These by-laws may be called the Court of Examiners of Homoeopathic and Biochemic Systems of Medicine, Bombay Examinations (Admission to Conduct of Appointment of Examiners, Paper-setters, Fees to be paid, etc.) By-laws, 1987.2.
The examinations shall begin on such dates as the Executive Committee of the Court of Examiners may fix. The dates, programme and places of examinations and the last date for receipt of application shall be notified in the Maharashtra Government Gazette, ordinarily two months before the commencement of examination.3.
All written and practical examinations shall be held twice a year under the general superintendence of the Chairman of the Court or under superintendence of such persons as may be appointed by him at as many centres, the Executive Committee may fix. The authorities of the institutions where the examinations are to be held shall make seating arrangements for the written examination and provide facilities in the laboratories and hospitals associated with the college for the conduct of the practical examinations. The principals of the colleges affiliated to the Court, shall help the Executive Committee in finding suitable places for holding the examination and conducting them smoothly.4.
A student who has undergone a course of training in an institution recognised by the Court of Examiners and is recommended by the head of the institution viz., the Principal, shall be admitted for the examination.5.
Every application for admission to the examination, shall be in the Form 'A' appended to these by-laws and shall reach the Registrar at least four weeks before the date prescribed for the examination. It shall be accompanied by a fee prescribed for the examination. Applications received late after the date announced in the examination programme for receiving the admission forms shall, however, be accepted with late fee of Rs. 20 per application for a period of 10 days after which no application shall be accepted for admission to the examination.6.
The fees once paid by the candidate shall not be refunded but may be reserved for the next examination to be held (a) in case of illness certified by a Registered Medical Practitioners, and such certificate shall be forwarded through the Principal of the Medical College, or (b) on recommendation of the principal of the institution for sufficient reasons :Provided that, application for such reservation shall reach to the Registrar at least two days before the commencement of the examination.7.

The Chairman may call the meeting of the Examiners before examination to guide them whenever he feels it necessary to do so to maintain standard of the examination for which no travelling allowance or daily allowance shall be paid to Examiners. The Executive Committee may issue from time to time instructions for the guidance of the Examiners. Failure to comply with these instructions shall render the appointment of any Examiner liable to termination. The Executive Committee shall withhold or reduce the remuneration of any Examiner in case of any neglect, delay, remissness or mistake on his part in executing his work or carrying out the instructions given to him. The aggrieved party may appeal to the Court of Examiners within a period of fifteen days from the receipt of communication addressed to him. The decision of the Court of Examiners in such appeal shall be final.9.
The question papers shall be delivered by the Examiners in person to the Registrar or send to him by insured post in sealed cover on or before the specified date which shall be at least thirty days before the date fixed for the commencement of the examination. No copy of the question paper shall be retained by the Examiners.10.
The Chairman of the Court of Examiners may get the question papers moderated in the manner as deems fit.11.
The Chairman of the Court of Examiners shall appoint a Supervisor or Supervisors to preside at the written examination who may engage one assistant, two inferior servants for every 50 or part of 50 candidates and one assistant and two inferior servants for the subsequent 50 or part of 50 candidates. The Chairman or any members of the Court of Examiners duly authorised by him in writing may pay surprise visit to any examination centre for the purpose of observing its working for which they shall be paid allowances according to sub-clause (i) of clause (a) of rule 1 in section 1 of Appendix XLII-A to the Bombay Civil Services Rules, 1959.12.
The Chairman of the Court of Examiners shall appoint a staff of the Expert, the Laboratory Assistant and two Menials for each subject for practical examinations, whenever required.13.
The Supervising Officer shall be responsible for the seating arrangements, distribution of the question papers, blank answer-books and writing materials and collect the answer-books and send them to the Examiners concerned by insured parcel in properly sealed packets.14.
The practical examination shall be jointly conducted by the Examiners when two Examiners are appointed for any subject. The number of marks secured by each candidate shall be recorded by both the Examiners in consultation.15.

The result of the written examination in a subject for which there is no practical, shall be forwarded by the Examiners to the Registrar on or before the date specified on the marksheet by registered post or personally in sealed cover with their remarks.17.
The examiners after examination and marking of answer-books shall despatch the answer-books to the Registrar within four days from the despatch of marksheets and the Registrar shall retain them in safe custody for one year.18.
The examiners, paper-setters, paper-moderators required to perform duties outside the radius of 8 kilometers of their residence shall be paid travelling and daily allowance at the following rates :-19.
The remuneration for the paper-setters, moderators and examiners shall be as follows :-20.
The remuneration to the supervisors (i.e., Chief Conductors of Examination). Invigilators and Inferior servants shall be as follows :-| (i)Supervisors | Rs. 30 per day for two sessions. |
| (ii)Invigilators | Rs. 20 per day for two sessions. |
| (iii) Blockpeons-cum-Waterman | Rs. 5.25 per day for two sessions. (Rs. 2.60 per session). |
| (iv) Inferiorservants | Rs. 5 per day. |

As soon as possible after the remarks of the Examiners if any, and the result have been considered by the Executive Committee of the Court of Examiners, the Committee shall publish a list of successful candidates with the first five places being arranged in order of merit in the Maharashtra Government Gazette or in such other manner as it may think fit.23.
A statement showing marks obtained by a candidate in all the subjects in any one examination shall be supplied to him on payment of a fee of Rs. 5.24.
For revaluation of answer-books the Court of Examiners of Homoeopathic and Biochemic Systems of Medicine, Bombay, Examinations (Revaluation of Answer-Books) By-laws, 1985, (The By-laws published under Government Notification, Medical Education and Drugs Department No. MHB. 1685-441/CR-348-85-MED-8, dated the 25th February. 1986) shall apply.25.

The advance payment to the supervisors shall be paid through the institutions at the rate of ¾ th's of the probable expenditure at the centre, to meet the expenditure connected with the examination at the centre.27.
The staff of the Board or Court of Examiners of Homoeopathic and Biochemic Systems of Medicine, Bombay required to travel carrying with them the examination material shall be paid travelling allowance and dearness allowance as per Maharashtra Civil Services Rules and in addition shall be paid Rs. 30 extra per day as they are required to do this responsible work of carrying a number of bundles of blank answer-books, sealed question papers, bank drafts of advances to supervisors etc., and have to make transhipment at a number of points.Form A(See By-law 5)Form of application for Admission to the....................................
