No. A-420 of 1966. - In exercise of the powers conferred by sections 4 and 5 of the Nilgiris Game and Fish Preservation Act, 1875 (Tamil Nadu Act II of 1879); sections 26,33 and 63 of the Tamil Nadu Forest Act, 1882 (Tamil Nadu Act V of 1882), and section 6 of the Indian Fisheries Act, 1897 (Central Act IV of 1897) and in supersession of the Nilgiris Fishing Rules published with the late Development Department Notification No. Nil, dated 23rd October 1953, published at pages 378-381 of Rules Supplement to Part I of the Fort St. George Gazette, dated 18th November, 1953, as subsequently amended, the Governor of Tamil Nadu hereby makes the following rules the same having been previously published for general information:-

1. Short title, application and direction.

(a)These rules may be called the Nilgiris Fishing Rules, 1966.
(b)They shall apply to the waters within the area specified in Schedule I to these rules;
(c)These rules shall remain in force for a period of fifteen to twenty seven years from the date of the publication in the Official Gazette.

2. Definitions.

- In these rules, unless the context otherwise requires,-
(a)"Assistant Director" means the Assistant Director of Fisheries having jurisdiction over the Nilgiris District;
(b)"Director" means the Director of Fisheries, [Chennai] [Substituted for the word 'Madras' by the City of Madras (Alteration of Name) Act, 1996 (Tamil Nadu Act 28 of 1996).];
(c)"Fishing" means and includes capture of, or attempt to capture, fish by any means including hooks and lines, fixed engines, curves, weirs or nets or by damming or baling of any water;
(d)"Government" means the Government of Tamil Nadu;
(e)"Inspector" means the Inspector of Fisheries.

3. Waters in which fishing is controlled by the Department of Fisheries.

- The Fisheries Department shall control fishing in all the waters specified in Schedules II to IV to these rules.

4. Prohibition of erection or use of fixed engines, etc., and fishing.

- No person shall-
(a)erect or use any fixed engine or net for capturing fish;
(b)use any poison or throw any toxic matter likely to result in fish mortality;
(c)use dynamite or other explosive substance for fishing;
(d)fish in any other method in the waters within the area specified in Schedule I to these rules except under, and in accordance with, the terms and conditions of a licence issued in the Form set out in Schedule V to these rules.

5. Authority to issue licences and the period.

(1)Fishing licences shall be issued by any officer of the Fisheries Department not below the rank of an Assistant Inspector of Fisheries or any other person, or association authorised in this behalf by the Director.
(2)The period covered by a licence shall be clearly endorsed on the licence.

7. Cancellation or refusal.

- The Officer issuing the licence may cancel the licence or refuse to issue a further licence to any person who fails to comply with the provisions of these rules.

8. Fees not to be refunded.

- No refund of the licence fees paid shall be made on any category of licence, (whether used or unused or cancelled), unless the licence is surrendered at least two clear days in advance of the date of commencement of the licence.

9. Furnishing of information by persons holding monthly and annual licences.

- Every holder of a monthly or annual licence shall send a report in the Form specified in Schedule VI to these rules within seven days of the close of each calendar month during the period of validity of the licence.

10. Time for fishing.

- No licensee shall fish before 6 a.m. and after 7 p.m.

11. Rules for trout fishing.

(a)Trout fishing shall be allowed in all the waters specified in Schedule II to these rules.
(b)Fishing in the waters specially reserved for trout fishing, and in the tributaries of such waters shall be, subject to the following provisions, namely:-
(i)The holder of a trout fishing licence may also take any other fish he may catch in the said waters. He may also fish in the waters mentioned in Schedule 111 to these rules, subject to the rules regulating fishing in these waters, but without alterations of the maximum catch of trout allowed on his trout licence, the holder of an annual licence for mixed fishing may, on payment of an additional sum of Rs. 50 (Rupees fifty only) per year or such other sum as may be fixed, from time to time, by the Director, obtain a yearly licence for trout fishing.
(ii)Fishing shall be closed in these waters including tributaries of such waters during such periods-as may, from time to time, be notified by the Director in the Nilgiris and Coimbatore District Gazette.
(iii)Fishing in the waters specially reserved for trout fishing or in the tributaries of such waters shall be with artificial fly or flies on a single hook only. No weight in any form shall be attached to the cast, fly or line. Spinning may be permitted in such water or waters by the Director in writing.
(iv)For the purpose of this rules, "spinning" means the use of artificial minnows, lure or spoon and dead bait (which means dead fish only) used with spinner or by attaching to the hook or hooks a dead fish so placed (i.e. by arranging the tail) as to spin in the water. The use of live bait is strictly prohibited. On no account shall unrequired bail dead or alive, be thrown into the lakes.
(v)Trolling in the Kukurti, Emerald, Avalanche and Upper Bhavani Reservoirs, within the limits specified on the notice boards in the office of the Assistant Director or Inspector, is permitted during such period as spinning is permitted.
(vi)All fishes of a length less than that fixed, from time to time, by the Director should be returned alive to the waters where they have been captured.
(vii)Every licence holder should carry a disgorger.
(viii)All trout bearing marks by the Fisheries Department of the Government for experimental purposes should, after capture, be surrendered intact to the nearest Fisheries Officer with information regarding the place, date and time of capture.

