The U.P. Cold Storage Order, 1972Published vide Notification No. H-1616/12-B-1104-67, dated March 14, 1972Whereas the State Government is of opinion that it is necessary and expedient so to do for securing the maintenance and increase of supplies and services essential to the life of the community and for securing the equitable distribution and availability of essential commodities at fair prices;Now, therefore in exercise of the powers under Rule 114 of the Defence of India Rules, 1971, the Governor is pleased to make the following Order:

1. Short title, extent and commencement.

(1)This Order may be called the Uttar Pradesh Cold Storage Order, 1972.
(2)It shall come into force at once.
(3)It extends to the whole of Uttar Pradesh.

2. Definitions.

- In this Order, unless the context otherwise requires-
(a)"agricultural produce" includes produce of agriculture, animal husbandry or horticulture, fish, shell fish, and articles of food or drink wholly or partly made from any of them;
(b)"cold storage" means an enclosed chamber insulated in the prescribed manner mechanically cooled by refrigeration machinery to provide refrigerated condition to agriculture produce stored therein but does not include refrigerated cabinets and chilling plants having capacity of less than 29.3168 cubic metre;
(c)"cold storage receipt" means a receipt issued by a licensee under this order and includes a duplicate receipt issued under this Order;
(d)"hirer" means a person who hires on payment of the prescribed charges spaces in a cold storage for storing agricultural produce and enters into a contract or agreement with the licensee for the purpose;
(e)"licence" means a licence granted under this Order;
(f)"licensee" means any person to whom or any firm or Co-operative Society to which a licence is granted under this Order."
(g)[ "Licensing Officer" means the Director of Horticulture and Fruit Utilization, Uttar Pradesh and includes any other officer of the Horticulture Department not below the rank of Deputy Director, or an Officer of the Revenue Department not below the rank of Sub-divisional Officer, empowered by the Director of Horticulture in this behalf to exercise some or all of the powers of the Licensing Officer under this Order.] [Substituted by Cold Storage (Third Amendment) Order, vide Notification No. M-49/12(8)-700 (8)-74, dated 6th June, 1974 and further Substituted by Cold Storage (Fourth Amendment) Order, 1975, published in U.P. 3. Regulation of storage of food stuffs in cold storage.

(1)No person shall carry on the business of storing any agricultural produce in a cold storage except under and in accordance with the terms and conditions of a valid licence.
(2)Notwithstanding the provisions of sub-clause (1) any person carrying on such business from before the commencement of this Order may make an application for licence under this Order within a week from the commencement of this Order, and in relation to any such person--
(a)the provisions of clause 18 and the Schedules shall apply immediately as if he were a licensee;
(b)the provisions of sub-clause (1) shall not apply for the said period of one week and the period intervening between the date of his application and its grant or refusal by the Licensing Officer.

4. Application for licence.

- Every person desiring to obtain a licence shall make an application in duplicate to the Licensing Officer in Form 'A' together with the fees prescribed therefor in clause 5 and a copy of the blue print of the cold storage building plan.

5. Fees for licence.

- The fees for a licence shall be--
(i)rupees fifty for storing food stuffs in a Cold Storage with a capacity up to 141 cubic meter (5,000 c. ft.)
(ii)rupees seventy-five for storing food stuffs in a Cold Storage having a capacity of above 141 cubic metre.

6. Licensing Officer to have regard to certain matters in granting or refusing licence.

- In granting or refusing a licence, the Licensing Officer shall have regard to the following matters, namely:

(ii)refrigeration conditions of the cold storage in which the agricultural produce are proposed to be stored;
(iii)any other matters which the Licensing Officer may consider necessary for the purpose.

7. Grant or refusal of licence.

(1)On receipt of an application for the grant of a licence, the Licensing Officer may, after taking into consideration the matters referred to in clause 6 either grant or refuse a licence.
(2)Where the application for a licence is refused, the reasons for such refusal shall be recorded in writing and a copy of the same shall be furnished to the applicant, and the fees paid by the applicant along with the application shall be refunded to him.
(3)Where the application for a licence is not refused, Licensing Officer shall grant the applicant a licence in Form B.

8. Conditions of Licence.

- Every licence shall be subject to the terms and conditions specified in Schedule I:Provided that where the licence is with respect to storage of any agricultural produce in any Cold Storage in existence at the commencement of this Order, nothing in paragraph 3 of Part 2 of the Schedule shall apply to such licence.

