Bihar School Examination Board, (Issuance of No-objection certificate, Affiliation norms and Procedure for physical education Regulation, 2019Last Updated 19th February, 2020In exercise of power conferred under section 17 of Bihar School Examination Board Act. 1952 (as amended from time to time), The Bihar School Examination Board, Patna is hereby making the following Regulation (in connection with physical teachers' education) subject to the confirmation of the Administrative department.

1. Short title extent and Commencement.

(1)This regulation shall be called Bihar School Examination Board, (Issuance of No-objection certificate, Affiliation norms and Procedure for physical education Regulation, 2019.
(2)It shall extend to the whole state of Bihar.
(3)This Regulation shall come into force from the date of notification.

2. In these regulation, unless the context otherwise requires.

- (i) "Act" means Bihar School Examination Board Act, 1952;
(ii)"Chairman" means the chairman of the Bihar School Examination Board;
(iii)"Secretary" means the secretary of Bihar School Examination Board;
(iv)"Director (Academic)" means Director (Academic) of education committee of Bihar School Examination Board, Patna;
(v)"National Council for Teachers' Education" means National council for teacher's education and its Regional committee/ committees;
(vi)"Board" means Bihar School Examination Board, Patna;
(vii)"Screening committee" means screening committee of the Board;
(viii)"State" means State of Bihar;
(ix)"State Government" means Government of Bihar;
(x)"Government Physical Education Teacher Training institution/college "means Physical Education Teacher training institution/college run by Govt;
(xi)"Private/Non-Government Physical training institution/college" means Physical teachers training institution/college managed by non-government organisation;
(xii)"Head of the Institution" means Principal of the concerned physical teachers training institution/college;
(xiii)"Composite Institution" means a duly recognised higher education institution offering undergraduate or post graduate programme of study in Arts, Science or Social Science, Humanities or Commerce or teacher education programme of Physical teachers education programme or Mathematics as the case may be at the time of applying for non-objection certificate in connection with teacher education programme conducting D.P.Ed. Course.

3. Preamble.

- This regulation shall be applicable in matters of issuance of non-objection certificate to institutions initialling new physical teachers education programme D.P.Ed. course, in the matter of obtaining affiliation from Bihar School Examination Board after having received recognition from National Council for Teachers education and for grant of affiliation and in matter of addition in the sanctioned in take for which recognition had been given by National council for teacher education namely: -
(i)In issuance of no objection certificate to composite institution of Govt/ non-govt Physical Education Teacher training institution starting Diploma in physical education (D.P.Ed.) new course;
(ii)In issuance of no objection certificate to Govt/non-govt teacher's training education institution starting Diploma in physical Education (D.P.Ed.) new course;
(iii)In obtaining affiliation for new Diploma in physical education (D.P.Ed) course from Board, after recognition is granted by National council for teacher education;
(iv)In obtaining affiliation for additional intake in Diploma in physical education (D.P.Ed) course after recognition for the additional intake is granted by National council for teacher education;
(v)In seeking consent from the Board for shifting or relocating premises where presently Diploma in physical education (D.P.Ed.) course is being offered, after the required consent is accorded by National council for teacher education.

4. Eligibility.

- The following categories of institutions are eligible for consideration of their applications under these regulations for obtaining recognition and no objection certificate, namely: -
(i)Institution/college established by the State government or its authority;
(ii)Institution/college financed by the State government;
(iii)Self-financed educational institutions/colleges established in Bihar and operated by "not for profit" societies or trusts registered under the appropriate law or self financed educational institution/college established by any company incorporated under the companies Act.

