The Global Open University (Nagaland) Act, 2006Act No. 3 of 2006Last Updated 17th February, 2020[Dated 18th September, 2006]No.LAW/ACT-10/2006. - The Global Open University (Nagaland) Act 2006 (Act No. 3 of 2006) which received the assent of the Governor of Nagaland on the 30th August, 2006 is hereby published for general information.An Act to establish a Private University by name the Global Open University (Nagaland) in the State of Nagaland and to provide for matters connected therewith or incidental thereto.Whereas, the Government of Nagaland had signed a Memorandum of Understanding with a Trust called the World Institution Building Programme (WIBP), New Delhi on the 13th September, 2005, for allowing the said Trust to establish a Private University in the State of Nagaland to offer to the people of Nagaland more choices for pursing higher professional technical and technological education; andWhereas the establishment of a Private University can be done only through an Act of the State Legislative Assembly as per provisions in the University Grants Commission (Establishment and Maintenance of Standards in Private University) Regulations, 2003 :Be it enacted by the Nagaland Legislative Assembly in the fifty-seventh year of the Republic of India as follows :

Chapter I
Preliminary

1. Short title and commencement.

- This Act may be called the Global Open University (Nagaland) Act, 2006.
(2)It shall come into force on the date appointed by the State Government by notification in the Official Gazette.

2. Definitions.

- In this Act, unless the context otherwise requires, the following words shall have the meanings assigned herein :
(1)"Academic Council" means the Academic Council of the University;
(2)"Board of Studies" means the Board of Studies constituted under this Act;
(3)"Chancellor" means the Chancellor of the University;
(4)"Director" means a Director of the University;
(5)"Executive Council" means executive Council of the University;
(6)"Finance Committee" means Finance Committee of the University;
(7)"Finance Officer" means Finance Officer of the University;
(8)"Fund" means the funds of the University and includes funds for a sponsored scheme;
(9)"Governing Council" means the Governing Council of the University;
(10)"Governor" means the Governor of Nagaland;
(11)"Notification" means notification published in the Official Gazette of the Government of Nagaland;
(12)"Pro-Chancellor" means the Pro-Chancellor of the University;
(13)"Registrar" means the Registrar of the University;
(14)"Regulation" means a regulation made under this Act;
(15)"Schedule" means schedule to this Act;
(16)"State Government" means the State Government of Nagaland;
(17)"Trust" means the World Institution Building Programme, New Delhi registered under the Indian Trusts Act, 1882;
(18)"UGC" means University Grants Commission constituted under the University Grants Commission Act, 1956
(19)"University" means the Private d by name the Global Open University (Nagaland) established under this Act; and
(20)"Vice-Chancellor" means the Vice-Chancellor of the University.

Chapter II
Establishment, Objectives, Powers and Functions of University

3. Establishment of University.

(1)As soon as after the commencement of this act, the State Government shall call upon the Trust to set up an Endowment Fund of Rs. one crore for the purposes of the University.
(2)Immediately after the setting up of the Endowment Fund as aforesaid the State Government shall accord sanction for establishment of the University by name the Global Open University (Nagaland) and thereafter the Trust shall accordingly establish the University.
(3)The State Government shall notify the fact of establishment of the University in the Official Gazette as soon as may be after the establishment of the University by the Trust."Provided that no such notification by the State Government shall be issued unless a High Powered Committee appointed in that behalf certifies to the State Government that all necessary infrastructure including buildings, equipments teaching staff etc., are in place and that the provisions of Section 60, wherever applicable, have been fully complied with by the University."
(4)The University shall be a body corporate by the name aforesaid having perpetual succession and common seal and shall, by that name sue and be sued.
(5)
(i)The main campus of the University shall be at Wokha in the State of Nagaland.
(ii)The University shall have power to establish other campuses, study centres etc. within the State of Nagaland for reasons of operational expediency and for broad basing the activities of the University.
(6)The University may establish off-campus centres, off-shore campuses and study centres subject to the provisions of the University Grants Commission Act, 1956 and the regulations made thereunder and the provisions of any law for the time being in force.
(7)The University may further institute its own colleges and also affiliate any other college of institution in accordance with the procedure enshrined in regulations.

4. Objects of University.

(1)The University shall design and run courses and programmes leading to the award of certificates, diplomas, degrees of bachelor, master, doctoral and postdoctoral leaves and other academic distinctions, under the faculties and in the subjects enumerated in the schedule to this Act.
(2)The University, by regulation has the power to abolish or create any faculty or any course or programme of study enumerated in the schedule without causing any detriment to the interests of teachers or students concerned and any such regulation shall not be deemed as amendment of this Act.
(3)
(i)The University may impart instructions in regard to a course or Programme of study through one or more modes, which may include distance, continuing and regular modes of teaching and learning.
(ii)Without prejudice to the above, the main objective of the University shall be lo provide high quality professional technical and technological in campus, class room formal and regularity courses of programmes of study to the students hailing from Nagaland in such subjects, areas and fields of study which are generally not offered by other institutions in Nagaland.
(iii)The University shall specially strive to have professional academic and other possible link-ups and ties with various Centres of Excellence in and outside the country for promoting the standards of education provided, for improving the methodologies of teaching and for upgrading the potentials of teaching and non-teaching staff of the University.