9. Cancellation of licence.

- The Licensing Officer may after giving the holder of the licence an opportunity to show cause and after giving him three months' notice, cancel any licence granted to him for any breach of the terms and conditions of the licence or for any contravention of the provisions of this Order.

10. Period of validity of licence.

- Every licence shall, unless previously cancelled, expire on the 31st day of December next following.

11. Renewal of licence.

(1)Every holder of licence desiring to renew the licence shall make an application for renewal in duplicate to the Licensing Officer in Form 'C' together with such fees as are payable under clause 5 of the original grant of the licence, on or before the 31st October.
(2)On receipt of such application together with such fees, the Licensing Officer may either renew the licence or refuse to renew the licence.
(3)Where the application for renewal is refused, the reasons for such refusal shall be recorded in writing and copy of the same shall be furnished to the applicant and the fees paid by the applicant along with the application shall be refunded to him.

12. Power to call for information, etc.

(1)The Licensing Officer or any other officer authorised by him in writing in this behalf, may with a view to securing compliance with this Order-
(a)require any holder of a licence to give any information in his possession with respect to the agricultural produce stored by him in the cold storage;
(b)enter and search any premises, where the cold storage is installed or run, at any time with a view to satisfying himself that the requirements of this Order are being complied with.
(2)Every holder of a licence shall be bound to furnish the information so required to the Licensing Officer or such other officer and afford all necessary facilities to the Licensing Officer or the officer for the purpose of exercising his powers under sub-clause (1).
(3)Subject to the provisions of this clause, the provisions of Sections 102 and 103 of the [Code of Criminal Procedure, 1898 (5 of 1898)] [Now see Criminal Procedure Code, 1973.] relating to search shall so far as may be, apply to searches under this clause.

13. Maintenance of records and submission of returns.

- The Licensing Officer may, by order in writing direct any holder of a licence-
(a)to maintain such record relating to storage of agricultural produce in a cold storage in such forms as may be specified in the order;
(b)to submit to him such returns or statements in such form and containing such information relating to the agricultural produce stored in the cold storage and within such time as may be specified in the order.

14. Appeal.

- Any person aggrieved by any order of the Licensing Officer made under this order may prefer an appeal to the State Government within thirty days of the date of communication of such order and the decision of the State Government thereon shall be final:[Provided that where the licensing officer is an officer other than the Director of Horticulture and Fruit Utilization, the appeal shall lie against his order to the Director of Horticulture and Fruit Utilization and the decision of the Director of Horticulture and Fruit Utilization thereon shall be final.] [Substituted by Notification No. M-49/12(8)-74, dated 6th June, 1974, vide U.P. 15. Cold Storage receipts.

(1)For the agricultural produce stored in a cold storage by each hirer, the licensee shall issue a cold storage receipt in Form 'D' containing particulars relating to the agricultural produce.
(2)[ The licensee shall not have any other terms and conditions entered on the receipt or on any other document signed by the hirer except as otherwise provided by the Order.] [Inserted by Notification No. A-2707/XII-G, dated June 27, 1972, vide U.P. Cold Storage (First Amendment) Order, 1972.]

16. Cold storage receipts to be transferable by endorsement and delivery.

- A cold storage receipt shall, unless it is otherwise specified thereon, be transferable by endorsement and delivery and shall entitle any lawful holder thereof to receive the agricultural produce specified in it as if he were the original hirer.

17. Duplicate cold storage receipt.

- If a cold storage receipt is lost, destroyed, torn or defaced, the licensee shall on application by the hirer and on payment by him of rupees two issue a duplicate cold storage receipt in accordance with the provisions of clause 15.

