Rule INSPECTOR-OF-MOTOR-VEHICLES-CLASS-II-IN-THE-GUJARAT-STATE-TRANSPORT-DEPARTMENT-COMPETITIVE-EXAMINATION-RULES-2011 of 2011

Inspector of Motor Vehicles, Class II, in the Gujarat State Transport Department, Competitive Examination Rules, 2011Published vide Notification No. PT/2011 / 77/MVO/10/2011/1048/KH, dated 16.12.2011Last Updated 6th November, 2019No. PT/2011 / 77/MVO/10/2011/1048/KH. - In exercise of the powers conferred by the proviso to Article 309 of the Constitution of India and in supersession of all the rules made in this behalf, the Governor of Gujarat hereby makes the following rules to provide for regulating the method of examination for recruitment to the post of Inspector of Motor Vehicles, Class II, in the Gujarat State Transport Department, namely:-

1. Short title.

- These rules may be called the Inspector of Motor Vehicles, Class II, in the Gujarat State Transport Department, Competitive Examination Rules, 2011.

2. Definitions.

- In these rules, unless the context otherwise requires,-
(a)"Appendix" means Appendix appended to these rules;
(b)"Commission" means the Gujarat Public Service Commission;
(c)"Examination" means the competitive examination for the recruitment to the post of Inspector of Motor Vehicles, Class II, in the Gujarat State Transport Department which includes written test and interview as referred to in Rule 6; and
(d)"Government" means the Government of Gujarat.

3. Eligibility.

(1)A candidate shall not be qualified for admission to the examination unless he is, -
(a)a citizen of India, or
(b)a subject of Nepal, or
(c)a subject of Bhutan, or
(d)a person of Indian origin who has migrated from Pakistan, Myanmar, Sri Lanka, East African countries of Kenya, Uganda, the United Republic of Tanzania, Zambia, Malawi, Zaire, Ethiopia and Vietnam, with the intention of permanently settling in India:
Provided that candidates belong to categories (b), (c) and (d) shall be required to furnish a certificate of eligibility issued by the Government.
(2)A candidate who is required to produce a certificate under sub-rule (1), may be allowed to appear at the Examination and if selected he may also be provisionally appointed, subject to the production of the same.

4. Educational Qualifications and Age limit.

(1)A candidate possessing the requisite qualifications for the appointment to the post of Inspector of Motor Vehicles, Class II, in the Gujarat State Transport Department under the relevant recruitment rules shall be eligible for admission to the Examination.
(2)A candidate shall have attained the age of 21 years and shall not have attained the age of 28 years on the date specified by the Commission in the advertisement.

5. Holding of Examination.

(1)The Commission shall, on receiving the requisition from the Government, by advertisement published in the news paper widely circulated in the State call for the application in the prescribed form from the candidate possessing the required qualifications for the post specified in Rule 1.
(2)The Commission shall decide the manner in which it shall conduct the Examination.
(3)The date, time and the places for holding the Examination shall be decided by the Commission.
(4)The candidate shall be required to attend written test and interview at his own expenses.
(5)The Commission shall clarify in the advertisement for the option to be given by the candidate for Paper I of the written test as specified in the Appendix.

6. Mode of Examination.

(1)The Commission shall after receiving the application from the candidates, verify the applications in accordance with these rules and call the eligible candidates to appear at the Examination which shall be held in two successive stages as specified in Appendix, in the following manner, namely:-
(i)written test; and
(ii)interview.
(2)The successful candidates in the written test shall be called for interview:
(3)The number of candidates called for interview shall ordinarily be three times the number of vacancies requisitioned.
(4)The candidate who fails to remain present at the interview on the specified date and time shall not be eligible for selection.
(5)The Commission shall declare the names of successful candidates, after completion of interview, equal to the number of vacancies requisitioned.

7. Syllabus and Medium of Examination.

(1)The syllabus for each of the papers shall be such as may be prescribed by the Commission and shall be supplied to the candidate along with the application form.
(2)The medium of written test shall be English except for Part B of Paper II of the written test.

8. Application to appear in examination.

(1)A candidate who desires to appear at the Examination shall submit an application in such form, within such time limit as may be prescribed by the Commission alongwith such fees as may be fixed by the Government.
(2)The fees shall be paid in such manner as the Government may direct. The fees once paid shall not be refunded or held over for the subsequent examination.
(3)The request of a candidate for withdrawal of application form and refund of fees shall not be entertained in any circumstances.

9. Disqualification for appointment on the ground of plural marriage.

(1)No person, who-
(a)has entered into or contracted a marriage with a person having spouse living; or
(b)having a spouse living, has entered into or contracted a marriage with any person;
shall be eligible for appointment to the said post:Provided that the Government may if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
(2)The candidate shall declare in the application form whether he or she, as the case may be, is married and, in the case of male candidate he has more than one wife living and in the case of a female candidate whether she has married to man who has already another wife living.

10. Qualifying standard of marks.

(1)The Commission shall fix the qualifying standard of written test of all candidates:Provided that the Commission may relax the qualifying standard of marks to make up the deficiency in the reserved posts.
(2)The candidate who has obtained minimum qualifying standard as may be fixed by the Commission for written test, shall be allowed to appear at the interview.