12. Licence fee for trout fishing.

(1)Subject to rule 20, the fee for a licence for fishing with one rod and a single hook in any of the waters to which rule 11 applies and the number of trout which a licensee is entitled to catch shall be as specified in the table below:-The Table

(2)Children of less than 15 years of age whose parent holds a current annual licence shall be charged for all categories of trout licences at 50 per cent of the rates prescribed above.

13. Issue of more than one licence.

(1)No person shall take more than three annual licences in a year for fishing in any of the waters.
(2)The Director may vary the maximum number and size of trout which can be captured with a trout licence of any description in such manner and for such period as he thinks fit.

14. Rules for mixed fishing (trout and carps).

(1)Fishing any species of fish with one rod and a single or triple hook bait or lure shall be permitted in the waters mentioned in Schedule III to these rules which are not reserved for trout fishing, but in which trout may also be available.
(2)The fees for such licences and the number of trouts which a licensee is entitled to catch shall be as specified in the table below:-The Table

15. Rules for carp fishing.

(1)Carp fishing shall be allowed in the waters mentioned in Schedule IV to these rules.
(2)The following fees shall be charged for licences for fishing in such waters with one rod and any bait lure or hook (except in the case of masheer for which triple hook is permitted).
(i)Daily-Rs. 3 (Rupees Three only).
(ii)Monthly-(30 days from the date of issue) - Rs. 30 (Rupees Thirty only).
(iii)Annual (12 months from the date of issue)-Rs. 75 (Rupees Seventy-five only).

16. General conditions of licence for trout, mixed and carp fishing.

(1)Licences issued are not transferable and shall be shown on demand to any Fisheries, Forest, Revenue or Police Officer or any person authorised by the Director.
(2)Licence holders shall, on demand, show their catches to any or all of the above officers or persons.

17. Cancellation or refusal of licence for conviction or other reasons.

- The officer issuing licences may refuse to grant a licence under these rules to any applicant who has been convicted of an offence against the provision of these rules or for any other reason to be stated in writing and may, on, similar grounds, cancel any licence already granted. When a licence is so cancelled, the fees paid for the licence shall not be refunded.

18. No refund of fee if declared to be closed for fishing.

- If during the currency of any category of licence, any water or waters or portions of waters thereof either specially reserved for trout fishing or otherwise are declared as closed for fishing for any reason or purpose whatsoever, the holder of a licence for fishing in such waters shall have no claim of refund of the licence fee or any portion thereof in respect of the licence held by him.

19. Prohibition of the use of more than one rod.

- The use of more than one rod at a time under one licence is prohibited. For the purposes of this rule, a rod which is not in the licence holder's hand, but which is left with its line in the water shall be considered to be a rod in use.

20. Powers of the Director.

(1)The Director may, by notification in the Nilgiris and Coimbatore District Gazette,-
(i)declare, from time to time, that all or any of the waters whether reserved for trout fishing or not are closed or open to fishing; or
(ii)prohibit the fishing of any particular species of fish in all or any or portions of any or all waters for any specified period.
(2)Notwithstanding anything contained in these rules, the Director may, by notification in the Gazettes of Nilgiris and Coimbatore districts,-
(i)reduce or increase the rate of fee for a trout or mixed or carp fishing licence;
(ii)decide the method of catching trout or other species of fishes;
(iii)permit spinning or other methods of fishing in any of the waters reserved for trout fishing;
(iv)declare any trout water as mixed fishing water and any mixed fishing waters as trout fishing water;
(v)permit or disallow the use of power boats or other kind of boats in any of the waters, subject to general or special concurrence of the Tamil Nadu State Electricity Board or any officer authorised by the Board for giving such concurrence;
(vi)permit any method considered necessary to eradicate undesirable fish in any of the waters;
(vii)permit the use of fixed engines in any or all waters for the purpose of fishing;
(viii)fix hours for fishing;
(ix)approve the forms of fishing licences;
(xi)authorise any person or body or group of persons other than the Fisheries Officers to issue any or all licences for fishing and prescribe the procedure and conditions for issue of licences by such persons or organisation.

