Manipur International University Act, 2018(Manipur Act No. 2 of 2019)Last Updated 25th February, 2020[Dated 14.2.2019.]An Act to establish, create and incorporate a full-fledged quality teaching, training, researching and affiliating multi model University and an international Institution which is to be called as "Manipur International University" in the State of Manipur for pursuit of intellectual, philosophical, historical, spiritual, scientific, professional and vocational studies at all subjects and at all levels and for matters connected therewith or incidental thereto in the State of Manipur.Whereas, it is desirable to establish a University to provide quality training and education for the encouragement of higher education, vocational studies, skill development, and research in the State of Manipur.And Whereas, it is deemed necessary to establish an International Institution in Manipur to impart quality education to the masses as Manipur International University by this Act, to provide education and training at all levels in all subjects. The University shall be established through a unique public-private partnership model without exerting any economic burden on the State or public;And Whereas, the Government of India clearly mentions and upholds in the constitution the right to education as one of the fundamental rights guaranteed to every citizen born in this land, the University believes in the constitution and aims at boosting and reviving the spirit of education. Hence, the- University intends to counter.the menace of commercialization of education and for the same reason, believes that merely securing certificates does not contribute to student's overall growth and employable skills; moral values, management skills, holistic approach, modern education in a traditional manner are essential;And Whereas, Article 26 of the Universal Declaration of Human Rights of the United Nations also mandates and upholds that everyone has the right to education. It also proposes that the higher education shall be equally accessible to all on the basis of merit;And Whereas, it is an ardent desire of the planners to steer towards a more job-oriented education which promotes the supply of manpower commensurate with the needs of the society, improvement of the standards, to assess the contribution of the teaching fraternity and so on. The objective of enforcing a few of its specific recommendations, it will be to effect certain structural alterations in the direction of improvement in the functioning of Universities and the education system;And Whereas, the proposing body approached the Government of Manipur after noticing the progressive and positive attitude of the Manipur Government and the people and the Government of Manipur reciprocated positively to support this mission and this unique project which shall serve as a role model for the rest of the world and mark as a milestone to the Free Education Movement and contribute towards the de-commercialization of education;And Whereas, the Government of Manipur has agreed to execute a dedicated Act for the establishment of this unique model University in the State of Manipur which shall be without any burden on the public exchequer, while the responsibility for administration and management shall be on its Governing Board, its Chancellor and its Founder with the burden to maintain it smoothly and effectively;And Whereas, the University shall be a non-profit, self-financing institution having an autonomous administration with full powers, which shall seek support from its donors, volunteers, scholars, philanthropists and from other sources but shall be self-Governing, self-financing, fully autonomous and accountable to the Governing Board of the University. However, the Governing Board of the University shall be accountable to the State of Manipur;And Whereas, it is expedient to establish and incorporate a quality teaching, training, researching and affiliating multi-model University and an international Institution for pursuit of intellectual, philosophical, historical, spiritual, professional and vocational studies at all subjects and in all levels and for matters connected therewith or incidental thereto in the State of Manipur.Be it enacted by the Legislature of Manipur in the Sixty ninth Year of the Republic of India as follows:-

1. Short title, extent and commencement.

(1)This Act may be called the Manipur International University Act, 2018.
(2)It extends to the whole of the State of Manipur.
(3)It shall come into force and shall have a permanent value from the day of its publication in the Official Gazette of Government of Manipur.
(4)It is applicable to the "Manipur International University" which is established and incorporated by this Act, and any matter relating and/or incidental thereto.

2. Definitions.

- In this Act, and in all Statutes, Ordinances, rules and regulations made hereunder, unless the context otherwise requires:-
(a)"Academic Council" means the Academic Council of the University;
(b)"Agenda Matters" means all the matters and business to be designated in the Statutes or in the. Ordinances each of which can be either included in the Agenda or be taken up for discussion and decision at a meeting of the Governing Board or the Academic Council or any of the Committees, as the case may be, only subject to the prior written approval of the Chancellor, consenting to the passing of such matters and business at such a meeting;
(c)"Central Government" means Government of India;
(d)"College" and "School"- ' means, respectively, a College and the School maintained or affiliated or recognized by the University;
(e)"Employee" means any person appointed by the University and includes teachers and other staff of the University;
(f)"Faculty" means Professors, Additional Professors, Associate Professors, Assistant Professors and such other persons as may be appointed for imparting education, teaching and instruction or conducting research in the University or in any College or Institution maintained by the University and also means a person giving instructions / teaching on behalf of the University, in the teaching department / School of the University, constituent or affiliated college / school / institute, and includes a Principal, Reader, Lecturer, Demonstrator, Director, Teacher, and such member of staff of a University Library and all those who may be declared and designated as Faculty by the Academic Council of the University or by the Chancellor of the University;
(g)"Founder", "Additional Founder" and "Co-Founder" mean, respectively, the Founder, Additional Founder and Co-Founder of the University-as appointed under this Act;
(h)"Governing Board" means the Governing Board of the University;
(i)"Hall" means a unit of residence or of corporate life for the students of the University, or of a College or an Institution, maintained by the University;
(j)"Institution" means an academic institution, not being a College, maintained or affiliated or recognized by the University;
(k)"Manipur" means the Indian State of Manipur and all the areas tinder the administrative control of State Government of Manipur unless specified otherwise;
(l)"Officer" means any person appointed by the University and includes all the administrative staff of the University;
(m)"Ordinance" means Manipur International University Ordinance, 2018, an Ordinance as promulgated by the Hon'ble Governor of the State in exercise of the powers conferred to him by clause (1) of Article 213 of the Constitution of India;
(n)"President", "Honorary Chairman/s", "Patron/s", "Brand Ambassador/s" "Founder", "Additional Founder", "Co-Founder", "Chancellor", "Pro- Chancellor", "Vice-Chancellor", "Registrar" and "General Counsel" mean, respectively, the President, Honorary Chairman/s, Patron's, Brand Ambassador/s, Founder, Additional Founder, Co-Founder, Chancellor, Pro-Chancellor, Vice-Chancellor, Registrar and General Counsel of the University.
(o)"Proposing body" means "Manipur International University Management Authority" a registered public charitable/educational trust and a special purpose vehicle established for the purpose of establishing, promoting and supporting an International University in the State of Manipur.
(p)"Regulations" means the Regulations made by any authority of the University under this Act for the time being in force;
(q)"RTI Act, 2005" means the Right to Information Act, 2005 (Central Act 22 of 2005);
(r)"Rules" means the Rules made by the Chancellor of the University under this Act for the time being in force;
(s)"State" or "State Government" or "Government" means the State of Manipur or the Government of Manipur, unless specified otherwise;
(t)"Statutes" and "Ordinances" mean, respectively, the Statutes and the Ordinances of the University made under this Act for the time being in force except as stated otherwise;
(u)"Student" means Student of the University or a person enrolled in the university for taking a course of study for a degree, diploma or other academic distinction duly instituted by the university, including a research degree;
(v)"UGC Act" means the University Grants Commission Act, 1956 (Central Act 3 of 1956);
(w)"University Grants Commission" or "UGC" means the University Grants Commission (IJGC) established under section 4 of the University Grants Commission Act, 1956 (Central Act 3 of 1956);
(x)"University" means the "Manipur International University" established and incorporated by this Act.

3. Establishment and Incorporation of Manipur International University.

(1)There shall be established and incorporated a University by the name and style of "Manipur International University", as an 'autonomous body corporate which shall enjoy full legal competence to pursue its activities and objectives, financial, academic and administrative independence and autonomy to discharge its business in the State of Manipur.
(2)The main campus, headquarters and administrative campus of the University shall-be in the State of Manipur and shall not be shifted outside the State whatsoever.
(3)The University shall establish a minimum of seven campuses of the University offering quality education in different streams across the State of Manipur and there shall have at least one campus which shall offer free/ near-free/ free-ship/ subsidized education.
(4)The University may establish, affiliate, recognize or maintain campus, off-campus, administrative campus, constituent college, training center, regional center, school, college, study center, learning center , research stations, extension centers, finishing schools anywhere in the State of Manipur and elsewhere/ anywhere in India as it may deem fit;Provided that the University may, with the approval of Governing Board, establish such centers anywhere outside of India or overseas as may be permissible under relevant laws of the land.
(5)The University shall be a body corporate and body politic by the name and style as "Manipur International University" and shall have perpetual succession and a common seal with the power to acquire, alienate, assign, bequest, demise, devise, gift, grant, hold, hypothecate, lease, mortgage, rent, sell, or to take and dispose of any property, movable and immovable, including trust property and endowments, which may be or may have become or deemed to be vested in or acquired by the University for 'the purpose of the University and to contract, and to do all things and acts necessary for the purpose of its constitution and may sue or be sued by its corporate name as aforesaid. It shall also have the power to assume armorial bearings.
(6)The first Chancellor, the first Vice-Chancellor, the first Registrar and the first members of the Governing Board and the Academic Council, and all persons who may hereafter become such officers or members, so long as they continue to hold such office or membership, shall constitute the University.
(7)The University established and incorporated by this Act shall be deemed to have been established, created and incorporated for the purpose, among others, of making provisions for imparting quality education and training,,for research and for the advancement and dissemination of knowledge and wisdom in such subjects and branches as the University may deem fit.
(8)The University shall provide quality education for the talented, needy and underprivileged students from across the globe.
(9)The University shall be a fully empowered/ authorized/ full-fledged accrediting, affiliating, educating, degree granting, teaching, training, researching, examining, certifying and recognizing body subject to observance of relevant guidelines of the UGC.
(10)No institution affiliated to or maintained by any other University in the State of Manipur shall be affiliated with the University for any purpose, except with the prior approval of the concerned University or the State Government or both as the case may be.

4. Declaration of Manipur International University as International University of Excellence.

(1)It is hereby declared that the institution known from now as the Manipur International University shall be an "International University of Excellence" and "Institution of State Importance".
(2)By the virtue of this Act, the, University is hereby declared and is eligible to call itself as "An Autonomous Public. International University of State Importance and Excellence" or in parts as it may deem fit.

