, dated 28-8-2002.]

4. Intimation of vacancies and publication of advertisement.

- For selection of appointment to the vacancies arising in public services and posts, a demand letter shall be sent to the Public Service Commission according to relevant recruitment rules and for other post to the Employment Exchange and an advertisement shall also be published.

4A. [ Relaxation to the candidates of Scheduled Castes/Scheduled Tribes in the minimum qualifying marks. [Inserted by Notification No. F. 6-1-2002-R.C.-1, dated 28-8-2002.]

- The candidates of Scheduled Castes and Scheduled Tribes shall get relaxation of 10% marks in minimum qualifying marks but their selection shall be made on the basis of merit of the selection list of the Scheduled Castes/Scheduled Tribes candidates.]

4B. [ Special provisions for Primitive Tribes. [Substituted by Notification dated 16.1.2018, published in M.P. Government Gazette dated 16.1.2018, Extraordinary, page 56.]

- If an applicant belonging to the Sahariya/Saharia primitive tribe of district Sheopur, Morena, Datia, Gwalior, Bhind, Shivpuri, Guna, and Ashok Nagar, Baiga, primitive tribe of district Mandala, Dindori, Shahdol, Umaria, Balaghat and Anuppur and Bhariya primitive tribe of Tamia block of District Chhindwara, applies for the post of Samvida Shala Shikshak or any post of Class III/IV or forest Guard (Executive) and possesses the minimum prescribed qualification for that post, then he shall be appointed on the said post without adopting the recruitment procedure.]

5. Certificate in the order of appointment/promotion.

- Appointing Authority shall certify below every order of appointment to the effect that the provisions of Madhya Pradesh Lok Seva (Anusuchit Jatiyon, Anusuchit Jan Jatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994 and the rules made thereunder have been complied with.

6. Submission of half yearly reports.

- For the purpose of sub-section (1) of Section 15, the half yearly report on the appointments made by every appointing authority shall be furnished in the following manner and in the forms indicated hereunder :
(a)A half yearly report of the appointments made by every appointing authority shall be submitted for the period from January to June in the month of August and from July to December in the month of February to the concerning Head of the Department in the form of statement in Schedule IV-A. Such half yearly report of appointments shall also be sent to the Divisional Commissioner in respect of Divisional level recruitment and to the Collector in respect of district level recruitment by every appointing authority.
(b)A half yearly report of the promotion made by every authority shall be submitted for the period from January to June in the month of August and from July to December in the month of February to the concerning Head of the Department in the form of statement in Schedule IV-B. Such half yearly report of promotion shall also be sent to the Divisional Commissioner in respect of Divisional Level Promotion and to the Collector in respect to District Level Promotion by every authority.
(c)The Secretary of the department in Government shall send to the State Government in the General Administration Department in the month of March and September of every year consolidated statement in Schedules IV-'A' and IV-'B' in respect of all offices under his control. Similarly Divisional Commissioners and Collectors shall also send to the State Government in the General Administration Department in the month of February and August of every year a consolidated statement in Schedules IV-A and IV-B in respect of all recruitment and promotion made at the divisional level and district level respectively.

7. Establishment of Cell at Divisional and District level.

- For monitoring reservation and recruitment and promotion in the categories of Class III and Class IV posts for each district and for each division, the Collector of the district shall be responsible for obtaining and maintaining the information from all the District Level appointing authorities and the Divisional Commissioner shall be responsible for obtaining and maintaining the information from All Divisional level appointing authorities. A cell shall be established for this purpose in the Office of Divisional Commissioner and Collector to ensure compliance of the provisions of the Act and Rules.

8. Appointment of Liaison Officer.

(1)In every Department under the State Government the Deputy Secretary in charge of establishment and in other establishments an officer not below the rank of Class I officer who supervises or deals with the establishment matters and appointments shall act as the Liaison Officer for the purposes of implementation of the provisions of the Act in all establishments and service under his administrative control.
(2)Every Head of the department or Head of office shall intimate the name and designation of the Liaison Officer in respect of his establishment to the concerned Secretary of the department in Government :Provided that in case of any change the Head of Department or Head of Office shall intimate to the concerned Secretary to the department the name and designation of the Liaison Officer within a month of such change. If such change is made in departmental level the Secretary of the Department shall intimate to the Secretary to Government in the General Administration Department.

9. Functions of Liaison Officer.

- The Liaison Officer shall be responsible for ensuring :-
(i)due compliance by the subordinate appointing authority, if any, of the provisions of the Act and these rules;
(ii)submission of the half yearly report as required under the Act by each appointing authority;
(iii)security and consolidation of the half yearly statements in respect of all officers and services in and under the establishment and timely submission of the consolidated report to the concerning authority;
(iv)regular inspection of the roster and registers maintained in his own office as well as in the offices under the control of the establishment;
(v)maintenance of proper liaison within the State Government in the General Administration Department in all matters concerning the implementation of the Act and Rules;
(vi)maintenance of a register of all appointments made in Department/Offices under the department and produce to the General Administration Department, if asked for;
(vii)intimation to Departmental Secretary and Secretary, General Administration Department, if any irregularity in appointment and promotion is noticed;
(viii)compliance of any other directions given by the Government.
Chapter-III Inspection of Records and Documents

10. Officers authorised to examine records and documents.

- For the purpose of sub-section (2) of Section 15, the following officers shall be the officers authorised by the State Government to examine records or documents maintained by the appointing authorities for implementation of the provisions of the Act, in offices located in areas mentioned against each namely :-