18. Service charges.

(1)Notwithstanding any contract to the contrary entered into before or after the commencement of this order, the licensee shall not levy for any period after the commencement of this order, storing charges exceeding the charges specified against each of the agricultural produce in Schedule II.
(2)The State Government may, [by notification in the Gazette revise the charges specified in Schedule II if on a consideration of the cost of storage and other relevant factors it thinks fit] [Substituted by Notification No. A-270/VXII-G, dated June 27, 1972, vide U.P. Cold Storage (First Amendment) Order, 1972.].
(3)[ For the purposes of sub-clause (1), where any agricultural produce was stored before the commencement of this Order and the storing charges in excess of those specified in Schedule II were agreed for the entire period of storage, but remained wholly or partly unpaid till the commencement of the Uttar Pradesh Cold Storage (Amendment) Order, 1972, the. payment so remaining to be made shall be subject to the condition that the licensee shall be entitled to storing charges for the period before the said date at the agreed rate, after spreading the agreed rate over the entire period of actual storage pro rata on a daily basis, and to storage charges for the period beginning from the said date at the maximum rate specified in Schedule II after spreading the said rate over the period specified in the Schedule pro rata on daily basis.] [Inserted by Notification No. A-270/VXII-G, dated June 27, 1972, vide U.P. Cold Storage (First Amendment) Order, 1972.]Explanation. - For the purpose of calculating the period specified in Schedule II, the words 'or part thereof wherever occurring in the said Schedule shall be disregarded.
(4)[ The storage charges specified in Schedule II includes charges for insurance under Clause 19 and for labour involved in weighing the agricultural produce or in carrying it from the precincts of the cold storage where the produce is unloaded by the hirer to the cold storage and turning of the bags in carrying the goods back from the cold storage to the precincts for purposes of return and for providing space for driage, and charges involved in process of drying and no separate charges shall be levied on any such account whatsoever.] [Substituted by Notification No. AA-1149/12-(6)-700(14)-72, dated 9.2.1973]Explanation. - [* * *] [Deleted vide U.P. 19. Insurance of agricultural produce in cold storage.

- Agricultural produce stored in a cold storage shall be got insured by the licensee against loss or damage by fire, [break down (whether mechanical or otherwise) or such other like cause] [Substituted by U.P. Cold Storage (First Amendment) Order, 1972 and published in U.P. Gazette (Extraordinary), dated 26 7.1972.].

20. [ Reasonable care of goods deposited. - Every licensee shall take such care of the goods deposited with him as a man of ordinary prudence would take of his own goods under similar circumstances and conditions.] [Inserted by U.P. 21. [ Precaution against damages to goods. - No licensee shall accept goods for deposit which are likely to cause damage to other goods which are, or may be, deposited in the cold storage.] [Inserted by U.P. 22. [ Preservation of identity of goods. - Every licensee shall keep in his cold storage, the goods of one depositor spreading from the goods of other depositors and from other goods of the same depositor for which a separate receipt has been issued, in such a manner as to permit at all times, the identification and easy delivery of the goods deposited:

Provided that where standardised and graded goods are deposited in the warehouse, the same variety of goods belonging to the same or different depositors may, subject to any contract to the contrary, be pooled together and each depositor shall be entitled only to his portion of the goods according to weight or quantity, as the case may be, as shown in his receipt, having due regard to driage or shrinkage.] [Inserted by U.P. 23. [ Licensee to allow facilities for depositor to inspect goods. - Every licensee shall allow during such hours, as the Licensing Officer may by order direct, necessary facilities to a depositor or such person, as may be authorised by him, to inspect and satisfy himself that his goods are properly cared for.] [Inserted by U.P. 24. [ Goods deteriorating in warehouse and their disposal. - (1) Whenever goods deposited in a cold storage being to deteriorate or are likely to deteriorate from causes beyond the control of the licensee, he shall forthwith give notice thereof to the depositor, requiring him to take delivery of the goods immediately after surrendering the receipt duly discharged and paying all charges due to the licensee.

(2)Where the depositor does not, within 15 days comply with notice given to him under sub-clause (1), the licensee may cause the goods to be removed from the cold storage and sold by public auction at the cost and risk of the depositor:Provided that the licensee shall give notice of the sale to the Licensing Officer at least 48 hours before such sale.Explanation. - Loss of weight or bulk by driage or shrinkage or gain of weight or bulk by absorption of moisture shall be deemed to amount to deterioration within the meaning of this clause, if the loss or gain exceeds such limits as the Licensing Officer may, from time to time having regard to the climatic conditions of different areas, fix by notification published in the Gazette.] [Inserted by the U.P. 25. [ Intimation regarding conditions of goods. - Any person having an interest in any goods deposited in a cold storage or in the receipt covering such goods may inform the licensee in writing of the fact and nature of his interest and the licensee shall keep a record thereof; if such person request in writing that intimation be given to him regarding the condition of goods and agrees to pay the charges for giving such intimation, the licensee shall give him intimation accordingly.] [Inserted by U.P. 26. [ Delivery of goods. - (1) Every licensee shall, without unnecessary delay, deliver the goods deposited in his cold storage to the depositor on demand made by him and on surrender of the receipt duly discharged and on payment of all charges due to the licensee:

Provided that the depositor may, subject to any agreement between the licensee and the depositor, take partial delivery of the goods deposited in a cold storage.
(2)Every such receipt after being so surrendered to the licensee shall, subject to the provisions of sub-clause (3), be defaced by him and no such receipt shall be re-issued.
(3)Where only partial delivery of the goods is taken by a depositor, the licensee shall make an entry of it in the receipt and return it to the depositor.] [Inserted by U.P. Cold Storage (First Amendment) Order, 1972, dated 27.6.1972.]