5. University shall be self-financing.

(1)The University shall, be a self-financing University and hereby dedicated to the Nation and to the service of the mankind.
(2)The University shall be fully autonomous and self-governing. The management and administration of the University shall completely lay or rest with the Governing Board.
(3)The Government of Manipur, at all times; shall not be considered responsible in regard to any debts or financial or other commitments related to the University or to any of its subordinate bodies owned totally or partially by it.
(4)The University shall not make a demand for any grant-in-aid or any other financial assistance from the State Government or any other body or, corporation owned or controlled by the State Government.Provided that voluntary donation of any kind from anybody including the State shall be accepted and acceptable by the University;Provided further that the State, at its discretion, may provide financial or any other support through grants or otherwise; for research, development and other activities for which other State Government organizations are provided with financial assistance or for any specific research or programs receiving support from the Government; and for the benefit of other Universities in the State whether subject to a change in State policy or otherwise; for the rural development and youth empowerment or for any other purpose which the State Government may think fit:Provided also that the State, at its discretion, may also provide / grant/ gift or assign free or subsidized land or any other movable or immovable property to the University anywhere in the State for the University or for building University facilities or for doing University activities including but not limited to research, agriculture and other purposes:Provided also that the University may receive any kind of support, donation, deposit and property either movable or immovable from any source at its discretion and at its own terms and it shall be as allowed as per law of the land.
(5)The proposing body shall provide all the support for the establishment of the University with all such assistance which it may be in need. It shall also be responsible for raising the necessary finance towards the establishment and maintenance of the University.
(6)The State shall have no objection to the University obtaining grants, soft loans from various funding organizations, institutions and agencies including International and bilateral agencies, for expansion, modernization of the facilities and augmenting the quality of education, training and research that is carried out at the University and in its accredited, affiliated or recognized colleges, training institutions/ facilities or centers provided that there shall be no financial obligation on the part of State Government and other relevant rules and regulations of the Country are observed.
(7)The University is permitted to purchase lands and immovable properties within and outside the State for the development and advancement of the University and its purposes. The State Government prior approval shall however be obtained in respect of purchases within the State.

6. University shall have absolute autonomy.

(1)Unless specified otherwise in any other law for the time being in force, the University shall have absolute and exclusive academic, administrative, financial, managerial and Statutory autonomy and freedom, including the exercise of exclusive powers with respect to
(a)management and administration of the university;
(b)the formulation and adoption of its academic policies and standards;
(c)formulation and collection of all kinds of fees etc;
(d)the establishment of its standards for admission and graduation;
(e)the selection, appointment, suspension and removal of its staff, including, employing and employment of Faculty, Officers, Teachers and other employees on such terms and conditions as may be prescribed by this Act, its Statutes, Ordinances, rules, and regulations.
(2)The management, administration, and control of the property, revenues, business and affairs of the University are hereby vested with the Governing Board and the Chancellor.

7. University to be non-profit.

(1)The University shall be non-profit, for charity, and self-financing University with autonomous administration/ management with full powers, which shall seek support from its donors, volunteers, scholars, philanthropists and from other sources including but not limited to consultancy and research.
(2)The University shall be self-Governing, fully autonomous and it shall be accountable to the,Chancellor and to the Governing Board of the University.
(3)The University shalt be a not-for-profit legal entity and no part of the surplus, if any, in revenue .of the: University, after meeting all expenditure in regard to its operations under this Act, shall be invested for any purpose other than for the growth and development of the University or achievement of its objectives or for conducting research therein.
(4)The University shall strive to raise funds for self-sufficiency, sustainability, and future development of the Institute.

8. Tax Exemption.

(1)The donations, gifts, grants or income received by, any income source and properties of the University shall be exempted from any kind of tax as are permissible under relevant statutory provisions from,time to time.
(2)The University shall be eligible to apply and may apply for all other tax exemptions (for example: tax exemption for the donations at the hands of the donor), necessary registrations, and permissions under any section of the Income-Tax Act, 1961 (Central Act No.43 of 1961) or the Foreign Contribution (Regulation Act), 2010 (Central Act No.42 of 2010) or any other, Central or State Act or with any authority as may be required and as it may deem necessary.

9. Exempt from expropriation.

(1)Real property that is now or at any time vested in the university not liable to be entered upon, used or taken by any authority or by any, person possessing the right ut taking lands compulsorily for any purpose whatsoever, and no power to expropriate real property hereafter conferred extends to such real property unless in the Act conferring the power it is made in expressed terms to apply to such real property.
(2)The University can receive any type of land as a gift or purchase the same from anybody, any person or any organization irrespective of caste, creed and religion or type of organization subject to the restrictions under section 158 of the Manipur Land Revenue and Land Reforms Act, 1960 (Central Act No. 33 of 1960) on transfer of land by a person who is a member of the scheduled tribes.
(3)Any land acquired, purchased or received as a gift by the University shall be free from encroachment, any kind of encumbrances, and free from all suits or appeals or proceeding of whatever nature. The Title of such land shall be deemed to be a free and clear title once it is acquired by the University.
(4)The University is free to use any land owned, acquired, purchased or received as a gift by the University for any bona fide purpose of the University as the Governing Board may think fit.

10. No restriction upon accumulation.

(1)Unless specified otherwise in any other law whether public or private, no restriction upon accumulation shall apply with respect to or in, any way limit devises or bequests, whether of capital or income to the University or any department or branch thereof, subject always to the expressed terms of any such devise or $$request.
(2)Upon the establishment of the University under this Act, the land and other movable and immovable properties acquired, created arranged or built by the University for the purpose of the University in the State of Manipur shall vest in the University.

11. Name of the University.

(1)Name of the University shall be "Manipur International University" and it shall be in its name and style, including its logo and concept, exclusive and the sole intellectual property of the University and no person, organization, body or no one, other than the University, shall have the right to use or own or modify or register the name or concept of the University in any manner or in any style unless authorized by the University.
(2)The University shall have a separate logo and it shall be the sole intellectual property of the University and it shall host its logo in its website, papers, certificates and its entire official stationery along with the name of the University.
(3)The University is permitted to use the State logo and emblem of the State in its website, papers, certificates and any of its stationery.

12. Power to establish Constituent Colleges and to have Affiliated Colleges.

(1)The University may, have affiliated, constituent or recognized colleges, regional centers, training centers, learning centers, academic centers, research centers, campuses, adjunct campuses, off-campus centers, offshore campuses, autonomous colleges / institutes, study centers, skill development centers, innovation centers, creative centers, vocational training centers, learning centers, institutions, colleges, schools, literacy camps, research stations, extension centers, finishing schools at all levels and ins all subjects. This includes recognition/affiliation of institutions, colleges and schools etcetera located in or outside the State of Manipur including overseas, and admission to such Institutions, Colleges, and Schools etcetera under the University for the purpose of conducting formal and informal education/certification which shall also include but not limited to professional and vocational Programs of the University subject to the observance of the relevant, laws of the country and National and State institutions governing such activities.
(2)The University shall have the right to affiliate any college or institution for any course and subject at all levels. The eligibility criteria for affiliation of such college/ institution, the fees structure etc shall be as decided by the Governing Board and as per the Ordinances and such rules and regulations of the University as published from time to time. In the case of affiliation/ recognition and association of a college or institution with the University; the University shall have the right to charge the, appropriate fees from that college/ institution and from the students enrolling through the same as per discretion of the University.

13. Jurisdiction.

(1)The Jurisdiction of the University shall extend to the whole of State of Manipur and to such centers and institutions affiliated/ established/ maintained/supported / recognized by the University within or outside India.
(2)The University is allowed to open campus / off campus / study center of the University and to affiliate and to recognize any college or institution in any State of India subject to the permission and extension of jurisdiction of the University through notification by the respective receiving State subject to observance of all relevant laws, rules and regulations of controlling institutions in this regard.

14. Recognition.

- The University and all the degrees, diplomas, certificates, courses, training, certifications, license, titles and any other academic distinctions or awards granted or conferred or offered or on anyone by the University through all modes at all subjects and at all levels shall be and shall automatically stand and deemed .to be fully recognized, authorized, accredited, registered and approved by the State and the State Government for all the purposes including for the purpose of employment for post and service with the State Government and shall also be recognized for the purpose of further eduCation in other Universities and higher learning institutions; they shall also be recognized by the State and State Government to the same extent and in the same manner and they are treated at par with the corresponding degrees, diplomas, certificates, courses, training, certifications, licenses, titles and any other academic distinctions or awards granted by any other University/Board/Institute/Body/Organization incorporated under any enactment or State subject to grant of recognition by appropriate authorities such as UGC, AICTE etc.

15. University open to all classes and creeds.

(1)The University shall be opened to all persons and shall not discriminate against any person irrespective of caste, creed, disability, ethnicity, gender, place of domicile, political belief/affiliation/opinion, race, color, national origin, religion, sex, sexual orientation, citizenship status, age, disability, genetic information or any other class or categorization of human beings and it shall not be lawful for the University to adopt or impose on any person, any test whatsoever of religious /political -belief or any profession in order to entitle him to be appointed as a Teacher of the University or to hold any other office therein or to be admitted as a student in the University or to graduate there at or to enjoy or exercise any privilege thereof.
(2)Notwithstanding anything, contained in clause (1) the University may make special provisions in the regulations for the employment or protection of educational interests of women, differently abled persons or of persons belonging to the weaker sections of the society or tribal and in particular of the Scheduled Castes and Scheduled Tribes and Other Backward Classes as may be directed by the Governing Board from time to time:Provided that nothing in this section shall be deemed to prevent religious instruction being given in the manner prescribed by the Ordinances to those who have consented to receive it, or, in the case of minors, whose parents or guardians have given their consent thereto in writing:Provided further that nothing in this section shall be deemed to prevent where in such special cases or where such test is specially prescribed by the Statutes or in respect of any particular benefaction accepted by the University or when such test is made ,a condition thereof by any testamentary or, other instrument creating such benefaction:Provided also that nothing in this section shall be deemed to require the University to admit students to any course of study larger in number than, or with academic or other qualifications lower than, those prescribed:Provided also that nothing in this- section shall be deemed to prevent the University to make special provision for the spread of University education among classes and communities or persons which/who are from the classes of a religious minority or educationally or economically backward:Provided also that nothing in this section shall be deemed to prevent the University from making special provisions for admission to the students domiciled in the State.

16. Eligibility and Equality.

- Men and women shall be equally eligible for admission to and as students of the University and for appointment to any Authority, office or employment of or under the University.

17. University Grants Commission and other matters.

(1)The University being a University established under a State Act, it shall also be deemed to be established under section 2(f) of the UGC Act and shall be eligible to apply for application, recognition and , listing by the UGC under section 2(f) and section 22 or under any other section of the UGC Act.
(2)The University is also hereby declared fit and eligible to apply for the registration and recognition with the UGC under section 12(b) and declared fit to apply for the central assistance as per approved pattern of assistance under various schemes of the Government of India from time, to time.
(3)Being a State University established under a State Act shall have the full right of conferring or granting degrees and it shall be competent and eligible to award degrees as specified by University Grants Commission under section 22 of the UGC Act. However, the University shall award degrees only within the framework of section 22 of the UGC Act. The University shall adhere to the approved nomenclature of degree(s) and ensure the observance of the minimum standards of, instruction before the award of degree(s) as specified from time to time by the UGC. If the University wishes to award a degree other than the one specified by the UGC then it shall be required to take due prior permission from the UGC.
(4)The University shall have the powers and is eligible to offer and grant all the degrees/courses at all subjects and at all levels as specified' by the University Grants Commission under section 22 of UGC Act. All the degrees, diplomas, certificates, and titles duly awarded /granted by the University as per rule shall automatically be entitled to be recognized for all the purposes including for employment in all the government and private service.
(5)The University shall work within the rules and regulations made by the UGC under the UGC Act and shall take permission/exception from the UGC whenever necessary/ required.
(6)Any Professional Institute or colleges established by the University or affiliated to it shall work in conformity with the rules and regulations as framed by the respective national professional councils and apex bodies.
(7)The University shall furnish such reports, returns, statements and any other information as may be required by the State Government, University Grants Commission and other statutory/ apex bodies/ authorities from time to time.
(8)The University shall appoint an adequate number of qualified teachers and officers in the University for maintaining the academic standards specified and shall ensure that the qualifications of such teachers or officers of the University shall not be lower than as prescribe by the relevant Regulatory Bodies.

