Chhattisgarh Panchayat Samvida Shala Shikshak (Appointment and Conditions of Service) Rules, 2004Published vide Notification No. 52/P/22/2004, dated 10-8-2004, C.G. Rajpatra (Asadharan), dated 10-8-2004 at pp. 592 (9)-(18)In exercise of the powers conferred by sub-section (1) of Section 95 read with sub-section (2) of Section 70 of the Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994); the Slate Government hereby makes the following rules, which were published as required by sub-section (3) of Section 95 of the said Act, namely :-

1. Short title and Commencement.

(1)These rules may be called Chhattisgarh Panchayat Samvida Shala Shikshak (Appointment and Conditions of Service) Rules, 2004.
(2)They shall come into force from the date of their final publication in the Chhattisgarh Gazette.

2. Definitions.

- In these rules, unless the context otherwise requires,-
(a)"Act" means Chhattisgarh Panchayat Raj Adhiniyam, 1993 (No. 1 of 1994);
(b)"Appointing Authority" means the authority designated in column (4) of Schedule-1;
(c)"Scrutinizing Committee" means the committee designated in column (6) of Schedule-2;
(d)"State Government" means Government of Chhattisgarh;
(e)"Panchayat" means Zila Panchayat, Janpad Panchayat or Gram Panchayat constituted under the Act, as the case may be;
(f)"State" means Chhattisgarh State;
(g)"Schedule" means a schedule annexed to these rules;
(h)"Samvida Shala Shikshak" means persons appointed under these rules by any Panchayat for teaching in a school under its control;
(i)"General Administration Committee" means the General Administration Committee of the Panchayat.

3. Extent and applicability.

- These rules shall apply to Samvida Shala Shikshaks.

4. Classification and contract amount.

- The Classification and contract amount of Samvida Shala Shikshaks shall be as given in Schedule-1.

5. Age limit and qualifications.

- Minimum and maximum age and qualifications for appointment shall be as given in Schedule-2.

6. Reservation.

(1)The provisions of Chhattisgarh Lok Seva (Anusuchit Jatiyon, Anusuchit Janjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994) shall apply to the appointment of Samvida Shala Shikshaks.
(2)The orders issued by the State Government from time to time regarding reservation in the direct recruitment of class three employees of the State Government shall apply to appointment of Samvida Shala Shikshaks.
(3)Reservation in the appointment of Samvida Shala Shikshaks shall be according to the roster prescribed by the State Government and kept by the concerned Panchayat, under the provisions of Chhattisgarh Lok Seva (Anusuchit Jatiyon, Anusuchit Janjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, 1994 (No. 21 of 1994).

7. Selection and method of recruitment.

(1)Selection of Samvida Shala Shikshaks shall be done by the method of direct recruitment.
(2)The officer authorised by the Slate Government shall communicate to the appointing authority the posts available for the appointment of Samvida Shala Shikshaks every year.
(3)Advertisement of the posts available for appointment of Samvida Shala Shikshaks shall be done in the following manner-
(a)by advertisement in at least one newspaper having large circulation in the Panchayat area; and
(b)by notification in the local Employment Exchange; and
(c)by displaying at the notice board of the concerned Panchayat.
(4)Scrutinising Committee shall scrutinise the applications received.
(5)The candidates found qualified after scrutiny shall be called before the Scrutinising Committee to test the knowledge of local language.
(6)Scrutinising Committee shall compute the marks on the basis of Schedule-3 after testing the knowledge of local language.
(7)After computing the marks, categorywise selection lists shall be prepared separately for unreserved category, scheduled caste category, scheduled tribe category and other backward classes category in the following manner-
(a)Selection lists shall be prepared in the order of merit in such a manner that the name of the candidate getting highest marks shall be kept at the top of the list, and other names shall be kept in descending order.
(b)In the event of marks being equal, the decision of which name is to be kept higher will be taken by the Scrutinising Committee by draw of lots.
(c)Names of all the candidates of unreserved and reserved category shall be kept in the selection list of unreserved category in the order of merit, and if any candidate of reserved category finds a place in this list on merit, his appointment shall not be considered to be against the vacancy in reserved category.
(d)In the selection lists of scheduled caste category, scheduled tribe category and other backward classes category, the names of candidates of these categories shall be kept in the order of merit, and the vacancies reserved for these categories shall be filled from these selection lists.
(8)A waiting list which shall remain valid for 9 months, shall be prepared for each category for 20 percent posts or a minimum of 5 posts.

8. Appointment.

- Persons selected under Rule 7 may be appointed by the appointing authority to a specific school in the area of the concerned Panchayat for the period of one year.

