The Maharashtra Homoeopathic and Biochemic Practitioners' (Registration of Enlistment) Rules, 1961Published vide Notification G. N., U. D. & P. H. D., No. BHP. 1160-Unification, dated 23rd November, 1961 (M. G., Part 4-B, page 1103)In exercise of the powers conferred by clauses (g), (h), (i), (j), (k), (l), (n), (o), (p), (q) and (r) of sub-section (2) of section 33 of the Bombay Homoeopathic and Biochemic Practitioners' Act, 1959 (Bombay XII of 1960), and of all other powers enabling it in that behalf, the Government of Maharashtra hereby, after previous publication, makes the following rules, namely :-

1. Short title.

- These rules may be called the Maharashtra Homoeopathic and Biochemic Practitioners' (Registration and Enlistment) Rules, 1961.

2. Definitions.

(1)In these rules, unless the context otherwise requires,-
(a)"Act" means the Bombay Homoeopathic and Biochemic Practitioners' Act, 1959 (Bombay XII of 1960);
(b)"Form" means a form appended to these rules;
(c)"Section" means a section of the Act;
(d)"Sub-committee" means the sub-committee appointed under sub-section (9) of section 20.
(2)The words and expressions used in these rules but not defined therein shall have the meanings respectively assigned to them in the Act.

3. Further particulars to be included in Register and List.

- The Register or List to be prepared and maintained under the Act shall include the following further particulars, that is to say :-
(a)registration or, as the case may be, enlistment number;
(b)if the practitioner is a married woman, her maiden name and surname;
(c)date of birth of the practitioner:
(d)where a practitioner possesses any qualifications, his qualifications, the place where he received training for such qualifications and the period of such training;

(f)if any disciplinary action is taken by the Board against the practitioner, the particulars of such action;
(g)if the name of the practitioner was removed from the Register or, as the case may be, List, and subsequently re-entered therein, the date on which the name was so re-entered;
(h)remarks, if any, of the Registrar.

4. Application for Registration.

(1)Any practitioner desiring to have his name entered in the Register under sub-sections (3), (7) or (8) of section 20, shall apply to the Registrar in Forms 'A', 'B' or 'C', respectively.
(2)Every application made under sub-rule (1) shall be accompanied by, -
(a)the registration fee of [one hundred rupees] [Substituted by G. N. of 17.1.1976.];
(b)birth certificate or matriculation certificate or S.S.C. certificate or school leaving certificate, in original, together with two copies thereof; and
(c)an undertaking in Form 'E' executed by the applicant [in Greater Bombay before a Presidency Magistrate and elsewhere before any Judicial or Executive Magistrate] [Substituted by G. N. of 8.10.1964.].
(3)Every application for registration under sub-section (3) of section 20 shall also be accompanied by the diploma or certificate, in original, in respect of the qualification of the applicant together with two copies of such diploma or certificate.
(4)Every application for registration under sub-section (7) of section 20 shall also be accompanied by the diploma or certificate, in original, in respect of any qualification which would have entitled the applicant to registration under sub-section (1) of section 16 of the Madhya Pradesh Homoeopathic and Biochemic Practitioners' Act, 1951, as in force in the Vidarbha region of the State of Maharashtra immediately before the appointed day and two copies of such diploma or certificate.
(5)Every application for registration under sub-section (8) of section 20 shall, also be accompanied by -
(a)a declaration made by the applicant [in Greater Bombay, before a Presidency Magistrate and elsewhere before any Judicial or Executive Magistrate] [Substituted by G. N. of 8.10.1964.] to the effect that the applicant had been regularly practising the Homoeopathic or the Biochemic system of medicine in any part of the State of Maharashtra for a period of not less than ten years immediately before the 25th day of August, 1959;
(b)a certificate signed by any Gazetted Officer of the State Government [* * *] [Deleted by G. N. of 23.1.1976.] to the effect that the applicant had been regularly practising the Homoeopathic or the Biochemic system of medicine in any part of the State of Maharashtra for a period of not less than ten years immediately before the 25th day of August, 1959;
(c)any other documentary evidence such as rent receipts in respect of the dispensary or clinic of the applicant, old prescription papers, receipts or cash memos in respect of medicines or drugs purchased by the applicant, which the applicant wants to adduce in support of his claim that he had been regularly practising the Homoeopathic or the Biochemic system of medicine in any part of the State of Maharashtra for a period of not less than ten years immediately before the 25th day of August, 1959.