18. Autonomous Organization.

- The University shall be deemed to be an Autonomous Organization under the administrative control of the State Government of Manipur.

19. Establishment of Free Campus.

(1)The University shall establish a unique Free International University Campus in the State in which all the courses shall be taught free of cost to the deserving and talented students with thirty percent of the seats reserved for deserving but from less privileged, economically / socially backward, indigenous, tribal and rural backgrounds from the State of Manipur.
(2)The University shall also establish a unique walk in, study and get certified International Skill Training school in various parts of the State which shall be opened to all and the courses taught in that center shall be free of cost to the students with twenty percent of the seats reserved for students from the State of Manipur.

20. Constituent Bodies of the University.

(1)The University is empowered to establish, create, accredit and to recognize constituent colleges/ centers/ schools/ institutes and bodies under the management and control of the University.
(2)The constituent colleges/ centers/ schools/ institutes and bodies shall be established and managed by the University as per their respective Ordinances. Name of such Institutes shall be as per the decision of the Governing Board.
(3)The University may also collaborate with esteemed houses, corporate bodies, embassies, consulates, diplomatic missions and organizations for the establishment of specialized institutes/colleges and for the introduction of special courses after observing due process through the concerned Ministries, Agencies etc. as may be required.

21. Special Reservation in the University for persons domiciled in the State of Manipur.

(1)The twenty percentage of the seats in all the regular courses conducted on the main campus of the University in the State shall compulsorily be reserved exclusively for the students domiciled in the State of Manipur or State Subjects or legal residents of State of Manipur or those belonging to the State origin including the indigenous population of Manipur origin at all times. The policy for reservation of such seats shall be developed by the University in association with the State.
(2)The University shall make provisions for reservation of non-teaching, non-administrative posts of the University inside the State of Manipur for persons domiciled in the State of Manipur to the extent of at least fifty percent of the total number of non-teaching/non-administrative employees of the University inside the State of Manipur.

22. Investment in the State of Manipur by the University.

- The University shall invest or make or bring a minimum investment of six billion Indian rupees either directly or indirectly in or to the State of Manipur within five years of passage of this Act. This shall be a moral obligation of the University towards the State and its development

23. Mandatory Requirement to be fulfilled by the University.

(1)Upon passage of this. Act, the University shall soon establish a Permanent Endowment Fund for the University with a minimum amount of two crore (twenty million) Indian rupees, by the way of fixed deposit in a nationalized bank and shall own or acquire or possess a minimum of 30 acres of contiguous land anywhere in the State of Manipur either bought or on a long term lease or on a permanent contract.
(2)A compliance report along with an affidavit to this effect by the Chancellor duly attested before the First Class Judicial Magistrate shall be submitted to the State Government as soon as this mandatory requirement as mandated in the sub section (1) is fulfilled.
(3)The mandatory requirement as imposed under this section shall deem to be fulfilled by the University upon such submission as stated in sub section (2).
(4)Upon receiving the compliance report and affidavit as stated in sub section (2), the State Government shall issue a notification, of such compliance, stating the facts including the fact that University has fulfilled its mandatory requirement as required by this section of this Act and by thus, allowing the University to start its full-fledged operations and admit the students. The said notification shall be published in the Official Gazette of the State.
(5)The University shall not admit any student to any of its course unless and until the above mandatory requirement as mandated under this section is fulfilled by the University. However, there shall not be any restriction whatsoever on the University once the mandatory requirement has been fulfilled by the University as per this section.
(6)The amount of Permanent Endowment Fund shall be invested and kept invested as mandated under sub section (1) permanently or until the dissolution of the University. However, the timely bank interest generated from it can be used for developmental activities of.the University as may be decided by the Governing Board of the University.

24. Special powers, privileges, condition, and exemptions for the University.

(1)The University shall be a fully autonomous and independent entity and shall have complete autonomy, accreditation, approval, authority, permission, and recognition from the State in, each and every aspect regarding the affairs related to education subject to observance of guidelines of competent authorities.
(2)By virtue of this Act, the University, shall be eligible for permission, recognition, accreditation and authorization to award/ certify/ conduct/ impart/ recognize any course through all modes and means including campus/ off-campus/ affiliated center/ partner/ regular/ distance/ -correspondence/ external/ online/ credit equivalency/ learning assessment/ honorary/ private etcetera both domestically and internationally in all fields/ subjects and at all levels including but limited to secondary, senior secondary, bachelors, masters, doctoral, post-doctoral, certificate, diploma, licentiate, skill education, professional and vocational training. It shall also have the powers to award various titles, scholarships and distinctions including' honorary doctorates, professorships, and fellowship after observing prior consent and approval from the various competent authorities.
(3)It shall be an International University offering high quality education, teaching, training and an international Institution for the pursuit of intellectual, philosophical, historical, spiritual, profession and vocational studies at all subjects and ,at, all levels and for matters connected therewith or incidental thereto.
(4)The University shall have all-the authority and permission to do everything legal as per law for the fulfillment of its powers and objectives and it shall be free to do so and it shall be fully empowered for the same by the State.
(5)Considering the fact that the University has been established on special grounds with special objectives along with the unique concept, the University shall be a fully empowered establishment/ body with full powers to accredit and recognize any other Institution or organization. The University may accredit, recognize and register any Institution or organization at any point of time with the approval of Governing Board.
(6)The University shall also be a state level accrediting, licensing, registering, recognizing and an assessment body on eduction. It shall also be a State recognized credential evaluating, equalizing and recognizing agency.
(7)The University shall also strive towards the development of the State including investment, promotion, infrastructure development, literacy campaign, poverty elevation, providing of basic facilities in the rural areas, providing all possible guidance to the Government and Government agencies whenever and wherever required (subject to the available resources), environmental protection and preservation, promote employment and skills of the people, promote/research and preserve the State language and culture etcetera.
(8)The University may start research laboratories or stations to conduct extensive research on any subject and to appoint persons of high talent as Scientists, Senior Scientists or Fellows or as Members.
(9)The salary, remuneration, and payment of wages to the faculties and to the staff of the University shall be exclusively decided and revised by the Governing Board. No other rule of any law shall apply as far as the matter of payment and wages at the University is concerned.
(10)Notwithstanding anything contained in any other law for the time being in force, the University shall have powers to confer degrees, diplomas and grant' certificates and confer degrees and honorary degrees and other distinctions and titles, as approved by the Chancellor and the Governing Board.
(11)The University shall have the power of conferring an honorary degree of academic distinction upon any person for his eminent attainments and position subject to the approval of the Chancellor and Governing Board.
(12)To enable higher' education to reach the unreached, the territorial limit shall not be insisted upon in the matter of distance /correspondence /Open or online education mode of learning whenever offered by the UniVersity wherever the relevant guidelines allow to do so.
(13)The University is empowered to establish companies or incubation centers for gainful applications of knowledge and innovations or engage in Partnerships with such agencies or entities, which shall undertake research and innovations for value creation to translate the results of research to products and processes useful to society and industry subject to observance of all necessary statutory and non-statutory provisions in this regard.
(14)The University by a resolution passed by the Governing Board may create different associations/ independent bodies/ councils/ committees/ boards/ bureaus etcetera with such terms and conditions for such purposes it may deem fit and all legal bodies created as such under this section shall be deemed to have been established by this Act provided the objectives of such initiatives is aligned to the promotion of education in general.
(15)Considering the need of the hour, sheer necessity and also for the overall development of the State, its people and its backward/tribal areas; the State hereby declares and also designates the University as its State Open University (SOU) with the dual mode education system subject to following of the relevant laws in this regard.
(16)The University shall also be Correspondence Course Institute (CCI) and shall operate in the conventional dual mode education system.
(17)The University shall also be a State Agriculture University and shall be partner in growth and development of Agricultural Research and Education under National Agricultural Research System especially in the State of Manipur and north eastern parts of India.
(18)The University may start Satellite/ Cable Television Channels, Radio/ FM Channels, and Community Radio Stations or use online platforms to impart education to the masses with prior licenses/approvals from competent authorities.
(19)The University shall have the powers to take and use the services of any person of any organization as Advisers or Consultants, paid or unpaid, honorary or on commission basis. It may include senior citizens/elders or retired employees/persons.
(20)The University shall have the power to appoint, provide support to eminent/talented people as scientist/ senior scientist/ fellow/ serum fellow etcetera as it may think fit along with powers to grant all such titles.
(21)The University shall conduct deep research and also offer various courses on ChausathKalas (sixty four kinds of Vidyas or Kalas) or 64 forms of arts which is believed to have existed in ancient India In 'Vedic times including various forms of dance, drama, literature, fine arts etcetera.
(22)The University may conduct extensive research, surveys, training and implement any schemes for the public and public welfare anywhere in the State such as (including but not limited to) Free Wireless Internet, Free Food, State Library, Creating Greenery and Forest, mass agriculture,. literacy mission, distribution of free plants, seeds and books, conducting health and awareness campaigns on various issues, conducting research and offering sustainable low cost housing etcetera. This can be done and implemented with the collaboration of various departments and agencies of the State.
(23)The University may create unique platforms to promote the State, its culture, tourism, investment and local talent globally.
(24)The University shall carry license and permission to conduct research on any subject and any such research conducted in the University or by the University shall automatically be an intellectual property of the University.
(25)The University shall carry license and permission to start all departments, schools of studies, and colleges of study at all subjects and at all levels.
(26)The University shall have the powers to provide instruction through correspondence courses/ distance education and it shall have the powers to declare a college, department, center or campus as an autonomous college, department, center-or campus, respectively provided the guidelines laid down by the appropriate authorities are fulfilled.
(27)Any college/ institution by whatever name it may be called is run and maintained by the university be treated as its constituent unit and shall have all the privileges of University.
(28)The Chancellor, after consultation with the Governing Board, may create new Schools of Studies on any subject or any field and may abolish or restructure the existing Schools of Studies keeping in view the contemporary needs of the local, state, national and international level.
(29)The University shall also be a State Research Institute with a focus to promote, stimulate and strengthen quality research and advanced research activity in all subjects.
(30)The University is empowered to do self-certification, which shall be exempted from obtaining any permission, approval, license, certificate, no objection certificate, authorization or any other document from the State Government or any entity or autonomous body created by the State Government or under any State Act or Central Act insofar as it is applicable to the State.
(31)The University shall have the powers to provide for the equivalence of degrees, diplomas and certificates of the students completing their courses partially or in full from any other University, Board, Council or any other competent authority.
(32)The University shall be an international legal personality and shall be an international organization, sui generis.
(33)The University may provide for dual degree, diploma or certificate and simultaneous degree or diploma or certificate provided such courses are approved by UGC and other competent authorities.
(34)Any person holding a duly issued valid photo identity card of the University shall have the freedom to enter, stay and move freely throughout the State unless specified otherwise from time to time by the Central and State Government
(35)The University may establish, recognize or affiliate any number of campuses, centers, colleges or institutions inside the State.
(36)The State or any Ministry or any Department or any governmental agency may consult the University for its Expert Opinion or guidance on any matter. The University subject to its resources may guide and advise them suitably.
(37)The University shall commit itself to uphold highest standards of integrity and gold governance and to follow ethical practices in conducting its activities.
(38)The University shall constantly try to take, maintain and update the membership of as many as reputed online libraries, research papers and platforms of online resources and make it available for the use of its students and faculty.