5. Manner of making application and time limit.

- (A) Application for no objection certificate.
(i)An institution/college eligible under Regulation 4 desirous of running Diploma course in physical education (D.P.Ed.) and for the said purpose it has to apply for grant of recognition before National council for Teacher education can apply with the processing fees and requisite documents.
(ii)The application which include details of programme/course being conducted from before along with the self-attested photocopy of the certificate of the validity of such course given by National council for teacher education/University/State Government and certificate of land establishing that the concerned institution/college has the ownership of the land.
(iii)Such not for profit societies, trust or company with composite institution which simultaneously intend to offer new course have to give evidentiary material in respect of the other course.
(iv)Application will be given by the head of the institution namely Principal, Chairman/Secretary of the Society/Trust acting managing director of the company.
(v)Application will be given to the Board within the time frame prescribed for grant of recognition by National council for Teacher Education and also before submissions of application at National council for Teacher Education for grant of recognition.
(vi)Applications submitted before or after the time frame prescribed shall not be considered and for which the Board shall not be liable and the amount of processing fees will be forfeited.
(vii)Application, received within the prescribed time frame will be considered on their merit as well as keeping in view the necessity of the said course within the State and within 15 days of its receipt, the final outcome will be made available to the applicant.
(viii)In no case the amount of processing fees will be returned to the applicant, whether no objection certificate is issued or rejected.
(B)Application for affiliation -
(i)Institutions/colleges which have been granted recognition for offering Diploma in physical education course by National council for teacher education council can apply for affiliation from the Board.
(ii)Application are required to be submitted in the prescribed form with prescribed processing and affiliation fees along with the requisite documents.
(iii)Out of requisite documents the following documents necessarily be enclosed with the prescribed application.
(a)Certificate stating following of prescribed working days.
(b)Certificate stating following of reservation as prescribed by the State Government.
(c)Certificate stating following of prescribed Admission fees and other fees.
(d)Certificate stating following of curriculum and courses.
(e)Certificate stating employment of staff, payment of salary and attendance.
(iv)Application duly filled up in all respects shall be submitted at Bihar School Examination Board within 10 days from the date of grant of recognition by National council for Teacher Education.
(v)After receipt of dully filled up application, the entire procedure shall be completed within a month and decision on the point of affiliation will be notified by the Bihar School Examination Board and will be sent to the concerned institution.

6. Processing fees.

- The following amount will be taken by the Bihar School Examination Board as processing fees: -
(i)No objection certificate. - With application for no objection certificate, a bank draft for Rs. 5,000/- (Rupees five thousand only) in favour of secretary, Bihar School Examination Board shall be submitted by the concerned institution.
(ii)Application Fees. - At the time of applying for affiliation, a bank draft of Rs. 15,000/- (Rupees fifteen thousand only) as processing fees for affiliation and Bank draft of Rs. 35,000/- (Rupees thirty-five thousand only) as affiliation fee per unit for this recognition granted by National council for Teacher Education shall be submitted in favour of Secretary, Bihar School Examination Board.

7. Processing of Application.

- (A) Application for no objection certificate. - The application received from an institution for no objection shall be immediately processed by Bihar School Examination Board and decided on its merit and in any condition information with regard to its result will be made available to the concerned institution within 15 (fifteen) days.
(B)Application for affiliation-
(i)Application received for grant of affiliation will be considered by the Bihar School Examination Board within 15 (fifteen) days as to whether the application is fit to be further proceeding.
(ii)An opportunity to rectify faulty application will be provided to the concerned institution and if within 15 (fifteen) days of communication made in this regard by Bihar School Examination Board and thereafter it will be responsibility of the concerned institution to submit rectified application at the Board.
(iii)In case of non-submission of the rectified application within the prescribed time, the right to take decision in the matter will be reserved by the Bihar School Examination Board which will be acceptable for the concerned institution. The processing time for such application will be calculated from the date rectified application is received.
(iv)Application of institution found to be appropriate in all respects, will be inspected by a four-member team of experts constituted by Bihar School Examination Board. The institution concerned shall arrange for videography of the inspection made by the team experts and shall make available CD of the videography to the inspection team on the same date.
(v)A district level enquiry committee will be constituted by the Board in the following manner: -
(a) District Education officer - Coordinator
(b) Officer nominated by Board - Member
(c) Field level Officer nominated by Director, ArtCulture & Youth Bihar, Patna - Member
(d) A Physical Education Faculty nominated byDirector, Art Culture & Youth Bihar, Patna - Member.
(vi)Rs. 1,500/- (Rupees on thousand five hundred only) will be admissible to the coordinator and every member of the enquiry committee from Board. Apart from this travelling allowance as per law will also be admissible. Board also will provide conveyance to them. Enquiry committee report will be positively submitted by the enquiry committee within 15 (fifteen) days.
(vii)The Bihar School Examination board will positively get enquiry report along with the CD of the institution within 30 Days from the date of receipt of application. It will be the responsibility of Bihar School Examination Board to follow the time schedule.
(viii)On the basis of enquiry report decision will be taken by the Screening committee of the Bihar School Examination Board associated with affiliation.
(ix)Screening Committee. - For grant and with drawl of affiliation to diploma in Physical Education training college/institution established by Govt/Non-Government organisation, Screening committee will be constituted in the Board in following manner: -
(a) Academic Director, Bihar School ExaminationBoard - Chairman.
(b) Examination Controller (Vividh) - Member.
(c) A departmental officer nominated by Director,Art Culture & Youth Bihar, Patna - Member.
(d) Deputy Secretary/Asstt. Secretary (Teacher'sTraining), Bihar School Examination Board, Patna - Member Secretary.
(x)On the basis of recommendation of the Screening committee decision will be taken in the meeting of the Bihar School Examination Board for grant/with drawl of affiliation to the institution.
(xi)Such institution in whose query certain shortcoming is found, they will be communicated and will be necessarily provided with an opportunity to rectify the shortcomings.
(xii)Amount deposited as processing fees and charges by such institution who despite being given opportunity to rectify in matters of affiliation but still was rejected, will be forfeited by the Board.