5. Powers and functions of University.

(1)Without prejudice to the generality of the foregoing provisions, the University shall have the following powers and functions :
(i)to provide for instruction, teaching and training in all branches of study and particularly for research advancement and dissemination of knowledge through establishment of institutes, departments schools, faculties and other centres of excellence;
to hold examinations and to grant and confer certificates, diplomas, degrees and other academic distinction on those who pass the examinations, to confer honorary distinctions on mean and women of.
(ii)eminence and to withdraw the certificates, diplomas etc. from those who had been conferred for good and sufficient reasons;
(iii)to transform the University into a Centre of Excellence particularly in the fields of healthcare, medical and para-medical education, hospital, administration, physical and biological sciences technology including information and communication technologies Engineering Social work Environmental Science, Law Fine Arts etc.
(iv)to maintain and manage the physical and financial assets of the University in the most effective manner with a view to promoting the purposes of the University;
(v)to appoint professors, associate professors assistant professors, readers, lecturers and others connected with teaching with a view to imparting instructions of very high standards;
(vi)to establish all physical amenities conducive to the most effective learning by the students, enrolled with the University;
(vii)to institute fellowships scholarships prizes medals etc. with a view to promoting research and motivating study;
(viii)to collaborate, cooperate and act jointly with other organizations, institutions Universities etc. within and outside India, particularly in the fields of medical education, Engineering Technology, Environmental Science, Law and Fine Arts etc., for strengthening research and improving the quality of instructions to students;
(ix)to disseminate knowledge through seminar, conferences, executive education programs, community development programs, publications and training programs;
(x)to provide consultancy to industry Government and public organizations;
(xi)to establish and maintain within the premises of the University or elsewhere such class rooms, study halls as the University may consider necessary and adequately furnish the same;
(xii)lo receive grants, subscriptions, donations and gifts for the purpose of the University and consistent with the objects for which the University is established;
(xiii)to purchase, take on lease or accept as gift or otherwise any land or building or works which may be necessary or convenient for the purpose of the University on such terms and conditions as the University may deem fit, and to construct or alter and maintain any such buildings or works;
(xiv)to execute conveyances, transfers, re-conveyances, mortgages, leases, licence and agreements in respect of property, movable including securities belonging to the University or to acquire the same for the purpose of the University;
(xv)to enter into agreements with Organizations which may include the Central Government the State Government, the University Grants Commission or other authorities for receiving grants;
(xvi)to accept grants of money securities or property of any kind on such terms and conditions as may be deemed expedient;
(xvii)to raise and borrow money on mortgage, promissory notes or on other obligations or securities based upon all or any of the properties and assets of the University with or without any securities and upon such terms and conditions as it may deem fit and to pay out of the funds of the University, all expenditures incidental to the raising of the money and to repay and redeem any money borrowed;
(xviii)to invest the funds of the University or money entrusted to the University in other such securities and in such manner as it may deem fit and from time to time transpose any investment; and
(xix)to do all other acts as the University may consider necessary that are conducive or incidental to the attainment and promotion of the aforesaid objectives.
(2)The Pro-Chancellor shall be responsible for the distribution of the aforesaid powers and functions of the University amongst the officers, councils committees, boards and other authorities of the University in accordance with the provisions of this Act for carrying out the objectives of the University.

Chapter III
Admission, Discipline, Honorary Degrees and Withdrawal, of Degrees

6. Secular character of University.

- The University shall be open for study to all persons irrespective of class, caste, creed, religion, language or gender or like considerations :Provided that nothing in this section shall be deemed as preventing the University from making special provisions for admission into courses of study in the University or for concessions in fee, in favour of students who are ordinary residents of the State of Nagaland.

7. Eligibility for admission.

- Subject to the provisions in this Act, no student shall be eligible for admission to a course or programme of study in the University unless he possesses the qualifications prescribed in the regulations.

8. Residence of students.

- Students of the University may reside in a hostel maintained or recognized by the University under such conditions as may be prescribed in the regulations.

9. Discipline.

(1)The Vice Chancellor shall be responsible for the maintenance of discipline in the University and his orders in this regard shall be carried out by the officers and authorities of the University.
(2)Notwithstanding anything in sub-section (1), the punishment of debarring a student from an examination of the University or rusticating him from the University or hostel or an institutions of the d or any other punishment of such serious nature, shall be imposed only by the Executive Council on receipt of a report from the Vice Chancellor :Provided that the Executive Council shall impose such a punishment only after giving the student concerned a reasonable opportunity of being heard.

10. Award of Certificates, Diplomas etc.

- A certificate Diploma or a Degree or any other academic distinction shall be granted to, or conferred upon a student only after he has undergone the relevant course or programme of study for the duration prescribed therefor and passed the same with qualifying marks prescribed therefor by the regulations.

11. Award of honorary degrees.

- The University shall have the power to confer an honorary degree of academic distinction of the University on any person for his eminent attainments and position, if the Governing Council approves by majority a recommendation of the Academic Council passed by two-thirds of the membership of the Academic Council for doing so.

12. Withdrawal of Certificates, Diploma etc.

- The Governing and Academic Councils shall have the power to withdraw a Certificate or a Diploma or a Degree or any other academic distinction, including an honorary degree of academic distinction granted to or conferred upon, a student or an eminent person, for good and sufficient reasons to be enumerated in the regulations. The Councils shall follows the same procedure followed for awarding honorary degrees.

13. Teaching and curriculum.

(1)All teaching in the University shall be done by teachers, appointed by the University in accordance with the regulations.
(2)The syllabus curriculum, the manner of organization of teaching and other connected matters in respect of each course or programme of study in the University shall be as prescribed in the regulations.

Chapter IV
Officers of University

14. Officers of University.

- The following shall be the officers of the University:
(1)The Chancellor
(2)The Pro Chancellor
(3)The Vice-Chancellor
(4)The Registrar
(5)The Directors
(6)The Deans
(7)The Finance Officer
(8)Such other persons who may be declared by regulation as Officers of the University.

15. Chancellor.

- The Governor of Nagaland shall be the Chancellor of the University.