5. Application for Enlistment.

(1)Any practitioner desiring to have his name included in the List under sub-section (6) of section 21 shall apply to the Registrar in Form 'D'.
(2)Every application made under sub-rule (1) shall be accompanied by, -
(a)enlistment fee of [one hundred rupees] [Substituted by G. N. of 17.1.1976.];
(b)birth certificate or matriculation certificate or S.S.C. certificate or school leaving certificate, in original, together with two copies thereof:
(c)an undertaking in Form 'E' executed by the applicant [in Greater Bombay, before a Presidency Magistrate and elsewhere before any Judicial or Executive Magistrate] [Substituted by G. N. of 8.10.1964.];
(d)a declaration made by the applicant [in Greater Bombay, before a Presidency Magistrate and elsewhere before any Judicial or Executive Magistrate] [Substituted by G. N. of 8.10.1964.] to the effect that the applicant was regularly practising the Homoeopathic or the Biochemic system of medicine in any part of the State of Maharashtra on the 25th day of August, 1959;
(e)a certificate signed by any Gazetted Officer of the State Government [* * *] [Deleted by G. N. of 23.1.1976.] to the effect that the applicant was regularly practising the Homoeopathic or the Biochemic system of medicine in any part of the State of Maharashtra on the 25th day of August, 1959; and
(f)any other documentary evidence such as rent receipts in respect of the dispensary or clinic of the applicant, old prescription papers, receipts or cash memos in respect of medicines or drugs purchased by the applicant, which the applicant wants to adduce in support of his claim that he was regularly practising the Homoeopathic or the Biochemic system of medicine in any part of the State of Maharashtra on the 25th day of August, 1959.

6. Enquiry by sub-committee.

(1)The sub-committee shall consider each application for registration under sub-section (7) or (8) of section 25 separately. Any application which does not satisfy the requirements of rules 4 and 5 shall be rejected by the sub-committee. The question of registration or enlistment in respect of each application shall be decided in accordance with the opinion of the majority of the members of the sub-committee.
(2)For the purpose of making enquiry in respect of any such application, the sub-committee may, if it considers necessary, direct the Registrar to call any applicant for interview at the applicant's cost, or may refer any application,-
(a)to the Collector of Bombay, if the applicant claims to be practising the Homoeopathic or the Biochemic system of medicine in Greater Bombay; or
(b)to the Collector of the District concerned, if the applicant claims to be practising the Homoeopathic or the Biochemic system of medicine outside Greater Bombay,
for verification of such facts mentioned by the applicant in the application, as the sub-committee may specify in that behalf.

7. Certificates of registration and enlistment.

- The certificates of registration and enlistment shall be in Forms 'F' and 'G', respectively. The certificate of registration shall be printed on white paper and the certificate of enlistment shall be printed on the blue paper.

8. Maintenance of Register and List.

- Each page of the Register and the List shall be verified by the Registrar's signature and each entry in the Register or the List, as the case may be, as respects particulars specified in clauses (e), (f) or (g) of rule 3 shall be attested by the initials of the Registrar.

