Pravidhik Shiksha (Admission Conduct of Examinations and Conferment of Certificates and Diplomas) Regulations, 1992Published vide Notification No. 2900 Pra-Shi-3-271 (B)-91 dated September 30, 1992, Uttar Pradesh Gazette, Part KA, 1-Ka, dated 16 January, 1993In exercise of the power under Section 22 and sub-section (1) of Section 23 of the Uttar Pradesh Pravidhik Shiksha Adhiniyam, 1962 (U.P. Act No. XVII of 1962) the Governor is hereby cancels from the date of publication of this notification the rules and orders issued on the subject relating to the regulation mentioned hereunder and approves and notifies the following regulations made by the Board of Technical Education, Uttar Pradesh in exercise of the powers under Section 23 of the said Act.

Chapter I
Preliminary

1. Short title and commencement.

(1)These Regulations may be called the Uttar Pradesh Pravidhik Shiksha (Admission Conduct of Examinations, and Conferment of Certificate and Diplomas) Regulations, 1992.
(2)They shall come into force from the date of their publication in the Gazette.

2. Definitions.

- In these regulation, unless there is anything repugnant in the subject or context-
(a)'academic year' means the period commencing on the first day of July in a year and ending with the 30th day of June next following;
(b)'Act' means the Uttar Pradesh Pravidhik Shiksha Adhiniyam, 1962;
(c)'head of the Administrative Department' means the Head of the Department under whose administrative control the affiliated institution may be;
(d)'Committee' means the Committee constituted by the Board for the purposes of these regulations;
(e)'Convenor' means a person appointed to convene the meetings;
(f)'Guardian' means the guardian mentioned in an application form for admission of any candidate;
(g)'Principal' means the head of an affiliated institution;
(h)'Private candidate' means a candidate seeking admission, without putting in the requisite number of attendance to an examination conducted by mi institution;
(i)'Regular course of study' means a course of study determined from time to time by the Board;
(j)'Session' means the period for which an institution is open for tuition during the academic year;
(k)'Sessional marks' means the marks allotted for sessional work relating to any examination for the Class or course;
(l)'Schedule' means a schedule appended to these regulations.

Chapter II
Conduct of Examination

3. Admission and Examinations.

(a)The candidates who have studied a course prescribed for diploma or certificate or other academic distinction at an affiliated institution shall have to appear in the examinations to be conducted by the Board for the award of the same.
(b)The examination shall be held twice a year i.e. once in the month of April/May and the other in the month of October/November or on such dates as may be fixed by the Examination Committee as per schedule given below;
(i)Course running on annual basis :
April/May examination shall be for the regular candidates alongwith private candidates. October/November examination shall be held only for the back paper candidates of Final year.
(ii)Course running on semester basis ;
May/June examinations shall be for the regular students of II, IV and VI semesters alongwith private students of all semesters.October/November examination shall be for the regular students I, III and V semesters along with private candidates having back papers of old semester.
(c)The examination shall be held at such centers and on such dates and at such times, as the Board may, from time to time decide. The exact dates of the main examination, except the back paper examination for final year students, shall be notified to all the institution affiliated to the Board, at least one month before the commencement of the examination. The examination shall be held simultaneously in at all centres.
(d)The exact dates and centre of back paper examination for final year students appearing under the annual scheme, and also both the. examinations under semester scheme, shall be notified to all concerned institutions at least fifteen days before the commencement of the examination.

4.

(1)The examination in various subjects may include.-
(i)Theory.
(ii)Practical.
(iii)Term work/sessional.
(iv)Oral.
(v)Project and will include each of the above under separate heads or together as prescribed by the Board in the syllabus and examination scheme.
(2)The oral and practical tests shall be conducted by the examiner appointed by the Board in such manner as the Examination Committee may prescribe, from time to time. The written test shall be by means of question papers and the question papers shall be given simultaneously at every centre at which the examination is being held.

5. Eligibility to appear in Examination.

(1)Every candidate sent up by an affiliated institution for admission to an examination held by the Board shall not later than the prescribed date each year;
(a)Pay the fees prescribed for such examination; and
(b)State the subject or subjects, which he/she offers for the examination as per the existing scheme under which he/ she is eligible as per rules.
(2)No candidates shall be presented for any examination unless the institution has furnished to the Secretary of the Board the following certificates in respect of each candidate-
(a)that his/her admission to the Institution is in accordance with the rules and regulations of the Board,
(b)that he/she has completed a regular course of study throughout, at an affiliated institution,
(c)that he/she has actually performed the experiments and satisfactorily completed his journals, project/design work, etc.
(d)that he/she has secured the minimum pass marks allotted to class work and periodical examinations, i.e. sessional as required under sub-clause (c) of Clause (1) of Regulation 23.
(e)that he/she has attended the classes as required under Regulation 6.
(f)that he/she has cleared off all his/her tuition fee, dues and other outstanding dues in connection with breakages of apparatus, equipment, loss of library books or any other miscellaneous fees or dues.
(g)that he/she has shown satisfactory progress in his/her studies and is of good conduct and character.
(h)that he/she has not been debarred for any period from appearing in an examination held by any Government constituted authority or statutory examining authority in India or by the Board.
(3)The certificate required under clause (a) of sub-regulation (2) shall be furnished at tire time of forwarding the application of the candidates sent up for the examination and certificates required under Clause (b) to (h) of sub-regulation (2) latest by ten days before the commencement of practical examination or theory examination, whichever is earlier in that academic year after counting the attendance as prescribed under Regulation 6 ;Provided that certificates required under Clauses (b) to (h) of sub-regulation (2) in respect of affiliated institutions in the Hills, above the attitude of 1200 meters, where winter vacations be observed, shall be furnished immediately after counting attendance up to three days prior to the commencement of the written or practical examination, whichever is held earlier.
(4)Such cases, where laboratory practicals, term sessional as incomplete by students and the Principal certifies for completion and allows students to appear in examination, shall be reported to Director of Technical Education and/or the Government for further action against the institution.
(5)No candidate who is disallowed from appearing in an examination for not fulfilling conditions specified under Clauses (b) to (h) of sub-regulation (2) shall be permitted to appear in that examination, unless he / she fulfills at all the conditions afresh.
(6)Notwithstanding the acceptance of application form and fee and allotment of roll number by the Board, the performance/Results of applicant at the examination will be cancelled, if it is later on found that the applicant was not eligible for admission to said year/semester and for admission to said examination. Further, Principal shall be liable to disciplinary action by the Director/Government for certification of the applicant.
(7)Notwithstanding the forwarding of an application, payment of examination fees and allotment of roll number for examination by the Board, the Principal shall be competent to withdraw applications of those candidates who fail to fulfill any of the conditions of relevant Regulation.

6. Attendance.

(1)An affiliated institution shall remain open during each session for the period prescribed under Regulation 18 including examination and extra-curricular activities.
(2)No candidate shall be presented for the Final Secretary Technical Certificate Examination unless he has put in at least 75 per cent attendance;Provided that the Principal on being satisfied that the candidate. remained absent due to illness or could not attend the classes for reasons completely beyond his control, may condone the shortage in attendance up to five per cent.
(3)Without prejudice to the provisions of sub-regulation (2), no candidate of any year/semester or Diploma/Post Diploma/P.C. Diploma, shall be presented for, any examination unless his attendance has been at least 75 per cent in each requirement including tutorials, laboratory work, drawing office, workshop, field work or studio in the relevant year of study provided that-
(i)the Principal, on being satisfied that the candidate, remained absent due to illness or could not attend the classes for reasons completely beyond his control may condone shortage in attendance up to five per cent in each requirement.
(ii)The calculation of percentage of attendance in each case shall be made by dividing the number of all periods attended by the number of periods actually to be attended under sub-regulation (4) and multiplying the fraction so at by 100.
(4)The attendance in any institution to which these regulations apply shall be counted in the manner hereinafter provided from the date of commencement of the session as specified in Regulation 18, up to March 31, of the academic session each year and in the case of affiliated institutions of hills above the attitude of 1200 meters where winter vacation may be observed shall be counted up to date three days prior to the commencement of the written examination;Provided that the attendance put in by any candidate in a particular class at an affiliated institution from which he/she has since then migrated under the authority of the Director of Technical Education with the concurrence of the respective head of department shall be counted for purposes of calculation of attendance in that particulars, at the institution, at which he subsequently studies;Provided secondly that the attendance of a candidate who seeks admission either as a fresh candidate in first or second or third or final year class/first or second or third or fourth or fifth or sixth semester to a diploma course (other than Secondary Technical Certificate Course) or as a repeater in first or second or third or final year class/first or second or third or fourth or fifth or sixth semester under Regulation 22 shall also be counted from the date of commencement of the session/semester;Provided thirdly that the attendance in cases of candidates, whose withheld results are released subsequently shall be counted from the date of joining or the 15th day from the date of release of their withheld result, whichever is earlier.
(5)Attendance of a candidate shall be counted only for a period attended by his/her provided that a candidate shall be allowed attendance for the period not exceeding seven days in a session during which he/she is sent for participation in extra-curricular activities representing his/her institution by the orders of the Principal;Provided that the period exceeds seven days, permission from the Director, shall be obtained by the Principal;Provided further that no attendance shall be marked for the period, during which an educational tour is organised by the institution for all the students of that class.
(6)Notwithstanding anything contained in this regulation, the Board may, under special circumstances, further condone the deficiency in the prescribed attendance up to 10 per cent over the above 5 per cent condonation granted by the head of the Institution, in accordance with the provision of sub-regulations (2) and (3):Provided that such condonation shall be extended for a particular institution/institutions under some abnormal circumstance and the director shall initiate and make a reference to the Board for condoning the deficiency in the prescribed attendance over and above the condonation granted by the Principal.

