Received the assent of the Governor and was first published in the Kolkata Gazette, Extraordinary, of the 6th April, 2006, vide notification No. 433-L., dated 6th April, 2006An Act to provide for regulation and control the activities of persons dealing with public works [or jobs] [Inserted by section 2 of the West Bengal Public Works Contractors (Regulation and Control) (Amendment) Act, 2010 (West Bengal Act No. 21 of 2010) (w.e.f. 10.9.2010).] under the Government of West Bengal in the Public Works Department and for matters connected therewith or incidental thereto;Whereas it is expedient to regulate and control the activities of persons dealing with public works [or jobs] [Inserted by section 3, ibid (w.e.f. 10.9.2010).] under the Government of West Bengal in the Public Works Department and for matters connected therewith or incidental thereto;It is hereby enacted in the Fifty-seventh Year of the Republic of India, by the Legislature of West Bengal, as follows :Chapter I
Preliminary
1. Short title, extent and commencement
. (1) This Act may be called the West Bengal Public Works Contractors (Regulation and Control) Act, 2006.2. Definitions

Registration
3. Registration
. [(1) Every person, intending to become an enlisted contractor shall on invitation by the State Government by means of advertisement, have to apply, for the purpose of registration for enlistment under Public Works Department, to the prescribed authority in such form, in such manner and with such fee, as may be prescribedProvided that different fees may be prescribed for different categories of enlisted contractors as well as different classes of enlisted contractors.] [[Sub-section (1) Substituted by section 6(1) of the West Bengal Public Works Contractors (Regulation and Control) (Amendment) Act, 2010 (West Bengal Act No. 21 of 2010) (w.e.f. 10,9.2010), which read as under :4. [ Certificate of registration.
(1) The prescribed authority shall, subject to the provisions contained under sections 5 and 6A direct the name and the particulars of persons be entered in the register maintained for the purpose and shall issue a certificate of registration for enlistment to the qualified person in the prescribed manner,4. Certificate of registration.(1) The prescribed authority shall, unless registration is refused under section 5, direct the name and the particulars of persons be entered in the register maintained for the purpose and shall issue a certificate of registration for enlistment to such person in the prescribed form.
5. Refusal to register
. (1) [The Advisory Board may not recommend registration] [Substituted by section 8(1) of the West Bengal Public Works Contractors (Regulation and Control) (Amendment) Act, 2010 (West Bengal Act No. 21 of 2010) (w.e.f. 10.9.2010) for the words The prescribed authority may refuse registration for enlistment of contractors.] under this Act on any of the following grounds, namely:(a)(I)If any person, who has applied for registration, is convicted of any offence punishable under any of the provisions of this Act or the rules made thereunder or theft, robbery, murder and sentenced;(ii)[* * * *] [[Sub-clause (ii) omitted by section 8(2), ibid (w.e.f. 10.9.2010), which was as under :(ii)Notwithstanding anything contained in section 5(1)(a)(1) the person convicted of any offence is punishable, under any law of the land and six months have not elapsed since the termination of the sentence imposed upon him;.]];(b)if any person has been declared an insolvent by a .court of competent jurisdiction and six months have not elapsed since he has been discharged;(c)if the name of any person has been removed from the register under clause (c) of section 7 and six months have not elapsed since he has been discharged;(d)if the person does not hold a license or certificate required under any other law for the time being in force; .(e)if any person does not fulfil the qualifications required for registration.6. Constitution of Advisory Board
. (1) [There shall be] [Substituted by section 9(1), ibid (w.e.f. 10.9.2010) for the words The State Government may, by notification in the Official Gazette, constitute.] an Advisory Board for judging the suitability for registration of person under this Act.6A. [ Approval Committee.(1) There shall be an "Approval Committee" for according approval to the names of the persons duly recommended by the Advisory Board to be registered under this Act for enlistment.
7. Removal of name from register
. The prescribed authority may, [subject to the approval of the Advisory Board,] [Inserted by section 11 of the West Bengal Public Works contractors (Regulation and Control) (Amendment) Act, 2010 (West Bengal Act No. 21 of 2010) (w.e.f. 10.9.2010).] by order in writing, remove the name of any person from the register and cancel its certificate of registration on any of the following grounds, namely :8. Before removing the name of person from the register under section 7, the prescribed authority shall give a notice, in writing, to the concerned person stating therein the ground or grounds on which it is proposed to take action and shall give him a reasonable opportunity of being heard.Chapter III

9. Appeal.-- (1) Subject to the provisions of sub-section (2), an appeal shall lie from every order of the prescribed authority, under this Act, to the appellate authority, to be appointed by the State Government.

9. Appeal.-- (1) Subject to the provisions of sub-section (2), an appeal shall lie from every order of the prescribed authority, under this Act, to the appellate authority, to be appointed by the State Government.
Chapter IV
Offences and Penalties
10. [ Penalty for false statement.
Any person, who makes a false statement or suppresses a material fact under this Act shall be liable to punishment with imprisonment which may extend to two years.] [[Section 10 substituted by section 13, ibid (w.e.f. 10.9.2010). which read as under :<b>10. Penalty for false statement.</b> - Any person. required to make a statement under this Act. wilfully makes a false statement or suppresses a material fact with an intention to mislead the prescribed authority, shall be liable to punishment with imprisonment which shall not be less than three years but may extend to seven years.]]11. Penalty for malpractice
. Any person, who commits malpractice or contravenes any of the provisions of this Act, for which no specific penalty has been provided, shall be liable to punishment with imprisonment [which may extend to two years] [Substituted by section 14. ibid (w.e.f. 10.9.2010) for the words which shall not be less than three years but may extend to seven years.].12. Certificate not to be assigned
. Any person, who lends, transfers or assigns the certificate of registration issued under this Act, shall be liable to punishment with imprisonment [which may extend to two years] [Substituted by section 15, ibid (w.e.f. 10.9.2010) for the wors which shall not be less than three years but may extend to seven years.].13. Certificate and document to be shown on demand.
14. Obstructing the lawful authorities.
Any person, who [ * * * * ] [The word wilfully omitted by section 16(1) of the West Bengal Public Works Contractors (Regulation and Control) (Amendment) Act, 2010 (West Bengal Act No. 21 of 2010 (w.e.f. 10.9.2010).] obstructs or offers any resistance to, or otherwise interferes in the discharge of, the functions of the prescribed authority or any Engineer, referred to in sub-section (1) of section 13, exercising any power or performing any duty conferred or imposed upon him in pursuance of this Act or the rules made thereunder, shall be liable to punishment with imprisonment [which may extend to two years] [Substituted by section 16(2), ibid (w.e.f. 10.9.2010) for the words which shall not be less than three years but may extend to seven years.].15. Institution of proceedings.
No prosecution shall be instituted against any person for any offence under this Act except on a complaint made by the prescribed authority or [an Engineer as specified in section 13] [Substituted by section 17, ibid (w.e.f. 10.9.2010), for the words a police officer not below the rank of Sub-Inspector.].16.

Powers of the prescribed authority to summon and enforce attendance of witnesses and other persons.- The prescribed authority shall have all the powers as of Civil Court constituted under the Code of Civil Procedure, 1908. while trying a suit, in respect of the following matters, namely :(1) summoning and enforcing the attendance of the complainant or the person against whom complaint is made under this Act and the witnesses required in connection therewith;(2) compelling the production of any document; and(3) examining witnesses on oath;and may summon and examine suo moto any person whose evidence appears to be material.Explanation. For the purposes of enforcing the attendance of witnesses and other persons mentioned in this section, the local limits of the jurisdiction of the prescribed authority extend to the whole of the State of West Bengal. |