16. Powers and functions of Chancellor.

(1)The Chancellor shall preside over the convocations of the University and in the case of his inability the Pro Chancellor shall do so.
(2)The Chancellor shall constitute a Committee every five years from the date of establishment of the University comprising eminent persons in the field of education to review the working of the University and cause its report to be laid before the Nagaland Legislative Assembly.
(3)The Committee's tenure shall ordinarily be three months and in no case be extended beyond six months.
(4)The University shall bear the expenditure incurred on the Committee.
(5)The Officers and Councils under this Act have an obligations to send all the notices, minutes and decisions of their meetings to the Chancellor well in advance.
(6)The Chancellor has the power to attend the meetings of the Governing Council and when he so attends, he shall preside over the meetings, of the Governing Council.
(7)The Chancellor has the power to seek form the Pro Chancellor information on all affairs of the University which shall be provided to him with utmost dispatch.

17. Pro Chancellor.

- The President or the Chief Officer of the Trust, by whatever designation he may be called, shall be the Pro-Chancellor of the University.

18. Powers and functions of Pro Chancellor.

(1)The Pro Chancellor is the plenipotentiary of the University and has all powers in regard to the conduct of the affairs of the University in accordance with the provisions of this Act and all unspecified powers shall vest in him which shall be used for more effective implementation of this Act.
(2)Subject to the foregoing provisions he shall preside over the meetings of the Governing Council.
(3)He shall also preside over the Executive and Finance Councils.
(4)He has the power to attend the meetings of other Councils under this Act and when he so attends he shall preside over the meetings of such Councils.

19. Vice-Chancellor.

(1)There shall be a whole time Vice Chancellor for the University who shall function as the Principal Executive and Academic Officer of the University.
(2)There shall be a Selection Committee to recommend the selection of the Vice-Chancellor which shall comprise a nominee of the Chancellor, a nominee of the Government of Nagaland, two nominees of the Trust and a nominee of the Pro Chancellor.
(3)The recommendation of the Selection Committee shall further be considered and recommended by the Governing Council to the Chancellor for his final approval.
(4)The Vice-Chancellor shall not hold office beyond 65 years of age.
(5)In case of emergent circumstances where the appointment of a Vice-Chancellor on the basis of a panel prepared by a Selection Committee is not possible for any reason, the Pro Chancellor until an appointment is made in accordance with that procedure, may appoint a suitable person to function as Vice Chancellor for a period not exceeding one year.
(6)Other terms and conditions of service of the Vice Chancellor shall be as per regulations.

20. Powers and functions of Vice-Chancellor.

(1)Subject to the foregoing provision the Vice-Chancellor shall preside over the meetings of the Academic Council.
(2)He shall,-
(i)exercise general supervision and control over the affairs of the University;
(ii)ensure the observance of the provisions of this Act and the regulations made thereunder;
(iii)be responsible for organizing instructions and maintenance of discipline in the University;
(iv)create temporary posts for a period not exceeding one year and abolish the same;
(v)take such action as he may deem necessary in case of any emergency and report the same to the officer or Council or authority concerned which would have ordinarily dealt with the matter :
Provided that if the Officer or Council or authority does not approve of the action taken by the Vice-Chancellor the matter will be referred to the Pro Chancellor whose decision shall be final:Provided further that the person affected by the decision of the Vice Chancellor or the Officer or Council or authority has a right of appeal to the Pro Chancellor or the Chancellor, as the case may be, within thirty days of the decision coming to the knowledge of the affected person; and
(vi)exercise such other powers and perform such other duties as may be assigned to him by the Pro Chancellor or any Council or Officer or authority under this Act or by any regulation.

21. Registrar.

(1)There shall be a whole time Registrar for the University.
(2)The Registrar shall be appointed by the Vice-Chancellor from out of three persons empanelled by the Executive Council which shall not indicate any order of preference and leave the selection solely to the independent judgement of the Vice-Chancellor.
(3)In case of emergent circumstances where the appointment of a Registrar on the basis of a panel prepared by the Executive Council is not possible for any reason, the Vice-Chancellor until an appointment is made in accordance with hat procedure, may appoint a suitable person/officer of the University to function as Registrar for a period not exceeding one year.
(4)The Registrar shall not hold office beyond the age of 62 years.
(5)Other terms and conditions of service of the Registrar shall be as per regulations.

22. Powers and functions of Registrar.

(1)The Registrar shall be the ex officio Secretary of all the Councils of the University under the Act.
(2)The Registrar shall,-
(i)comply with all directions and orders of the Executive Council and the Pro Chancellor;
(ii)be the custodian of the records, the common seal and such other property of the University as the Executive Council may commit to his charge;
(iii)issue notices for, and keep minutes of the meetings of the Councils Board of Studies and other authorities of the University;
(iv)conduct all official correspondence between the University and others outside the University and between various Councils Board and authorities within the University;
(v)furnish notices, minutes and other records of the University to the Chancellor on his own and furnish all information when asked by the Chancellor;
(vi)call meetings of the Executive Council for taking emergent decisions, if any, in the absence of both the Pro Chancellor and the Vice Chancellor;
(vii)perform such other duties as may be assigned by the Pro Chancellor, Vice Chancellor and the Executive Council; and
(viii)be directly responsible to the Vice-Chancellor for the proper discharge of his duties.

23. Directors.

(1)There shall be the following whole time Directors who shall be appointed by the Pro Chancellor :
(i)a Director for operations in the State of Nagaland; and
(ii)as many Directors, as required to be fixed by regulations for looking after the operations outside the State of Nagaland.
(2)The Directors shall not hold office beyond the age of 62 years.
(3)Their other terms and conditions shall be as per regulations.