7. N.C.C./Physical training/games/model making/discipline.

(1)Every student studying in an affiliated institution shall be required to opt one of the four extra-curricular activities i.e. N.C.C./Physical training/Games/Model Making marks shall be allotted for extracurricular activities and discipline separately;Provided that the guiding principle in allotment of marks in extracurricular activities and discipline should be in the ratio of 2 : 3 so opted;Provided further that this is subject to any further change, that may be made by the Board, from time to time :Further also that in the case of Part Time Course however, 100 per cent marks will be allotted for discipline as they do not get time for N.C.C./Physical Training/Games/Model making;
(i)Head of Institution will award marks to students according to their actual performance in the extra-curricular activities so opted;
(ii)The marks for discipline shall be awarded at the end of the practical and theory examination by the Principal in consultation with the Head of the Department and the members of the Faculty of that branch, provided the appease of any dispute in award of marks the Principal shall form a cumulates of at least three members of faculty of that branch in which dispute has occurred and shall award marks as recommended by the Committee to which the candidate belongs.
(iii)Where a substantial education of discipline marks for a Regular student is being made, reason for such deduction shall be recorded and preserved up to six months after the declaration of the result of Final Diploma Examination.
(iv)Marks for discipline already awarded to private candidates in the previous years/(5) semesters (5) of their being a regular student, can be received depending upon his/her behaviour in the ensuing examination as well during the relevant academic session of which he/she is an examinee;
Provided that in case of a reduction in marks of discipline already awarded, Principal/Centre Superintendent in consultation with the Head of Department/Assistant Centre Superintendent/Invigilator/Teachers shall review the marks and communicate it to the Board for recorded reasons thereto.

8. Change of course.

(1)Change of course in engineering branches other than pharmacy course and such other courses where the change of course is not allowed due to curriculum and admission qualification requirement may be allowed to the students already admitted in the first year in any one of the affiliated institutions through the Joint Entrance Examination Council, strictly on the basis of merit obtained in the ensuing qualifying entrance examination.
(2)Change in course to the student admitted in branches, other than those through the Joint Entrance Examination, shall be allowed through Director of Technical Education strictly on the basis of merit obtained in the qualifying entrance test held for those common branches.
(3)Change in course to the students admitted in branches other than the sub-regulations (1) and (2) above i.e. through merit, calculation of which has decided by the Board, from time to time and on the basis of last qualifying examination shall be allowed to avail the opportunity of a choice to join the course wherein the admission is strictly on the same basis of merit calculation.
(4)No enter change of course shall be permitted to students admitted under the sub-regulations (1), (2) and (3) above and also to the candidates whose courses of study and admission qualification is not common.
(5)No change of course shall be permissible after a candidate, admitted in the first year class, has filled up his form for admission to the Boards examination and the same has been received in the Boards Office.

9. Admission to an affiliated institution.

(1)
(a)Admission to the First year classes under annual/ semester basis of the courses specified, for which the Council of Joint Entrance Examination holds the entrance test, shall be completed by 70th day of the date of entrance test.
(b)Admission to the First year classes for the courses under annual semester basis other than specified in above shall be completed by 15th of July each year.
(c)The admission to First year classes in no case shall be made in any affiliated institution, after 31st August each year.
(d)The minimum eligibility for admission to a class, shall be regulated as per Regulation 10.
(e)A candidate after having taken admission in first year of any of courses through Joint Entrance Examination or through any other mode prescribed by Board of Director, shall have to seek admission against through the same mode, if he/she does not prosecute his/her studies in that session/semester and abstains from the institution for more than two months from the date of admission continuously in that session/ semester.
(2)Subject to the provisions of Regulation 12 admissions shall be made by Principals of the affiliated institutions, but a candidate who does not possess the qualifications prescribed under these regulations, may not be permitted to appear in the Boards Examination even though he/she may have been admitted in the institution.
(3)Seats for candidates belonging to Scheduled Castes and other shall be reserved as per Government orders issued from time to time. If the required number of student(s) be not available in the categories as reserved by Government against their respective quota, the reserved seats thus falling vacant will be treated as unreserved and filled up on the basis of merit from the list of qualified candidates by the permission of the Board.
(4)The admission to the Part Time Courses shall be governed by the following conditions :
(i)The admission to the Part Time Course shall be held at the institutions, where the facilities for running a regular course in the concerned branch is existing. No institution, shall start a Part Time Course without the permission of the Board, and only on the recommendations received through the Director.
(ii)The admission to the Part Time Course shall be restricted to the regular in service bona fide employees, of any of the following concerns only :
(a)Industry registered under Factory Act.
(b)Technical Institutions.
(c)State Government/Corporations/Undertakings.
(d)Central Government/Corporations/Undertakings.
(e)Local Body.
(f)Government Department:
Provided that an employee seeking admission to the Part Time Course is engaged in the technical field in one of the above concerns.
(iii)Experience-Further an employee seeking admission to Part Time Course shall essentially be engaged at the time of admission in the service as referred to in sub-para (i) above for the last two years.
Calculation of two years experience in service as above shall be calculated on June 30 of the calendar year of the admission :Provided that the experience obtained after attaining the minimum eligible educational qualification, shall only be counted.The period of training in Industrial Training Institute having passed minimum educational qualification shall be counted towards experience.
(iv)The certificate in support of the conditions laid down in Clauses (ii) and (iii) above shall be acceptable only, if the same issued by the employer.
(5)
(a)Direct admission II or III Final year classes of a course under annual basis by promotion shall not be permitted except that a candidate has studied at any of the affiliated institutions and has passed I/II/III 3'ear annual examination, as the case may be, conducted by the Board, provided he/she is eligible of admission under Regulation 25 and permitted for transfer under Regulation 17 :
Provided that the admission to the next higher class in II/III/IV Final year shall be made provisionally on the start of academic session or 3rd Monday of July each year, whichever is earlier without waiting for the results of preceding year. The admission, however, shall be ratified only after the declaration of the results of the examination of the concerned previous class :Provided further that a candidate shall not have a claim to the provisional admission, if he/she fails and does not satisfy the relevant regulation for promotion to the next higher class.
(b)Direct admission to II/IV /VI or III/ V semester of a course under the semester basis by promotion shall be made provisionally on or after the tenth day but not later than 15th day of completion of the previous examination without waiting for results. The admission shall be ratified only after the declaration of results of the concerned previous class :
Provided that a candidate shall not have a claim to the provisional admission; if he/she fails and does not satisfy the relevant regulation for promotion to next higher semester,
(c)The students of all classes/semesters promoted and admitted to next higher class/semester after completion of examination conducted as per Clauses (a) and (b) above their attendance for next higher class/ semester shall be counted, irrespective of declaration of result of previous class/semester, from the date of start of their session/ semester, the schedule of which is approved by the Board.
(6)Promotion to higher Class/semester shall be made on the following conditions :
(a)For courses run on an annual basis for duration of three years or more-A candidate will be allowed to join 2nd or 3rd or 4th year class, as the case may be, only after he/she has passed all the subjects prescribed in first year and second year/third year respectively or is allowed to keep term as under Regulation 18.
(b)For courses run on semester basis-A candidate will be allowed to join V or VI semester only after he/she has passed all the subjects prescribed in the first and second semester respectively.

