The Orissa Forest Rest House Occupation Rules, 1983Published vide Notification No 6560-F.F.A.H, dated 21st March, 1983, O.G.E. No 852, dated 19.5.1894No 6560-F.F.A.H. - The Orissa Forest Rest House Rules, 1983 is hereby published for information.Preamble. - Whereas it is necessary to frame a comprehensive set of rules for occupation of Forest Rest Houses, the following rules are therefore made by the Government of Orissa in supersession of all previous rules and orders on the subject.

1. Short title, extent and commencement.

(1)These Rules may be called The Orissa Forest Rest House Occupation Rules, 1983.

(2)They shall come into force on the date of their publication in Official Gazette.

2. Definitions.

- In these rules, unless the context otherwise requires-

(1)Rest House means a house primarily meant for occupation of inspecting officers of Forest Department and includes a "Rest Shed" under management of an officer-in-charge of a Forest Division.

(2)Day means 24 hours between the time of arrival of a date and such time of the next date.

(3)Competent authority means the Divisional Forest Officer in respect of Rest Houses and in respect of his jurisdictions to grant or sanction the reservation of Forest Rest Houses.

3. Right for occupation of Forest Rest House.

(1)Forest Rest Houses are mainly intended for the accommodation of the Gazetted Officers of the Forest Department on tour. Such officers of Forest Department have prior right of reservation and occupation at all time of Forest Rest Houses.

(2)Subordinates of the Forest Department may make use of Rest House with the written sanction of the (Divisional Forest Officer) but such sanction may be given if no other accommodation is available and if the Rest House is not required by an Officer of Forest Department. Such occupation shall be vacated immediately when required by an Officer of Forest Department.

4. Other Persons entitled to occupy Forest Rest House.

- A Rest House may be occupied by gazetted officers of State Government, other than Officers of Forest Department travelling on duty, without payment of rent subject to the following conditions :

(1)When the Rest House is not required for occupation by an officer of the Forest Department on duty.

(2)The Rest House shall be vacated immediately, when required by an officer of the Forest Department while on duty.

(3)Reservation of accommodation for officers belonging to other departments shall ordinarily be made in accordance with priority of receipt of request and in case of simultaneous receipt, in accordance with seniority in rank.

(4)When the period of occupation is intended to exceed or exceeds a period of ten days, prior permission of the Divisional Forest Officer shall be obtained in writing and rent shall be charged for the period in excess of ten days at the rate specified in Rule 9.Note - Officers of Commercial Departments of the Central Government, while on duty will be charged rent for occupying Rest Houses.

5. Accommodation in the Forest Rest Houses to the non-entitled persons.

- Accommodation in Rest Houses is not usually available for non-officials and members of the general public are not entitled to accommodation, but may occupy the Rest Houses on payment of prescribed rent, provided accommodation is not required by the person entitled.

6. Accommodation in the Forest Rest House to other Gazetted Officers while not on tour and non-officials.

- Gazetted Officers of State Government other than Officers of Forest Department not travelling on duty may occupy Rest House with the written permission of the Divisional Forest Officer who will fix the period of such occupation subject to the conditions laid down in Sub-rules (1), (2) and (3) of Rule 4. They will be liable to pay rent at the rates specified in Rule 9.

7. Control and reservation of accommodation.

(1)Control of accommodation rests with the Divisional Forest Officer in charge of the Forest Rest House. Persons requiring accommodation are advised to obtain reservation in advance from the concerned, authority. Proof of the reservation is indicated by production of the Divisional Forest Officer's order which is also Dated on the Forest Rest House Notice Board, ordinarily one suit room is reserved for each visitor.

(2)Divisional Forest Officers are authorised to sanction the occupation of Forest Rest Houses by non-Gazetted Officers other than of Forest Department travelling on duty temporarily for specified time and by name in each case.

8. Circumstances under which reservation once made can be cancelled.

(1)In cases, when accommodation has not been previously reserved under the written orders of the competent authority, preference of occupation will be given to any Forest Officer on duty, than to the senior ranking Gazetted Officers of other Departments travelling on duty and then to other entitled person. All entitled persons shall have preference over members of the general public.

(2)Vacation of Occupation shall be made when asked for on the above preference within six hours as between officers of Government and as between other entitled persons and within three hours of members of the general public in favour of entitled persons. Exercise of this preference should be made with caution and consideration and not between sunset and sunrise.

(3)The Divisional Forest Officer has the right to cancel the reservation without assigning any reason. He should however send intimation to the concerned officer/party by telegram at the earliest opportunity.

9. Rate of rent.

(1)Rent shall be charged for the following Forest Rest House as the rates noted against each per day or fraction thereof exceeding 3 hours and at the rate of Rs. 2.50 for the period of occupation of less than three hours duration.

(i)Puri, Nandankanan, Sambalpur, Panposh, Chandipur and Badbil at the rate of Rs. 15 (Fifteen) per day.

(ii)Jashipur, Baripada, Bhanjanagar, Balimela, Umerkote, Badrama, Nawna, Chahata, Gudgudia, Kotaput, and Tikarpara at the rate of Rs. 10 (Ten) per day.

(2)Rent shall be charged for occupation of all other Forest Rest Houses at the rate of Rs. 7. (Seven) per day or fraction thereof exceeding three hours and at the rate of Rs. 3 (three) for a period of occupation of less than three hours' duration.

