Staff Nurse Class III, Competitive Examination Rules, 2013Published vide Notification No. GP-12-NSG-102013-332-E, dated 6.8.2013Last Updated 7th November, 2019No. GP-12-NSG-102013-332-E. - In exercise of the powers conferred by the proviso to Art. 309 of the Constitution of India, the Governor of Gujarat hereby makes the following rules to provide for regulating the method of Competitive Examination for recruitment to the post of Staff Nurse, Class III, in the Subordinate Services of the Commissionerate of Health, Medical Services and Medical Education and Research, Gujarat State, namely:-

1. Short title.

(1)These rules may be called the Staff Nurse Class III, Competitive Examination Rules, 2013.
(2)They shall come into force on the date of their publication in the Official Gazette.
(3)They shall apply to the persons, who are eligible to be appointed by direct recruitment as Staff Nurse, Class III, in the Subordinate Services in the Commissionerate of Health, Medical Services and Medical Education and Research, Gujarat State.

2. Definitions.

- In these rules, unless the context otherwise requires,-
(a)"Appendix" means an Appendix appended to these rules;
(b)"Commissioner" means the Commissioner of Health, Medical Services and Medical Education and Research;
(c)"Examination" means the Competitive Examination held by the Examination authority under these rules for the purpose of direct recruitment to the post of Staff Nurse, Class III;
(d)"Examination authority" means an authority appointed and authorized by the Government to conduct the examination;
(e)"Government" means the Government of Gujarat.

3. Eligibility.

(1)A candidate shall not be qualified for admission to the Examination unless he is a citizen of India.

4. Disqualification for appointment on ground of plural Marriage.

(1)No person,-
(a)Who, has entered into or contracted a marriage with a person having a spouse living: or
(b)Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the post:
Provided that subject to the provisions of any law for the time being in force, the. State Government may, if satisfied that there are special grounds g for doing so, exempt any person from the operation of this sub-rule.
(2)The candidate shall declare in the application form whether he or she,, as the case may be, is married and, in the case of the male candidate whether he has more than one wife living and in the case of female candidate whether she married to a man who has already another wife living.

5. Age Limit.

- A candidate shall have attained the minimum age and shall not have attained the maximum age prescribed in the relevant recruitment rules on the date as specified in the advertisement.

6. Educational qualification.

(1)A candidate possessing the requisite educational qualification for the appointment to the post of Staff Nurse, Class III, in the subordinate service of the Office of the Commissioner of Health, Medical Service and Medical Education and Research, Gujarat State, under the relevant recruitment rules shall be eligible for admission to the examination.
(2)A candidate shall require to get himself registered with the Gujarat Nursing Council in accordance with the provisions of the Gujarat Nurses. Midwives-and Health Visitor's Act, 1968 at the time of making an application.
(3)Candidate must have basic knowledge of computer application as prescribed in the Gujarat Civil Services Classification and Recruitment (General) Rules, 1967.

7. Admission to the Examination.

- A Candidate who applies and pays the prescribed fees shall be admitted to the examination:Provided that if at any time the candidate is found not eligible because he does not possess the requisite-educational qualifications or does not possess eligibility in accordance with the Provisions of Rule 6 above, his candidature shall be cancelled even if he attains the qualifying standard for the examination.

8. Holding of Examination.

(1)The Examination authority shall, on receiving the requisition from the Government, by an advertisement published in the prominent news papers widely circulated in the State call for the application in the prescribed form from the candidates possessing requisite qualifications.
(2)The Examination authority, on receiving the requisition from the Government, shall hold a competitive examination for selection of candidates for recruitment to the post of Staff Nurse, Class III, in the Subordinate Service in the office of the Commissioner of Health-Medical Service and Medical Education and Research, Gujarat State.
(3)The, date, time and the places for holding the examination shall be-decided by the Examination authority.
(4)The Candidate shall require to appear in the examination at his own expenses.

9. Application for appearing in Examination.

(1)A candidate who desire to appear at the examination shall submit an application in such form,, within such time limit as may be prescribed by the examination authority along with such fees in such manner as may be determined by the Government, from time to time.
(2)Fees once paid shall not be refunded or held over for the subsequent examination in any circumstances.

10. Appearance at the examination.

(1)No candidate shall be allowed to appear at the examination unless the examination authority is satisfied that-
(i)the candidate possesses the requisite qualification under the recruitment rules for the said post; and
(ii)he has paid the requisite fees along with the application.
(2)The decision of the examination authority as to the eligibility of a candidate for admission to the examination shall be final.

