The Rajasthan Homoeopathic Medicine Board (Recognition for the Purposes of Affiliation) Regulations, 1973Published vide Notification No. G.S.R. 81(87)/ RBHM/ Gen-97 (Volume-2)/13979, dated 13-12-1973, published in Rajasthan Gazette Part 4-C, dated 28-2-1974In exercise of the powers conferred by clauses (i) and (viii) of section 40 read with sub-clauses (a) and (m) of clause (1) of section 58 of the Rajasthan Homoeopathic Medicine Act, 1969 (Rajasthan Act 1 of 1970), the Board hereby makes the following Regulations, the same having been previously published in the Rajasthan Gazette, Part 3(b) dated the 29th June, 1972. These regulations have also been confirmed by the State Government.

1. Short title and commencement.

(1)These regulations may be called the Rajasthan Homoeopathic Medicine Board (Recognition for the purposes of Affiliation) Regulations, 1973.
(2)They shall come into force with effect from the date of their publication in the Rajasthan Rajpatra.

2. Definitions.

- In these regulations unless the context otherwise requires:-
(a)"Act" means the Rajasthan Homoeopathic Medicine Act, 1969 (Act No. 1 of 1970);
(b)"Board" means the Rajasthan Board of Homoeopathic Medicine, constituted under the provisions of the Act;
(c)"Courses of Study" means the courses of study and curricula duly prescribed by the Board under section 40(ii) of the Act;
(d)"Form" means a form prescribed by and appended to these regulations;
(e)"Institution" means a Homoeopathic educational or instructional institution:
(f)"Panel" means a panel consisting of not more than 3 members of the Board appointed by the Board for inspecting an institution:
(g)"Recognition" means recognition for the purposes of affiliation under section 40(i) of the Act and affiliation means affiliation under section 40(i) of the Act:
(h)"Registrar" means the Registrar of the Board appointed under the Act:
(i)"Regulations" means the Regulations framed by the Board under section 58 of the Act:
(j)"Rules" mean the Rajasthan Homoeopathic Medicine Rules, 1971, or any other rules framed by the Government under the Act;
(k)"Section" means a section of the Act:
(l)Words and expressions used but not defined in these Regulations shall have the meaning assigned to them in the Act.

3. Submission of application for affiliation.

(1)An institution desirous of obtaining recognition for the purposes of affiliation from the Board, shall submit an application therefor in writing. The application shall be addressed to the Registrar and shall be in the form as per Appendix I. It shall be signed by a competent office bearer of the institution and shall be accompanied by an application fee of Rs.50/-which shall not be refundable. The fee may be sent to the Registrar either by postal order or by money order. The postal orders or the money order receipt, as the case may be, shall be enclosed with the application.
(2)A separate application shall be submitted for obtaining affiliation with respect to each course of study.
(3)The Registrar shall, on receipt of an application for affiliation place it before the Board.

4. Appointment of a panel by the Board.

(1)When the Board is satisfied that an application for affiliation, is in order, it shall depute a panel of not more than 3 of its members to inspect the institution for verification of the facts mentioned by the institution in its application for affiliation and for ascertaining how far the institution fulfils the conditions of affiliation as laid down in these regulations and to submit its. report to the Board within a period specified by it.
(2)The panel will have the power to call upon the governing body 'or the authority of the institution to furnish such reports, returns or other information as may be required by the panel for the due performance, of its duties. The institution will provide all reasonable facilities to the panel for the inspection of its buildings, laboratories, hospital, dispensary, library, records etc.
(3)The panel will in respect the institution and submit its report to the Board within the time limit prescribed by the Board.

5. Decision by the Board.

(1)On receipt of the report of the panel, the application for affiliation will be considered and decided by the Board in the light of the report submitted by the panel. The decision so taken by the Board will be communicated to the institution concerned by the Registrar as soon as possible.
(2)The fee for affiliation of an institution shall be Rs. 250/- for each course of study to be paid at the time when affiliation is first granted and such annual affiliation renewal fee with respect to each course of study as may be prescribed by the Board from time to time subject to a minimum of Rs. 50/- for each course of study.
(3)On receipt of an intimation from the Registrar to the effect that the Board is prepared to affiliate it, the institution shall deposit the affiliation fee of Rs. 250/-with the Board within the specified time. The annual affiliation renewal fee shall be paid into the Board before the end of July, every year failing which affiliation will terminate automatically. Unless previously otherwise directed by the Board, annual renewals of affiliation will be granted by the Registrar after the fee therefor, has been paid into the Board.
(4)After the prescribed fee of Rs. 250/- has been deposited with the Board, the Registrar will issue a letter of affiliation to the institution as per Appendix II. Necessary entries in. this letter will be made by the Registrar every year after the annual affiliation renewal fee has been paid into the Board.