21. Penalties.

(1)Whoever commits a breach of the rules hereinbefore contained shall be punishable with fine which may extend to one hundred rupees and when the breach is a continuing breach with a further fine, which may extend to ten rupees for every day after the date of the first conviction during which the breach is proved to have been persisted in.
(2)A Magistrate may, on the conviction of any person for the breach of these rules, order the seizure, forfeiture and removal of fixed engines erected or used or nets used in contravention of these rules and also order the forfeiture of any fish taken by means of any such fixed engine or net.
(3)Whoever commits breach of rules, 4,11,12,14,15 and 16 shall be punishable with imprisonment for a term which may extend to one month or with fine which may extend to two hundred rupees or with both.

22. Persons appointed to enforce these rules to be deemed to be Forest Officers.

- Every person appointed or authorised by, or acting under the orders of the Director for the purpose of enforcing these rules shall be deemed to be a Forest Officer under the Tamil Nadu Forest Act, 1882 (Tamil Nadu Act V of 1882).

23. Savings.

- Nothing contained in these rules shall apply to fishing conducted by, or under the orders of, the Director or any other Fisheries Officer empowered by the Director in this regard.

I

(i)The right bank of the Bhavani River from the point where Gopaner stream joins the Bhavani river on the Tamil Nadu-Kerala State boundary up to Niralai.
(ii)A straight line drawn from Niralai in item (2) above to Gazalhatti Chatram in item (iii) below:-
(iii)The left bank of the Moyar river from Gazalhatti chatram up to the inflow of the Kakenhulla and thence the western boundary of the Ootacammund taluk to the Nilgiris peak, the whole width, of the Moyar river, being included where it form the taluk boundary.
(iv)From that point the Western crest of the Nilgiris Hills to its termination below "Sispara".
(v)The portion of the Kalkundi stream and its tributaries lying within the Gudalur taluk are included in this area.

II

1. Mukurthi lake and river above Mukurthi lake;

2. The Rrurmund river above the falls (which is 200 meters below the confluence of Mekod river);

3. The Partimund Stream and the Partimund Reservoir (when formed);

4. Mekod river below Mekod falls;

5. The reservoirs formed of the Avalanche and Emerald rivers including top waters;

6. The Peerumund streams;

7. Kokithurai stream;

8. Chembar stream;

9. Kalkundi stream;

10. The Upper Bhavani reservoir (when formed). Billithadahulla river with its tributaries (i.e.) Talakunda, Lakkidian Deverbetta streams.

11. Bhavanipuzha;

12. Arokiampuzha and western catchment reservoir (when formed).

13. Parsons valley stream and the parsons valley reservoir (when formed);

14. King Dhar stream and western catchment reservoir (when formed);

15. Tirupanthorai stream;

16. Emeripuzha stream;

17. Silent valley stream;

18. Banghihullah stream and reservoir (when formed);

19. Kaineerhundi; and

20. Riverside stream-Off Pykara river.

5. Glemmorgan Reservoir.

(b)The holder of this licence can also fish for trout and carp in the following mixed fishing waters with any bait or line, provided the total number of trout killed does not exceed the maximum catch of trout allowed in this trout licence:-

1. Pykara Reservoir;

2. Pykara River below the Dam to the Pykara Falls;

3. Emerald and Avalanche streams below the Emerald and Avalanche Dams to their confluence;

4. Kundha river from below the confluence of Emerald and Avalanche streams including Kundha Forebay till its confluence with Bhavanit River; and

5. Glemmorgan Reservoir.

2. The following waters are closed for fishing during the season of 196-

3. Fishing shall be closed in these waters during such periods as are notified in the District Gazette, from time to time,

4. Fishing shall not be permitted within 30 meters of the face of the Dam.

5. Fishing shall not be permitted between 19.30 hours and 06.00 hours excepting Mukurthi lake where fishing is permitted till 21.00 hours.

(a)Spinning is permitted with the permission of the Director of Fisheries in the Mukurthi and Upper Bhavani lakes and in the Avalanche and Emerald lakes only in those areas demarcated by notice Board.
Spinning is defined as the use of:-Artificial minnow lure or spoon and (ii) dead bait (which means fish only) used with a spinner or by attaching to the hook or hooks a dead fish so placed, (e.g. by arranging tail) as to spin in the waters. The use of live and unrequired baits are strictly prohibited.In case of fishing waters any bait or line may be used.

6. Fishing at any time with more than one rod is prohibited (a rod with the line and hook left in the water shall be considered to be a rod and line in use even though it is not held in the Angler's hand).

7. All fish of length less than that fixed, from time to time, by the Director must be returned alive to the waters.

8. Every licence holder shall carry a disgorger.

9. The following fees are charged for a licence for one rod and line per angler:-

For one year Rs. 75 to cover 250 trouts.
For one month (30 days from any chosen date) Rs. 25 to cover 75 trouts.
For one week (seven days from any chosen date) Rs. 10 to cover 25 trouts.
For one week end (Friday noon to Monday noon) Rs. 5 to cover 15 trouts.
For one day Rs. 3 to cover 6 trouts.
Note. - The licence ceases to be valid after the expiry of the period even if the maximum allowance of fish is not caught.