25. Corporations and joint ventures.

- For the purposes of one or more of the objects of the University, it may in accordance with the guidelines and at the discretion of the Chancellor -
(a)be a member of any company, organization, association, society, trust or partnership;
(b)form, manage or participate in the formation of a company, association, trust or partnership;
(c)enter into a joint venture or joint undertaking or agreement or memorandum of understanding with another person, persons, companies, organizations, institution or any University;
(d)to do everything for the fulfillment of its powers and objectives.

26. National and international Accreditation.

(1)The University shall be eligible to seek, apply and accept accreditation/ membership/ recognition/ registration/ award/ listing/ rating etcetera, from any respective national and international accreditation, recognition, auditing, controlling, listing, academic, professional bodies, associations, organizations and other institutions and various authorities for the benefit of the University, its students, faculty, staff and public in general.
(2)The University shall comply and apply to ISO 9001 - Quality Management System (QMS) and ISO 14001 - Environmental Management System (EMS) and shall always be an ISO Certified University from a reputed and recognized ISO auditing and certifying agency affiliated to a reputed international agency/body which shall be a member or signatory of the International Accreditation Forum (IAF).

27. National and International Collaboration and other matters.

(1)The University may collaborate, tie-up and have any kind of agreement or understanding, enter into faculty or student exchange programs or credit sharing or co-certification or joint certification including use of syllabus, text books, training material, or use of the facility or use of infrastructure etcetera with any Indian or Foreign University/ Institute or Organization in whatever way it deems fit for the fulfillment of its objectives.
(2)The Chancellor may also appoint qualified Indian or Foreign Nationals / Scientists/ Academicians as Emeritus/ Special/ Research/ Honorary/ Visiting/ Meritorious/ Distinguished/ University/ Clinical/ Adjunct/ Teaching/ Collegiate Professor or as a Professor or with whatever name it may call it under special category with a rank and grade equivalent to that of Indian or University Professors. However all such posts and appointments under such special category shall be honorary and voluntary. All those appointees appointed under special category shall not be entitled to any kind of salary except some customary privileges including but not limited to travelling and housing allowances or honorarium as allowed as per the terms and conditions of appointment.
(3)The University may recognize the educational degrees/diplomas of any native or foreign University or of an educational institution, and may grant or fix the equivalency and standard of various degrees of the University with those degrees.
(4)The University may appoint its representatives, resident/ regional Commissioners or its Ambassadors in any region/ state or country for the purposes and objectives, it may deem fit.
(5)The University is hereby declared fit and eligible to apply from time to time for the appropriate membership category and it shall have cooperation and active association / membership with the University Grants Commission (UGC), the Association of Indian Universities (MU), the Council of Boards of School Education in India (COBSE), etcetera including all other such associations, councils, boards and related Chambers of Commerce and Industries.
(6)The University shall co-operate, coordinate and tie-up with various national and international educational bodies /organizations including apex professional bodies for creating various courses, quality content and educational programs etcetera.
(7)The University may sign cooperation agreement with all the Universities and other institutions in the State of Manipur which may include knowledge/ information sharing, facility / infrastructure sharing, dual degree, faculty/ student exchange etcetera.
(8)The University may start, acquire, venture, partner or own the Universities or Specialized Institutions in other parts of India and the globe subject to conforming to the rules and regulations of such place or territory.
(9)The University shall partner, tie-up or enter into an agreement with Indian Institute of Management's (IIM's) and Indian Institute of Technology's (UT's) for development of quality content and programs. The agreement may include knowledge/ information sharing, facility or faculty, sharing, dual degree programs and consultancy for developing a world-class School of Studies or anything mutually beneficial.
(10)The University may acquire or own any Trust, Society, non-governmental organization or entity registered under any enactment and the properties owned by them anywhere in the country for the attainment of its purposes and objectives.
(11)The University shall establish secured international seed and safety vault in the State of Manipur with such National and International collaboration as may be , required.
(12)The University shall be the founding member and host partner of the International Federation of Indian Universities. the International Free Universities Alliance, and the Federation of International Universities.
(13)The University shall establish a world class science observatory in the long term and shall offer short term courses on astronomy and its related sciences in association with the related professional bodies and shall obtain membership and guidance of the Astronomical Society of India and the International Astronomical Union.
(14)The University shall offer various academic titles and professorships such as Distinguished Visiting Professor, Visiting Professor, Emeritus Scientist, Senior Scientist, Junior Scientist, Emeritus Professor, International Fellow, National Fellow etcetera. This shall be a special initiative of the University to attract distinguished academicians/personalities for short term period to teach course in their area of expertise, foster multiculturalism, diversity, international exposure and academic excellence and also the development and evaluation of research, faculty development program/ seminar, conducting special course / expert workshops, developing grant projects. The University shall publish a separate set of rules and regulations for the same.

28. State Advisory Council of the University and other matters.

(1)There shall be a State Advisory Council of the University.
(2)The State Advisory Council of the University shall be constituted by the Governing Board in consultation with the State Government and it shall provide all the necessary guidance, assistance, and local ,support whenever required by the University.
(3)It shall also consist of representatives from the State Government and eminent personalities including people from the State of Manipur.
(4)It shall frame rules and criteria for the selection of local candidates for the admission and it shall also function as a selection committee for the selection of students from the State of Manipur under reserved category.
(5)It shall serve as an advisory body to the University which may advise and assist the University in different aspects as required from time to time.
(6)The Chancellor may brief the State Advisory Council of the University on any matter concerning the University and seek guidance and opinion on various matters.
(7)There shall be an. Internal Quality Assurance Cell (IQAC) of the University and an External Quality Assurance Cell (EQAC) of the University. The External Quality Assurance Cell (EQAC) of the University shall work directly under the directions and guidance of the State Advisory Council of the University while the Internal Quality Assurance Cell (IQAC) of University shall report to the Chancellor.
(8)The periodic reports submitted by the Internal Quality Assurance Cell (IQAC) of the University and External Quality Assurance Col (EQAC) of the University shall also be placed before the State Advisory Council of the University for its suggestions.
(9)It may call for 'any information related to the University and it shall be the duty of the University to furnish all such information which is available with the University.
(10)This shall also work as a chain linkage between the University and the Government for effective coordination.
(11)There shall be a separate State Development Council which shall be chaired by the Chancellor of the University which is to be constituted by the Governing Board and it shall be dedicated to the public polity, planning, promotion, research and development of the State of Manipur in total and it shall constantly work and coordinate with various state /central Governments and international agencies, organizations, including companies or corporate entities for the promotion of the State of Manipur in total including its culture, heritage, tourism, language, human resource development, skill improvement and its infrastructure development
(12)There shall be an international Planning and Advisory Board of the University which is to be constituted by the Governing Board of the University for the promotion and propagation- of the University, national and international collaboration, scientific and academic excellence, assistance and expert guidance on various matters, replication of University model and for the overall development of the University. It may consist of various eminent personalities and peoples from various cultural backgrounds including eminent educationalists/ scientist etcetera and it may assist the Governing Board and the Chancellor whenever required. They shall also assist, advise and indicate the lines on which the University shall develop.
(13)The University shall always strive towards overall development and promotion of the State of Manipur including extending complete support in all possible ways and in all aspects including extending advisory services, rural development, infrastructure development, promotion/ protection / preservation of culture/ language/ tradition/ heritage of the State tourism promotion, environmental protection, development of economy etcetera.