24. Powers and functions of Directors.

(1)The Director in-charge of operations in the State of Nagaland shall be a member of all councils of the University.
(2)The Pro Chancellor may appoint the Director-in-charge of operations in the State of Nagaland to any other Committee, Board or authority of the University.
(3)The Pro Chancellor may co-opt any other Director of the University in any Council, Committee, Board or authority of the University.
(4)The Directors shall be solely responsible fort the operations of the University at the respective field levels.
(5)Their other powers and functions shall be as per regulations.

25. Finance Officer.

(1)There shall be a whole time Finance Officer for the University who shall be appointed by the Pro Chancellor.
(2)The Pro Chancellor, on his subjective satisfaction may replace the Finance Officer by any other Officer in the employment of the University or by special recruitment, in which case, the outgoing Finance Officer, if he is considered it shall be assigned some other duties in the University.
(3)His other terms and conditions of service shall be as per regulations.

26. Powers and Functions of Finance Officer.

(1)The Finance Officer shall be responsible for assisting the Pro Chancellor Vice Chancellor, the other Officers the Councils Committees, bodies and other authorities of the University in managing the administration of the finances of the University subject to regulations.
(2)He shall be a member of the Governing Executive and Finance Councils.
(3)The Pro Chancellor may co-opt the Finance Officer in any other Council Committee, Board or authority of the University.

27. Deans/Heads of Departments/Faculties.

(1)There shall be a Dean or Head for each Department of Faculty of study in the University who shall be appointed in accordance with the regulations.
(2)Their other terms and conditions of service shall be as per regulations.

28. Powers and functions of Deans/Head.

(1)The Deans/Heads of Departments/Faculties are mainly responsible for the educational administration in respect of courses or programmes of study in the University.
(2)Their other powers and functions shall be as per regulations.

Chapter V
Councils, Committees and Boards

29. Councils of University.

- The following shall be the Councils of the University:
(1)The Governing Council
(2)The Executive Council
(3)The Academic Council.

30. Governing Council.

(1)The following shall be the members of the Governing Council:
(i)The Pro Chancellor shall be the ex officio Chairman;
(ii)The Vice-Chancellor shall be the ex officio Vice-Chairman;
(iii)The Director in-charge of the operations in Nagaland shall be an ex officio member;
(iv)The Finance Officer shall be an ex officio member;
(v)Two eminent educationist/academicians nominated by the Chancellor;
(vi)Two persons nominated by the Government of Nagaland;
(vii)two persons nominated by the Trust;
(viii)Two persons nominated by the Pro Chancellor;
(ix)Two members of the teaching community of the University to be nominated by the Academic Council; and
(x)The Registrar shall be the ex officio Secretary.
(2)The Governing Council shall be reconstituted every five years.
(3)A nominated member may resign from the membership of the Governing Council at any time by addressing his resignation to the Pro Chancellor.
(4)An ex officio member shall cease to be a member of the Governing Council when he ceases to be ion office by virtue of which he became an ex officio member.
(5)A nominated member shall cease to be a member of the Governing Council if he ceases to be in office on account of which he was nominated to the Governing Council.
(6)A member shall cease to be a members of the Governing Council on declaration to be of unsound mind or insolvent by a competent Court or if he is convicted for a criminal offence involving moral turpitude or if he fails to attend three consecutive meetings of the Council.
(7)The nominating authorities shall have a right to replace their nominees to the Council at any point of time.
(8)Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term.

31. Powers and functions of Governing Council.

- The Governing Council shall,-
(1)recommend the broad policies and programmes of the University and suggest measures for the improvement and development of the University;
(2)consider and pass resolutions on the Annual Report the financial statements and audit reports;
(3)take all necessary steps for the fulfilment of the objectives of the University;
(4)acquire, hold, control and administer the property and other movable and immovable assets of the University;
(5)administer funds placed at the disposal of the University;
(6)manage and regulate finances, accounts, investments, property and business and all other administrative affairs of the University and for that purpose appoint agents as it may deem fit;
(7)invest the money belonging to the University including any income from trust, endowment funds etc., in such stocks, funds, shares or securities as it may, from time to time, deem fit an appropriate;
(8)enter into, vary, carry out and cancel contracts on behalf of the University;
(9)regulate and determine all other matters concerning the University;
(10)cooperate with other institutions Universities and other authorities in such manner and for such purposes as it may determine;
(11)delegate any of its powers to the Vice-Chancellor or Registrar or any council or any other authority of the University for a temporary duration, and
(12)perform such other functions a s it may deem fit for the proper functioning and administration of the University.

32. Meetings of Governing Council.

(1)The Governing Council shall meet at least once in a year on a date fixed in consultation with the Executive Council.,
(2)The Chairman or in his absence, the Vice Chairman or in the absence of both, the Secretary shall preside over the meetings.
(3)If the Chancellor chooses to attend any meeting, the Chancellor shall have the overriding right to preside over the meeting.
(4)A report on the working of the University during the previous year, the statement of receipts and expenditure, the balance-sheet the audit report and other such data shall be placed before the Annual Meeting of the General Council.
(5)All meetings of the Council shall be called by the Secretary at fifteen days notice.
(6)If any five members of the Council desire a meeting to discuss a matter of urgent importance, the Secretary shall call a meeting forthwith and the requirement of fifteen days notice shall be deemed to have been waived.
(7)Two-fifth members shall constitute quorum.
(8)All questions shall be decided by majority of members present and voting. (9) Each member shall have one vote and in case of tie, the Presiding Officer shall have an additional casting vote.
(10)If business of the Council has to be transacted urgently without waiting for a formal meeting to take place, the Pro Chancellor may authorize the circulation of questions to the members for decision, which shall be deemed as valid decision of the council for action, however, such decisions shall be circulated at the earliest to all concerned for information and compliance.
(11)All other details relating to the conduct of meetings, functions etc., of the Governing Council shall be as per regulations.