10. Every holder of licence must furnish after each month or week in respect of annual and monthly licences and within Iwo days of the expiry of the licences for weekly, week end, daily licences the informations as to the water-fished, number and weight of fishes caught and killed, and number returned alive to the waters and individual size and weight of fishes of 500 grams and above for which cards can be obtained from the office of the issue of the licence.

11. The officer issuing the licence may cancel the licence or refuse to issue a licence to any person who fails to comply with any or all the provisions of Nilgiris Fishing Rules, and no refund of licence fee paid will be made under any circumstances.

12. The licence is not transferable and shall be shown on demand to any Police, Fisheries, Forest, or Revenue Officer. Tire licence holder must, on demand, show the catches also to any or all the officers or persons mentioned above, or persons authorised by them in this behalf.

Note. - The licence not being transferable, a licence holder may not lend his rod to any persons not holding licence nor can airy such person use the rod of the licence holder.

13. No licence holder may take fish for purposes of stocking in private waters and all fish retained must be killed immediately at the water side.

14. Licence fee once paid is not refundable or adjustable subject to rule 8.

(iv)Kundha river from below the confluence of Emerald and Avalanche streams including Kundha Forebay till its confluence with Bhavani River; and
(v)Glemmorgan Reservoir.

2. Waters in which fishing is closed during present season.

3. Fishing shall not be permitted between 19.30 hours and 06.00 hours.

4. Fishing with more than one rod at a time is not permitted.

5. Fishing shall not be permitted within 30 meters efface of Dam.

Note. - A rod left with its line and hook in water shall be considered to be a rod in use even though it is not held in the Angler's hand.

6. All fish of a length less than that fixed, from time to time, by the Director must be alive to the water.

7. No licence holder may take fish for purpose of stocking in private waters. All fish retained must be killed immediately.

8. The following licence fees are charged for mixed fishing for one Rod and line per angler.

For one year Rs. 3 to cover 5 trouts.
For one month (30 days from any chosen date) Rs.15 to cover 50 trouts.
For one week (seven days from any chosen date) Rs. 30 to cover 100 trouts.
Note. - There is no limit on the number of the fishes.

9. Everyday holder of licence must furnish within two days after expiry of the days licence, one week after the expiry of the monthly licence, and in the first week of every month till and after the expiry of the annual licence, the information as to the water fished, number and weight of fishes caught and killed and number returned alive to the waters and individual size and weight of fishes of 500 grams and above.

10. The officer issuing the licence may cancel or refuse to issue a further licence to any person who violates any or all conditions of the licence and the provisions of the Nilgiris Fishing Rules.

11. The licence is not transferable and shall be shown to any Police, Fisheries, Forest or Revenue Officer or any other person who is authorised in this behalf. The licensee must, on demand, show the catches also.

Note. - The licence not being transferrable, a licence holder may not lend his rod to any person not holding a licence nor should any such person use the rod of a licence holder.

12. Licence fee once paid is neither refundable nor adjustable subject to rule 8.

2. Waters in which fishing is closed for the season.

3. Fishing shall not be permitted between 19.30 hours and 06.00 hours.

4. Fishing shall not be permitted within 30 meters of the face of the dam.

5. Fishing only with one rod and line with single hook only is permitted.

Note. - A rod left with its line and hook in water shall be considered to be a rod in use even though it is not held in the Angler's hand.

6. A separate licence shall be obtained for fishing in each of the waters.

7. German carp (which denotes the three varieties, viz., Mirror Carp, Scale Carp and Leather Carp) of a length of 35 cm and below if caught from any of the waters shall be returned alive to the waters immediately.

8. The following licence fees are charged for a licence for one rod and line per angler:-

Daily licence- Rs. 3 (Rupees three only).Monthly (30 days from date of issue)- Rs. 30 (Rupees thirty only).Annually (12 months form the date of issue) - Rs. 75 (Rupees seventy five only).

9. Every holder of licence must furnish within two days after expiry of the days licence, within one week after the expiry of the monthly licence, and in the first week of every month till and after the expiry of the annual licence, the information as to the water fished, number and weight of fishes caught and killed and number returned alive to the waters and the individual weight of fishes of 500 grams and above captured (cards can be had from the office of issue).

10. The officer issuing licence may cancel the licence or refuse to grant a further licence, for the violation of any or all the conditions of the licence or for violation of the provisions of the Nilgiris Fishing Rules.

11. The licensee on demand, shall show his licence or catches to any Police, Fisheries, Revenue, Forest Officers or any other persons authorised by the Director of Fisheries in this behalf.

12. The licence is not transferable.

13. The licence fee once paid is neither refundable nor adjustable subject to rule 8.