8. Condition for grant of affiliation.

- The board after finding the application appropriate in all respects will grant affiliation for Diploma in Physical Education (D.P.Ed.) course to the concerning institution/college under the following conditions.: -
(i)An institution/college shall necessarily comply with the norms and standard prescribed under Regulation, 2014 by National council for Teacher Education and amendments/modification from time to time;
(ii)The Bihar School Examination Board/Art, Culture & Youth Department, Govt. of Bihar, Patna on time to time will be competent to get the institutions/colleges getting affiliation inspected and supervised by officers/experts;
(iii)An institution/college will make available audit report of income and expenditure every year to the Board;
(iv)An institution/college will make payment of honorarium/salary through Bank to the teaching and non-teaching employees legally appointed and working as per standard and will maintain the details of deductions made towards provident fund;
(v)In formation in case of registration or removal of teaching and non-teaching employee will be immediately given to the Board/Art, Culture & Youth Department, Govt. of Bihar, Patna the institution/college and on the above said post appointment will be made immediately in accordance with law;
(vi)On receipt of complaint and after its enquiry on finding the charges to be proved affiliation will be cancelled with recommendation to National Council for Teacher Education for cancellation of recognition;
(vii)Each year after taking of admission a certificate will be made available by the institution/college to the Board to the effect that the certificates of the admitted candidates is in conformity with the standard prescribed by National Council for Teacher Education and it has been got verified from the issuing institutions;
(viii)After legally constituting of managing committee the list of members will be made available to the Board by both Govt./Non-Government Physical Education Teacher Training Colleges/Institutions;
(ix)The account of institution/college will be operated by the joint signature of the Chairman/Secretary of the managing committee and the Principal or the Principal and Senior Lecturer/Professor;
(x)Whenever needed the institution/college will have to furnish information or documents to the Board or its authorised representative and non submission of the required documents will be treated to be violative of the condition of affiliation;
(xi)Institution/college shall maintain such records, register and other documents which are essential for functioning of an institution/college;
(xii)The institution/college will ensure disclosure of necessary information and will upload the latest information on its official website which will be verified by the Board on time to time basis and non-observing of the same will amount to violating the conditions of affiliation;
(xiii)Such Institutions which were recognized from NCTE prior to the date of this regulation came into force, will be empowered to provide affiliation of such institutions from the date of recognition of the NCTE as it seems fit.