10. Minimum qualification.

- A candidate seeking admission to the first year class in any of the Certificate Diploma or Post Diploma or P.G. Diploma course in various Technological/Engineering branches or other courses shall have the minimum qualification as prescribed by the Board, from time to time, subject to the following explanation. The minimum qualification prescribed for admission by the Board at present are given in Schedule IV.Explanation - (a) A candidate having passed Higher Secondary Examination from any examining body, declared equivalent to under the rule framed under the Intermediate Education Act, 1921, and as amended from time to time for the purpose of enabling his/her to enter into the course of study permitted for the Intermediate Examination of Board of High School and Intermediate Education, U.P. Allahabad shall be deemed equivalent to High School Examination of the Board of High School and Intermediate Education, U.P. Allahabad for purpose of admission.Any other examination at the Intermediate stages of Secondary, Boards even though recognised by the Board of High School and Intermediate Education, U.P., Allahabad under the said Act, shall need reference to the Board of Technical Education for admission to the Diploma Certificate courses.
(b)A candidate having passed 10th Class of 10+2 examination from a Board and recognised equivalent to High School or 10th class of 10+2 scheme under Intermediate Education Act, 1921 as amended from time to time, shall be deemed equivalent for purpose of admission to Diploma courses.
(ii)Science includes General Science and Physical Science.
(iii)Pre-University Examination with Science and Mathematics passed after High School, if it is a public examination shall only be deemed to be at per with High School.
(iv)B.Sc. Part I Examination with Physics, Chemistry and Mathematics of a three year degree-course, if it is a public examination shall be deemed to be at per with Intermediate with Physics, Chemistry and Mathematics.
(v)The grade marks, which are awarded to a candidate under the rules of any particular examining body to make him eligible for a pass either in subject or in aggregate six all not be added in aggregate or calculating the percentage of marks in aggregate for admission.
(vi)Pre-Engineering Examination after Higher Secondary Examination with Physics, Chemistry and Mathematics. If it is a public examination shall be considered at per with an Intermediate with Physics, Chemistry and Mathematics.
(vii)A candidate who did not offer Science or Mathematic or both at the qualifying examination but passed the same higher examination offering the required subjects as prescribed, shall also be eligible for admission.
(viii)In regard to a candidate who passed the qualifying or higher examination as departmental candidate with the same subject as prescribed, the percentage of marks shall be calculated as follows :
'The marks obtained by such a candidate at the Supplementary Examination be added to the marks obtained by him at the main examination after excluding the marks obtained in the subject in which he /she once had been declared eligible for supplementary Examination. The aggregate thus obtained be considered for working out the percentage."
(ix)The proof of minimum eligible educational qualification required for any of the courses under the Board shall have to be submitted to the Principal of the concerned affiliated institution not later than the last date(s) prescribed by the institution for seeking the admission by a candidate and in any case not later than 31st August of each year.

11. Age limit for admission.

(1)For all the Diploma and Certificate other than Secondary Technical Certificate and part time course the age of the candidate on and inclusive of June 30 of the calendar year of the admission, should not be less than 14 years and more than 22 years, except in the case of Scheduled Castes and Scheduled Tribes candidates in whose cases the upper age limit shall be relaxable by 3 years.Upper age limit shall be further relaxable without any limit, in case of candidates sponsored by the Industry and seeking admission in regular courses by the Examination Committee. Such cases shall be forwarded by the Head of the Institution with supporting evidence from the candidate with his definite recommendation.
(2)There shall be no upper age limit for girl candidates: Provided that there shall be no upper age limit for the candidate for part time Diploma Course or in the regular Post Diploma Courses in various branches.
(3)The minimum age for admission to the part time courses shall not be less than 21 years on and inclusive of June 30, of the calendar year of admission.
(4)Candidate must be physically fit to undergo the prescribed course of study.

12.

Candidates for admission in the First Year Class of the Secondary Technical Certificate Course should-
(1)have passed Junior. High School Examination of VIII class of the Institution recognised by the Board of High School and Intermediate Education, U.P., Allahabad or an examination recognised by the Board of High School and Intermediate Education, U.P., Allahabad or an examination recognised by the Board of High School and Intermediate Education, U.P., Allahabad as equivalent thereto with Hindi, English and Mathematics;
(2)be not less than 13 years or more than 20 years of age on ends inclusive of June 30 of the calendar year of admission;Provided that the upper age limit prescribed above in the case of Scheduled Castes and Scheduled Tribes candidates shall be relaxable by three years :Provided further that in the case of other deserving candidates the upper age limit may be relax up to 2 years by the Principal.
(3)be physically fit to undergo the training.

13. Sanctioned seats.

(1)The number of seats in each class/ semester and course shall be fixed by the Board.
(2)The sanctioned seats in First Year Class/First semester may be increased up to 10 per cent to accommodate repeaters in any particular course. Fresh admission shall be restricted to such extent as shall accommodate those repeaters who seek admission and are eligible for the purpose :Provided that the Director, may order such increase of seats as may be found necessary to regularise any admission and intimation thereof shall be sent to the Board within a week.
(3)In case of Second/Third/Final year class/First or second or third or fourth or fifth semester no increase in sanctioned seats shall be permitted :Provided that all the repeaters of this class/semester as are eligible for readmission under these regulations and the student promoted from the lower class shall be offered a seat even though, it may exceed the number of sanctioned seats.
(4)The seats which may be required for the nominees of the Government, of India under Colambo Plan or other similar admissions shall not be counted under sub-regulations (2) and (3) and shall be over and above the limit prescribed therein.
(5)The admission to the Part Time courses to be run in an institution, shall be on the following conditions :'The maximum number of admissions in the First Year Part Time Courses in an institution shall not be more than 60 seats or 25 per cent of the total intake taking together of the particular courses in which the admissions are to be made. However, 10 per cent increase is admissible keeping in view the drop out cases :Provided that the number of candidates admitted in any branch of the courses shall not exceed the sanctioned intake for regular courses in that particular branch, in case the sanctioned intake for the regular course in that particular branch is less than 60.
(6)Admission to First year of all courses shall be made strictly on the basis prescribed under rule and shall be subject to the provisions made by the State/Central Government in respect of reservations for seats for different categories, from time to lime. For the present the reservation for different categories will be as per Schedule V.

14. Secondary technical certificate course promotion.

- Promotion from First year to Second year and from Second year to Final year in respect of Secondary Technical Certificate course shall be made and announced by the Principal in accordance with the following conditions :
(a)No candidate shall be presented for First Year or Second Year Examination unless he has put in 75 per cent attendance: Provided that the Principal may on genuine grounds condone shortage wherever he is satisfied up to 5 per cent :
Provided further that the calculation of attendance shall be made from the date of commencement of the session to a date of three weeks prior to the date of theory examination.
(b)The medium of examination in all subjects except English language shall be Hindi.
(c)No candidate shall be declared to have passed the First or Second Year Examination, unless he obtains :
(i)at least 33 per cent marks in each subject of Group 'A' : Provided that in the Science (Physics and Chemistry) subject student will have to secure the minimum pass marks in theory and practical separately as prescribed by the Board of High School and Intermediate Education, Uttar Pradesh, Allahabad;
(ii)not less than 33 per cent marks in aggregate in Group 'A';
(iii)at least 50 per cent marks in each theory subject (including sessionals) in Group 'B';
(iv)at least 60 per cent marks in each practical (including sessionals) in Group B';
(v)not less than 45 per cent marks in aggregate of all the theory, praeticals and sessionals of Group 'A' and Group 'B' together and including Disciplinary/N.C.C. game marks.
(d)The Director of Technical Education, Uttar Pradesh may for reasons to be recorded in writing relax any of the above conditions in deserving cases and intimation thereof shall be sent to the Board Within a week.
(e)The decision of the Principal of the Secondary Technical Education regarding the promotion of students from First or Second Year shall be announced latest by the end of June each year and shall subject to the provisions of sub-clause (d) be final.
Group 'A'All subjects prescribed for High School (Science Group) Examinations by the Board of High School and Intermediate Education, Uttar Pradesh, Allahabad namely :
(i)Hindi,
(ii)English,
(iii)Mathematics,
(iv)Science,
Group 'B'All subjects prescribed for Industrial Training Institute Examination by the National Council for Training in Vocational Trades, Government of India for a particular trade except 'Workshop Calculation and Science' which has been replaced by the subject 'Rural Technology' with effect from Board Examination, 1981, namely :
(i)Trade Theory.
(ii)Trade Practical.
(iii)Workshop Calculation and Science.
(iv)Engineering Drawing.
Eligibility of regular candidate to appear at the Boards Examination subject to the provisions of regulations.

15. Courses running on annual basis.

(1)Candidate for the First Year Annual Examination of Diploma or Certificate Course shall be required to have fulfilled the minimum educational qualification prescribed therefor under these regulations and to have attended an Engineering or the Technological Institution affiliated to the Board for a period of not less than one session.
(2)Candidates for the Second Year Annual Examination of Diploma or Certificate Course shall be required to have passed the First Year Annual Examination conducted by the Board and to have attended anEngineering or Technological Institution affiliated to the Board for a period of not less than one session thereafter.
(3)In the case of Part Time Diploma Course having a duration of Four Years, candidate for the Third Year Annual Examination shall be required to have passed the Second Year Annual Examination conducted by the Board and to have attended an Engineering or Technological Institutions affiliated to the Board for a period of not less than one session thereafter.
(4)Candidate for the Final Examination of Diploma Course shall be required to have passed the First or Second Year or Third Year Annual Examination, as the case may be, conducted by the Board and to have attended an Engineering or Technological Institution affiliated to the Board for a period of not less than one session thereafter.
(5)Candidate for the Final Secondary Technical Certificate Examination shall be required to passed the educational qualification prescribed thereafter. They shall also be required to have passed the Second Year Annual Examination conducted by a Secondary Technical School affiliated to the Board and attended Secondary Technical School affiliated to the Board for a period of not less than one session thereafter.
(6)Candidate for the First Examination of the Post Diploma Course must have attained the requisite qualification as prescribed by the Board, from time to time, and to have attended an Engineering Institution affiliated to the Board in that course for period of not less than one session thereafter.

