Deputy Ministers Free Rail Travel (Concession) Rules, 1988Published vide Notification No. G.S.R. 6/P.A. 22/56/Sections 6 and 5-B dated 12.1.1988.No. GSR6/PA.22/56/Ss 6 and 5-B/88. - In exercise of the powers conferred by section 6 read with the provisions of section 5-B of the Salaries and Allowances of Deputy Ministers, Punjab Act, 1956 (Punjab Act No. 22 of 1956 and all other powers enabling him in this behalf, the President of India is pleased to make the following rules, namely :-

1. Short title.

(1)These rules may be called the Deputy Ministers Free Rail Travel (Concession) Rules, 1988. These rules shall mutatis mutandis apply to the Chief Parliamentary Secretary and Parliamentary Secretaries.

2. Definitions.

- In these rules, unless there is anything repugnant in the subject or context :-
(a)'Act' means the Salaries and Allowances of Deputy Ministers, Punjab Act, 1956 (Punjab Act No. 22 of 1956) as the case may be;
(b)'Government' means the Government of the State of Punjab in the Department of General Administration (Cabinet Affairs Branch); and
(c)'Sanctioning Authority' means the Deputy Secretary (Co- ordination) or Joint Secretary (Co-ordination) to the Government of Punjab as the case may be for the time holding charge of the Cabinet Affairs Branch of the Department of General Administration.

3. Requisition for supply of Coupon Books Sections 6 and 5-B.

(1)The Sanctioning Authority shall, whenever necessary, make a requisition to the General Manager, Northern Railway, New Delhi for the supply of First Class Coupon Books for use by Deputy Ministers/Chief Parliamentary Secretary/Parliamentary Secretaries.
(2)On receipt of requisition under sub-rule (1) the General Manager, Northern Railway, New Delhi shall supply to the Sanctioning Authority and raise necessary debit against the head "201w - Council of Ministers - 108 Tour Expenses" for the price of such Coupon Books.

4. Supply of Coupon Books Section 5-B.

- The Sanctioning Authority shall issue Coupon Books to every Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretaries to enable him and his spouse and his dependent children accompanying either of them and an attendant accompanying him to travel by first class or if they so desire by first class Air Conditioned Coach any time by any Railway in India :Provided that the cost of aggregate distance travelled on such Coupon in any financial year shall not exceed the money value of twenty thousand kilometres in first class computed in the manner specified in the explanation to sub-rule (1) of rule 5 :Provided further that the dependent children and the attendant shall not be entitled to travel independently.

5. Section 5-B. Money value for which Coupon Books will be available.

- The Coupons shall be available in Books. Each book will contain the Money Value Coupons as under :-

Explanation. (1) For the purpose of computing the money value of twenty thousand kilometres, referred to in section 5-B of the Act, the cost of One Hundred Kilometres, calculated according to the Railway Tariffs in force at the time when the journey was performed, will form the basis.
(2)Each Coupon book shall be numbered and each coupon contained therein shall bear the number of the book and coupon numbers, shall be in serial order.

6. Certificate on Coupon Books Sections 6 and 5-B.

(1)Every coupon book shall contain the following certificate duly signed by the Sanctioning Authority :-"I hereby certify that Shri/Shrimati_________________ is Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretaries in the State of Punjab and tickets may be issued to him/her/his spouse Shri Shrimati _________________ his/her dependent children accompanying either of them and the attendant accompanying him/her, in exchange for the rail travel coupons for journeys to be undertaken by him/her/them within our outside India.
(SEAL)Sanctioning Authority."
(2)The name of the Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary to whom a coupon book is issued, shall be filled in by Sanctioning Authority before it is issued to him.
(3)The Sanctioning Authority shall get the following certificates on the coupon book from the concerned Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretaries at the time of issuing coupon book."I _________________ hereby declare that the coupons will be used by me for journey undertaken within India or outside India admissible under section 5-B of the Salaries and Allowances of Deputy Ministers Act, 1956, as amended from time to time and the rules made thereunder :-Signature of the Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary."
(4)The concerned Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary shall sign the register maintained by the Cabinet Affairs Branch in the Department of General Administration, in token of having received the coupon books desired by him/her.

7. Issue of Coupon Books and their availability Sections 6 and 5-B.

(1)The Coupon books issued to a Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary shall be used only by a Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary and his/her spouse his/her dependent children accompanying either of them and the attendant accompanying him/her and shall not be transferable;
(2)A coupon book can be issued from any date and will be available for a period which will be endorsed by the Sanctioning Authority provided that the period of validity of the coupon books so issued shall not extend beyond the following 31st March.In the event of any Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary ceasing to be in office, the coupon books issued to him/her for his/her use and for the use of his/her spouse and dependent children accompanying either of them and the attendant accompanying him/her shall be returned forthwith to the Sanctioning Authority.