9. Norms and standard for Diploma in Physical Education (D. P. Ed.) in Physical Education programme.

- (i) Duration. - The Diploma in Physical Education Program me shall be of duration of two years, however, the students shall be permitted to complete the programme within a maximum period of three years from the date of admission to the programme.
(ii)Working days. - (a) There shall be at least 200 (two hundred) working days in each year which will be exclusive of the period of examination and admission.
(b)The institutions/colleges shall work for a minimum of 36 (thirty-six) hours in a week (five or six days) during which physical presence in the institutions/college of all teachers and students is necessary to ensure their availability for advice, guidance, dialogue and consolation, as and when required.
(c)The minimum attendance of student and teacher shall be 80% for all course work including practical and 90% for school internship.
(iii)Admission capacity. - The basic unit shall be of 50 students. Two basic unit are permissible initial which will be covered by the recognition letter issued by the National Council for Teacher Education in connection with the concerned institution/college. However, the institution/college established by Government of Bihar shall be sanctioned a maximum intake of four units' subject to fulfilment of other requirements.
(iv)Eligibility. - (a) Candidates with at least 50% marks in the higher secondary (+2) or its equivalent examination (recognized by Govt. of Bihar) are eligible for admission.
(b)Five (05) percent relaxation be given to those who have at least participated in international/national/SGFI/Sports competition or position holders in Inter-Zonal sports competition.
(c)The reservation and relaxations in marks for SC/ST/OBC and other categories shall be as per the rules of the state government which is applicable.
(v)Admission procedure. - Admission shall be made on merit on the basis of marks obtained in the entrance examination (sports proficiency test, physical fitness test and marks obtained in qualifying examination) or any other selection procedure as per the policy of the State Government.
(vi)Fees. - The institution/college shall charge only such fees as prescribed by the affiliating body/State Government in accordance with provision of National council for Teacher Education (Guidelines for regulation of tuition fees and other fees chargeable by unaided teacher education institutions) Regulation, 2002 as amended from time to time and not charge donation, capitation fees etc. from the students.
(vii)Evaluation. - For each theory course, at least 20% to 30% marks may be assigned for continuous internal assessment and 70% to 80% for term end examination conducted by the examining body and one fourth of the total marks shall be allocated to evaluating the student's performance during the school internship. The weight age for internal and external assessment shall be fixed by the affiliating body within the ranges specified above. Candidates must be internally assessed on the entire practicum course and not only on the project/field work given to them as part of their units of study and basis for assessment and criteria used ought to be transparent for students benefit maximally out of professional feedback. Students shall be given information about their grades/marks as part of professional feedback so that they get the opportunity to improve their performance. The basis of internal assessment may include individual or group assignments, observation, records, diaries, reflective journal etc.

10. Academic and Non-Academic structure.

- (A) Academic staff. - Number for a basic unit of 50 (fifty) students of less with combined strength of one hundred or less for two years course.
(i) Principal/H.O.D. - 01 (one)
(ii) Lecturer - 06 (six)
(iii) Physiotherapist - 01 (one)
(iv) Librarian - 01 (one)
(v) Experts (Sports experts) part time faculty - 04 (four)
(vi) Dietitian/Nutrition expert - 01 (one) part time.
(vii) I.C.T. instructor - 01 (one)
Note. - (i) For additional intake which will be in multiples of fifty students, the number of full time faculty shall be increased by six per additional unit. On each occasion additional intake of one basic unit shall be considered. Physical education teacher preparation courses can also be run in comprehensive or composite institutions subject to fulfilment of norms and standards prescribed by National Council of Teacher Education.
(ii)Appointment of teachers shall be distributed as to ensure the required nature and level of expertise for teaching courses/subjects and activities related to physical education. Faculty can be utilized for teaching in a flexible manner so as to optimize academic expertise available.
(B)Qualification: -
(i)Principal/Head of the Department. - M.P.Ed or equivalent degree with at least 55 (fifty five) percent marks and B.P.Ed with at least 50% marks and at least five years of experience as a lecturer in a physical education teacher training institution.
(ii)Lecturer. - M.P.Ed or equivalent degree with at least 55 (fifty five) percent marks and B.P.Ed with at least 50% marks and at least eight years of experience as a physical training instructor/physical education teacher at a school level.
(iii)Physiotherapist. - Post Graduate degree in physiotherapy with specialization in sports physiotherapy.
(iv)Librarian. - Post Graduate degree in library and information science.
(v)Experts part time faculty (sports). - Bachelor's/Master's degree in physical education with specialization in one game/sport/Bachelor's degree in physical education with Diploma in coaching in specialized sports at least one game/sport.
(vi)Dietitian/Nutrition expert. - Post Graduate degree in nutrition sciences.
(vii)I.C.T instructor. - Post graduate degree in information practices/ information sciences.
Note. - In case of composite institution, the Principal and Academic, Administrative and Technical staff shall be shared.
(C)Technical support and Administrative staff: -
(i) Ground staff (with knowledge of marking groundand maintaining sports fields) - Two
(ii) Technical assistant - One (part time)
(iii) Office assistant (with knowledge of working withcomputer and accounting software.) - One
(iv) Store keeper (with knowledge of handling stores) - One
(v) Helpers/Attendants - Two
(D)Qualifications. - For all above mentioned posts the educational and other qualification will be as per state Government norms.
(E)Terms and conditions of service. - The term and condition of service of teaching and non-teaching staff including selection procedure, pay scale, age of superannuation and other benefits shall be as per the policy of the state Government/Affiliating body.