29. Purposes and powers of the University.

- The purposes and powers of the University shall be the following, namely:-
(i)to disseminate and advance knowledge by providing instructional and research facilities in such branches of learning as it may deem fit; to make special provisions for integrated courses in humanities, social sciences, science and technology in its educational programs; to take appropriate measures for promoting innovations in teaching-learning process and interdisciplinary studies and research; to educate and train manpower for the development of the country; to establish linkages with industries for the promotion of science and technology; and to pay special attention to the improvement of the social and economic conditions and welfare of the people, their academic, cultural, creative and intellectual development;
(ii)to provide quality education, training to the masses at all levels and in all subjects;
(iii)to promote, support, recognize and accredit the concept of free education and its movement;
(iv)to make provision for providing, upgrading and promoting holistic and inclusive education and training and research in such education as set out in the objects, and to create an enabling and conducive environment for the pursuit of such education in close cooperation with other experts, scholars and interested persons in India and abroad;
(v)to provide instruction, teaching, training, and coaching in the field of secondary, senior secondary, higher, technical, professional education; and to make provisions for research, advancement and dissemination of knowledge. and to provide for instruction in such branches of learning as the University may think fit including but not limited to professional, vocational and technological studies;
(vi)to set up a consortium of international partners, institutions, Universities and friendly countries in furtherance of the objects of the University;
(vii)to generate and maintain resources through consultancy services, continuing education programs, national and international collaborations and intellectual property rights;
(viii)to provide for instruction in such branches of learning as the University may, from time to tithe, determine and to make provisions for research and for the advertisement and dissemination of knowledge;
(ix)to establish such special centers and specialized, laboratories and such other units for research and instruction as are necessary for the furtherance of its objects;
(x)to establish, recognize and to support any such University, Institute, college or school as the University may deem fit to achieve any of its objectives especially to promote and popularize the concept of free education and its movement;
(xi)to plan and prescribe courses of study and training for degrees, diplomas, certificates or for any other purpose;
(xii)to recognize, accredit, affiliate, de-recognize, disaffiliate, start and support any University, any institute, any school, any college, any organization, any certification or any program of any kind for the fulfillment of the purposes of the University;
(xiii)to inspect colleges and institutions affiliated, recognized, accredited or seeking affiliation /accreditation/recognition with the University;
(xiv)to prescribe and update conditions for the course of instruction/examinations and conduct examinations and to grant qualifying certificates to successful candidates in all subject and at all levels.
(xv)to institute and to confer degrees, titles, diplomas, certificates and other academic distinction of any type and also to confer honorary degrees, ad eundem degrees or other distinctions, honorary Professorships or other academic distinctions in the manner prescribed;
(xvi)to hold examinations, conduct coaching or training and to grant diplomas or certificates to, and confer degrees and other academic distinctions on, persons who have pursued a course or training of study or conducted research in India and anywhere in the world including any of its centers, in the manner laid down by the Statutes, Ordinances, Rules or regulations;
(xvii)to Institute Professorships, Readerships and Lectureships and other teaching and academic positions, required by the University and to appoint persons to such Chairs, Professorships, Readerships and ,Lectureships and other teaching and academic positions;
(xviii)to appoint visiting professors, Emeritus professors, Research ProfeSsors, consultants, advisers, coordinators, counselors, scholars and such other persons who may contribute to the advancement of the objects of the University;
(xix)to recognize persons as professors, associate professors, or assistant professors or otherwise as teachers of the University;
(xx)to create administrative and other posts as the University may deem necessary from time to time and make appointments thereto;
(xxi)to lay down conditions of service of all categories of faculties, employees, including their code of conduct;
(xxii)to establish and maintain various centers of learning or training at all levels and across all subjects in India or outside India, as may be determined from time to time;
(xxiii)to admit institutions situated within its jurisdiction as the University institutions and to confer or to withdraw all or of those privileges in accordance with such conditions as may be laid down by its Statutes, Ordinances, Rules or Regulations;
(xxiv)to establish University Main Campus' and Headquarters in the State of Manipur, and to establish, recognize or to have or to maintain campuses, training centers, regional centers, academic centers, research centers, skill development centers, vocational training centers, colleges, study centers, learning centers, institutions, colleges, schools, Off-Campus centers, research stations, extension centers, finishing schools either direct/indirect/virtual/affiliated mode anywhere in the State of Manipur and elsewhere in India or abroad as it may deem fit:
Provided that the University may, with the approval of Governing Board, establish such centers anywhere outside India;
(xxv)to affiliate, recognize or collaborate with any other college, University, research, institution, industry association, professional association, or to develop and run specific educational research programs, vocational training, exchange programs and any such programs anywhere in India or abroad (outside India) which the University may consider appropriate for students, faculty members, general public and others;
(xxvi)to recognize the various courses and programs offered by the individuals, institutions, and organizations in various streams of education offered in the multi-mode methodology of teaching;
(xxvii)to undertake surveys, studies, and consultancy for any organization in India or overseas;
(xxviii)to develop, register and license all forms of Intellectual Property rights, including inter alia patents, trademark and service marks, copy rights, know-how etcetera;
(xxix)to conceptualize, design, develop, produce, recognize, support, manufacture and to market various products, equipments, ,and machinery as part of the research, development and vocational training activities;
(xxx)to co-operate or collaborate or associate with any other University or author, or institution of higher learning or any other public or private body, having in view the promotion of purposes and objects similar to those of the University, in such manner as may be prescribed and for such purposes as may be determined or agreed upon by the University;
(xxxi)to determine standards of admissions, including examination, evaluation or any other method of testing, to the University, and the institutions maintained by or admitted to the privileges of the University;
(xxxii)to create higher levels of intellectual abilities, to promote self-esteem, personality development, and skill enhancement;
(xxxiii)to develop, offer and to institute various vocational certificate and diploma courses, Personality Development Studies, Executive Development Programs, Life Skill Education, Bridge courses for Technical/non-technical Students and various specialized training programs at all subject and at all levels;
(xxxiv)to institute, maintain and manage. University, its colleges, laboratories, libraries, museums and other institutions necessary to carry out the objects of the University;
(xxxv)to affiliate colleges, institutes, centers and schools to the University as affiliated, professional or post-graduate colleges under conditions prescribed and to withdraw affiliation from such colleges and institutions;
(xxxvi)to approve colleges and schools providing courses of study for admission' to the examinations for titles and diplomas and the secondary and senior secondary courses of the University under conditions prescribed and to withdraw such approval;
(xxxvii)to exercise such control over the students of the University through the colleges as will secure their health and well being;
(xxxviii)to conduct awareness campaigns on various aspects/issues and actively participate in such awareness campaigns;
(xxxix)to launch any academic or research programs, courses, the discipline of education, training deemed suitable for meeting the purposes and powers of the University;
(xl)to create academic, administrative and support staff and any other necessary posts;
(xli)to organize and conduct refresher courses, orientation courses, workshops, seminars and other programs for industry executives, teachers, developers of course-ware, evaluator and other academic staff;
(xlii)to provide for the preparation of instructional materials, including films, audio visual communication, CD, VCD, DVD, online and other software;
(xliii)to recognize examinations of periods of study (whether in full or in part) of other Universities, institutions, or other places of learning as equivalent to examinations or periods of study in the University and to withdraw such recognition at any time;
(xliv)to create Industry academia partnership by inviting industry in the University;
(xlv)to start, recognize, or to affiliate any industry/ organization specific program in partnership with any industry;
(xlvi)to institute degrees, diplomas, certificates and other academic distinctions on the basis of examination, or any other mode of evaluation and assessment as laid down by the Academic council;
(xlvii)to offer all types of courses and training at all levels and at all subjects through all modes of education including but not limited to traditional, residential, distant, correspondence, open, online and virtual modes;
(xlviii)to demand and receive payment of any fees from students and all other fees including consultation fees and other charges where the expertise/ support of me University, its assets or Scholars has been sought by any corporate, organization or institution etcetera.
(xlix)to establish Halls and to recognize, guide, supervise and control Halls not maintained by the University and other accommodation for students, and to withdraw any such recognition;
(l)to supervise and control the residence and discipline of the students of the University;
(li)to establish and maintain hostels, and under prescribed conditions, to recognize hostels not so established or maintain, and to withdraw such recognition;
(lii)to create all such posts as are required for the University and appoint persons thereto;
(liii)to provide and to recognize, in the manner prescribed, lectures, trainings and instructions for the persons who are not pursuing a course of study in the UniVersity, and to grant diplomas, certificates, and awards to them;
(liv)to institute, and confer various awards, fellowships and including travelling fellowships, scholarships, medals and prizes in the manner prescribed;
(lv)to launch any academic or research programs, courses, the discipline of education, training deemed suitable for meeting the purposes and powers of the University;
(lvi)to create Academic administrative and support staff and any other necessary posts;
(lvii)to organize and conduct refresher courses, orientation courses, workshops, seminars and other programs for industry executives, teachers, developers of course-ware, evaluator, (sic) academic staff or to the public and the masses in general;
(lviii)to provide, publish, support for Pie preparation of instructional materials, texts, including films, cassettes, tapes, video cassettes, CD, VCD, DVD and, other software;
(lix)to innovate and impart education/training through any means of communication, such as broadcasting, telecasting, the internet, open and distant learning, correspondence courses, online, e-learning, seminars, contact programs or the combination of any two or more such means;
(lx)to recognize examinations of periods of study (whether in full or in part) of other Universities, Institutions, or other places of learning as equivalent to examinations or periods of study in the University and to withdraw such recognition at any time;
(lxi)to create Industry academia partnership by inviting industry in the University campus and other University centers for mutual benefits;
(lxii)to enter into, carry out, vary, or cancel contracts, memorandum of understandings, and agreements;
(lxiii)to create, amend and cancel the rules and regulations to fulfill the purposes and powers of the University;
(lxiv)to seek and to give accreditation/ recognition/ certification from/to respective national and international accreditation/ recognition bodies, other Academic Institutions, and authorities for the benefit of the University, its students, faculty and public in general;
(lxv)to ensure that the standard of the degrees, diplomas, certificates and other academic distinctions of a high standard;
(lxvi)to make arrangements for promoting health and general welfare of students and employees of the University;
(lxvii)to regulate and enforce discipline among the students and the employees, and to take such disciplinary measures in this regard as may be deemed by the University to be necessary;
(lxviii)to receive benefactions, donations and gifts of any kind and to acquire, hold, manage, lease, mortgage and dispose of any property, movable or immovable, including trust and endowment properties, for the purposes or object of the University or its constituent institutions, colleges, centers, and schools etcetera and to invest funds in such manner as the, Governing Board may deem fit;
(lxix)to govern, maintain, administer, dispose of and, save as hereinafter provided, to invest all the property, money, assets, and rights of the University, to manage the business and all other affairs whatsoever of the University, and to enter into engagement's and to accept obligations and liabilities without any restriction whatsoever, in the same manner in all respects as an individual may manage his own affairs;
(lxx)to sell, buy, exchange, lease, rent, grant or take on lease or rent, real or.personal property or portions thereof on behalf of the University, and to acquire any easement over any property held by other persons or to consent to any easement whether public or private over any property of the University;
(lxxi)to enter into, vary, carry out or cancel contracts on behalf of the University, to compound or compromise any action, suit or proceedings or any debt or claim, and to refer any matter to arbitration;
(lxxii)to raise, collect, subscribe and borrow with the approval of Governing board whether on a security of the property of the University, money for the purposes of the University;
(lxxiii)to recognize for any purpose, either in whole or in part, any institution or members or students thereof on such terms and conditions as may, from time to time, be prescribed and toy withdraw such recognition;
(lxxiv)to provide for research and the advancement and dissemination of knowledge;
(lxxv)to co-operate and have an association, understanding with other Universities, Institutions, authorities or Governments for promoting the purposes of this Act;
(lxxvi)to provide "Education for All" which includes formal and informal modes of instructions keeping in view the literacy and the' educational needs of deprived sections of the society by establishing informal educational centers in and outside the State of Manipur and overseas as to achieve maximum percentage of literacy and education at least up to the level of matriculation;
(lxxvii)to create, search, provide multiple opportunities, employment, talent, placement solutions etcetera for students and to one and all;
(lxxviii)to take and bring educations to 'the rural and tribal parts and to provide education, and training to deprived class;
(lxxix)to demand and receive any kind charges and fee including but not limited to consultancy, subscriptions, deposits, fines and such other payments, and to effect payment of any monetary obligation;
(lxxx)to take such steps as it thinks fit for the purpose of procuring and receiving contributions to the funds of the University to farther the objects of the University, and, for this purpose, to raise money in such manner as it thinks fit;
(lxxxi)to encourage sports, cultural, extracurricular and co-cur 'War activities for students, staff and to the masses;
(lxxxii)to organize and to conduct inter-cultural, intra-cultural, competitions including sports, games etcetera for students, staff and to the masses;
(lxxxiii)to make provision for research and advisory services and for that purpose to enter into such arrangements with other institutions or bodies as it may deem necessary;
(lxxxiv)to provide for the printing, reproduction, and publication or research and other work which may be required by the University;
(lxxxv)to appoint bankers, and any other officers or agents whom it may deem expedient to appoint, to determine any matters relating to the selection and period, terms and conditions of appointment of such persons, to determine and control all matters relating to the opening, use and closing of any such bank accounts as it thinks fit to have, and to cause proper books of account to be kept and audited for all sums of money received and expended by the University and for the assets and liabilities of the University so that the books give a true and fair view of the state of the University's affairs, and explain its transactions;
(lxxxvi)to determine the terms of service and general conditions relating to the employment of faculty, officers or any other administrative, clerical, technical and support staff, and to establish, disestablish, or otherwise make or discontinue financial provision for appointments to such posts;
(lxxxvii)to determine the salary scales and general rates of payment for alt categories of Faculty, Officers and other Staff appointed by the University and for other persons commissioned to give services to the University, and to appoint and employ such persons, pay their salaries, wages or fees, and, subject to the provisions of this Act, its Statutes, Ordinances, Rules and regulations, and to terminate their appointments;
(lxxxviii)to make provision, so far as it thinks fit, for schemes of insurance, superannuation, pensions or retirement benefits for persons in the employment of the University and the wives, widows, and dependents of such persons, to subscribe to benevolent and other such funds for the benefit of such persons, and to make such payments as it thinks fit to such persons;
(lxxxix)to make provision for research and advisory services and with these objects to enter into such arrangements with other institutions or with public/private bodies as may be thought desirable;
(xc)to provide for the printing and publication of research and other works which may be issued by the University;
(xci)to appoint scientists/ senior scientists/ scholars, teachers for research;
(xcii)to provide teaching, research, development, consultancy or other services for public or private entities;
(xciii)to assist or engage in the development or promotion of the University's research or the application or use of the results of that research;
(xciv)to prepare, publish, distribute, market or to license the use of literary or artistic work, audio or audiovisual material or computer software;
(xcv)to commercially exploit a facility or resource of the University, including but not limited to, study, research or knowledge developed by or belonging to the University, whether alone or with another entity;
(xcvi)to promote and conduct agricultural/ horticultural research activities and programs;
(xcvii)to start, establish, recognize and to support an alumni association of the University;
(xcviii)to pay special attention to the improvement of social and economic welfare of the people by developing suitable Programs in all aspects of life;
(xcix)to promote interest in the life, literature, languages, and culture of State and the Nation;
(c)to establish schools of studies and courses in disciplines relevant to the life, needs, and aspirations of the people and their geographical and industrial profile;
(ci)to provide adequate facilities for the educational and professional advancement of socially, economically and educationally backward and under privileged 'community from rural areas;
(cii)to create an opportunity for appropriate academic and professional education 'for men and women;
(ciii)to promote interest in physical efficiency and excellence in sports, and social service among the youth;
(civ)to associate or admit any educational institution, college or school with or to the privileges of the University by way 'of affiliation, recognition or approval;
(cv)to grant, withdraw or modify either in whole or in part, affiliation, recognition, Approval, accreditation of any educational institution, college or school;
(cvi)to institute, initiate, start, fund, recognize, promote and to manage any department/ bureau including but not limited to Printing and Publication Department, Information Bureau, Bureau of Student Welfare and Support; Employment Bureau etcetera within or outside the University;
(cvii)to make provision for the various activities including but not limited to continuing education, adult education, skill education, vocational studies, extension services, extra moral teaching, sex education and other recognized education activity, physical education, National Cadet Corps, National Service Scheme, National Sports Organization, the Bharat Scouts and Guides, Indian Red Cross, military training and such other recognized activities, various sports and athletic activities etcetera;
(cviii)to make arrangements for training for competitive examination for recruitment to the services under the Union and State Governments;
(cix)to act as trustees or managers of any property, legacy, endowment, bequest or gift for purpOses of education or research or otherwise in furtherance of the work and welfare of the University, and to invest any fun& representing such property, legacy, endowment, bequest or gift, if not immediately required, on such security as the University may deem fit;
(cx)to enter into contracts, establish trusts, act as trustee, solely or jointly with any other person, and employ and act through agents;
(cxi)to approve, honor, recognize and to execute any agreement, instrument, document Memorandum of Understanding, done or agreed by the University or by the Chancellor in any capacity;
(cxii)to erect, provide, equip and maintain libraries, laboratories, lecture hails, halls of residence, refectories, sports grounds, playing fields, memorials, museums, observatories, and other buildings or things (whether in Manipur or elsewhere) necessary or suitable or convenient for any of the objects of the University;
(cxiii)to hold public lectures, seminars, campaigns and to undertake publishing and book selling;
(cxiv)to research, recognize, support, protect, preserve, promote, research and to recognize any / all subjects/ fields at all levels including but not limited to ancient/ traditional/ oriental Indian System, 'Sciences and Technologies, local State culture, Traditional medical/treatment systems, healing therapies, Yoga etcetera and matters related thereto;
(cxv)subject to any limitations or conditions imposed by statute, to invest any amount of money appertaining to the University by way of endowment, whether for general or special purposes, and such other moneys as may not be immediately required for current expenditure, in any investments or securities or in the purchase or improvement of land, with power from time to time to vary any such investments, and to deposit any moneys for the time being not invested with any bank on deposit, savings or current account;
(cxvi)to make 'gifts for any charitable purPose or to any charitable organization;
(cxvii)to take such steps as it thinks fit for furthering the objects and interests of the University by making provision for teaching and research, for the printing and publication of research and other works which may be issued by the University, and for the welfare of the Faculty, the staff and the students of the University; such steps to include the provision and maintenance of grounds, recreation facilities, buildings, premises, furniture, equipment and other means required for carrying on the work of the University and maintaining its efficiency and well-being;
(cxviii)to enter into agreements and other relationships with other institutions or bodies, whether academic or otherwise, for such purposes as the Council may determine, including the embodiment within the University of any other institution or body and the taking-over and assumption of the property, the property, right, privileges and liabilities of such other institution or body;
(cxix)to accept, recognize and certify any person who have or who have not received their instruction at the university, or in any affiliated college or institution, who may be admitted as candidates for examination for standing or for any degrees, honours, scholarships or certificates of proficiency authorized to be granted or conferred by the university on such conditions as the Chancellor may from time to time determine;
(cxx)to exercise such other powers accorded to it and to do all such other acts and things as may be necessary, incidental or conducive to the promotion of all or any of the purposes and powers of the University aforesaid or not but not inconsistent therewith; as may be requisite to further the purposes and objects of this Act;
(cxxi)to act and to execute all powers and objectives of the University given not only in this section but also anywhere in this Act or by Statutes, Ordinances, Rules and Regulations made thereafter,
(cxxii)to do anything and everything for the fulfillment of its Powers and Objectives and for the matters and incidents related thereto;
(cxxiii)to pursue any other objective as may be approved by the Governing Board.