11. Appearance at the examination.

(1)No candidate shall be allowed to appear at the Examination unless the Commission is satisfied that -
(i)the candidate possesses the requisite qualifications under the recruitment rules of the post;
(ii)he has paid the requisite fees along with the application;
(iii)he possesses the requisite physique and age as prescribed under the recruitment rules of the post.
(2)The decision of the Commission as to the eligibility of a candidate for admission to . the Examination shall be final. The candidate who does not qualify shall not be permitted to appear at the Examination.

12. Duty of candidate.

- The candidate shall be required to answer all the question papers in his own handwriting.

13. Prohibition to use certain devices in the examination Hall.

- A candidate shall not be allowed to carry with him a cellular phone, calculator, pager, or any other electronic communication device.

14. Preparation of Select List and waiting List.

(1)The Commission shall cause to prepare the select list of the successful candidates in order of merit on the basis of aggregate marks finally awarded to each candidate in the Examination and in that order, the Commission shall forward the same with its recommendation to the Government.
(2)The Commission shall also recommend the names of successful candidates belonging to the Scheduled Castes, Scheduled Tribes, Socially and Educationally Backward Classes including Nomadic Tribes and De notified Tribes and Women to the extent of the number of vacancies reserved for such categories.
(3)The result of the successful candidates shall be declared by the Commission and it shall be arranged in order of merit specifying their names, seat numbers and total marks obtained by the candidate.
(4)The Commission shall display on the notice board of the Commission, the names of the unsuccessful candidates specifying their seat number and the total marks obtained by them.
(5)The Commission shall submit a copy of the result to the Government and the Government shall publish the same in the Official Gazette.
(6)The Commission shall communicate the result to the successful candidates individually in the manner as may be decided by it.
(7)The Commission shall prepare the waiting list of qualified candidates which shall contain about 50 per cent, of total number of vacancies advertised for. The waiting list shall remain in force as per the instructions issued by the Government in that behalf.

15. No right to appointment.

- The successful candidates shall ordinarily be considered for appointment to the post in order of merit determined by the Commission up to the number of posts to be filled in. The mere success in the Examination shall not itself confer any right to appointment and it shall be open to the appointing authority to drop a candidate, if after such inquiry, it is satisfied that the candidates is not suitable for public service.

16. Medical Examination.

- The candidates qualified for appointment shall be required to pass the medical examination in accordance with the rules made by the Government in that behalf.

17. Disciplinary actions.

- A candidate who is of has been declared by the Commission to be guilty of -
(i)obtaining support for his candidature by any means, or
(ii)impersonating, or
(iii)procuring impersonation by any person, or
(iv)submitting fabricated documents or documents which have been tampered with, or
(v)making statement which are incorrect or false or suppressing material information, or
(vi)resorting to any other irregular or improper means in connection with his candidature for the Examination, or
(vii)using unfair means during the Examination, or
(viii)writing irrelevant matter, including absurd language or pornographic matter, in the scripts, or
(ix)misbehaving in any other manner in the Examination hall, or
(x)harassing or doing bodily harm to the staff employed by the Commission for the conduct of the Examination, or
(xi)attempting to commit or, as the case may be, abetting the commission of all or any of the acts specified in the foregoing clauses, or
(xii)violating any of the conditions for admission to appear in the Examination as prescribed and specified in the admission certificate, may, in addition to rendering himself liable to criminal prosecution, be liable-
(a)to be disqualified by the Commission from the Examination for which he is a candidate, or
(b)to be debarred either permanently or for-a specified period-
(i)by the Commission, from appearing in any examination or from any interview for direct selection to be held by it, or
(ii)by the State Government, from any employment under it:
Provided that no penalty under clause (a) or (b) shall be imposed except after giving the candidate an opportunity of being heard, or
(c)to disciplinary action under the relevant rules, if he is in Government service.

18. Mark-sheet and rechecking of Marks.

(1)A candidate who desires to have the mark-sheet of the Examination shall apply to the Commission alongwith such fees as may be fixed by the Commission within a period of thirty days from the date of declaration of the final result.
(2)A candidate who desires to have his marks of examination rechecked may apply to the Commission along with such fees as may be fixed by the Commission within a period of fifteen days from the date of declaration of result of the Examination or from the date of the receipt of the Mark-sheet, whichever is later.

19. Conduct and regulation of Examination.

- The Commission shall regulate all matters relating to appointment of examiners and conduct of examination in accordance with the procedure adopted by it and in conformity with the Government's order in that behalf.

20. Training and examination.

- The selected candidate shall be required to undergo pre-service training and pass the post-training examination and the departmental examination, if any, in accordance with the rules as prescribed by the Government in that behalf.Appendix[See Rule 6](A)Written Test:
(1)The written test shall consist of the following:

(2)List of optional subject for Written Test Paper 1.
(1)Mechanical Engineering;
(2)Automobile Engineering.Note. - (i) The paper I and II shall be objective type.
(ii)The standard of paper I shall be equivalent to the degree Examination of Mechanical or Automobile Engineering or an equivalent Examination.
(iii)The Commission shall clarify in the advertisement for the option to be given by the candidate for Paper I of the written test and the candidate shall have to opt for any one subject as specified in the list above, in his application form.
(iv)The standard of Part A of paper II shall be equivalent to the English subject (lower level) of twelfth standard of Gujarat Secondary and Higher Secondary Education Board.
(v)The standard of Part B of paper II shall be equivalent to the Gujarati subject (higher level) of twelfth standard of Gujarat Secondary and Higher Secondary Education Board.
(vi)The syllabus for each of the paper shall be such as may be prescribed by the Commission.