27. [ Liability of licensee for shortage and excess in goods deposited. - The licensee shall be liable to pay compensation to the depositor for any loss sustained by him by reason of the goods having lost weight or bulk in excess of the limits fixed by the Licensing Officer owing to shrinkage or driage or by reason of deterioration of the quality in goods owing to their having gained weight or bulk, in excess of the limits fixed by the Licensing Officer, by the absorption of moisture.] [Substituted by Notification No. AA-1149/12 (5)-700 (14)-72, dated 9th February, 1973 vide U.P. 28. Licensee not to deal in lend money against the goods in cold storage.

- [No licensee shall except with the written authority of the hirer, pledge or otherwise deal in goods received by him for deposit in the cold storage.] [Substituted by Notification No. AA-1149/12 (5)-700 (14)-72, dated 9th February, 1973 vide U.P Cold Storage (Second Amendment) Order, 1973.]

28A. [ If any money is lent by the licensee to the hirer against the goods deposited by the latter, the rate of interest in no case shall be higher than 0.50 per cent per annum simple interest over the current interest charged for the specific purpose at the time of the loan by the State Bank of India in respect of advance made against the goods pledged with it.] [Inserted by Notification No. AA-1149/12 (5)-700 (14)-72, dated 9th February, 1973, and further Substituted by U.P. 29. Licensee's lien.

- Every licensee shall have lien on the goods deposited in his cold storage for storing goods and for all other lawful charges incidental thereto.

30. Disputes regarding damages.

- If any dispute regarding damages arises between the licensee and the depositor or the holder in due course of the cold storage receipt, it shall be decided by the Licensing Officer, whose decision shall be final.

31. [] [Renumbered by U.P. Cold Storage (First Amendment) Order, 1972, dated 27.6.1972.] Saving. - Nothing in this order shall apply to the storage of foodstuffs in any cold storage with a capacity of less than 8.50 cubic metres (300 c.ft.

32. [ Duty to exhibit capacity of the Cold Storage. - (1) It shall be the duty of every licensee to display and exhibit on or near the main entrance of Cold Storage the following information:

(a)Total capacity of cold storage (both in area and tonnage);(b)Capacity physically occupied (both in area and tonnage);(c)Vacant capacity (both in area and tonnage).
(2)The information required by sub-clause (1) shall be displayed and exhibited with reference to the position existing at 8 a.m. on each day.
(3)The board displaying and exhibiting the aforesaid informations shall be kept at some conspicuous place near the Cold Storage so that it may be easily accessible to general public including the hirers and intending hirers.] [Clauses 32 and 33 inserted by Notification No. 970-XII-8/700 (23)-75, published in U.P. 33. [ Licensee not to refuse acceptance of goods so long a vacancy exists. - The storage area of a Cold Storage which is not physically occupied by an agricultural produce, shall be deemed to be vacant and no licensee shall refuse to accept for storage any agricultural produce for so long as the storage area permits such acceptance.] [Clauses 32 and 33 inserted by Notification No. 970-XII-8/700 (23)-75, published in U.P. 34. [ A licensee shall not refuse to store potato seed of bona fide cultivators as certified by the Gazetted Officers of Horticulture Department or the Block Development Officers, as the case may be.] [Inserted vide U.P. Cold Storage (Fifth Amendment) Order, 1975, dated 23 5.1975.]

35. [ Transitory provisions. - For so long as the Cold Storage Order, 1964 made by the Central Government under Section 3 of the Essential Commodities Act, 1955 remains in force in Uttar Pradesh, where any cold storage is licensed under the said Order--

(a)the Licensing Officer shall not, under clause 6, refuse a licence in respect of such cold storage;
(b)the Licensing Officer shall not under clause 9, cancel, or under clause 11, refuse to renew, the licence relating to such cold storage on the ground of any breach of the terms and. conditions specified in Schedule I;
(c)the Licensing Officer or any other officer authorised by him shall not exercise the power under clause 12 [with a view to satisfying himself that the requirements of Schedule I are being complied with].

Part I – Sanitary requirements--

1. The premises where the cold storage is installed shall be clean. Inside the cold storage electric lights should be provided at the rate of I watt per 4645 sq. cm (5 Sq. ft). The disinfecting or deodourising of the cold storage should, however, be carried out as and when required.