11. Syllabus.

(1)The examination shall comprise of the papers specified in Appendix-I, and the syllabus for each paper shall be as such provided by the Indian Nursing 'Council and specified against each paper in the said Appendix.
(2)Each paper shall carry 100 Marks and each shall be of two hours duration.

12. Medium of Examination.

- The medium of examination of Paper-I (Nursing Subject) shall be Gujarati or English and of Paper-II (Gujarati Language) shall be Gujarati.

13. Qualifying standard for passing of examination.

- The qualifying standards for passing the examination shall be as determined by the Examination authority.

14. Result of the Examination and preparation of select list and Waiting list.

(1)The examination authority shall cause to prepare the select list of successful candidates in Part-I in the order of their merit on the basis of aggregate marks finally awarded to each candidate in the examination and shall forward the same with its recommendation to the Commissioner.
(2)The Examination authority shall cause to prepare list of name of candidates to be kept in a waiting list in Part-II as far as feasible for about ten percent of the number of candidates recommended by the examination authority under sub-rule (1) for recommendation on demand by the Commissioner.
(3)The Examination authority shall also recommend the names of successful candidates belonging to the Scheduled Castes, Scheduled Tribes, Socially and Educationally' Backward Classes, Women, Physically Handicap Persons and Ex-servicemen to the extent of the number of vacancies reserved for such categories.

15. Publication of Result.

(1)The Examination authority shall submit a copy of the result to the Commissioner and the office of the Commissioner shall publish the same on website.
(2)The Examination authority shall communicate the result to the successful candidates individually in the manner as may be determined by it.

16. No right to appointment.

- The passing of the examination shall not by itself confer upon a candidate any right to appointment and no candidate shall be appointed to the post unless the appointing authority is satisfied after such inquiries as may be considered necessary that the candidate is suitable in all respect for appointment to public service.

17. Medical Examination.

- The Candidates qualified for appointment shall require to go through the medical examination in accordance with the rules made by the Government in that behalf.

18. Disciplinary action.

- A candidate who is or has been declared by the Examination authority to be guilty of:-(a)obtaining support for his candidature by any means, or(b)imprersonating, or(c)procuring impersonation by any person, or(d)submitting fabricated documents or documents which have been tampered with or#'(e)making statement which are incorrect or/false or suppressing material facts or information, or(f)restoring to any other irregular or improper means in connection with his candidature for the examination, or(g)using unfair means during the examination, or(h)writing irrelevant matter, including absurd language or pornographic matter in the scripts, or(i)misbehaving in any other manner in the examination hall, or(j)harassing or doing bodily harm to the staff employed by Examination authority for the conduct of the examination, or(k)attempting to commit or, as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses, or(l)violating any of the conditions for admission to appear in the examination as prescribed and specified in the admission certificate, may, in addition to rendering himself liable to criminal prosecution, be liable -
(1)to be disqualified by the Examination authority from the examination for which he is a candidate, or
(2)to be debarred either permanently or for a specified period-
(i)by the Examination authority, from appearing in any examination or from any interview for direct selection to be held by it, or (ii) by the State Government, from any employment under it:
Provided that-no penalty under clause (1) or (2) shall be imposed except after giving the candidate an opportunity of being heard or representation as he may wish to make in that behalf, or
(3)to disciplinary action under the relevant rules, if he is in Government service.

19. Mark-Sheet and rechecking of Marks..

(1)A candidate, who desires to have his marks of the examination rechecked, may apply to the Examination authority alongwith such fees as may be fixed by the Commissioner for each paper within a period of fifteen days from the date of declaration of the result of the examination.
(2)A candidate, who desires to have the mark-sheet of the examination shall apply to the Examination authority alongwith such fees as may be fixed by the Examination authority within a period of fifteen days from the date of declaration of the result.

20. Prohibition to use certain devices in the examination hall.

- A candidate shall not be allowed to carry with him any other electronic communication devices like cellular phone, calculator, pager, laptop etc.

21. Conduct and regulation of Examination.

- The examination authority shall regulate all matters relating to appointment of examiners and conduct of examination in accordance with the procedure adopted by it and in conformity, with the Government's order in that behalf.Appendix-1[See Rule 11]Paper and syllabus for the competitive Examination for recruitment to the post of Staff Nurse, Class III.

Note. - (1) Above test consists of multiple choice question (MCQ) and each of one mark with negative marking system i.e. 0.25 will be deducted for each wrong answer based on above syllabus.
(2)The standard of questions of Gujarati shall not be lower than that of the Higher Secondary School Certificate examination conducted by the Gujarat Secondary and Higher Secondary Education Board.