8. Method of purchasing tickets with coupons Sections 5-B and 6.

(1)Any Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary or his/her spouse intending to undertake a journey, shall present the coupon books to the Railway Booking Clerk without detaching any coupon therefrom. In no circumstances loose Coupons shall be accepted by the Railway Booking Clerk.
(2)The Railway Booking Clerk shall personally remove from the coupon books the number of coupons necessary for the journey. Before removing the coupons, the Railway Booking Clerk shall satisfy himself regarding the indentity of the Coupon Book Holder, where coupons in excess of those actually required, are detached from a coupon Book by a Railway Booking Clerk, a suitable remark such as "wrongly detached", shall be made by him/her on the back of the detached coupons and the loose coupons with remark so made shall be accepted when presented for the issue of a ticket subject to the condition that the Coupon Book from which the coupons have been detached is also produced before the Railway Booking Clerk.
(3)In exchange of the coupon or coupons, the Railway Booking Clerk shall issue single journey ticket(s) as may be required, after scoring out the fare printed thereon and writing on the reverse of the ticket in red ink the words "R.T. Coupons for Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary only".Explanation. - If Rail travel coupons from two different Coupon Books issued in favour of the same Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary are presented for issue of tickets they shall subject to the provisions of this rule, be accepted by the Railway Booking Clerk.

9. Identity of Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary Section 6

. - A Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary when travelling with ticket issued to him under rule 8 shall keep with him his identity card containing his photograph duly attested by the Sanctioning Authority and produce the same when demanded by the Railway Authorities.

10. Travel by Air.

- Where a Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary or his/her spouse and his/her dependent children accompanying either of them and an attendant accompanying him performs journey within or outside India by air and furnishes the counterfoil of the air ticket, the cost of air ticket shall be reimbursed to him by the Sanctioning Authority and the amount so reimbursed shall be adjusted against his entitlement to travel by rail and consequently his maximum aggregate distance of travel admissible under the Act shall stand reduced by such distance as could be travelled by rail on a First Class railway Ticket purchased with such an amount, in accordance with the railway tariffs in force at the time when the journey was actually performed :Provided that where the counterfoil is lost, destroyed or misplaced, the Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary shall produce a certificate from the office of the concerned airlines as a proof of his/her having performed the journey by air.Explanation. - For the purposes of this rule, the cost of rail travel coupons will be calculated on the basis of the railway tariffs in force at the time when the journey was performed and further on the basis of the cost of one hundred kilometres as the maximum unit.

11. Availability of tickets issued on rail travelling coupons.

- The period of availability of a ticket issued in exchange of the coupon or coupons under sub-rule (3) of rule 8 and rule 10 shall having regard to the date on which it is issued, be the same as it is for an ordinary ticket.

12. Pilgrim and Terminal Taxes Sections 6 and 5-B.

- While issuing a railway ticket in exchange of railway travel coupons for journey to and from stations at which pilgrim or terminal taxes liable, the pilgrim or terminal tax shall be collected in cash from the Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary or his/her spouse presenting coupons and the amount of tax so collected shall be entered on the face of the Railway ticket.

13. Luggage Sections 6 and 5-B.

- A Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary, his/her spouse his/her dependent children accompanying either of them or an attendant accompanying him shall be entitled to carry such luggage free of charges as, is permissible on first class ordinary Railway ticket and the Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary or his spouse as the case may be, shall pay in cash the charges for the excess luggage, if any, to the Railway Authorities, for which no reimbursement shall be made by the Sanctioning Authority.

14. Un-exchanged Coupons.

- A Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary, his/her spouse, his dependent children accompanying either of them or an attendant accompanying him found travelling on unexchanged rail travel coupons shall be considered as travelling without a railway ticket and shall be liable to the penal action by the railway authorities. In such cases the fares and excess charges shall be paid by such Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretary or his spouse in cash, and shall not be reimbursed by the Sanctioning Authority.

15. Use of Coupons Section 6.

- The rail travel coupons shall not be used for any purpose except for the purpose of exchanging them for passenger ticket at the Booking office of the railway Administration concerned for journey in India and the coupons shall not in any circumstances be accepted by the Railway Administration concerned towards payment of any other charges, such as luggage charges, excess fares, penalties reservation fees, supplementary charges on superfast trains etc.

16. Confiscation of Coupons Section 6.

- The Railway Administration concerned may confiscate a coupon book on proof that the conditions on which it has been issued have not been observed. Before doing so, the matter shall be referred to the Chief Secretary to Government of Punjab and his approval shall be obtained for such confiscation. On such confiscation, the value of the Coupon Book shall be refunded to the Sanctioning Authority.

17. Refund Admissible on unused Coupons.

(1)The refunds shall not be granted on unused coupons unless the same are returned to the Railway Administration concerned by the Sanctioning Authority within one month after the period of validity.
(2)Subject to the Railway Rules, refunds shall be admissible on unused or partly used tickets on its presentation to the Railway Administration.
(3)The refunds shall in all cases, be made only to the Sanctioning Authority.

18. Rules to be printed on the Coupon Books.

- Each Coupon book shall have printed thereon in extenso, the provisions of rules 6 to 18 inclusive :Provided that the Coupon Books printed and supplied to the Sanctioning Authority prior to the coming into force of these rules shall be deemed to be valid notwithstanding that such Coupon Books have not been printed in conformity with the provisions of this rule.

19. Repeal and Saving.

- The Rules for regulating the facility of free Rail Travel to the Deputy Minister/Chief Parliamentary Secretary/Parliamentary Secretaries published in Punjab Government Gazette (Extraordinary), dated the 20th June, 1980, - vide Department of General Administration (Cabinet Affairs Branch), Notification No. 771-Cabinet 80/27, dated the 16th May/20th June, 1980, in so far as they relate in regulating the aforesaid facility admissible to the Deputy Ministers, shall be repealed :Provided that any action taken or any order issued under the rules so repealed shall be deemed to have been taken or issued under the corresponding provisions of these rules.
