Jamadar, Class-III, Prohibition and Excise (Competitive Examination) Rules, 2013Published vide Notification No. GG /32/2013/MKM/102011 /3139/E-1, dated 15.5.2013Last Updated 7th November, 2019No. GG /32/2013/MKM/102011 /3139/E-1. - In exercise of the powers conferred by the proviso to Art. 309 of the Constitution of India and in supersession of all the rules made in this behalf, the Governor of Gujarat hereby makes the following rules to provide for regulating the method of examination for recruitment to the post of Jamadar, Class-III, in the Subordinate Service of the Prohibition and Excise Department, namely:-

1. Short title.

- These rules may be called the Jamadar, Class-III, Prohibition and Excise (Competitive Examination) Rules, 2013.

2. Definition.

- In these rules, unless the context otherwise requires,-
(a)"Appendix" means an Appendix appended to these rules;
(b)"Board" means the Gujarat Subordinate Services Selection Board, Gandhinagar;
(c)"Examination" means the competitive examination for the recruitment to the post of Jamadar, Class-Ill, in the Prohibition and Excise Department and includes the preliminary examination, physical screening test and main examination;
(d)"Main Examination" includes objective type written examination.

3. Conditions for Eligibility.

(1)A candidate shall not be qualified for admission to the examination unless he/she is,-
(a)a citizen of India, or
(b)subject of Nepal, or
(c)a subject of Bhutan, or
(d)a person of Indian origin who has migrated from Pakistan, Myanmar, Sri Lanka, Zambia, Malawi, Zaire, Ethiopia and Vietnam, with the intention of permanently settling in India:
Provided that candidates belonging to categories (b), (c) and (d) shall furnish a certificate of eligibility issued by the Government.
(2)A candidate who is required to produce a certificate under sub-rule (1) may be allowed to appear in the examination conducted by the Board and he/she may also be appointed provisionally subject to the production of eligibility certificate issued by the Government.

4. Age limit.

- For appearing in the examination, a candidate shall have attained the age of 18 years [and shall not have attained the age of 28 years] [Inserted by Notification No. GG/65/2013/MKM/102011/3139/E-1, dated 26.9.2013 (w.e.f. 15.5.2013).] on the date specified by the Board in the advertisement.

5. Educational Qualification.

- A candidate possessing the requisite qualifications for the appointment to the post of Jamadar, Class-Ill, under the relevant recruitment rules shall be eligible for admission to the examination.

6. Holding of Examination.

(1)The Board on receiving the requisition from the Government, shall hold a competitive examination for selection of candidates to the post of Jamadar, Class-Ill.
(2)The date, time and the place for holding the examination shall be such as may be decided by the Board.
(3)The candidate shall be required to appear at the preliminary examination, physical screening test and main examination at his/her own expenses.

7. Syllabus.

- The Syllabus for preliminary examination and for main examination shall be as specified in Part I and Part III of the Appendix.

8. Mode of Examination.

(1)The examination shall be held in three successive stages in the following manner, namely:-
(i)Part I - Preliminary Examination (Screening Test- Objective type) (for selection of candidates for admission to the physical screening test);
(ii)Part II - Physical Screening Test for ascertaining the physical standard of the candidate as specified in Part II of the Appendix;
(iii)Part III - Main Examination (Objective Type - written examination) as specified in Part III of the Appendix.
(2)The candidate who qualifies the preliminary examination shall be allowed to appear in the physical screening test.
(3)The candidate who is physically fit shall be allowed to appear in the main examination.

9. Medium of Examination.

- The medium of examination shall be Gujarati except the paper of English for which the medium shall be English.

10. Application to appear in examination.

(1)A candidate who desires to appear at the preliminary examination shall submit an application in such form, with such fees and in such manner as may be prescribed by the Board.
(2)The candidate who is declared qualified for appearing in the main examination shall be required to submit an application in such form, with such fees and in such manner as may be prescribed by the Board. The fees once paid shall not be refunded or held over for the subsequent examination.

11. Appearance at the main examination.

- No candidate shall be allowed to appear at the main examination unless the Board is satisfied that,-
(i)the candidate possesses the required qualifications under the recruitment rules of the post;
(ii)he has paid the requisite fees along with the applications;
(iii)he has successfully passed the physical screening test as specified in Part II of the Appendix.

12. Qualifying Standard and Marks.

(1)The Board shall fix the qualifying standard for passing the preliminary examination and main examination for all candidates including those belonging to reserved categories.
(2)The candidate who has obtained qualifying marks in Main Examination (Objective type-written examination) as may be fixed by the Board shall be declared pass:Provided that the candidates belonging to the Scheduled Castes or Scheduled Tribes or Socially and Educationally Backward Classes may be allowed to appear in the Physical Screening Test or, as the case may be, in Main Examination by relaxing the standard in the preliminary examination or, as the case may be, in the physical screening test, if the Board is of the opinion that sufficient number of candidates from these communities are not likely to be available for Physical Screening Test or, as the case may be, on the basis of the qualifying standard fixed for general category to fill up the vacancies reserved for such categories.