11. Infrastructure.

- The institution shall have in its possession, a minimum of five acre i.e. 500 decimal of exclusive well demarcated land which shall provide enough space for organizing games and sports. Build up area for basic unit consisting of class rooms and other rooms shall be 1,200 sqm. (one thousand two hundred square meter.) Build up area for running other courses in combination with D.P.Ed. Programme shall be as under: -
(i) Only for Diploma in physical education (D.P.Ed.) - 1,200 sqm
(ii) D.P.Ed.+B.P.Ed. - 2,700 sqm
(iii) D.P.Ed.+B.P.Ed.+M.P.Ed. - 3,900 sqm
Note. - (i) Additional intake of one unit of D.P.Ed. will require additional build up area of 500 sqm (five hundred sqm) for each additional intake of one unit.
(ii)There shall be provision of two class rooms per unit intake. Besides class room, one multipurpose hall, one multipurpose laboratory, seminar hall, separate rooms for Principal/Head of the Department, faculty members, office for administrative staff and store room. For every instructional room; like class room, laboratory, library etc. Space shall not be less than 10 sqft (ten sqft) per student. Multipurpose hall shall have the seating capacity for two hundred persons having a total area of 2,000 sqft (two thousand sqft).
(iii)There shall be multipurpose field for outdoor sport, with at least two- hundred meter track and a hall for gymnastic and indoor games and sports.
(iv)Safe guard against fire hazard be provided in all parts of the building.
(v)The institutional campus, building, furniture etc. should be disabled friendly.
(vi)If necessary, separate hostel for boys and girls shall be provided. In addition, some residential quarters for faculty must be provided.
B. Instructional: -
(i)There shall be a library equipped with minimum two thousand titles and reference books related to the prescribed courses of study, educational encyclopedias, year books, electronic publications (CD-ROMs) and at least five journals on physical education and related subjects. The library shall have photocopying facility and computer with internet facility for the use of faculty and students, teachers.
(ii)Laboratories: -
(a)Education technology laboratory equipments. - Hardware for projection and duplication and educational software required for imparting ICT literacy; T.V., LCD. Projector, Display boards (three), Movie camera in the minimum of ten with internet connectivity, music system, computer system-two with printer, photocopy machine, GOs/DVDs/ROM- twenty for various sports/Games/skill teaching, smart boards.
(b)Anatomy, physiology and health education laboratory equipments. - Human Skelton- Articulated (one), Dis articulated-(Two), Electronic/ digital/lever based weighing machine-(one), Anthropometric kit- (one set), Stadiometer-(one), Growth charts and Body system charts-(ten), Desirable weight and Height table-(two), Skin fold calipers (two), Measuring tape (steel)-two, Peak flow meter-(one), Grip Dynamometer- (two), Flexo meter - (sit and reach apparatus)-(two), B.P. Apparatus (sphygmomanometers, stethoscopes and stopwatches)-(two).
(iii)Sports and field equipments. - The sports and field equipment will be classified in following categories.: -
(a)Athletics. - Measuring tape (steel)- 15m. 30m., 50m., wire for asking and track (fifty meter)-one, stop watches- four, starting clapper-one, stand for judges at finish-two, flag poles-six, Starting blocks- six, starting boards-two, Take off boards-two, Hurdles-twenty, High jump stand-one pair, High jump cross bars-six, Shot-put for men and women- two(each), Discus for men and women-two each, Hammers for men and women two each, Javelin for men and women-six each, Vaulting box for jumping-two, Relay batons-six, mattress, weight training set (mats), landing for high jump.
(b)Sports and Games. -
Badminton : Post, Nets, Racket, Shuttle cocks.
Basketball : Stand and Board, Net, Balls.
Cricket : Batting pad, Batting Gloves, Abdominal Guard,Helmet, Wicket keeping Gloves, Wicket Keepers Leg Guard, Stumps,Bails, Balls, Tenis Balls.
Football : Goal post, Net Balls (Minimize 4 No.), Post andFlags.
Gymnastics : Vaulting table/Horse (men and women), ParallelBar (men), Horizontal Bar (men) Balance Beam (adjustable),Gymnastics Mattress.
Handball : Goal posts, Nets, Balls.
Hockey : Goal post, Nets, Balls, Stick, Goal keeping kit.
Lawn tennis : Posts, Nets, Balls, Rackets.
Table tenis : Table, Rackets, Balls.
Volleyball : Posts, Nets, Balls, Antenna.
Kho-Kho : Poles.
Weight Training : Rods, Weight plates-2.5kg, 5 kg., 10 kg. 15kg.20 kg., collars, Benches, Weight stand, Weight belts and weightjackets, one multi-gym or separate station wise (at least tenstation), Judo/Taekwondo/wrestling-mats.
(c)Equipment for indigenous activities/mass demonstration. - Lizums, dumbbells, Flags, Hoops, Wands, Balls, Umbrellas, Skipping ropes, Music system, Music-CDS/Cassettes, Material like scarf drill, ribbon, placard etc. For mass display activities, Demonstration/ Display equipment for material arts.
(d)Cultural activities. - Suitable and adequate instruments, as and when needed for various activities shall be provided.
(e)Miscellaneous. - Other equipment required for major, minor game, recreational games, relays, combative games and Yoga.

