The Rajasthan Education Department (Primary and Secondary Teachers) Benevolent Fund Rules, 1975Published vide Notification No. F. 23 (63) Education/Gr. 2/74, dated 8-8-1975; Published in Rajasthan Gazette Part 4-(1), dated 2-10-75, page 530G.S.R. 158(44). - The Governor has been pleased to make the enclosed rules namely - "The Rajasthan Education Department (Primary & Secondary Teachers) Benevolent Fund Rules, 1975 for the welfare of the teachers".

1. Short title and commencement.

(1)These rules may be called the Rajasthan Education Department (Primary and Secondary [Education] [Substituted by G.S.R. 54, dated 23-6-1979; Published in Rajasthan Gazette Part 4-C(I), dated 19-7-79]) Benevolent Fund Rules, 1975.

(2)They shall come into force with immediate effect.

2. Applicability.

- These rules will be applicable to all the employees of the Education Department (Primary & Secondary [Education] [Substituted by G.S.R. 54, dated 23-6-1979; Published in Rajasthan Gazette Part 4-C(I), dated 19-7-79], but they shall not be applicable to the temporary employees appointed for less than one Calendar year.

- The fund shall be utilised for all the employees of the Education Department including all categories of officers, teachers, ministerial staff and class IV servants in the circumstances specified hereunder:]

(a)To the dependents in distress after death of an employee, while in service.

(b)To the employees disabled or incapacitated to perform their duties and need financial help.

(c)To the employees, who need loan for further professional studies,

(d)To the sons/ daughters of the employees who need loan for further studies.

(e)To the employees suffering from chronic illness of serious [nature and their dependents suffering from T.B., Cancer/ Paralysis etc. (serious diseases)] [Inserted by G.S.R. 54, dated 23-6-1979; Published in Rajasthan Gazette Part 4-C(I), dated 19-7-79] requiring prolonged hospitalization.

(f)[ Scholarship (Merit) to the children of the employees for further studies. [Added by G.S.R. 54, dated 23-6-1979; Published in Rajasthan Gazette Part 4-C(I), dated 19-7-79]

(g)To be utilised for constructions of hostels, cottage wards at various places and other benevolent institutions of similar nature for the exclusive use of employees of Education Department.]

4.

(a)All the Gazetted and non-gazetted members of the staff of the Education Department (Primary & Secondary) including Subordinate, Ministerial and Class IV services will contribute to the fund at the rates specified against each.

(b)Contribution from the Teachers Welfare Fund may be diverted to this fund and utilised for the purposes mentioned in rule 3.

(c)Other donations from outsiders may also be accepted with the approval of the Chairman.

(d)Donations from the film Exhibitors i.e. film show contribution etc. may be sought with the approval of the district authority.

The first annual subscription from the employees already in service will be realized in the month following the sanction of the rules by the Government (if they are sanctioned after October) and thereafter annual subscriptions shall be realized from the pay disbursed in the month of October every year. In case of new entrants the subscription will be realized after completing one year's continuous service.

6.

All subscriptions, donations will be remitted to the Chairman of the fund after deducting remittance charges, if any, along with the list of donors or subscribers.

7.

Registration, dismissal, discharge, removal or retirement from service will not entitle the subscribers to any refund of the subscription paid by him.

8.

The Fund will be regulated and administered by a Committee consisting of the following:-

1.	Director of Primary and Secondary Education	Chairman

4.	Principal, Higher Secondary School (one) to be nominated byMember	Member

7.	Senior Teachers (two)/ to be nominated by Member	Member
8.	Second Grade Teachers (two).Teachers Association	Member
9.	Third Grade teachers (two)	Member
10.	Representative of Ministerial Staff (one)/ to be nominated byMinisterial Staff Association)	Member

Note. - The Secretary in consultation with the Chairman and Treasurer shall make rules for keeping the accounts of the funds and prescribe necessary forms and registers.

In the absence of Chairman the Vice-Chairman will preside over the meeting. Six members besides the presiding officer, will form a quorum.

10.

The decision will be taken by majority of votes. The Chairman will cast his vote only in case of a tie.

11.

The Secretary shall record the minutes of the proceedings at the time of the meeting and get it signed by all the members present.

12.

Seven days clear notice along with agenda will be given by the Secretary for holding a meeting.

The Committee will be competent to sanction relief upto maximum of Rs. 2,000/- to the members and their family for the objects specified in rule 3 except that for the daughters marriage amount will not exceed Rs. 500/-.

13B.

The Committee will be competent to sanction any adequate amount for construction of cottage wards and hostels at important places for welfare of employees of education department.

13C.

The Committee will be competent to sanction the loan upto maximum of Rs. 3000/- for courses upto 3 years and upto 4000/- for courses beyond three years.]

14.

The Chairman of the fund will be competent to sanction immediate relief to the members during their life time of their dependent after death of the member in case of emergency upto Rs. 1000/- but only upto Rs. 500/- in case of daughter's marriage without the prior approval of the Committee. The grant of such relief will be placed before the committee for confirmation. Assistance will be admissible to those employees who are regular subscribers. However, the Committee may consider hard cases in exceptional circumstances.

The grant of any relief by the Government to the Board of Secondary Education, Rajasthan or teachers welfare fund will be no bar to the grant of relief under these rules.

15A.

The primary function of these funds is to give assistance to the employee/ dependents as proved in rule (3)(a) to (f). If funds permit financial assistance will be provided to voluntary organisations on the recommendation of the District Education Officer provided there has been a collection of atleast 50% of the total estimated cost of the project by way of donation, voluntary subscription staging shows and performance or organising charity shows etc. The assistance will be given on first come first served basis.]

16.

Relief under these rules after death shall be paid in the following order:-

(i)To widow,

(ii)Failing widow, the minor sons and daughters equally.

(iii)Failing minor sons and daughters, to dependent father or mother or both.

(iv)Failing mother and father, to dependent minor brothers and unmarried sisters if they were entirely dependent on the deceased.

(v)Failing brother and unmarried sisters, to the widowed daughters, if any, and if they were dependent on the deceased.

17.

The Committee will meet atleast twice a year and decide all cases and transact normal business of the fund.

18.

An account for the fund will be opened with any of the Banks doing Government business and will be operated upon by the Chairman who may authorise the Vice-Chairman to operate upon it on his behalf in case of necessity.

19.

A register of the subscribers will be maintained by the Treasurer and each subscriber will be allotted a separate number which will be communicated to him.

The loans given out of this fund will be re paid in suitable instalment by the employees regularly through his head of office who will also maintain the record and see that timely repayment is done. Money order Commission will be borne out by the employees. Detailed rules regarding repayment of loans shall be framed by the Committee. The loan will be given on 5% interest. The amount of outstanding loan would be recoverable from pension and gratuity of the loanee.]

21.

The loans given out of this fund will be repaid in suitable instalments by the employee regularly through his Head of Office who will also maintain the record and see that timely repayment is done. Money order commission will be borne out by the employee. Detailed rules regarding repayment of loans shall be framed by the Committee. The loan will be given on 5% interest.

The Chairman will be competent to sanction contingent expenditure upto Rs. 100/- at a time subject to the limit of Rs. 5000/- in a year without the approval of the committee.]

23.

The accounts of the fund will be audited once a year by the Examinee Loan Fund Audit. Besides it the committee will appoint a member or members of the Committee to examine the accounts once a year. The Director of Primary and Secondary Education, Rajasthan, may authorise to Departmental Audit Party to examine the accounts and to assist the members nominated by the Committee for the purpose of examination of accounts.