16. Back paper.

(1)The candidate of diploma/post, diploma/post graduate diploma course shall be allowed to keep term with Back Paper provided that he/she fails in not more than two requirements of theory and/or practical.
(2)A candidate even if he has failed in no more than the requirements given in Clause (1) as the case may be he/she shall be allowed to keep term and promoted to next higher class/semester provided that-
(i)he/she has secured 45 per cent in aggregate and has passed in sessional work.
(ii)he/she fulfills the conditions of sub-regulation (6) of Regulation 9.
(3)A.T.N.T. (Allowed to keep term) candidates belonging shall be promoted to the next higher class and he/she should appear at the ensuing entire examination of the next higher class. In the case of Final Year Class, however, candidates declared eligible for 'Back Paper' shall appear at the ensuing Special Back Paper Examination conducted by the Board, and unless they clearly pass in such Back Paper(s) Diploma shall not be awarded to them.
(4)The number of Back Papers in any class/semester shall not exceed the limits of Back Papers, as the case may be, as given in sub-regulation (1) above :Provided that the candidates to be promoted to Final Year class may have one or two Back Papers of First Year two or one Back Papers of Second Year respectively. But in no case he/she shall have more than two Back Papers of First Year, Second Year and, not exceeding the eligibility limit given in sub-regulation (1) above :Provided further that candidates belonging to Third Year or Four Years part time/regular course shall also not be entitled to have more than two back papers of First Year or Second Year in case of final year of Four Years part time/regular course, not more than two Back Papers of First/Second/Third year shall be allowed with that of Third year in such a way that the total of Back Papers allowed does not exceed the eligibility limit of Back Papers given in sub-regulation (1).
(5)Candidates who pass their Final Year Examination after clearing 'Back Papers' shall be awarded the division on the basis of the aggregate of the original Annual Examination at which they appeared and were declared eligible for 'Back Papers'. In their diploma the words under sub-regulation 16 shall be written.
(a)Explanation-When a candidate appears at the ensuing Annual Examination of the next higher class with Back Paper(s) of the proceeding lower class :
(i)the Back Paper(s) shall be considered as part of the next higher class for the award of grace mark under Regulation 24. But no grace marks shall be awarded if a candidate appears only in Back Paper(s) as the case may be. In such case he shall have to obtain the minimum pass marks prescribed for the respective theory/practical examination;
(ii)he shall not be required to appear again in the Back Papers in which he obtains the minimum pass marks prescribed for the respective theory/practical, even if he fails at the ensuing examination of the next higher class.
(b)The Back Paper(s) shall he considered as one requirement for the provision of this regulation i.e., the number of requirements including the Back Papers of the proceeding lower class and the entire theory Papers and praeticals of the next higher class, shall not exceed more than that given in sub-regulation (1) above.
(c)If a candidate of the Final Year Examination, earns the privilege of Back Papers and is otherwise eligible to appear at the lull examination under Regulation 22 or 25 he may have the opinion of appearing either in the Back Papers only or at the full examination, his result of the full examination as under rules shall be declared.
(d)The candidates, who have opted for full examination and have exercised the opinion, shall not allowed to opt again. He/she have to undergo the same method to at the examination.
(6)Final Year students, who have to appear in Back Papers only-
(i)shall also be subject to the limit of number of change as given in Regulation 22; and
(ii)also have to appear in the subjects as per the existing scheme so as per Regulation 25, in case there is a chance in the syllabus; or
(iii)have to appear in the subject, equivalent thereof, and decided by the Board.
(7)The candidates of the Diploma in (AME) Aircraft Maintenance Engineering Course shall be allowed to keep term promoted to next semester provided that he/ she does not carry more than one theory requirement/subject to next semester.
(8)The candidates, who have appeared in the annual explanation, should only be allowed to appear in the ensuring special Back Paper Examination.

17.

(1)Subject to the conditions given below, a student of Second, Third and Fourth Year as the case may be, may seek transfer from one , affiliated institution to another affiliated institution imparting education in the same course of study, which such student was pursuing as the former institution :
(a)In case of those candidates admitted through Entrance Examination, the Council of Joint Entrance Examination shall only decide transfer of institution on merit basis. This benefit shall be given only in the year the candidate was declared for the admission.
(b)In case of those candidates who are admitted on merit basis at the individual institution level, will not be generally transferred.
(c)In case of second, third and final year students, the Principal of Institution shall obtain applications from the students desertions of institution transfer within seven days after the last date of admission. Such students may give three names of institution in order of preference. Such applications shall be forwarded to the Directorate of Technical Education after filling up the marks obtained by the students in the previous years and number of seats vacant in different branches within one week from aforesaid date. The students declared pass with Back Paper, shall not be eligible for transfer of institution ;
(d)Provided there should be a seat vacant in the affiliated institution to which he /she intends to migrate.
(e)No students shall be allowed to be transfer after November 15 ; of the academic session.
(2)No relaxation in respect of attendance and sessional marks as also the last dates referred to in Schedule II shall be allowed to the students migrating under this regulation.
(3)The attendance put in by such a student at the former affiliated institution in each subject or practical and the sessional marks obtained thereon shall be counted for the purpose of calculating the total attendance and the sessional marks during the session.
(4)The Transfer Certificate referred to in sub-regulation (1) shall contain the attendance put in by the student in each subject theory, practical and the sessional marks obtained thereon till the date of his leaving the institution.
(5)The Principal of the institution to which the student seeks transfer, shall obtain a true copy of the Transfer Certificate from Principal of the institution from which the student is transferred and the later shall send it as early as possible, but not later than 15th day of issue of Transfer Certificate.
(6)The authority granting permission to student to transfer under the regulation shall also send a copy of such permission to the Secretary of the Board.

18. Session.

(1)The session at the Engineering or Technological institutions affiliated to the Board shall be as follows:
(a)For courses running on Annual Basis-
(i)For the First Year Class:
From the 30 day of declaration of results of entrance examination to May 31 of year next following-
(ii)From the 20th day of declaration of entrance test/merit list for the courses other than under the perview of Joint Entrance Examination Council, to the May 31 of the year next following.
(iii)For Second Year, Third Year in the case of four years (Part time courses) and Final Year Classes or Post Diploma or for the students whose results are declared in accordance with Rule 28 from the 15th day of the declaration of results of I/II/III year classes by the Board of Technical Education, U.P., Lucknow to May 31 of the year next following :
Provided that in a session, an institution is required to complete 24 weeks of study.
(b)For Courses running on Semester Basis :
(i)For I, III and V Semester-From 1st July to 15th November of a calendar year.
(ii)For II, III and V Semester-From 11th day after the completion of examination of I/III/V. Semester or 10th December each year: provided that in each semester an institution is required to complete 12 weeks of training.
(2)The administrative department, however, if required may complete the necessary weeks of training by keeping the institution open on day of holidays/vocation in order to complete the training prior upto 7 days of commencement of examination :Provided that atleast 7 days shall be given to the students for preparation of examination in each session/semester :Provided further that beyond the regular periods of training and extra-curricular activities in a day, the periods of zero hours allotted, if required and if possible, may be calculated towards the requirement of completion of the required seek of training. The principal of the institution in such cases, shall seek permission of Director and the copy of such permission, if accorded should also be intimated to Board.
(3)
(a)Ordinarily no admission in the First Year semester in an affiliated institution shall be alter the commencement of the academic session. However in exceptional cases this may be extended upto 45th day of declaration of the results by Joint Entrance Examination Council, U.P. at Lucknow or entrance test or merit list declared by an institution, so the case may be, in accordance with Regulation 9.
(b)No candidate, who is failure and is, otherwise, eligible for readmission in First Year Class Semester shall have claim to his seat unless he reports himself in person or in writing to Principal of the affiliated institution last attended before the start of the session and deposits the prescribed fee, but not later than the last date prescribed admission of regular students.
(4)The students of all semester/classes shall be promoted to the next higher semester, class after completion of examination conducted as per clause of sub-regulation (3) above and their attendance for next higher class shall be counted from the date of commencement of that session, schedule of which to be approved by the competent authority.

19. Sessional marks.

(1)Sessional work being a paper prerequisite to the training as per Regulation 4 its marks shall without prejudice to anything contained in these regulation be awarded and communicated to the Board in the manner the Board may, from time to time prescribe.
(2)Sessional marks shall be awarded in the individual subject, theory or practical or project and communicated to the Board out of the total marks allotted to such subjects, theory or practical :Provided that this regulation shall not be applicable to the Secondary Technical Certificate Course :Provided further that sessional marks are being awarded on the basis of actual class work and attendance as a prerequisite of curriculum of courses of that class in order to appear in an examination under Regulations 4, 5, 6, and other relevant, as such candidate, without undergoing the term work and having obtained pass in individual subjects of that class towards sessionals, shall not be awarded any Diploma Certificate.
(3)A candidate who falls to secure at least 50 per cent of the sessional marks allotted to a subject, theory or practical or project, shall not be allowed to appear in the Board's Examination.Note - Guardians of Candidates are advised to keep in touch with the principal of an affiliated Institution to ascertain the progress of their awards in sessional work. No student or guardian shall have any right to question the awards or detention under sub-regulation (3) on the ground that no communication was made to the students or guardian concerned.
(4)Sessional marks shall not be added to the marks obtained in any subject in any examination conducted by the Board, but shall directly be added to the grand total or aggregate and considered for division :Provided that this regulation shall not be applicable to the Secondary Technical Certificate.
(5)Sessional marks shall be communicated to the Board in whole numbers. When the sessional marks obtained by any candidate involve fractions, they shall be rounded of the next higher number e.g. from 10 ½ to 11.
(6)For determining the minimum pass marks in sessional work based on 50 per cent, the fraction, if any, shall be dropped by reducing the figure to the proceeding whole number e.g. from 12-½ to 12 where the maximum is 25.