33. Executive Council.

(1)The following shall be the members of the Executive Council:
(i)The Pro Chancellor shall be the ex officio Chairman;
(ii)The Vice Chancellor shall be the ex officio Vice-Chairman;
(iii)The Director in-charge of the operations in Nagaland shall be an ex officio member;
(iv)The Finance Officer shall be an ex officio member;
(v)One nominent of the Government of Nagaland, who shall be a member of the Governing Council, to be named by the Government of Nagaland;
(vi)One nominee of the Trust who shall be a member of the Governing Council to be named by the Trust;
(vii)One nominee by the Pro Chancellor who shall a member of the Governing Council to be named by the Pro Chancellor; and
(viii)The Registrar shall be the ex officio Secretary.
(2)The term of the Executive Council shall run smilutaneously with the Governing Council.
(3)A member of the Executive Council when ceases to be a member of the Governing Council, shall cease to be member of the Executive Council.
(4)The nominating authorities shall have a right to replace their nominees to the Council at any point of time.
(5)Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term.

34. Powers and functions of Executive Council.

(1)The Executive Council shall,-
(i)create posts and appoint from time to time, the members of the teaching and non-teaching staff for carrying out the purposes of this Act on such terms and condition prescribed by regulations;
(ii)exercise control and impose discipline over the employees of the University;
(iii)accept on behalf of the University, endowment bequests, donations, grants and transfers of any immovable property;
(iv)receive money, securities, instruments or any other movable properties for and on behalf of the University;
(v)grant receipts, sign and execute instruments and endorsement discount cheques or other negotiable instruments, through its accredited agencies;
(vi)make sign and account for such documents and instruments as may be necessary for proper carrying out of the management of the property or affairs of the University;
(vii)introduce courses of study at the University and take decisions in this regard on the recommendations of the Academic Council;
(viii)cooperate with and coopt other educational medical and other institutions and authorities in India and abroad;
(ix)create followships and scholarships or other assistance on such terms and conditions, as it may prescribe by regulations, for carrying out research investigation and study;
(x)grant leave except casual leave to officers and other employees of the University and provide for alternative arrangements in the absence of offices and employees;
(xi)manage and regulate finances, accounts, investments property, business and all other administrative affairs of the University and appoint for that purpose, agents;
(xii)invest money belonging to the University, including any unapplied income, in such stocks, funds, shares or securities or movable and immovable property in India and abroad, as it may from time to time, deem fit, and vary such investments;
(xiii)transfer or accept transfers of movable or immovable property on behalf of the University;
(xiv)enter into, vary, carry out and cancel contracts on behalf of the University and for that purpose appoint agents;
(xv)provide buildings, premises, furniture, apparatus and other infrastructual facilities for the carrying out the work of the University;
(xvi)entertain adjudicate upon, and if it thinks fit, redress grievances of officers, and employees of the University;
(xvii)appoint examiners, moderators and others and if necessary to remove them for good and sufficient cause, in consultation with the Academic Council;
(xviii)select a common seal for the University and provide for the custody of the seal;
(xix)delegate any of its powers to the Vice-Chancellor or Registrar or any Council or any other authority of the University for a temporary duration; and
(xx)exercise such other powers and perform such other duties as may be entrusted to it by the General Council or by regulations.

35. Meetings of Executive Council.

(1)The Executive Council shall meet at least once in three months.
(2)The Chairman or in his absence, the Vice Chairman or in the absence of both, the Secretary shall preside over the meetings.
(3)All meetings of the Council shall be called by the Secretary at fifteen days notice.
(4)If any three members, of the Council desire a meeting to discuss a matter of urgent importance, the Secretary shall call a meeting forthwith and the requirement of fifteen days notice shall be deemed to have been waived.
(5)Two-fifth members shall constitute quorum.
(6)All questions shall be decided by majority of members present and voting.
(7)Each member shall have one vote and in case of tie, the Presiding Officer shall have an additional casting vote.
(8)If business of the Council has to be transacted urgently without waiting for a formal meeting to take place, the Pro Chancellor may authorize the circulation of questions to the members for decision, which shall be deemed as valid decision of the council for action, however, such decisions shall be circulated at the earliest to all concerned for information and compliance.
(9)All other details relating to the conduct of meetings, functions etc., of the Governing Council shall be as per regulations.

36. Academic Council.

(1)The following shall be the members of the Academic Council:
(i)The Vice Chancellor shall be the ex officio Vice-Chairman;
(ii)The senior most Dean/Head of Department/Faculty of the University as the ex officio Vice Chairman;
(iii)The Director in-charge of the operations in Nagaland shall be an ex officio member;
(iv)Four professors of the University to be nominated by the Vice-Chancellor who shall be ex officio members;
(v)The Finance Officer shall be an ex officio member;
(vi)Four external experts to be nominated by the Pro Chancellor who shall be members;
(vii)The Dean/Head of Department/Faculty concerned with the subject matter under discussion shall be co-opted as member; and
(viii)The Registrar shall be the ex officio Secretary.
(2)The term of the Academic Council shall run smilutaneously with the Governing Council.
(3)An ex officio member ceases to hold the office by virtue of which he became an ex officio member, shall cease to be a member of the Academic Council.
(4)The nominating authorities shall have a right to replace their nominees to the Council at any point of time.
(5)Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term.