2. The holder of the licence shall not store any product(s) which will be repugnant or alien to the smell of the agricultural produce stored in the cold storage. Products having repugnant smell shall, however, be stored in separate chambers of the cold storage.

3. All yards, out-houses and all approaches of the premises where the cold storage is installed shall be kept clean and sanitary.

4. No person suffering from any infectious or contagious diseases shall be allowed to work in the cold storage. Arrangements shall be made for examination of the employees other than daily paid labourers working in the cold storage once a year to check that they are free from any infectious, contagious, or other disease.

5. The employees working inside. the cold storage operating above freezing- point shall be adequately provided with proper clothes to protect them from cold. The employees working in cold storage which operates below freezing point shall also be provided with boots.

Part II – Requirement as to operation-

1. The door(s) of the cold storage shall be provided with adequate insulation and should be reasonably airtight. The design of the door(s) shall be such that a person must be able to open it from inside as well as outside.

2. Wherever racks are provided they shall be so constructed that loading and unloading operation shall be carried out without endangering the life of the employees working in the Cold Storage.

3. For the distribution and circulation of air and for actual operation of loading and unloading, the following directions shall be adhered to:

(a)The passage between the rows of the racks should not be less than 76 metres.
(b)The racks should be kept away at least 20 cm. from the wall/floor.
(c)A gap of at least 30 cm. should be maintained between the ceiling and the top level of the load in the top most shelf of every rack.
(d)A gap of at least 7.5 cm. should be maintained on every shelf of rack between the load on the shelf and the succeeding shelf.

4. The diffusers or direct expansion pipes for conveying the refrigerant shall be so arranged in the cold storage so as to maintain proper temperature with maximum allowable variation of 1°C, and percentage of relative humidity with an allowable variation of 5 per cent in every location of the Cold Storage where an agricultural produce is stored.

5. The Coal Storage shall be provided with thermometers, reading dry bulb and wet bulb temperatures.

Part III – Maintenance of log book-

1. Every licensee shall maintain a "Log Book" as prescribed in the Annexure to this Schedule for the maintenance of temperature and relative humidity as well as the pressure reading of the compressor on four hourly basis all throughout night and day during the operation of the cold storage unless automatic recording instruments are installed. The Licensing Officer or any person duly authorised by him in this behalf shall sign the Log Book at every inspection after personal verification of the records.

2. Any stoppage of function of the cold storage exceeding 24 hours continuously shall be reported immediately by the holder of the licence to the Licensing Officer. The reasons for such break down shall be recorded in the Log Book and reported to the Licensing Officer.

II

(Vide clause 18)Maximum charges for storing in Cold Storage of Agricultural Produce Name of the commodity and maximum storage charge

1. Potato-

[Rs. 8 per quintal for the entire period February- October or part thereof; [Substituted by U.P. Cold Storage (First Amendment) Order, 1972, dated 27th June, 1972.]If the goods stored earlier or not taken away by the end of October then an additional charge of rupee one per quintal for the month of November or any part thereof] [Inserted vide U.P. 2. Cabbage-

Rs. 1.20 per 40 kg. for seven days or part thereof.

3. Orange-

(i)Rs. 1.50 per case per month.
(ii)Rs. 4.50 per case for the entire period March-July or part thereof.

4. Pears-

Rs. 1.00 per month per crate of approximately-100 fruits.

5. Apple-

Rs. 1.50 per month per case or tokri containing 200 to 250 fruits.

6. Pomegranate-

Rs. 1.00 per case per month.

7. Mosambi-

Rs. 1.00 per bag per month.

8. Dry Fruit-

Rs. 1.00 per month or part thereof, for a tin or packets not exceeding 20 kg. in weight.

9. Fish-

(i)Rs. 2.80 per 40 kg. for seven days or part thereof,
(ii)Re. 0.20 per kg. for seven days or part thereof.

10. Meat-

(i)Rs. 2.80 per 40 kg. for seven days or part thereof,
(ii)Re. 0.25 per kg. of Beef / Pork for seven days or part thereof.

11. Dressed poultry-

Rs. 0.20 per kg. for seven days or part thereof.

12. Egg-

(i)Rs. 1.00 per basket per week or part thereof.
(ii)Rs. 1.50 per c.ft. for four weeks or part thereof for hen eggs,
(iii)Rs. 1.25 per c.ft. four weeks or part thereof for duck eggs.