20. Carry over.

(1)In the Scheme of examination for Diploma Courses under annual basis other than one Year Post-Diploma Courses and Secondary Technical Certificate Examination provision for carry over of marks to final year class shall be to the following extent:
(a)In the case of a Three year course 30 per cent of the aggregate of First year and 70 per cent of the aggregate of Second year.
(b)In case of Two years course 50 per cent of First year.
(c)In case of Four years course and Four year Part Time course 30 per cent of the aggregate of First year, 30 per cent of the aggregate of Second year and 70 per cent of the aggregate of Third year.
(2)The 30 per cent or 70 per cent of the aggregate of First or Second Year Annual Examination as the case may be, conducted by the Board be drawn in whole numbers by increasing the fraction, if any, to the next whole number.
(3)The carry over of marks under Clauses (i) and (ii) above shall be made in respect of those examinations, only which have been conducted b}' the Board from 1960 onward.
(4)No carry over of marks shall be allowed to any candidate appearing in a different examination in another branch under Regulation 28.
(5)In the scheme of examination for diploma courses under semester basis, the provision for carry over of marks to First year classes shall be to the following extent
(i)50 per cent of aggregate of I and II's semester.
(ii)100 per cent of the aggregate of III, IV and V semester. Provided that for Diploma Course in Aeronautical Maintenance Engineering the carry over shall be applicable as prescribed by the Board, from time to time, as per requirement of DGCA

21. Medium of instruction and examination.

- The medium of instruction and examination for all courses shall be Hindi except that the medium of instruction and examination for General English shall be English. The Technical Terms may however, be retained in English. The student will, however, have the option of answering the question papers either in Hindi or in English.

22. Number of chances.

- Chances as detailed below shall be admissible for passing out the Diploma, Post-Diploma, Post-Graduate Diploma and Certificate Courses :
(i)A candidate shall be allowed only three chances (including regular and private both) to pass the First/Second/Third year Examination and Final Year Examination.
(ii)A candidate shall be allowed only one chances to appear as a regular candidate to pass the First/Second/Third/Final Year Examination (except A.M.B.) Courses:
Provided that at the most two more regular chance as per exception provided for under Regulation 25(1) to appear as regular candidate shall be allowed only when-
(a)a candidate had been detained in any class on account of shortage in attendance for having failed to secure the minimum pass marks in sessionals;
(b)the examination of a candidate has been cancelled under Regulation 29 for having used unfair means at any examination and wishes to seek re-admission, however, in case of private student his/her sessionals of previous year shall be carried forward;
(c)a candidate had been unable to appear in the examination partially or fully due to illness or other genuine cause beyond his control;
(d)there is a change of syllabus, a candidate will have to seek re-admission in the class in which he/she was declared unsuccessful.
(iii)A chance shall be counted if the name of candidate continues on the rolls of an affiliated institution beyond 31st December of the calendar year in which he joins the institutes irrespective of the fact whether he had appeared in the examination or not (including cases of detention on account of shortage of attendance or failure to obtain 50 per cent marks in sessionals work or cancellation of an examination for having used unfair means). Provided that the appearance as a private candidate under Regulation 25 shall be counted as a chance and that such chance are availed in consecutive succession without any gap.
(iv)A candidate shall have to maintain the continuity of the course and in no circumstances a gap or a break in taking up his due chance, shall exceed two years in any case whatsoever. In the case of the failure of the Final years class however the gap/break shall not exceed three years :
Provided that in case of a girl candidate who for unavoidable circumstances has left her studies in between and if he/she wishes to complete her course of studies, subsequently, shall be allowed to continue her studies under special circumstances subject to the conditions that-
(a)the girl candidate concerned has passed her previous year examination;
(b)the gap /break in the study shall not exceed more than six years;
(c)in case of major revision of syllabi, such candidate shall have to attend the special classes to complete revised syllabi after which only she shall be eligible to appear in the coming examination;
(d)The concerned girl candidate has not been found guilty of indiscipline during her period of study in the institution;
(v)If a student gets re-appear he/she has the option to appear in the examination privately or as a regular student but when once he/she joins as a regular student, he/she shall, not be allowed to appear as a private candidate.
(in)A candidate undergoing the A.M.E. course shall be allowed only one more chance to appear as a regular candidate to para I/II/III/IV /V semester as per specific requirement of the course :
Provided that the candidates declared as failed in second chance also, shall not be allowed any more chance.

23. Minimum percentage.

(1)A candidate appearing in Diploma or Certificate Examination other than Final Pharmacy Examination and the Final Secondary Technical Certificate Examination shall be declared to have passed an examination, if he/she obtains-
(a)not less than 33 per cent marks in written examination in each theory subjects;
(b)not less than 40 per cent marks in each of the practical examination;
(c)not less than 50 per cent sessional marks in each subject, theory/practical/project;
(d)not less than 45 per cent marks in the aggregate.
(2)A successful candidate in the Final Diploma or Certificate Examination other than Final Secondary Technical Certificate Examination who obtains atleast:
(a)Sixty-six per cent of the total marks in the aggregate shall be placed in the First Division.
(b)Forty-five per cent of the total marks but less than 66 per cent of the total marks in the aggregate shall be placed in the Second Division.
(c)A successful candidate of the Final Diploma or Certificate/ Special Back Paper Examination shall be awarded division on the basis of his aggregate obtained at the preceding Annual Examination.
(d)A candidate getting 80 per cent or above in the aggregate shall be awarded 'Honours'.
(3)A successful candidate at the first or Second Year Annual or Special Back Paper Examination shall only be declared passed.
(4)A candidate appearing at the Final Secondary Technical Certificate Examination shall be declared to have passed the Examination if he/she obtains-
(a)at least 33 per cent marks in each subject Group 'A';
Provided that in the Science (Physics and Chemistry) subject the student will have to secure the minimum pass marks in theory and praeticals separately as prescribed by the Board of High School and Intermediate Education, U.P., Allahabad.
(b)not less than 33 per cent marks in aggregate, to Group 'A';
(c)at least 60 per cent marks in each practical (including sessionals in Group 'B';
(d)not less than 45 per cent marks in aggregate of all the theory, praeticals and sessional of group 'A' and 'B' together and including discipline/N.C.C./Games marks.
(5)Successful candidates in the Final Secondary Technical Certificate Examination obtaining :
(a)Sixty-six per cent of the total marks in aggregate shall be placed in the First Division;
(b)Forty-five per cent of the total marks but less than 66 per cent of the total marks in aggregate shall be placed in the Second Division;
(c)Successful candidates of Final Secondary Technical Certificate, Special Back Paper Examination shall be awarded division on the basis of the aggregate obtained at the preceding Annual Examination.
(d)Candidates getting 75 per cent or above in a theory subject shall be awarded at distinction in the theory subject.
(6)A candidate appearing in the Diploma Pharmacy Examination shall be declared to have passed an examination, if he/ she obtains :
(a)At least 33 per cent marks in English and at least 40 per cent marks in each of the remaining subjects separately in the written tests (including sessional records) and at least 45 per cent in the practical tests (including sessional records) in such subject.
(b)The candidate securing 75 per cent or above in any subject or subjects shall be declared to obtain distinction in that subject or those subjects provided he passes in all the subjects in the same examination.
(7)A candidate appearing in Diploma in Air Craft Maintenance Engineering Course-
(i)has to appear in each of theory and practical subjects and has to pass each requirement separately;
(ii)The theory subjects shall contain one section of objective type questions and another section, of essay type questions carrying 60 per cent and 40 per cent pass marks separately-
(a)obtain minimum of 70 per cent marks in section 'A' i.e. objective type questions; and
(b)obtain minimum of 60 per cent pass marks in section 'B' i.e. essay type question.
(iii)shall be declared to have passed an examination, if he/she obtains minimum of 70 per cent marks in each paper separately.
(iv)A student who have to reappear/back paper in not more than one subject shall have to obtain 80 per cent in that subject to qualify it in subsequent examination.