12. Amenities.

- (i) Functional and appropriate furniture is required number for instructional and other purposes.
(ii)The institution shall provide separate common rooms for male and female teacher educators/students-teachers.
(iii)Sufficient number of toilets, separate for male and female shall be made available for staff and students.
(iv)Arrangement may be made for parking of vehicles.
(v)Safe drinking water be provided in the institution.
(vi)Effective arrangement be made for regular cleaning of campus, water and toilet facilities, repair and replacement of furniture and other equipment.
Note. - In case of composite institution, the facilities of multipurpose hall, playground, library and laboratory (with proportionate addition of books and equipment.) and instructional space may be shared by various programmes.

13. Managing committee.

- The institution shall have a managing committee constituted as per rules if any of the state government. In the absence of any such rule, the sponsoring society/trust/company shall constitute the managing committee on its own. The committee shall comprise representative of sponsoring society/trust/company, Physical educationists, representative of Bihar School Examination Board and representative of educational staff.

14. Examination fee.

- The following amount will be charged by the Board as examination fees: -
i. Application form   - 250/-  
ii. Examination fee   - 100/-  
iii. Miscellaneous   - 600/-  
iv. Marks sheet fee   - 350/-  
v. Late fee   - 175/-  
Total - 1475/-  
(Rupees one thousand four hundred seventy fiveonly.)
The aforesaid fees will stand revised from time to time by the Bihar School Examination Board.

15. Academic calendar.

- After completion of two years Training examination will be conducted by the Bihar School Examination Board and certificate shall be issued. The prescribed course could be completed by the institutions/colleges in a better manner and within the time schedule and for holding of examination on time the Board in Co-operation with the state council of Educational Research and Training will release academic calendar which is to be followed necessarily.