30. The President of the University and his Powers, duties, and privileges.

(1)The Chancellor shall have the powers to appoint, anyone as the President of the University in consultation with the Governing Board.
(2)He shall have the power to promote the University, the Free international Education for Free Movement, the (sic) importance of Free Knowledge Society, the State, its culture etcetera in every possible way.
(3)He shall also lobby for the establishment of more such Universities and institutes around the globe and he shall supervise, advise, guide and assist the University in all matters concerned and, related to the University.
(4)He shall hold office normally for three years and eligible for re-appointment unless terminated/withdrawn or as specified by the Chancellor.
(5)The President shall supervise advise, guide and assist the University in all matters concerned and related to the University.
(6)He shall be permanent invitee to the Convocations and award functions of the University.
(7)The President may be entitled to a fixed honorarium and all such customary and standard privileges as may be fixed by the Chancellor.
(8)The President shall exercise such other powers and perform such other duties as may , be conferred on him under the provisions of this Art, its Statutes, Ordinances etcetera or specifically given/granted by the Chancellor.

31. General Counsel of the University.

(1)There shall be General Counsel of the University who shall be appointed by the Chancellor in consultation with the Governing Board.
(2)The General Counsel shall be the Chief Legal Officer of the University. He is empowered to appoint other legal representatives on a case to case basis as to assist him or to represent or the University in a way he may deem fit.
(3)The General Counsel shall be assisted by the Senior and Junior Law Officer/s of the University. Senior and Junior Law Officer/s shall be full-time salaried law officers of the University.
(4)The General Counsel shall have the right to appoint/replace Senior and Junior Law Officer/s of the University in consultation with the Chancellor.
(5)There shall be Office of the General Counsel (OGC) which shall be responsible for the coordination and management of all legal issues affecting the University including incubation centers and any other undertakings or subsidiaries of the universities. It shall advise the Governing Board, the Chancellor and the University's academic and administrative units regarding a wide range of issues, including contracts, regulatory compliance, employment law, intellectual property, student conduct, and governance etcetera.
(6)The goal of the Office of the General Counsel (OGC) shall be to provide, quality legal services promptly and effectively and to assist in minimizing legal risks and costs efficiently, reliably and professionally while supporting the University's missions including teaching, research, and scholarship.
(7)The General Counsel shall not be considered as an employee of the University and shall not be debarred from private legal practice. He is entitled to the honorarium and other monthly allowances and privileges as may be decided by the Governing Board.
(8)The Chancellor may seek the legal advice of the General Counsel on all the important legal, official and confidential matters.
(9)All the contracts which the University shall be party to shall be attested by the Office of the General Counsel (OGC).
(10)The General Counsel shall exercise such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etc.

32. The Patron/s of the University, their Powers, duties, and privileges.

(1)The Chancellor shall have the powers to appoint eminent personalities in any field or in their respective field as the Patron/s of the University at his discretion.
(2)The Patron/s shall hold office for life unless terminated/withdrawn by the Chancellor.
(3)The Patron/s shall be the Advisers of the University.
(4)They shall be permanent invitees to they Convocations and award functions of the University and they shall assist, guide and support the University in every possible way.
(5)The Patron/s, at all times, shall be the honorary officer/s of the University and shall not be entitled to any kind of salary except the customary and standard privileges, support services as may apply and as may be required for proper functioning of his powers and duties as Patron/s or as may be decided by the Chancellor.
(6)The Patron/s shall exercise such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera or specifically given/granted by the Chancellor.