24. Grace marks.

- (i) Grace marks may be awarded to a candidate subject to the condition hereinafter appearing, provided by awarding such grace marks he/she is able to pass the examination.
(ii)No grace marks in more than two requirements shall be awarded.
(iii)Not more than ten grace marks in an aggregate shall be awarded. N.H. Limit-Grace marks in each requirement shall not be exceed 10 per cent of the maximum marks of the requirement in which grace marks are awarded.
(iv)No grace marks shall be awarded at the Special Back Paper Examination.
(v)Grade marks so awarded shall meant to condone, the deficiency in the respective marks and not for altering the marks actually gained or the aggregate thereof, as such there shall not be added towards calculating the division/honours.
(vi)That the order of merit of a candidate shall not be effected by the award of such grace marks.
(vii)No grace marks shall be provided in the Diploma Examination in the Air Craft Maintenance Engineering as a pre-requirement of Directorate General of Civil Aviation to appear in the examination of relevant licence.

25. Private Candidate.

(1)Each candidate after availing regular chance(s) shall have to appear as a private candidate in the second chance except under the provision as laid down in Regulation 22(H) and (a), (b) and (c) and (d) and additional rule in Regulation 16.
(2)A private candidate subject to the following provision, shall have to reappear only in all the theory examination. The pass marks secured by him in practical examination and those for sessional work in theory, project and praeticals in the previous examination in which he appeared and failed in theory paper only shall be carried forward for working out the aggregate and division, provided that a candidate who failed in any of the practical examinations also at the previous examination, he shall have to appear in all the practical examinations along with all the theory examinations.
(3)A candidate will be allowed to appear as a private candidate on the conditions hereinafter given-
(a)that he/she puts in his application on the prescribed form through the Principal of the institution last attended along with the prescribed fee within the last date prescribed for the purpose;
(b)that he/she shall be required to appear according to that Scheme of examination only which may be prevalent at that time for regular candidates. Explanation for the purpose of award of diploma or certificates. By the Board he/ she shall be deemed to have appeared as a regular candidate.

26. Examination result.

- The result of the Examination shall be announced through press and shall be published in the Uttar Pradesh Gazette. A copy of the result sheet concerning affiliated institution shall be sent to the principal of the institutions for their record and to issue detailed mark-sheet to the candidate.
(2)The result sheet sent shall be scrutinised by the Principal of the institution utmost within a period of fifteen days from the receipt of the result sheet and if any discrepancy be observed in respect of posting of result as per Regulation 23, total carry over posting of sessional marks, division, award of honours or distinction in respect of any candidate the same shall be intimated by him to the Secretary for clarification before issuing the marks sheet to the candidate concerned.
(3)In any case where the result of an examination is declared and such result is affected by any error (except these covered under malpractices, fraud or improper conduct) such errors shall be placed before Examination Committee. The Secretary of the Board as per decision of the Examination Committee shall have power to amend such result in such manner as shall be in accordance with true position.
(4)No result shall however be amended after six months from date of declaration of results or after the commencing of the next examination under annual semester scheme whichever is earlier :Provided that the result of examination shall not be cancelled on the ground of a bona fide error of the Board after expiry of 90 days from the date of announcement of results of the examination :Provided further that internal assessment marks (Sessional, Games, Discipline) once communicated by institution and accepted by the Board shall not be altered after the declaration of results. In any case where the result of an examination has been declared and it is found that such result have been affected by any malpractice, fraud or any other improper conduct whereby a candidate has been benefited and has been party or privy to of such malpractice, fraud or improper conduct has been connived at such cases shall be placed before the Examination Committee of the Board for scrutiny. Examination Committee shall have power at any time notwithstanding the issue of a Diploma/Post-Diploma/Post-Graduate Diploma/any other diploma to amend the result of such candidates and makes such declaration as shall be considered necessary in this behalf.

27. Diploma and Certificate.

(1)A diploma or certificate on the form prescribed by the Board bearing the signatures (facsimile stamp) of the Chairman and the Secretary shall be issued through the principal of the respective institutions to a candidate who has been declared to have passed the Final Examination provided that no fresh diploma shall be issued to a candidate who passes an examination under Regulation 28, but an endorsement in such a case shall be made on the original diploma itself.
(2)The diploma or certificate shall be sent to the principal of the respective institutions as far as possible by 31st March next following for being issued to the candidate concerned.
(3)A candidate pending receipt of the diploma or certificate may obtain a provisional certificate from the principal of the institution from which he passed on the form prescribed by the Board. Provisional Certificate so issued shall not be valid from the date he received the diploma or certificate by the Board under sub-regulation (1).
(4)The diploma or certificate not claimed by any candidate after five years from 30th June of the year in which he took examination or the receipt of diploma from the Board shall be returned by the Principal to the Board :Provided that the Principal of the concerned institution shall make necessary and genuine efforts to intimate the candidate(s) at the addresses permanent and or employment or available in the institutions record.
(5)The unclaimed diploma or certificate returned by the principal to the Board, will be obtainable by a candidate and on payment of the prescribed fee and in manner prescribed by the Board.
(6)A duplicate copy of a diploma or certificate can be obtained on an application by the candidate under the following conditions on payment of the prescribed fee and in. manner prescribed by the Board-
(a)in the case of diploma or certificate being lost or destroyed;
(b)in the case of a Diploma or certificate having been spoiled or disfigured or mutilated and is surrendered to the Board for being impounded.
(c)in the case of diploma or certificate entries whereof have grown faint but which is otherwise, infact, and is surrendered to the Board for being cancelled.

28. Examination for those candidates who have already passed the diploma examination in one branch of Engineering or Technology.

- A candidate who passed the Diploma Examination in any one branch of the course in :
(a)Civil Engineering or Electrical Engineering or Mechanical Engineering or other engineering courses of three year duration-
(i)that in the case of Civil Engineering or Electrical Engineering or Mechanical Engineering or other engineering courses he/she joins at an affiliated institution from the second year class in which he wishes to qualify, subject to the availability of the seats in the course :
Provided that the Director of Technical Education shall specify the names of such affiliated institution. The number of seats for such candidates shall be made available up to 10 per cent over and above the intake of that branch of course in that affiliated institution :Provided further that the admission of the candidates to that branch of engineering shall be strictly on the basis of merit of the entrance test conducted for such purpose.
(ii)That he puts in their requisite attendance and satisfactorily completes the prescribed course.
(iii)Such candidates be given exemption in these subjects which are common in the first year/second year and/or final year- to the branch he has already qualified in and the branch in which he wishes to qualify now :
Provided that the candidate shall have to qualify those subjects of first year in addition to the subjects of second year course seeking admission therein, which were not common to that branch of diploma, he/she has already qualified.
(iv)No carry over of marks of the previous examination shall be allowed in such cases.
(v)Such a candidate shall subject to his securing the minimum pass marks prescribed under the Regulation 23 be declared as passed, and neither the aggregate shall be drawn nor division awarded in such cases only 'P' (for pass) will be awarded to such a candidate.
(vi)No separate diploma shall be issued to such candidate but an endorsement indicating that the candidate has also passed in a particular course will be made on the Diploma already awarded to him.
A candidate who has passed diploma Examination from other Boards and passes the Diploma under the scheme of 'Crash Programme' from the Board shall be awarded a separate diploma in 'Civil Engineering' for which the Crash Programme was set up.A candidate who has passed the Diploma Examination in any one branch of the course in Civil/Electrical/ Mechanical Electronics Engineering or other Engineering Course of three years duration wishes to have fresh diploma certificate in any other branch of engineering with provision of division will have to seek fresh admission in the first year of the course only at such centres and in such course as prescribed by the Board from time to time and shall have to study all the subjects in all the years irrespective of the fact that if he has already passed some subject(s) of the curriculum.