6. Conditions for affiliation.

(1)Before affiliating an institution the Board shall satisfy itself that the institution fulfils the following conditions, namely that:-
(i)Its managing committee is composed of prominent public personalities and gives an undertaking that it shall faithfully carry out such directions of the Board as may be given to it from time to time and strictly comply with the provisions of the Act, Rules and the Regulations.
(ii)It is a body corporate under the provisions of the Societies Registration Act, 1860.
(iii)It has such endowment, or fund deposited in a Scheduled Bank as may be considered adequate by the Board for the development and the running of the institution on sound lines.
(iv)It has been in existence for at least two years before applying for affiliation.
(v)It has a diploma course of at least four year's duration.
(vi)It has at least High School or equivalent examination as the minimum qualification for admission.
(vii)It maintains regular attendance registers in respect of the staff and the students.
(viii)It has at least fifteen duly qualified teachers and other necessary staff and has on its roll at least thirty bonafide students.
(ix)It has its own dissection arrangements.
(x)It has an attached hospital and outdoor dispensary for practical training of such standard as may be prescribed by the Board from time to time.
(xi)It imparts training in all clinical and preclinical subjects such as Anatomy, Chemistry, Physics, Biology, Hygiene, Physiology, Pathology, Medical Jurisprudence, Mid-wifery, Gynecology, Minor Surgery and practice of Medicine etc.
(xii)It imparts training in all Homoeopathic subjects such as organon of Medicine, Pharmacology, Homoeopathic Philosophy, Chronic diseases, Materia Medica Bio-Chemistry, case taking and Repertorisation etc.
(xiii)It has a well-equipped library containing such number of standard books, on clinical, pre-clinical and Homoeopathy subjects and other literature as may be determined by the Board from time to time.
(xiv)It has such buildings, rooms, laboratories and furniture etc. for educational purposes as may be determined by the Board from time to time.
(xv)It has such equipment in its laboratories for practical works, institutional requirements, equipments and furniture etc. as may be determined by the Board from time to time.
(xvi)It has a pharmacy to prepare medicines for teaching and hospital purposes.
(2)The Board may with the previous approval of the State Government and subject to such limitations and restrictions as may be considered appropriate, waive or relax any one or more of the above conditions in suitable cases.
(3)Affiliation for a course of study other than a 4 year diploma course of study shall not be granted by the Board to any institution unless the institution is already affiliated to the Board for at least a four year diploma course of study.

7. Conditions of affiliations.

- The recognition for the purposes of affiliation granted by the Board shall be subject to the following conditions and the institution concerned shall at all times during the currency of the period of affiliation, fulfill the following conditions, failing which, affiliation may be withdrawn by the Board anytime after giving a notice in writing to the institution and after giving it an opportunity of being heard:-
(1)It will abide by the provisions of the Act, Rules and the Regulations framed by the Board and shall faithfully carry out the directions and orders of the Board given to it from time to time.
(2)It will during the currency of the period of affiliation always remain equipped with such laboratory equipment, library' books, institutional requirements, furniture, staff and other requirements as may be determined by the Board from time to time.
(3)It will pay to the Board the necessary affiliation fee and the necessary annual affiliation renewal fee within the prescribed time limits.
(4)It will prepare students only for the Board’s examination in the course of study for which it has been affiliated to the Board and for no other examinations of the Board or other institution.
(5)It will maintain regular Attendance Registers for the students and the staff.
(6)It will appoint and maintain on its teaching and hospital etc. staff such persons in such numbers as possess the qualifications laid down by the Board.
(7)It will pay to its teaching and hospital etc. staff such salary and allowance as may be prescribed by the Board from time to time.
(8)It will charge from the students only such tuition and other fees as may be prescribed by the Board from time to time.
(9)It will collect from its students and pay into the Board such enrolment, examination etc. fees as may be determined by the Board from time to time.
(10)It will maintain proper accounts of all money received by it and of all payments made by it in such manner and in such form as may be prescribed by' the Board. The accounts kept and maintained by the institution for each financial year will be got audited by a Chartered Accountant, a copy of whose report will be submitted by the institution to the Board within 6 months of the close of each financial year.
(11)It will not admit to the course of study more than such number of students as may be determined by the Board.
(12)It will regulate its working hours as per directions of the Board.
(13)It will allow its buildings, laboratories, libraries, rooms, equipments, furniture, records etc. to be inspected by the Registrar or by any other person so authorised or appointed by the Board.
(14)It will have a programme of teaching for each year, term and month and for each working day.

8. Suspension or withdrawal of affiliation.

- If at any time during the currency of the period of affiliation it is found that affiliation was obtained by an institution by fraud or false representation or the institution is not faithfully fulfilling the conditions of affiliation as laid down in these regulations, the Board may after such enquiry as it may deem proper and after giving the institution concerned an opportunity of making such representation as it may deem proper, suspend or withdraw the affiliation.Appendix I[See Regulation 3(1)]Form of application for affiliationTo,The Registrar,Rajasthan Board of Homoeopathic Medicine,JaipurSubject:-Application for grant of recognition for the purposes of affiliation.Sir,We beg to apply for recognition for the purpose of affiliation for the ..................... 2. Detailed information with respect to our institution is as stated in the Annexure. The information contained in this annexure is true to the best of our knowledge and belief. A duly attested true copy of the certificate of registration of the institution under the provisions of the Societies Registration Act, 1860, a certificate from ........... (name of the Scheduled Bank) with respect to endowment/Fund deposited by the institution with them and a copy of the site plan showing the measurements of buildings, laboratory, hospital, dispensary, library, teaching rooms etc. and its surroundings, are enclosed.

3. We agree to abide by the provisions of the Rajasthan Homoeopathic Medicine Act and the rules and regulations framed thereunder by the Government and the Board respectively. We further agree to carry' out faithfully all directions that would be given to us by the Board under the Act. Rules and Regulations.

4. It is requested that our case may please be placed before the Board for granting us recognition for the purpose of affiliation for the aforesaid course of study'.