9. Making new entries or altering entries in Register and List.

(1)Any registered or enlisted practitioner who desires -
(a)to have the entry as respects his name in the Register or List, altered, or
(b)to have an entry as respects any additional qualification acquired by him subsequent to the date of his registration or enlistment, made in the Register or List; or
(c)to have any alteration made in the entry as respects his additional qualifications in the Register or List;
may make an application in that behalf to the Registrar.
(2)The application made under sub-rule (1) shall be accompanied by a fee of [rupees fifteen] [Substituted by G. N. of 17.1.1976.], if it relates to clause (a) and a fee of [rupees twenty] [Substituted by G. N. of 17.1.1976.], in any other case.
(3)On receipt of the application and the fee, the Registrar shall alter or make any entry as applied for :[Provided that, no entry as respect alteration of the name shall be made unless the application is accompanied in duplicate, by the marriage registration certificate, or any notification in the Official Gazette, relating to such alteration of name, or an affidavit regarding such alteration of name made before any Metropolitan Magistrate, Judicial or Executive Magistrate. The original document shall be returned when no longer required] [Inserted by G. N. of 17.1.1976.] :[Provided further that] [Inserted by G. N. of 17.1.1976.] no entry as respect additional qualification shall be made in the Register unless a person possessing such qualification is entitled to have his name entered in the Register under sub-section (3) of section 20.
(4)[ When the name of any practitioner is altered under sub-rule (3), then the certificate of registration in Form 'F' of enlistment in Form 'G' shall stand amended accordingly; and if such certificate is produced by the practitioner, the certificate shall be duly amended by the Registrar under his hand and seal, if any.] [Added by G. 10. Change of address to be intimated to the Registrar.

- It shall be the duty of every registered or enlisted practitioner who changes his address to intimate such change of address to the Registrar within one month of such change.

11. [ Entries to be made in register. [Substituted by G. N. of 17.1.1976.]

- After the end of every year on the 31st day of March, there shall be entered in the register and the list separately :-
(a)the number of practitioners already registered upto the end of the year, immediately preceding;
(b)the number of practitioners registered during the year immediately preceding;
(c)the number of practitioners whose names are restored to the register and the list, during the year immediately preceding;
(d)the number of practitioners whose names have been removed from the register and the list, during the year immediately preceding, stating the provisions of the law under which the names have been removed; and
(e)the number of practitioners whose names have been removed by reason of death or for misconduct.

12. Form of general notice, etc.

(1)The general notice to be published at an interval of not less than sixty days as required by sub-clause (i) of clause (a) of sub-section (1) of section 26 shall be published in Form 'H'.
(2)The general notices shall also be published in three newspapers having wide circulation selected by the President.
(3)The individual notice to be sent under sub-clause (ii) of clause (a) of sub-section (1) of section 26 shall be in Form 'I'.
(4)The application to be enclosed with the individual notice shall be in Form 'J'.
(5)The Registrar shall inform the registered or enlisted practitioner in Form 'K', within thirty days after all the fees outstanding from such practitioner are received.

13. Removal of names of defaulting practitioners from register, etc.

- The Registrar shall publish the names of the defaulting practitioners referred to in sub-clause (iv) of clause (a) of sub-section (1) of section 26 which are removed from the register or the list, as the case may be, in the Official Gazette. Such names shall also be put on the notice board in the office of the Board. The Registrar shall send an intimation of removal of his name to the defaulting practitioner under certificate of posting.

14. Withdrawal of certificate of registration.

- The Registrar shall send a registered notice to the defaulting practitioner whose certificate of registration or enlistment is cancelled, and require him to return such certificate for cancellation, within thirty days from the date of the receipt of the registered notice.

15. Period for making application for re-entering name in register.

- The period within which an application for re-entering in the register the name of any defaulting practitioner shall be one year from date on which the fact of the removal was published in the Official Gazette.

16. Power of Registrar to get fresh application for registration and undertaking in certain cases.

- When the certificate of registration or enlistment or an undertaking under section 22 given by a practitioner has been spoiled, lost or destroyed and the practitioner desires to continue his name on such register or list, then it shall be lawful for the Registrar to require the practitioner to make a fresh application in the prescribed form for such registration or enlistment, or as the case may be, to give a fresh undertaking under that section.

17. Postage charges to reimburse.

2. Individual notices along with the prescribed form of application are being sent under certificate of posting to each person registered or enlisted including the defaulters at his address entered in the register of the list. The application in Form B for continuation of the name should be returned to the undersigned duly completed within forty-five days of the date of such notice. Any practitioner not receiving the form by post may obtain it from the office of the Registrar.