29. Use of unfair means and disciplinary action.

(1)If a candidate is found using unfair means in the examination the invigilator shall report such matter to the Superintendent of the centre. A written explanation shall be obtained from such an examinee on the prescribed charge-sheet and the Superintendent of the centre shall take into his possession all connected papers including the answer book and the materials but shall permit him to appear for the rest of the examination after giving him a fresh answer book. The Superintendent of centre shall immediately thereafter report the matter with full details of evidence and as per instructions of the Board to the secretary who shall place it before the Examination Committee for necessary action.
(2)In case a candidate refuses to give a written explanation the fact of his/her refusal shall be recorded by the Superintendent witnessed by the last two invigilator on duty at the time of occurrence.
(3)If a candidate is found talking to another candidate during the examination hours inside or outside the examination room/hall, the Superintendent shall record the statement of both candidates and the invigilator and send it to the Secretary of the Board with his/her comments.
(4)A candidate found copying from notes written on any part of his/her clothing, body, desk or table or instrument like line rule, set squares, protectors, scales etc. who is guilty of swallowing or destroying any notes or paper found with his/her or is talking to a person or consulting notes or books outside the examination hall while going to or coming from urinal/w.e., shall be deemed to have used unfair means and action as proposed in Clause (d) shall be taken.
(5)If a candidate fails to deliver his/her answer book to the supervisory staff before leaving the examination hall the Superintendent shall report the matter in full evidence to concerned police station and also a report shall be sent to the Secretary of the Board in a separate sealed cover.
(6)If a candidate is found to use of unfair means which includes a candidate-
(a)Before the start or during the examination writes either on the blotting paper / desk/ drawing instrument/desk slips/ admission card/any other piece of paper/question paper any solution of the question set in the paper complete or incomplete.
(b)found guilty of passing during the examination a copy of question(s) set in the paper or a solution/answer complete or incomplete whereof to any one.
(c)found possession of a complete or incomplete solution through connivance of any members of staff or some outside agency.
(d)found guilty of smuggling in an answer book/continuation sheet taking out or arranging to send out or sent out.
(e)found guilty of using abusive or obscene language or influencing the examiner by writing or by any means.
(f)found guilty of possessing an unauthorised paper of any kind/note book or any other material either in pocket or person or inside or outside the desk seat shall be deemed to have adopted unfair means, and as such the Superintendent of the examination centre shall act in accordance with sub-regulation (1).
(g)found guilty of having adopted unfair means covered by sub-regulations (2) to (5) and Clauses (a) to (f) above.
(7)An examiner discovering that any candidate has used unfair means at the examination shall immediately report the matter to the Secretary who shall place it before the Examination Committee for necessary action.
(8)Where the Secretary receives a report against any candidate(s) or instruction(s) regarding the use of unfair means by him from any source other than the source referred to in sub-regulation (1) and (6) above the Secretary may appoint a Screening Committee of experts to go through the answer books of such candidates of that institution and place the matter along with the report of the Screening Committee of Experts if so appointed, before the Examination Committee for necessary action.
(9)To avoid impersonation, all candidates, regular and private appearing for the Board examination shall be required to have in their possession, of admission card and their own identity cards, passport size photograph posted therein, and duly certified by the Principal of the institution to which they belong.
(10)All cases of impersonation shall be reported by the Superintendent together with the evidence which lead to this conclusion must be reported to local police and also matter may be referred to the Secretary of the Board.
(11)A candidate who refuses to obey the Superintendent/Invigilator of the examination Centre/room and changes his/her seat with another candidate and/or deliberately write another candidates roll number in his/her answer book and/or creates disturbance of any kind during the examination and/or otherwise misbehaves in the examination hall is liable to be turned out from the examination hall by Superintendent and his/her answer book along with a report with full recorded reasons shall separately be sent to the Secretary. In case candidate continues to disturb the conduct of examination, the Superintendent shall use the magisterial powers delegated to him and act accordingly.
(12)A candidate to have committed an act of indiscipline which includes subjecting of any physical assault on Centre Superintendent and/or Invigilator or any staff connected with the conduct of an examination in their period prior to the commencement and of two months immediately following the close of such examination, declaration of results of such examination shall be deemed to be an offence under sub-sections (1) and (2) of Section 21 of the Act the matter shall be reported to the Secretary with the proper and full, evidence and thereupon the case(s) shall be put up before the examination committee
(13)In all the above cases and in cases where an examinee has concealed any fact or make a false statement in his application form or has committed a breach of rules to secure undue admission in an examination had committed fraud (including impersonation) at the Examination or is guilty of moral offence, indiscipline, the Examination Committee shall determine the punishment to be awarded in that case and the decision of the Examination Committee shall be final subject to the provisions of sub-clause (e) of Clause (i) of sub-section (2) and subsection (1-A) of Section 13 of the Act.The committee may award penalty which may be one or more of the following :
(1)Withdrawal of Diploma/Certificate of having passed the examination.
(2)Cancellation of the Examination.
(3)Exclusion from the ensuing Examination.
(4)Withdrawal of certificate of having passed or cancellation of or exclusion from subsequent examination including higher examination of the Board.
(5)Deduct up to 40 per cent of the marks obtained by the students in each subject of the examination.
(14)The Examination Committee/Result Committee pending inquiry in cases where use of unfair means has been resorted to attempted or suspected to have been resorted to or attempted, may withhold the examination results of such candidates.
(15)If in the opinion of the Examination/Result Committee a candidate(s) is/are found to have used unfair means or suspected to have used unfair means, whether reported by the Centre Superintendent/ Examination Committee or not, or have concealed any fact or made a false statement in his application forms or rules to secure undue admission to an examination or has/had committed fraud (including impersonation) at the examination or is/was guilty of a moral offence or indiscipline, the Examination/Results Committee pending inquiry may withhold his result and/award one or more of the punishments mentioned above.
(16)During the period of punishment such candidates shall not be eligible for admission to any of the institute/examination both for lower /higher semester/year.
(17)If a candidate wants to make an appeal to the court of law against the decision of the Examination Committee, he/she can do so within 90 days for the date of decision of the Examination Committee and subject to jurisdiction of Lucknow.

30. Scrutiny procedure.

(1)Any candidate who has appeared at an examination conducted by the Board may apply direct to the Secretary for the scrutiny of his marks in any theory subjects.
(2)Such an application must be made on the prescribed form obtainable from the institution concerned and must be submitted within time specified in Schedule III.
(3)All such applications must be accompanied with such fee as may be prescribed by the Board. Such fee may be paid through Bank Draft payable to the Secretary, Board of Technical Education, U.P. at Lucknow or to be deposited in the Treasury. A copy of treasury challan in the latter case shall be sent to the Secretary of the Board, Indian Postal Order, money-order or cash payment wall not be entertained.
(4)No candidate shall be entitled to a refund of scrutiny fee unless as a result of the scrutiny a mistake affecting his examination result is detected.
(5)The result of all cases of scrutiny shall be communicated to the candidate concerned after the scrutiny is over. In such cases, no other correspondence shall be entertained.
(6)The work of scrutiny does not include re-examination or revaluation of the answer books of any candidate. It consists of scrutinizing whether there has been any mistake in carry over of the marks assigned to individual question, or in their totalling or in posting of the total marks obtained or if there has been any omission in marking a question or a pail thereof.
(7)The work of scrutiny shall not include the subjects, whose examination is held either in viva voce or job work on project etc, through orally or practically or both.

31. Mar.

- sheet.-(1) Mark-sheet showing marks obtained in the individual subject, theory or practical shall be supplied to a candidate by the Principal of the institution concerned on payment of the prescribed fee (Schedule-I). This fee shall be collected from every candidate along with the examination fee.
(2)If a candidate detects any discrepancy in total, carry over posting of sessional marks, division, award of honour of distinction in his mark-sheet, he shall make an application for the same within a period of not exceeding one month from the date of declaration of results, to the Secretary, Board of Technical Education, U.P. Lucknow through the Principal of his institution and he shall also forward a copy of such an application direct to the Board Office through registered post within the same period.
(3)Mark-sheet shall be issued to the candidate within a period of fifteen days from the receipt of the result in the institution. Provided that, if there be any discrepancy, discovered by the Principal of the institution, in the result of any candidate, his mark-sheet shall not be issued instead the matter shall be referred to the Board for clarification and after the receipt of such clarification, the necessary mark-sheet shall be issued to the candidate.
(4)A duplicate copy of the mark-sheet, if so required shall be issued to the candidate by the Head of Institution on payment of the prescribed fee as specified in Schedule-I which shall be remitted to the Board through treasury challan or Bank Draft.

32. Refund of fee.

(1)Fee once paid shall not be refunded except in the following cases-
(a)in the case of candidates death prior to examination,
(b)in the case of a candidate who after paying the prescribed fee for the ensuring examination is declared successful as a result of scrutiny or release of his/her withheld result.
(c)in the case of a candidate who deposits fresh fee due to nonreceipt of timely intimation of holding over of his/her fees under Regulation 33,
(d)in case of candidate whose application form is rejected by the Board.
Explanation - In this rule 'fees' means only examination fee and does not include the fee to be deposited for securing particulars of marks obtained.
(2)Application on the prescribed form for a refund of fee shall be entertained if submitted through the Principal of the institution within the time specified in Schedule-Ill.

33. Holding over fee.

(1)The Board may, on application made in that behalf within the time prescribed in Schedule-111 and in such form as the Board may prescribe, admit a candidate who was unable to present himself to an examination to the next ensuing examination by holding over his/her fee on the following conditions-
(a)that the candidate was detained by the Principal of the affiliated institution under Regulation 5.
(b)that the candidate was seriously ill at the time of examination the fact being duly supported with the certificate of a registered medical practitioner.
(2)Fees once held over shall not be held over once again.Explanation:
(a)Appearing in any part of the examination (Theory or Practical) will be considered as appearing in the whole examination under this rule.
(b)Fee means only the Examination Fee.

34.

Examination and other fee from candidate should be charged according to the rates given in the Schedule-I.

35. Simultaneous appearance at other examination.

(1)No candidate who is appearing in airy of the Boards Examination shall be permitted to appear simultaneously in any other examination except a competitive examination or examination conducted by professional bodies such as-Associate member of the institution of Engineers etc. for which no regular course of study in an institution is prescribed.
(2)No change in the date of Boards Examination shall be made in order to accommodate or give facility to any candidate for appearing in the examination permissible under sub-section (1).