16. Withdrawal of affiliation.

- (A) Affiliation may be withdrawn by the Bihar School Examination Board either in a particular subject or in all subjects. Institution/College imparting Diploma in physical Education (D.P.Ed.) course may be disaffiliated if the Board is satisfied that such institution/college are not fit to enjoy continuing affiliation to the Board.
(B)Proceeding for withdrawal of affiliation may be initiated by the Board for nonobservance of the following condition by the institution/college: -
(i)Financial irregularities and to draw amount against norms prescribed in the rule.
(ii)Engagement in activities prejudicial to the interest of the state, inculcating or promoting feelings of disloyalty or dis-affection against the Government established by law.
(iii)Encouraging or tolerating disharmony/hatred between different section of the society.
(iv)Non-fulfilment of conditions laid down regarding deficiencies to be removed even after due notice.
(v)Disregard to rules and conditions of affiliation even after receiving warning letters.
(vi)Hindrance in the smooth functioning of the institution/college on account of dispute between revelries within the institution/college management.
(vii)Poor academic performance of the institution/college for three consecutive year and not being able to keep at least 50(fifty) percent of passes of the general pass percentage.
(viii)Non-availability of proper equipment/space/staff for teaching a particular subject.
(ix)Any other misconduct in connection with the admission/examination/any other area which in the opinion of the Board warrants immediate disaffiliation of the institution/college.
(x)In case of transfer of property/sale institution/college by one society/management/trust to another society/management/trust through agreement/sale deed.
(xi)Any violation of the norms that have been prescribed by the Hon'ble supreme court of India in the writ petition (criminal) no. 666-70 of 1992 Vishaka and others v/s State of Rajasthan and others delivered on 13.08.1997 for protection of women from sexual harassment at the work place if established would attract strict action against the institution which may even lead to disaffiliation.
(C)The Board shall provide adequate time and opportunity to the management of the institution/college served with a "Show cause Notice" up to a maximum of one year for adequate compliance/removal of defects failing which the Board may declare the institution/college disaffiliated. Such decision by the Board shall be final and binding. The maximum period of reply to "Show cause Notice" may not exceed one month.
(D)Mere submission of application form for affiliation or its pendency with the Board shall not entitle any institution/college a right to be affiliated to the Board nor will it resort to do anything in any manner which may create any wrong impression in the public mind to this effect.
(E)In the event of a institution/college failing to maintain the prescribed norms for affiliated Physical Training college and/or rules of the Board and/or the institution/college deteriorates in standards of performance, the Board will ask such a institution/college to rectify the deficiencies and come up to standard prescribed for maintaining affiliation within a period not exceeding one year. If the institution/college fails to meet the requirement it may lose the status of an affiliated institution/college and may be dis-affiliated, if considered necessary by the Board.
(F)In case institution/college is subjected to disaffiliation and if files application for revival of the affiliation within five years of such disaffiliation, its case shall be considered on merit by the screening committee without charging fresh fee for affiliation. However, repeated violation of the Bye-laws will lead to permanent disaffiliation of the institution/college.

17. Sale/Transfer of the college.

- The Board will not permit sale/transfer of the institution/college or any property of the institution/college through an agreement sale deed by one society/management/trust to an another society/management/trust. If such act is done apparently or impliedly the Board will withdraw affiliation with immediate effect.

18. Removal of Hardship.

- After implementation of this Regulation if any hardship is occasioned for removal of which the Board will be competent and for the said purpose shall be issuing separate Rule/Regulation, guidelines and letter which will be the part of the present regulation and compliance of which will be essential for institution/college.

19. Repeal and Saving.

- Rule, regulation, circular and letter issued by Bihar School Examination Board earlier shall stand repealed with effect from the date of implementation of this regulation. Notwithstanding such repeal, anything done or any action taken or purported to have done or taken under the regulation hereby repealed shall, is so far as it is not inconsistent with the provision of these regulation, be deemed to have been done or taken under the corresponding provision of these regulation.The present regulation is to be followed by institution/college which had been granted affiliation by the Bihar School Examination Board prior to this regulation and the prescribed affiliation fees is not deposited by them, the same shall be deposited within 15 days from the date of issuance of this regulation and in case of not doing so their affiliation will be cancelled.Format - 1Application for Affiliation of D.P.Ed.