37. Powers and functions of Academic Council.

(1)The Academic Council shall be the supreme academic body of the University and it shall subject to the provisions of this Act and the regulations made thereunder, have power of control and general regulation in regard to and be responsible for, the maintenance a standards of education instruction and examinations of the University.
(2)The academic council shall,-
(i)make recommendations to the Executive Council with retard to creation, abolition classification and other conditions of service of posts in teaching cadre in the University;
(ii)formulate and modify or revise schemes for the organization of the teaching Departments/faculties, assign subjects to the Departments/faculties and report on the expediency of creation, abolition, division and merger of Departments/faculties;
(iii)make arrangements for instruction and examination of persons other than those enrolled in the University;
(iv)promote research in the University and require, from time to time, reports on such research;
(v)consider proposal submitted by the Departments/faculties;
(vi)appoint Committees for admission to the University;
(vii)recognize diplomas, degrees and other academic distinctions of other Universities and institutions after determining their equivalence to diplomas degrees and other academic distinctions of the University;
(viii)fix the time, mode and conditions of competition of fellowship scholarship and other prizes and award the same;
(ix)make recommendations to the Executive Council in regard to the appointment of examiners and if necessary their removal, and the determination of their fees, emoluments and travelling and other expenses;
(x)make arrangements for the conduct of examinations and fix dates for holding them;
(xi)declare the results of various examinations appoint Committees or officers to do so make recommendations regarding conferment or granting of degrees, honours diplomas licenses titles and marks of honour;
(xii)award stipends, scholarships medals and prizes and make other awards in accordance with the regulations and such other conditions as may be attached to the awards;
(xiii)publish lists of prescribed or recommended text books and syllabus for courses and programmes of study at the University;
(xiv)prepare such forms and registers as are, from time to time, required to be maintained by regulations;
(xv)report on any matter referred or delegated to it by the Governing and Executive Councils;
(xvi)receive periodic reports from the Boards of Studies and make recommendations in regard thereto; and
(xvii)perform all other functions assigned to it by this Act and the regulations made thereunder as well as by the Governing and Executive Councils.

38. Meetings of Academic Council.

39. Committees of the University.

- The University shall have a Finance Committee and establish other ad hoc Committees whenever occasion arises.

40. Finance Committee.

- The following shall be the members of the Finance Committee :
(1)The Pro Chancellor as the ex officio Chairman;
(2)The Vice-Chancellor as the ex officio Vice-Chairman;
(3)The Director in-charge of the operations of the University in Nagaland as ex officio member;
(4)The Finance Officer of the University as an ex officio member;
(5)One nominee of the Government of Nagaland, in the Governing Council, lo be named by the Government of Nagaland;
(6)One nominee of the Trust in the Governing Council to be named as a member by the Trust;
(7)One nominee by the Pro Chancellor in the Governing Council to be named as a member by the Pro Chancellor; and
(8)The Registrar shall be the ex officio Secretary.
(2)The term of the Finance Committee shall run simultaneously with the Governing Council.
(3)An ex officio member when cease to hold the office by virtue of which he became an ex officio member, shall cease to be a member of the Finance Committee.
(4)The nominating authorites shall have a right to replace their nominees to the Committee at any point of time.
(5)Casual vacancies arising in the Council before its reconstitution shall be filled for the unexpired term.

41. Powers and functions of Finance Committee.

(1)The Finance Committee shall be responsible for the financial administration of the University and in doing so, shall take decisions subject to the approval of the Governing and Executive Councils. Finance Committee shall,-
(i)examine and scrutinize the annual budget of the University and make recommendations on financial matters to the Executive Council;
(ii)consider all proposals for new expenditure and make recommendations to the Executive Council;
(iii)examine the annual accounts of the University and advise the Executive Council on matters pertaining to the annual accounts;
(iv)review the financial position of the University from time to time;
(v)make recommendations to the Executive Council on all financial matters relating to the University;
(vi)make recommendations to the Executive Council on all proposals involving the raising of funds, receipts and expenditure; and
(vii)scrutinize all proposals having financial implications presented to it by the officers, Councils and other authorites of the University and make recommendations in regard thereto.

42. Meetings of Finance Committee.

(1)The Finance Committee shall meet at least twice in a year.
(2)The Chairman or in his absence, the Vice Chairman or in the absence of both, the Secretary shall preside over the meetings.
(3)All meetings of the Council shall be called by the Secretary at fifteen days notice.

43. Ad hoc Committees.

- The University shall have power to constitute ad hoc Committees for any purpose connected with the affairs of the University and such Committees shall present their reports to the Pro Chancellor. The reports are advisory in nature and wherever feasible shall be acted upon by the University.

44. Boards of Studies.

(1)For each Department/Faculty, the University shall establish a Board of Study which shall comprise the following :
(i)Senior most member of the academic community in the Department/Faculty concerned as the Chairman;
(ii)The next senior most member of the academic community in the Department/Faculty concerned as the Vice-Chairman; and
(iii)Three members of the Academic Committee in the Department/Faculty as members of the Board.
(2)The Chairman, Vice Chairman and members of the Board will be nominated by the Pro Chancellor.
(3)The Board shall meet every quarter in a year and submit quarterly reports to the Academic Council which shall consider the reports at the earliest and report to the Governing and Executive Councils.
(4)The reports of the Boards are advisory in character and mainly should relate to academic and connected administrative matters with the utmost aim of converting the Department/Faculty into a Centre of Excellence.
(5)All other details relating to the conduct of meetings, functions etc., of the Boards of Studies shall be as per regulations.