36. Forwarding Officer and Application Forms.

(1)Application forms for admission to the Board's Examination for a regular candidate shall be obtainable from the Principal of the institution who shall act as forwarding officer for him. Candidates intending to appear as a private candidate shall obtain the application form from the Principal of the Institution last attended by him who shall be the Forwarding Officer for him. The application form duly filled in and completed in every respect along with the prescribed fee must be submitted to the Forwarding Officer by the date mentioned in Schedule-II. An application form incomplete in any respect is liable to be rejected by the Board.
(2)The forwarding officer after receiving the application form duly completed in every respect till a particular last date prescribed in Schedule-11 shall get them checked thoroughly as per rules regarding the eligibility of the candidate as also the fact that no column has been left blank or the cutting if any is duly signed or none of the desired enclosures are missing and shall proceed as follows :-
(a)Sort them out coursewise separately for each course.
(b)Arrange the forms as alphabetically according to Hindi Dictionary for each course. The forms of private candidate in a particular course shall as a rule follow the forms of regular candidates.
(c)Prepare nominal roll alphabetically separately for each course in triplicate (Two copies to be sent to Board and Third one for his office).
(d)Forward all the forms and Nominal roll to Secretary, Board of Technical Education, U.P. Lucknow latest within 20 days from the last date prescribed as in Schedule-II.
(e)An additional late fee of Rs. 100 per day per coursewise irrespective the number of application form(s) shall be payable by the institute in case an institute fails to submit application(s) and fees to the Board on the due date. A maximum number of two weeks will be permissible for this submission and the expiry of this date, application forms will be accepted except if approved by the Examination Committee of the Board.
(f)Notwithstanding the acceptance of application form and fee by the Board the performance result of applicant at the examination will be cancelled if it later found that the application was not eligible for admission to the said year and for admission to the said examination and further Principal and staff concerned shall be liable to disciplinary action by the competent authority for wrong certification of applicant.
Explanation-
(i)Where a last date has been prescribed for any purpose and a fee also prescribed for that purpose the fee must be deposited into Treasury or the Bank Draft, as the case may be, on or by the date so fixed for the purpose.
(ii)as a day each month is not a full working day for public transaction in Treasuries the forwarding officers are permitted to credit the fee realised on that day into Government Treasury on the next following working day.
(iii)if the last date indicate above fall on Sunday or a Gazetted holiday the next following date shall be considered as the last date in regard to that particular date. The institution who do not abide by time schedule of submission of application for admission to Boards examination-
(a)In case of Government, institutions, defaulting persons shall be fined Rs. 100 per day for each late day in addition to any other punishment as deemed fit by the Examination Committee.
(b)in case of Government aided institutions such institutions have to pay fine of Rs. 100 per day for each late day and would be liable to face stoppage of grant-in-aid and any other action as deemed fit by the competent authority.
(c)in respect of the institutions who do not fall under the categories mentioned above to pay fine of Rs. 100 per day for each late day and shall be liable for other appropriate action which may extend even to disaffiliation of the Institution from the Board of Technical Education, U.P.

37. Other rules concerning examination.

(1)The theory examination of the Board shall he held simultaneously at all the centres and ordinarily in the month of April of the academic year.
(2)The dates of practical examination shall be finalised by the respective Principals of institutions in consultation with the practical examiner and shall ordinarily be held either before or immediately after the theory examination. The practical examinations shall be ordinarily held at each of the institution, provided that in case of Special Back Paper examination, they may be held at one or more centres.

38.

(1)The Principal of institution shall be required to inform the Secretary latest by 31st August each year of number of candidates that are likely to take the examination of the Board at the next ensuing examination in each class and course.
(2)At least one month before the commencement of the practical/ theory examinations whichever is earlier the Principal of the Institutions shall submit a certificate that complete course has been taught to candidates and practical and experiments have actually performed and satisfactorily completed journals, project design work etc., by the student of the institution.

39. Entry in the examination centres.

(1)No candidate shall be permitted to enter the examination hall after the commencement of the examination. The Superintendent of the Centre may however at his discretion permit a candidate to take the examination if a candidate reports himself within half an hour of the commencement of the examination.
(2)The Superintendent/invigilator/flying squad/observer may ask the examinee to give search of his/her possession inside and outside the examination hall before the commencement or during the examination.
(3)The Superintendent/invigilator may be demand to ask an examinee to show his/her admission cards and may refuse his/her entry into the examination hall/centre; if without valid reasons he/she does not have his/her admission card and doubts/finds an act of impersonation.
(4)No candidates shall be ordinarily permitted to leave the examination hall finally before the expiry of the full term of the paper :Provided that the Superintendent of centre may permit a candidate who was completed his paper or on other satisfactory grounds to leave the examination hall within the last half an hour.

40. Preserving the records of examiners.

(1)The answer books of the candidates shall be preserved for a period of six months from the date of declaration of results. The answer books of the candidates who may have used unfair means at the examination shall be kept for a period of two years.
(2)The jobs prepared by the candidates during the practical examination shall be retained by the Principal affiliated institution and in case of special examination by the Centre Superintendent under their safe custody till 31 December of the year of examination. For private candidates it will be obligatory on the part of Principal to retain their jobs/project/sessionals work etc., for a period till the candidates passes,
(3)The award lists/sessional marks list shall be destroyed after two years from the date of declaration of the result.

41. Admission cards and procedure for obtaining them.

(1)An admission card shall be issued under the signature (facile stamp) of the Secretary to each candidate who is not detained and who fulfills the condition for admission to an examination of the Board and is permitted to appear in an examination.Provided that-
(i)the admission cards for the main examination shall be issued to each candidate by the Principal of the institution.
(ii)admission card for the practical examination on form prescribed by the Board shall also be issued by the Principal to candidate for identification during practical examination :
Provided further that the admission card fox the special Back Examination shall be issued by the superintendent of Centre on production by each candidate, letter of identification from the Principal of his own institution.
(2)The admission cards shall be obtained by the candidates concerned on a working day at least 24 hours before the commencement of the examination.
(3)Every candidate shall present his/her admission card to the Superintendent of Centre or the Invigilator or Flying squad or observer whenever demanded.
(4)The Superintendent of Centre, if he/she is satisfied that the admission card issued to a candidate has been lost or destroyed, shall issue to the candidate duplicate admission card on payment of the prescribed fee as specified in Schedule 1, which will be remitted by the Superintendent of Centre to Secretary' of the Board through a Bank Draft or through Treasury Challan as the case may be.

42. Rustication or expulsion.

(1)Notwithstanding anything contained in these rules, no candidate who has been rusticated at any time during an academic year by the Head of the Administrative Department shall be admitted to an examination held that academic year.
(2)No candidate who has been expelled from an affiliated institution after the submission of this application form for admission to any of the Board's Examination and who is not admitted to any affiliated institution thereafter shall be allowed to appear at the examination.Note-If the above penalty is imposed during the course of an examination or after the examination but before the close of that session in which the examination is conducted his/her examination shall be cancelled.

43. Copyright of the question paper.

- The Board reserve the copyright of its question papers. In case however a publisher/author observe the following conditions the Board may extend permission for the reproduction of question papers of the Board's examination in any publication-
(i)The publisher/author shall not be include any solution/ answers, alongwith the questions in the publication.
(ii)It shall be the responsibility of the publisher/author to reproduce the question or question papers correctly.
(iii)It shall be obligatory on the part of the publisher/author not only to mention the fact that the question/question paper(s) was/were being published under permission by the Board but he shall specifically quote the number and date of the said permission letter.
(iv)The application of the permission extended by the Board shall be strictly restricted to the calendar year for which it is granted, and shall automatically cease to operate unless renewal has been sought and granted under these rules.
(v)The fee for seeking permission is Rs. 10 per question paper.

44. Admission test.

(1)Application for admission test shall be invited by the Joint Entrance Examination Council/Director Technical Education/Principals as the case may be. The last date for receipt of the application forms shall be fixed and announce publicly through the newspaper.
(2)Admission to the first year class shall be made strictly on the basis of merit (percentage of aggregate marks) obtained in the common admission test.
(3)Seats for candidates belonging to Scheduled Caste and others shall be reserved as per Government orders issued from time to time. If the required number of students be not available in the categories as reserved by Government against their respective quota, the reserved seats thus falling vacant will be created as unreserved and filled upon merit from the waiting list after seeking a written permission of the Director of Technical Education/State Government.
(4)Subject to the provision of sub-regulations (2) and (3) admission shall be made directly by the principal of the affiliated institutions but a candidate, who does not and have not deposited the required proof there of latest by the 15t.h day of the last date of admission as declared by the entrance examination council or the director of Technical Education or before 31, August of that calendar year whichever is late may not be permitted to appear in the Boards examination, even though he may have been admitted in the institution.
(5)Direct admission however to II or III/Final year classes of course, shall not be permitted except in the following case.A candidate who has studied at any of the affiliated institution and has duly passed the I year on II/III year Annual Examination, as the case may be, conducted by the Board, provided he is eligible for admission under Regulation 22 and permitted for migration under Regulation 17.

45.

Notwithstanding anything contained in these regulations the examination committee may consider cases of relaxation in the admission minimum qualification and age requirements in the case of nominees of the State Government or the Government of India, under any aid programmes.
