1. Short title and commencement.
- (i) These Regulations may be called the Central Electricity Regulatory Commission (Open Access in Inter-State Transmission) Regulations, 2004.2. Definitions.
- In these Regulation, unless the context otherwise requires:-3. Extent of application.
- These Regulations shall apply for access to inter-state transmission system.4. Categorisation of transmission customers.
- (i) The transmission customers shall be divided into two categories, namely-5. Criteria for allowing transmission access.
- (i) The long-term access shall be allowed in accordance with the transmission planning criterion stipulated in the Grid Code;6. [ Criteria for allotment and reservation of transmission capacity. [Substituted by Notification No. L-7/25(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
- (i) Allotment priority of a long-term customer shall be higher than reservation priority of a short-term customer7. [ Declaration of Long-term Open Access. [Substituted by Notification No. L.-7/25(5)/2003-CERC dated 21.02.2005, w.e.f 1.4.2005.]
- Every transmission licensee shall declare the existing long-term customers using its transmission system (including self-use and use by unbundled agencies which were previously integrated) either on its website or on the website of the Regional Load Despatch Centre or the State Load Despatch Centre concerned latest by the thirtieth day of June 2005.]8. Nodal agency.
- (i) The nodal agency for arranging the long-term transmission access shall be the Central Transmission Utility if its system is used, otherwise the nodal agency shall be transmission licensee in whose system the point of drawal of electricity is situate;9. Procedure for long-term customer.
- (i) An application for long-term access shall be submitted to the nodal agency;10.
The allotment of transmission capacity to a long-term customer may be relinquished or transferred to any other long-term customer in accordance with Regulation 12 of these Regulations.11. Bulk Power Transmission Agreement.
- A long-term customer shall enter into Bulk Power Transmission Agreement with the transmission licensee for use of inter-state transmission system.12. Exit option.
- (i) A long-term customer shall not relinquish or transfer his rights and obligations specified in the Bulk Power Transmission Agreement, without prior approval of the Commission.13. Procedure for short-term customer.
- (i) A short-term customer shall submit an application for transmission access to the nodal Regional Load Despatch Centre;13A. [ Bidding Process for Short-term Access. [Inserted by Notification No. L-7/25(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
- (i) The floor price for bidding shall be the ST_RATE determined in accordance with Regulation 16 of these regulations.14. [ Non-Utilisation of reserved transmission capacity by short-term Customer. [Substituted by Notification No. L-7/25(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
- (i) In case a short-term customer is unable to utilise, full or substantial part of the reserved transmission capacity, he shall inform the nodal Regional Load Despatch Centre along with reasons for his inability to utilise the reserved transmission capacity and may surrender the reserved transmission capacity.15. . - Any person granted open access before commencement of the Central Electricity Regulatory Commission (Open Access in Inter-state Transmission) Regulations, (First Amendment) Regulations, 2005 shall not be disturbed till expiry of the period for which open access has been granted.]16. [ Transmission charges. [Inserted by Notification No. L-7/2.5(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
- The transmission charges for use of the transmission system of the transmission licensee for inter-state transmission shall be regulated as under, namely:-17. [ Operating Charge [Substituted by Notification No. L-7/25(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
. - (i) A composite operating charge @ Rs.3,000/- per day or part of the day and @ Rs 1,000/- per day or part of the day shall be payable by a short-term customer for each transaction to the each of the Regional Load Despatch Centre involved and State Load Despatch Centre respectively.Note 1. - The operating charge includes fee for scheduling and system operation, fee for affecting revisions in schedule on bona fide grounds and collection and disbursement charges.Note 2. - The operating charge collected by the Regional Load Despatch Centre in accordance with Clause (i) shall be in addition to the fees and charges specified by the Commission under sub-section (4) of Section 28 of the Act.Explanation. - Operating charge shall be payable by a generating company when it is granted short-term access under these regulations.]18. Unscheduled inter-charge (UI) charges.
- (i) The mismatch between the scheduled and the actual drawal at drawal point(s) and scheduled and the actual injection at injection point(s) shall be met from the grid and shall be governed by UI pricing mechanism applicable to the inter-state transactions;19. [ Reactive energy Charges. [Inserted by Notification No. 1-7/25(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
- The payment and receipt of the reactive energy charges by the direct customers on account of open access shall be calculated in accordance with the scheme applicable to transactions involving inter-state transmission approved by the Commission from time to time.]20.
The reactive energy charges payable to or receivable by the State Electricity Board or the State Transmission Utility shall be paid to or received from the pool by the State Electricity Board or the State Transmission Utility concerned and shall not be apportioned to the embedded customers.21.
The reactive energy drawals and injections by the embedded customers shall be governed by the Regulations applicable within the State concerned.22. [ Time-schedule for processing Application. [Inserted by Notification No. L-7/25(5)/2003-CERC dated 21.02.2005, w.e.f. 1.4.2005.]
- (i) In addition to the time schedule prescribed under regulation 6 for processing of applications for advance reservation, as far as practicable, the following time schedule shall be adhered to by the respective nodal agency for processing of the application for grant of access, namely:-| S.No. | Type of service /activity | Maximum Processing time |