9. Compassionate Appointment and Special Appointment.

(1)If the State Government upgrades any center of teaching children by whatever name called to a primary school, then the State Government may for reasons to be recorded, direct the appointing authority to appoint those persons as Samvida Shala Shikshaks for a period of one year to such upgraded primary schools who have been teaching children in such centers, and who fulfil the minimum qualifications of Samvida Shala Shikshak under these rules, and in compliance of the directions of the State Government the appointing authority shall appoint that person in that upgraded primary school for the period of one year on the post of Samvida Shala Shikshak.
(2)The posts of Samvida Shala Shikshaks shall be available for compassionate appointments for the employees of the State Government, and Collector may, under the orders issued by the State Government from time to time, direct the appointing authority that a person be appointed on compassionate grounds to the post of Samvida Shala Shikshak for a period of one year, and in compliance of the direction of the Collector, the appointing authority shall appoint that person on the post of Samvida Shala Shikshak for a period of one year in a specific school.

10. Reappointment.

(1)Appointing authority shall evaluate the work of persons appointed under Rule 8 and Rule 9 and reappointed under sub-rule (2) of Rule 10, and if in the opinion of the appointing authority the work of the person so appointed is good, then that person may be appointed for another period of one year by the appointing authority.
(2)If persons reappointed under sub-rule (1) of Rule 10 acquire the qualification of B.Ed. or D.Ed., then their work shall be evaluated by the appointing authority, and if in the opinion of the appointing authority the work of persons so appointed is good, then that person may be appointed for another period of one year by the appointing authority.
(3)If a Samvida Shala Shikshak does not require the qualification of B.Ed., or D.Ed., within two years of first appointment to the post of Samvida Shala Shikshak, then such a person shall not be eligible lo be reappointed to the post of Samvida Shala Shikshak.

11. Discipline and Control.

- Samvida Shala Shikshaks shall be under the administrative control of the concerned Panchayat.

12. Appeal.

- Appeal against the orders passed under these rules shall be under the provisions of the Act.

13. Other Conditions.

(1)The rules applicable to the employees of the Panchayat for medical facilities and travel allowance shall also be applicable to Samvida Shala Shikshaks.
(2)Samvida Shala Shikshaks appointed under these rules shall be eligible to get 13 days casual leave and 3 days optional leave. Female Samvida Shala Shikshaks shall also be eligible to get maternity leave according to the orders issued from time to time by Government of Chhattisgarh regarding maternity leave for class three government employees. They shall not be eligible for any other leave.
(3)Samvida Shala Shikshaks appointed under these rules shall not be eligible to receive any pay or allowances other than the contract amount.
(4)The services of a Samvida Shala Shikshak appointed under these rules, may be terminated at any time before the expiry of the period of appointment by the appointing authority without assigning any reason by giving a one month notice or the contract amount of one month, similarly Samvida Shala Shikshaks appointed under these rules, may resign by giving one month notice or the contract amount of one month to the appointing authority.
(5)The Samvida Shala Shikshaks appointed under these rules shall be governed by the Chhattisgarh Panchayat Seva (Achran) Niyam, 1998.
(6)Other conditions mentioned in the appointment order shall also apply to the persons appointed under these rules.
(7)The headquarters of Samvida Shala Shikshaks appointed under these rules shall be that village where the school to which they have been appointed is located, and it shall be mandatory for Samvida Shala Shikshaks to reside at their headquarters, and in the event of not residing at their headquarters, the appointing authority may terminate their services.
(8)In addition to the regular teaching work, Samvida Shala Shikshaks appointed under these rules shall be required to do all the work given to them by the concerned Panchayat, including training, enrolment of drop-out children, conducting special classes for children who have failed in examinations, etc.
(9)Samvida Shala Shikshaks shall be appointed to a specific school under these rules, and they shall not be transferred under any circumstances.
(10)Samvida Shala Shikshaks. who die while in service will be eligible to get exgratia relief according to the instructions issued by Government of Chhattisgarh for exgratia relief to class three government employees.

14. Amendment in Schedules.

- State Government may amend any Schedule annexed to these rules by issuing a notification in the official gazette.

15. Repeal and Saving.

- All rules corresponding to these rules which were in force immediately before the commencement of these rules are hereby repealed :Provided that any orders made, and any action taken under the rules and instructions so repealed, shall be deemed to have been an order made or action taken under the corresponding provisions of these rules.

Note - 1. Orders issued by the State Government from time to time with regard to the relaxation in age limit for direct recruitment of class three employees of the State Government shall apply to age relaxation under these rules.

2. Those candidates who have done teaching job in educational institutions under the supervision of Panchayat will be. entitled to relaxation upto three years in the upper age limit.

3. Instructors/Supervisors of Non-formal education centers will be entitled to relaxation up to eight years in the upper age limit.

Note - 1. For all the certificates in sports, NCC, NSS, and all the awards in scouts and guides taken together, the maximum marks to be awarded shall not be more than 5 percent.

2. Full 15 percent marks shall be given for having knowledge of local dialect, and 0 marks will be given for not having knowledge of local dialect. Marks between 0 and 15 percent shall not be given under any circumstances viz. the Scrutinising Committee has only to test whether the candidate has or does not have knowledge of local dialect, but it will not evaluate the level of this knowledge.

3. Local dialect means "locally spoken dialect", viz. the dialect which is spoken in the locality.