13. Preparation of Select List and Waiting List.

(1)The Board shall prepare the Select List to the extent of the number of vacancies advertised for, of the successful candidates in order of merit on the basis of aggregate marks finally awarded to each candidate in the Main Examination and in that order, the Board shall forward the same with its recommendation to the State Government.
(2)The Board shall also prepare a Waiting List showing the names of qualified candidates as far as feasible for about twenty-five per cent, of the total number of candidates recommended by the Board under sub-rule (1) for recommending further candidates to the Government on demand.
(3)The result of the examination shall be divided into two parts as follows, namely:-Part -I: Select List - Names of successful candidates.Part - II: Waiting List - Names of candidates to be kept on the waiting list.
(4)The Board shall submit a copy of the result to the Government for publication in the Official Gazette.
(5)The Board shall communicate the result to the successful candidates individually in the manner as may be decided by it.

14. Decision of Board to be final.

(1)No candidate shall be allowed to appear at the main examination unless the Board is satisfied that-
(i)the candidate possesses the required qualifications under the recruitment rules of the post;
(ii)he /she has paid the requisite fees along with the applications.
(2)The decision of the Board as to the eligibility of a candidate for admission to the main examination shall be final.
(3)No candidate shall be allowed to appear at the main examination unless the Board is satisfied that the candidate is eligible in all respect and has complied with all the requirements.

15. No right to appointment.

- The candidates shall ordinarily be considered for appointment to the post in order of merit as determined by the Board up to the number of posts to be filled in. The mere success in the main examination shall not itself confer any right to appointment and it shall be open to the appointing authority to drop a candidate, if, after such inquiry, it is satisfied that the candidate is not suitable for public service.

16. Medical Examination.

- The candidate qualified for appointment shall be required to pass the medical examination in accordance with the rules made by the Government in that behalf.

17. Disciplinary action.

- A candidate who is or has been declared by the Board to be guilty of-
(i)obtaining support for his candidature by any means, or
(ii)impersonating, or
(iii)procuring impersonation by any person, or
(iv)submitting fabricated documents or documents which have been tampered with, or
(v)making statement which are incorrect or false or suppressing material information, or
(vi)resorting to any other irregular or improper means in connection with his/her candidature for the examination, or
(vii)using unfair means during the examination, or
(viii)writing irrelevant matter, including absurd language or pornographic matter, in the scripts, or
(ix)misbehaving in any other manner in the examination hall, or
(x)harassing or doing bodily harm to the staff employed by the Board for the conduct of the examination, or
(xi)attempting to commit or, as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses, or
(xii)violating any of the conditions for admission to appear in the examination in admission certificate to take the examination, may, in addition to rendering himself liable to criminal prosecution, be liable-
(a)to be disqualified by the Board from the examination for which he/she is a candidate, or
(b)to be debarred either permanently or for a specified period, or
(i)by the Board, from appearing in any examination or held by it, or
(ii)by the State Government, from any employment under it:
Provided that no penalty under clause (a) or (b) shall be imposed except after giving the candidate an opportunity of, being heard as he/she may wish to make in that behalf, or
(c)to disciplinary action under the relevant rules, if he/she is in the Government service.

18. Mark-sheet and rechecking of Marks.

(1)A candidate who desires to have his/her marks of preliminary examination rechecked, may apply the Board along with such fees as may be fixed by the Board within a period of thirty days from the date of declaration of the result of the preliminary examination.
(2)A candidate who desires to have his/her marks of main examination rechecked may apply to the Board along with such fees as may be fixed by the Board within a period of thirty days from the date of declaration of the final result of the main examination.
(3)A candidate who desires to have the mark-sheet of main examination shall apply to the Board along with such fees as may be fixed by the Board within a period of fifteen days from the date of declaration of the final result.

19. Duty of candidate.

- The candidate shall be required to answer all question papers of the examination in his own handwriting.

20. Prohibition to use certain devices in the examination Hall.

- The candidate shall not be allowed to carry with him/her in the examination hall, a cellular phone, calculator, pager or any other electronic communication devices.

21. Conduct and regulation of examination.

- The Board shall regulate all matters relating to appointment of examiners and conduct of examination in accordance with the procedure adopted by it and in conformity with the Government's order in that behalf.Appendix[See Rules 7 and 8]

Part I – Preliminary Examination

(Screening Test-Objective Type)
General Knowledge-Objective Type 100 Marks 1 Hour

Part II – Physical Screening Test

The particulars of test and qualifying standard shall be as under:
Candidate Test Qualifying Standard
(A) For Male Candidate Running 800 Meters In 5 minutes
(B) For Female Candidate Running 400 Meters In 3 Minutes
(C) For Ex- Serviceman Candidate Running 1200 Meters In 8 Minutes
Note. - The candidate shall be required to achieve the minimum qualifying standard as prescribed above. In case of failure to achieve the qualifying standard, the candidate shall not be entitled for appearing at the Main Examination.

Part III – Main Examination:

Objective Type-Written Examination: One Hour Total 100 Marks

Note. - The standard of questions of Gujarati and English shall not be lower than that of the Higher Secondary School Certificate Examination conducted by the Gujarat Secondary and Higher Secondary Education Board.