33. The Brand Ambassador/s and Honorar, Chairman of the University, his Powers, duties, and privileges.

(1)The Chancellor shall have the powers to appoint eminent personalities in any field or in their respective field as the Brand Ambassador/s of the University at his discretion.
(2)The Chancellor shall have the powers to appoint any eminent personality as the Honorary Chairman of the University.
(3)The Brand Ambassador/s and Honorary Chairman of the University shall and shall have the power to promote the University, the Free International Education for Free Movement, the importance of Free Knowledge Society, the State, its culture etcetera in, every possible way.
(4)They shall assist, guide, promote and support the University in every possible way.
(5)They shall also lobby for the establishment of more such Fred near-free Universities and institutes around the globe.
(6)The Brand Ambassador/s shall hold office for life unless terminated/withdrawn or as specified by the Chancellor.
(7)The Honorary Chairman/s shall hold office for a fixed term of three years and they are eligible for re-appointment.
(8)They shall be permanent invitees to the Convocations and award functions of the University.
(9)The Brand Ambassador/s and - honorary Chairman, at all times, shall be the honorary officer/s of the University and shall not be entitled to any kind of salary except the customary and standard privileges, support services as may apply and as may be required for proper functioning of his powers and duties as Brand Ambassador/s or honorary Chairman as may be decided by the Chancellor.
(10)The Brand Ambassador/s and Honorary Chairman shall exercise such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera or specifically given/granted by the Chancellor.

34. The Founder of the University, his Powers, duties, and privileges.

(1)The present Secretary of the proposing body who is an eminent national level social activist, constitutional expert and the founder of the International Education for Free Movement shall ï be the First Founder of the University in his individual capacity.
(2)The Founder shall be the principal holder of the University as an individual and he shall be the Principal Chief Supervisor of the University.
(3)The Founder shall be the ex-officio invitee to all the meetings of the University. He shall also be the ex-offiCio member of all Boards, Councils and authorities of the University.
(4)The First Founder shall be the first Chancellor of the University.
(5)The Founder shall be the Chancellor-in Charge whenever the Chancellor post remains vacant or Chancellor is on Approved long leave, if any.
(6)He shall be the permanent invitee to the Convocations and award functions of the University.
(7)The Founder may require any officer of the University to furnish him with the information and all papers or copies thereof relating to any matter concerning the University at any point of time. The Founder may also request further consideration of the matter by the authorities or officers concerned or place his views thereon before the Governing Board for their due consideration or may do both.
(8)The Founder and the Additional-Founder, at all times, shall be the honorary officer/s of the University and shall not be entitled to any kind of salary except the customary and standard privileges, support services as may apply and as may be required for proper functioning of his powers and duties as Founder / Additional Founder or as may be decided by the Governing Board.
(9)The Founder shall always be a State Subject of the State for all purposes and state laws shall apply.
(10)The First Founder shall be Founder of the University in his individual capacity, for life at his pleasure.
(11)The Founder shall have the right and power to nominate/appoint /change/ replace any suitable person as the Founder Co-Founder at his absolute wish, will, discretion and with such terms and conditions at any point of time.
(12)The First Founder shall appoint the next 'Founder and he shall continue as Founder of the University until he appoints the next one.
(13)The present designated Member Trustee of the proposing body shall be the Additional Founder of the University and shall have all such powers, privileges, and honours as of the Founder and shall have the right and power to nominate any (Sic) suitable person as the Additional Founder at his absolute wish, will, and discretion.
(14)The Founder shall also exercise such other privilege, such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera.

35. Officers of the University The following shall be the officers of the University.

(1)The Chancellor;
(2)The Vice-Chancellor,
(3)The Registrar;
(4)and such other officers as may be declared by the Statutes to be the Officers of the University.

36. The Chancellor of the University, his Powers, duties, and privileges.

(1)The Chancellor shall, by virtue of his office, be the Acting and Executive Head of the University and shall preside at the Convocations and award functions of the University.
(2)He shall be Member ex-officio of the Governing Board, the Academic council and all such authorities of the University and shall be entitled to be present at and to address any meeting of any authority of the University.
(3)The Chancellor shall be the Chief Executive Authority, Chief Principal Executive, Chief Administrative Officer and Chief Academic Officer of the University and shall exercise general supervision and control over the affairs of the University and give effect to all the decisions of all the authorities oldie University.
(4)The Chancellor of the University shall be the Special Adviser to the State in an honorary capacity especially on the matters of Education and Rural Development. He shall also be the Education and Cultural Ambassador of the State in an honorary capacity.
(5)All powers relating to the proper maintenance of discipline in the University shall stand vested with the Chancellor.
(6)All the authorities and offices of the University shall be subordinate to the Chancellor. The Chancellor shall be and shall have plenipotentiary powers of the University at all matters pertaining to the University. However, he will report to the Governing Board.
(7)The Chancellor shall be entitled to a fixed monthly honorarium or a fixed monthly salary and all such customary and standard privileges, support services as, may apply and as may be required.for proper functioning of his powers and duties as Chancellor or as may be decided by the Governing Board.
(8)Every proposal for the conferment of. any honorary degree shall be subject to the confirmation of the Chancellor and the Founder.
(9)The Chancellor may take action as he deems necessary in any emergency which, in his opinion, calls for immediate action. He shall in such a case and as soon as may be thereafter, report his action to the officer, authority or another body of the University concerned who or which would ordinarily have dealt with the matter.
(10)The Chancellor shall give effect to the orders of the Governing Board, and the Academic Council and all other authorities of the University.
(11)It shall be the duty of the Chancellor to ensure that the provisions of this Act, and the Statutes, Ordinances, Rules and Regulations and of any appropriate Instrument are duly observed and he shall have and may exercise all such powers as he may deem necessary for the purpose.
(12)The Chancellor may, by order in writing, annul any proceedings of any of the authorities of the University which is not in conformity with this Act and the Statutes, the Ordinances, the Regulations, the Rules or any other law for the time being in force: Provided that, before making any such order, the Chancellor shall call upon such authority to show cause why such an order should not be made and consider the cause if any, shown by such authority within a reasonable time.
(13)The Chancellor shall have the power to sign, verify and enter into agreements, contracts, documents, instruments and authenticate records on behalf of the University and shall exercise such powers and perform such duties as may be prescribed by the Statutes.
(14)In all suits and other legal proceedings by or against the University, the pleadings shall be signed and certified by the Chancellor and all processes in suits and proceedings shall be issued to, and served on, the Chancellor.
(15)The Chancellor shall have the right to appoint, suspend or dismiss any of the authorities. of the University and to take measures for the interim administration of the University:Provided that before taking any such action, the Chancellor shall give an opportunity to such authority to show cause why such an action should not be taken.
(16)The Chancellor shall have the right to create, appoint, suspend, abolish or dismiss any / all the employment, employees, staff faculties of the University including but not limited to the ministerial, technical and inferior staff and to delegate, any of the work's as per his discretion. He shall exercise supreme control over all the employees, staff; faculties of the University.
(17)The Chancellor shall have the right to create / appoint any post and to appoint anyone for the post which he may think fit. He shall also, be empowered to outsource any service or the work of the University to any organization, agency or, to any person/s. This may be done in consultation with the Governing Board.
(18)The Chancellor shall be responsible for the execution of policies and measures approved by the Governing Board in relation to the University and, subject to such policies, the direction, supervision, and control of the University, including its administration; and for the maintenance of discipline within the University and any of its centers.
(19)The Chancellor shall have powers to resolve any conflict in the manner he may think fit. In the event of there being a conflict inter-se between the functionary or functionaries or body or bodies and any other functionary or body of the University, then the issue shall be referred to the Chancellor and the decision' of the Chancellor in respect of such issue shall be final and binding on the University.
(20)The Chancellor shall have the power to change and to relocate the University Headquarters and the Administrative Campus or the Main Campus of the University to any location or place in the State, subject to the approval of the Governing Board. He shall also have the powers to establish Main or additional Administrative Campus/ Research Campus at any location in or outside Manipur, subject to the approval of the Governing Board. This is in addition to all such powers which may exist.
(21)The Chancellor shall, if present, be entitled to attend any meeting of any Authority, body or Committee of the University.
(22)The Chancellor may, upon the recommendations of the Governing Board, remove any person from the membership of the Governing Board or Academic Council:Provided that before passing such resolution the Governing Board shall provide the member concerned a fair hearing.
(23)The Chancellor shall also have the powers to
(a)direct Officers, Faculty members, Teachers and other employees of the University to take up such assignments in connection with examination, administration and such other activities in or , for the University as he may consider necessary for the purposes of the University;
(b)sanction by re-appropriation an amount not exceeding an amount prescribed by the Governing Board for an unforeseen item not provided for in the budget and report it to the Governing Board at the next meeting;
(c)create, re-designate and fill contract, temporary posts in such a manner as may be prescribed by the Statute;
(d)make appointments of any employees of the University in such a manner as may be prescribed by the Statutes;
(e)suspend, punish and remove, in accordance with prescribed procedure, from service, the faculty, Officers, Teachers and other employees of the University;
(f)delegate, subject to such conditions as may be prescribed, any of his powers under this Act to an officer of the University;
(g)appoint, teachers, faculty, examiners or reviewers and paper setters for all examinations .of the University and related schools, colleges, and institutions;
(h)appoint foreign and local referees for evaluation of candidates for faculty positions; and
(i)exercise and perform such other powers and functions as may be prescribed by this Act, its, Statutes; Ordinances etcetera.
(24)The Chancellor is , empowered to appoint an inquiry officer or officers for the purpose of inquiry into any matter which he may deem fit for inquiry. The inquiry officer or officers, inquiring under this Act, shall be deemed to be a civil court for the purposes of section 195 and Chapter 26 of the Code of Criminal Procedure, 1973 (Central Act no. 2 of 1974.
(25)The Chancellor may delegate to the Vice-Chancellor or Registrar or any other Officer of the University with such or any of his powers under this Act or the Statutes, as he may specify.
(26)The Chancellor shall periodically submit a detailed report of all his actions with reasons (whenever necessary) for such actions to the Governing Board and shall place them before such meetings of the Governing Board for review.
(27)Any matter which needs to come before the Governing Board shall need the pre-approval of the Chancellor and Chancellor shall give effect to all the decisions of the Governing Board.
(28)He shall' hold office normally for three years and eligible for re-appointment and it will be as per the decision of the Governing Board.
(29)There shall be the Office of the Chancellor (OoC) which shall assist the Chancellor in all matters.
(30)In-case it appears necessary to have a Pro- Chancellor, then the Chancellor shall appoint such person as the Pro-Chancellor in consultation with the Governing Board. In case of an appointment of a Pro- Chancellor then
(a)The Pro- Chancellor shall be permanent invitee to the Convocations and award functions of the University;
(b)The Pro- Chancellor shall exercise such other privilege, such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera or as specifically given/granted by the Chancellor.
(31)The Chancellor shall exercise such other privilege, such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera.