45. Inter se priority amongst Councils, committees boards etc.

(1)As far as possible the Councils, Committees, Boards under this Act and the ad hoc Committees that may be constituted under regulations shall function in harmony.
(2)Notwithstanding anything in this Act or any regulation made thereunder any conflict between the Councils, Committees Boards under this Act shall be deemed to have been resolved in favour of the Council or Committee or Board which has precedence over the other as found in the following order :
(i)The Governing Council
(ii)The Executive Council
(iii)The Academic Council
(iv)The Finance Committee
(v)The Boards of Studies
(vi)The ad hoc Committees.

Chapter VI
Finance, Contract, Audit etc.

46. No financial obligation on State Government.

(1)This Act and the regulations that may be made thereunder shall not cast any financial obligation in any manner on the Government of Nagaland or its agencies. All expenditure called for the implementation of this Act and the regulations shall be exclusively borne by the University.
(2)Nothing herein shall be deemed to prevent the Government of Nagaland from contributing or giving a grant to the University for promoting academic excellence.

47. Funds of University.

- The University shall operate the following two funds, namely:
(1)The Endowment Fund
(2)The General Fund.

48. Endowment Fund.

(1)Immediately after the commencement of this Act, the University shall set up an Endowment Fund with Rupees one crore to begin with, into which further amounts as determined by the Governing Council shall be credited every year.
(2)The University shall have power to invest the Endowment Fund in such manner as may be prescribed by regulations.
(3)The interest dividends and other forms of growths of the money from the Endowment Fund on account of deposits, investments etc. shall be credited to the Endowment Fund.
(4)When a resolution by the Trust or an Act for repeal of this Act by the Nagaland Legislative Assembly for dissolution of the University is passed, all moneys in the General Fund and all other receipts of the University on all other counts, shall stand transferred to the Endowment Fund for exclusively applying the Fund for the purposes of rehabilitating the students and other affected by such dissolution :Provided that the quantum of moneys in the Endowment Fund shall be reviewed on a five yearly basis by the Governing Council and at the end of such review, if the fund position is found to the reasonably comfortable, one third of moneys in he Endowment Fund may be withdrawal and credited to the General Fund for purposes of developing the infrastructure of the University if two-thirds of the members of the Governing Council vote in favour of such proposal.Provided further that no such transfer as in the first proviso shall be made once a resolution or an Act for dissolving the University has been passed.

49. General Fund.

(1)The University shall also set up a General Fund into which the following shall be credited :
(i)Contributions and grants made by the Trust;
(ii)Contributions and grants made by the Government of Nagaland;
(iii)Contributions and grants made by the University Grants Commission;
(iv)Contributions and grants made by the Central Government;
(v)Contributions and grants made by other organizations in India and abroad, subject to laws in force;
(vi)Bequests, donations endowments or other grants made by private individuals and organizations;
(vii)Income received by the University on account of fees and other charges; and
(viii)Amounts received from any other source.
(2)The funds shall be deposited in a banking institution or held in shares, securities, debenture, or in any other form as may be determined by regulations and as far as possible they may held in such form which does not pose serious risks.
(3)The funds shall be operated exclusively for the purposes of the University in such manner as may be prescribed by regulations.

50. Funds for sponsored schemes.

- The contributions, funds, amounts, grants received for a sponsored scheme shall not be credited to the University Fund but shall be kept separately and utilized only for the purpose of the scheme. The staff required to execute the sponsored scheme shall be recruited in accordance with the terms and conditions stipulated by the sponsoring organization.

51. Annual accounts and audit.

(1)The Annual Accounts of the University shall be prepared by the Finance Officer under the directions of the Executive Council.
(2)The accounts of the University shall be audited every year by certified auditors duly appointed by the Executive Council.
(3)The annual accounts and the audit reports shall be first approved by the Finance Committee before presented to the Governing and Executive Councils.
(4)The Executive Council and the Governing Council in that order consider the annual accounts and audit reports and make recommendations in regard thereto for further action by the Finance Committee which shall give aril ' Action Taken Report to the Governing and Executive Councils at the earliest.

52. Financial estimates.

(1)The annual budget from a financial year shall be prepared by the Finance Committee well before the commencement of the financial year.
(2)The budget will thereafter be considered by the Executive Council and then finally approved by the Governing Council.
(3)Expenditure in excess of the budget in a financial year in extraordinary circumstances shall be incurred only with the approval of the Executive Council.
(4)Such excess expenditure shall further be approved by the Governing Council at the time of approving the annual budget for the next financial year.

53. Execution of contracts.

(1)All contracts relating to the management and administration of the University shall be expressed to have been made by the Executive Council. The Vice Chancellor shall execute contracts above rupees ten lakhs and the Registrar shall do so in all other cases. All contracts shall be executed with the prior approval of Pro Chancellor.
(2)Nothing herein shall be deemed to prevent the Registrar, with the prior approval of the Pro Chancellor, to delegate some of his contracting powers to the Finance Officer.

Chapter VII
Recruitment and Conditions of Service of Employees

54. Recruitment and conditions of service of employees.

(1)Subject to the provisions of this Act, also officers and employees of the University shall be recruited under a written agreement.
(2)Officers and employees shall hold the posts to which they are recruited as per terms and conditions prescribed in regulations.

55. Preference to persons from Nagaland.

(1)Persons who are ordinarily residents in the State of Nagaland shall be given preference over other in the matter of recruitment to all posts in the University in the State of Nagaland, subject to fulfillment of the qualifications, terms and other conditions of appointment prescribed in regulations.
(2)The Executive Council has a right to relax the qualifications, terms and other conditions of appointment to various posts in the University in favour of persons who are ordinarily residents in the State of Nagaland without grossly compromising merit.