(3)Rent as specified in Sub-rules (1) and (2) above shall be realised in the following cases of occupation :

(i)for occupation under Rules 4(4) and 7(2) for everyday after the first ten days,

(ii)for occupation under Rules 5 and 6,

(iii)for keeping the non-official's or prospective occupant's belongings in the Forest Rest House in the absence of the owner (Rent at the half the above rates will be charged). This does not apply to the class of occupiers noted in Rules 3, 4 and 7 (2).

Note - (a) The First day of the occupation shall be reckoned as 24 hours from the time of arrival. Every subsequent period of 24 hours shall count as one day. In reckoning the total rent to be charged any incompleted day shell be charged as full day.

(b)Rent shall be paid for guests, friends or relatives other than wife, children of officer and others who are entitled to occupy Forest Rest Houses free of rent.

10. Accommodation of the entire Forest Rest Houses.

- Allotment of more than one suit in arrest House shall not be made to one party without the previous permission of the Divisional Forest Officer. Permission may be given unexceptional circumstance to one party for occupation of two suits at a time. The rent to be charged in such cases shall be double the rate prescribed in Rule 9. The period of stay in such cases shall not ordinarily exceed five days at a stretch. In no circumstances more than two suits shall be allotted to any party for any purpose.

11. Manner of payment of rent, service charges, etc.

(1)Rent recoverable from non-entitled person should be paid to the Chowkidar in advance immediately on arrival and a temporary receipt be obtained against such payment, failing which occupation in the Rest House shall be refused. Such payment in advance should be made day to-day and the account being closed after recovering the dues or refunding the excess when the occupant vacates himself or is required to, vacate under Rule 8.

(2)If the occupant vacates the rest house temporarily, but keeps any of the rooms locked, he would be charged rent of this period as if he was in occupation.

12. Pitching of tents and use of kitchens, etc.

(1)All persons whether occupying the Rest House or not, but using the compound for pitching tents shall be subject to the Rest House Rules. Priority of the use of kitchens, out houses and utensils, etc. shall rest with the occupants of the Rest House.

(2)All non-entitled persons occupying the Rest House and also using the compound for pitching tents shall pay fee of Rs.5 (Rupees five) for the period in addition to the Rest House rent payable by them.

13. Use of garage.

- A fee of Rs. 5 per day or fraction thereof from non-entitled persons will be charged for garaging a car in the absence of the owner. A car thus garaged at the risk of the owner may be removed from the garage by any entitled person who occupied the Rest House and requires the garage.

14. Rate of electric charges.

- When Rest Houses are fitted with electric lights and fans, tents for consumption of current will be charged as follows :

(1)From 15th March to 15th November @ Rs. 1, 50 per day for 24 hours or for any less period in excess of three hours.

(2)From 16th November to 14th March at half of the above rate.

(3)If the period of stay does not exceed three (3) hours than half the rate at (2) above shall be charged.

(4)Whenever air coolers are fixed to and suite in a Forest Rest House, additional electric charge @ Rs. 5 (five) per day for non-entitled persons and @ Rs. 2. 50 for entitled persons is payable in addition.

15. Manner of use of Forest Rest Houses.

(1)Officers or others who may occupy Rest Houses are required to keep and leave them clean. If they have no servants of their own or cannot themselves arrange for doing so, they will pay the Chowkidar Rs. 0.50 for each day or portion of day occupancy in addition to the usual fee and the latter will strange to keep the Rest Houses clean and be responsible that it is kept clean.

(2)All persons occupying Rest House must make their own arrangements for obtaining water, fuel and supplies. The Chowkidar is not to be employed for the purpose.

(3)The verandah, compound or the rooms of the Rest Houses are not meant to be used as courts and kutchary or for any purpose involving the gathering of people. If for any special reason any Government Officer requires to do so, permission of the Conservator of Forests must first be obtained in advance.

(4)No person shall convene or cause to convene or hold in any circumstances political conferences or meetings within the compound of any Forest Rest House.

16. Visitor's book.

- A Visitor's Book shall be kept in each Rest House in which every person occupying the Rest House shall immediately an arrival enter his name and designation, full address together with the date and time of arrival. The date and time of departure should be written at the time of departure and the amount paid, under his signature.

17. Valuation of articles.

- A list showing the valuation of each article of furniture and crockery, etc. shall be hung up in the Rest House. The recorded price of any article lost, or broken and the cost of repairing any article damaged by an occupant or his servant should be paid to the Chowkidar and the fact recorded in the Visitor's Book.

18. Responsibility for loss to occupants' property.

- Government accept no responsibility for loss or damage to any property of the occupants of the Rest House.

19. Diseased Persons not to occupy Forest Rest House.

- No person suffering from any infectious or contagious disease may occupy any Forest Rest House.

20. Recovery of rent for non-occupation.

- Persons who do not intend to occupy accommodation reserved for them in a Rest House are liable to pay charges at the rate of Rs. 10 per day unless the reservation is cancelled by intimation in writing to the reserving authority 24 hours in advance. In case of private person full rate shall be charged and recovered.

21. Exclusive occupation by the Governor.

- The Governor of Orissa has the right of exclusive occupation of any Rest House. On receipt of notice of exclusive occupation by the Governor of Orissa the competent authority shall cancel reservation.

22.

Rent, fees, damage charges collected/realised from occupant shall be deposited by the concerned Divisional Forest Officers in the Forest receipt head.