Chapter VIII
Annual Report, Directives and Dissolution

56. Annual Report.

(1)The Annual Report of the University shall be prepared by the Executive Council and approved by the Governing Council. The Annual Report shall be sent to the Chancellor who shall cause it to be laid before the Nagaland Legislative Assembly.
(2)If the University has off-campus in another State or off-shore campus in another country the Annual Reports shall also be sent to the Government of the State or foreign county.

57. Directives by State Government.

(1)The Government of Nagaland has powers to give directives to the University if mismanagement, mal-administration, indiscipline, financial crisis and failure to comply with this Act and regulations made thereunder, come to notice of the Government of Nagaland.
(2)The University shall comply with all the directives given to it by the Government of Nagaland.

58. Dissolution.

(1)If a resolution by the highest decision making body of the Trust is passed for the dissolution of the University or a Bill for repeal of this Act is passed by the Nagaland Legislature Assembly and assented to by the Governor of Nagaland, for gross inability of the University to carry out it s functions in accordance with this Act and regulations made thereunder,r the University shall stand dissolved within one year of the passing of the resolution or the Act:Provided that any such resolution passed by the Trust may be rescinded by it before the expiry of one year from the date of passing of the original resolution.
(2)The dissolution shall not affect the pursuit of courses by students but no further enrollment of students shall take place from the date of passing of the resolution or Act and if for any reason, such continued pursuit of courses by students is not possible, the Trust shall take necessary steps for transferring the studies of students to other institutions organizations or Universities etc. in consultation with UGC etc., or provide reasonable financial compensation in lieu thereof, as may be determined by the Governing Council of the University :
(3)The moneys in the Endowment Fund of the University shall be exclusively applied for the purposes of rehabilitating the students and others affected by the dissolution of the University.
(4)The State Government shall have overriding powers to monitor and ensure the implementation of the provisions in this section and, in case of any failure of the University to discharge its obligations, it shall take over the funds, property and other assets of the University, at any time, for fulfilling the obligations either by itself or by appointing an agency on its behalf.
(5)After all the obligations under this section have been met, the remaining funds, assets and liabilities of the University shall stand transferred to the Trust immediately.

Chapter IX
Regulations

59. Regulations.

(1)All matters relating to the conduct of affairs of the University not expressly provided for in this Act in details shall be provided for in the regulations of the University.
(2)The Executive Council shall make all draft regulations.
(3)While making draft regulations which affect the powers, functions authority and other relating matters of officers, Councils, Committees, Boards, Employees etc., of the University, the Executive Council shall provide an opportunity of being heard to the affected parties.
(4)All draft regulations made by the Executive Council by majority shall have to be approved by the Governing Council by tow thirds majority of members present and voting for coming into effect.
(5)All regulations approved by the Governing Council shall be notified in appropriate form.
(6)A copy of the regulations shall be circulated to all concerned in the University.
(7)A copy of the regulations shall also be sent to the Chancellor, State and foreign Governments concerned.
(8)All regulations as soon as made, shall be laid before the Nagaland Legislative Assembly which may annual or amend the regulations by motions by simple majority within 90 days of laying.
(9)If the regulations are annulled or amended by the Nagaland Legislative Assembly they will be of no effect or of amended effect as the case may be, from the date of passing of the motions for annulment or amendment.

Chapter X
Miscellaneous

60. Accreditation and compliance with laws.

(1)The University shall seek, obtain and retain accreditation from respective national accreditation bodies, for all its courses and programmes of study, as required under the University Grants Commission Act, 1956 and the University Grants Commission (Establishment and Maintenance of Standards in Private Universities) Regulations 2003, as amended from time to time.
(2)The University shall obtain proof permission/recognition from bodies like all India Council of Technical Education, Bar Council of India, Distance Education Council, Dental Council of India Indian Nursing Council Medical Council of India, National Council for Teacher Education, Pharmacy Council of India etc., for its courses and programmes of study.
(3)The University shall also comply with all other laws, rules regulations in force in regard to maintenance of educational and other standards in the University.

61. Acts not invalidated on ground of defect etc.

- No act or proceedings of the University shall be invalidated merely on the ground that a Council, Committee, Board or any other authority of the University has not been duly constituted or there is a vacancy in such Council etc., or on ground of any technical defect or demerit in this Act or regulations made thereunder or on ground of any irregularity in service of notice of meetings etc.

62. Transitory powers.

(1)Until the Councils, Committees Boards etc. and the officers and employees of the University are established or appointed the Vice Chancellor with the assistance of the Registrar, with the prior approval of the Pro Chancellor discharge all the duties under this Act and no action taken by him shall be questioned on ground that the procedure laid down in this Act has not been followed ;Provided that the transitory powers as aforesaid shall be available only for one year from the date of commencement of this Act.

63. Of doubts.

(1)Nothing in this Act shall be construed as transferring from the Trust to the University any right of ownership or possessions, if any held over, or in respect of the institutes established by it other than the University established under this Act.
(2)If any difficulty arises in giving effect to the provisions of this Act, the State Government may, by order make such provisions not inconsistent with the provisions of this Act, as appear to it to be necessary or expedient for removing the difficulties :Provided that no order under sub-section (2) shall be made after the expiration of a period of five years from the commencement of this Act.
(3)Every order made under sub-section (2) shall, as soon as may be, laid before the Nagaland Legislative Assembly which may annul or amend the orders by motions by simple majority within 90 days of laying.
(4)If the orders are annulled or amended by the Nagaland Legislative Assembly, they will be of no effect or be of amended effect, as the case may be, from the date of passing of the motion for annulment or amendment.

64. Protection of acts.

- No suit prosecution or other legal proceedings shall lie against and no damages shall be claimed from the officers, Councils Committees, Boards, Employees and other authorities of the University in respect of anything done or purported to have been done in good faith in pursuance of this Act or any regulation made thereunder.