37. The Vice-Chancellor of the University, his powers, duties, and privileges.

(1)The Vice- Chancellor shall be appointed by the Chancellor in consultation with the Governing Board and in consideration of the recommendations of the selection committee constituted by the Governing Board, for that purpose.
(2)The Vice-Chancellor of the University shall be a whole-time resident and salaried officer of the University. The terms and conditions of the service of the Vice-Chancellor shall be such as may be prescribed by the Act, its Statutes, its Ordinances or as decided by the Chancellor.
(3)He shall be the Principal Academic Officer and Principal and Principal of the University and shall be Principal In-Charge of all the academic activities of the University. He shall also be the Chairman of the Academic Council of the University.
(4)The Vice-Chancellor shall be a highly experienced person with such proven academic credentials.
(5)He shall hold office normally for three years and eligible for re-appointment and it will be as per the decision of the Governing Board.
(6)There shall be the Office of the Vice-Chancellor (OoVc) which shall assist the Vice-Chancellor in all matters.
(7)The Vice- Chancellor shall exercise such other privilege, such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera or specifically given/granted by the Chancellor.

38. The Registrar of the University, his powers, duties and privileges.

(1)The Registrar shall be appointed by the Chancellor in consultation, with the Governing Board and in consideration of the recommendations of the selection committee constituted for that purpose.
(2)The Registrar shall be a whole-time resident and salaried officer of the University. The terms and conditions of the service of the Registrar shall be such as may be prescribed by the Act, its Statutes, its Ordinances or as decided by the Chancellor.
(3)The Registrar shall-be subordinate of the Chancellor and the Vice-Chancellor and he shall be the custodian of the properties of the University as the Governing Board or the Chancellor shall commit to his charge.
(4)The Registrar shall be responsible for the due custody of the' records and the common seal of the University and shall be bound to place before the Chancellor, the Vice- Chancellor or any other authority, all such information and documents as may be necessary for the transaction of their business.
(5)The Registrar shall be responsible for the proper administration of the University and for close coordination and integration of teaching, research, and dissemination of knowledge.
(6)He shall be responsible for the document preservation, record, and archives of all records.
(7)He shall have the powers to conduct all the official and general correspondence within the University system, its Authorities, colleges, Institutions etcetera.
(8)He shall have the powers to look after the general administration, maintenance, Cleanliness, and discipline at the University, its centers and in their premises.
(9)He shall be the Chief State Public Information Officer, Chief Welfare Officer, Chief Protocol Officer, Chief Public Relation Officer and Chief Customer Relation Officer of the University.
(10)He shall have, the powers to issue all notices convening meetings of all/any authorities and committees of which he shall be the Secretary, to keep minutes of meetings of all such Authorities and Committees. However, no meeting' shall be conveyed without the instructions of the Chancellor or the Governing Board.
(11)The Registrar shall arrange/superintend, conduct and take steps to evaluate all the examinations/ test held/ conducted by the University, as directed by the Academic Council, Governing Board or by the Chancellor.
(12)The Registrar shall have the powers to inspect and recommend new centers, colleges, institutions, schools of the University and also to recommend for the termination of the same. However, in any case the decision of the Chancellor shall be final and binding.
(13)To manage, subject to the control of the Governing Board, the properties of the University.
(14)To prepare and to present the Governing Board the annual report of the working of University, the annual statement of accounts and the budgets of the University for next financial year, and to maintain properly the action of the University.
(15)The Registrar of a University shall, subject to the sanction of the Chancellor and subject to the Rules and Regulations that may be framed in this behalf, control the ministerial, technical and inferior staff of the University concerned.
(16)The Registrar shall prepare and update the Handbook of Statutes, Regulations, and Rules approved by authorities, bodies or committees from time to time, and make them available to public, all respective members of the authorities and officers of the University;
(17)He shall be responsible for the discipline of the University in accordance with this Act, Statutes, Rules, and Regulations.
(18)He is also empowered to perform any such other work as may from time to time be assigned to him by the Governing Board or by the Chancellor.
(19)The Registrar shall be a highly experienced person with such proven academic credentials.
(20)The Registrar may delegate to any other Officer of the University with such or any 13r his powers under this Act or the Statutes, as he may specify, with the approval of the Chancellor.
(21)There, shall be a post of Administrative Officer of the University who shall report to the Registrar and to the Chancellor. The Administrative Officer of the University shall exercise such powers and duties as may be given/granted to him by the Chancellor or by the Registrar from time to time.
(22)There shall be the Office of the Registrar (OOR) which shall assist the Registrar in all matters.
(23)The Registrar shall exercise such other privilege, such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances etcetera or those specifically given/granted by the Chancellor or the Governing Board.

39. Other Officers.

- The manner of appointment, terms, and conditions of service and powers and duties of the other officers of the University shall be such as may be specified by Statutes.

40. Authorities of the University.

- The following shag, to the authorities of the University, namely;
(1)The Governing Board;
(2)The Academic Council;
(3)The Schools of Studies;
(4)such other bodies or authorities as may to declared by the Statutes to be authorities of the University.

41. Governing Board.

(1)There shall be a Governing Board of the University consisting of the following persons as its members, namely:-
(a)the Chancellor;
(b)the Vice-Chancellor;
(c)the Registrar;
(d)the Founder;
(e)the Additional Founder;
(f)the Co-Founder/s;
(g)the General Counsel;
(h)five members nominated by the Founder and as approved by the Chancellor;
(i)one member to be nominated by the proposing body and as approved by the Additional Founder;
(j)two members nominated by the Additional Founder and as approved by the Chancellor;
(k)two Member advisers from amongst the persons being experienced personalities in their respective field, to be nominated by the Chancellor;
(l)two female members, to be nominated by the Chancellor;
(m)Two ex-officio members, officers equivalent to the rank of Deputy Secretary/Joint Director or above as may be nominated by the Department of Higher and Technical Education, Government of Manipur,
(2)Each member of the Governing Board referred to in clauses (h) to (l) of sub-section (1) shall hold office for a fixed term of three years and eligible for reappointment as per the discretion of the Chancellor.
(3)The Chancellor shall be the Chairperson of the Governing Board. All the meetings of the Governing Board shall always be chaired by the Chancellor and in his, absence by any one of the nominees of the Chancellor. If Chancellor has not nominated any person to Chair such a meeting, members present at the meeting shall elect the Chairperson for that meeting only from among themselves by a simple majority.
(4)The Chancellor shall also have a veto power including absolute, amendatory, package, reduction, suspension, and pocket which are discretionary by the Chancellor.
(5)The Registrar shall be the Member-Secretary of the Governing Board.
(6)The members of the Governing Board can also be called as Directors of the Governing Board of the University.
(7)The Governing Board shall meet at least twice in a year.
(8)Subject to the provisions of this Act; the Statutes, the Ordinances, the Rules and the Regulations made there Under, the Governing Board may regulate its own procedure (including quorum) for the conduct of its meetings and other related things.
(9)The Governing Board shall have the powers to terminate any of the officer, faculty or the employees of the University by giving the prior notice to such officer, faculty or the employee. In all such cases, it shall provide a reasonable hearing opportunity to such officers faculty or the employee concerned.
(10)The Chancellor of the University shall be appointed by the Governing Board except in the case of first Chancellor.
(11)The Governing Board shall be the Supreme Authority of the University.

42. (Sic).

(1)The Governing Board shall be responsible for all the policies and directions of the University and management of its affairs.
(2)The Governing Board shall exercise such powers as may be prescribed by the Statutes.

43. (Sic).

(1)The basic responsibilities of Governing Board members shall be;
(a)to act reasonably to ensure that the Governing Board carries out its functions and exercises its powers appropriately, effectively and efficiently;
(b)to act in good faith, honestly and for proper purposes consistent with the objects and interests of the University;
(c)to exercise reasonable skill, appropriate care and diligence; and to take reasonable steps to avoid all conflicts of interest unless they are declared in accordance with the Constitution and Governance of the University under this Act or its Statutes, its Ordinances, rules and regulations made there under.
(2)A member of the Governing Board must not make improper use of his or her position as a member, or of information acquired because of his or her position as a member, to gain, directly or indirectly, an advantage for the member or for another person.

44. The Academic Council.

(1)The Academic Council shall be the principal academic body of the University and shall, subject to the provisions of this Act, the Statutes, and the Ordnance's, have the control and general regulation of, and be responsible for, the maintenance of standards of learning, education, instruction, evaluation and examination within the University and shall exercise such other powers and perform such other functions as may be conferred or imposed upon it by the Statutes.
(2)The Constitution of the Academic Council and the term of office of its members , including its procedure and other matters shall be prescribed by the Statute.

45. The School Studies.

(1)The University is fully empowered to have Schools of Studies in all subjects and is empowered to offer all courses at all levels including School of Humanities and Social Sciences; School of Sciences; School of Education; School of Continuing Education; School of Engineering and Technology; School of Commerce and Management Studies; School of Health Sciences; School of Computer and Information Sciences and such; other Schools as may be set-up by the Statutes.
(2)Each such, School of Studies shall be chaired by a Dean and each department under the School of Studies shall have a Head of the Department.
(3)Every School of Studies shall have a Board of Studies. The constitution of Board of Studies shall be in accordance with such conditions as may be laid down by its Statutes, Ordinances, Rules or Regulations.

46. Constitution of other authorities.

- The Constitution, powers, and functions of authorities of the University or such other authorities which may be declared by the Statutes to be authorities of the University shall be prescribed by the Statutes and it shall be in the manner prescribed.

47. Statutes.

- Subject to the provisions of this Act, the Statutes may provide for all or any of the following matters, namely:-
(a)the manner of appointment of the Chancellor, the emoluments and other conditions of his service and the powers and functions that may be exercised and performed by him;
(b)the manner of appointment of the Vice-Chancellor, the term of his appointment, the emoluments and other conditions of his service and the powers and functions that may be exercised and performed by him;
(c)the manner of appointments of the Registrar, and other officers and terms and conditions of their service and the powers and functions that may be exercised and performed by such officers;
(d)the other authorities of the University, the terms of office of the members of such authorities and the powers and functions that may be exercised and performed by such authorities;
(e)the appointment of teachers and other employees of the University, their emolument and other conditions of service;
Provided that the terms and conditions of teachers and employees shall not be varied to their disadvantage;
(f)the constitution of a pension or provident fund and the establishment of an insurance scheme for the benefit of the faculty and employees of the University;
(g)the principles governing the seniority of service of the employees of the University;
(h)the procedure for regulating the work of the Tribunal of procedure for regulating the work of the Tribunal of Arbitration; the procedure for the settlement of disputes between the employees or students of the University, and the University;
(i)the co-ordination and determination of standards in the University;
(j)all other matters which by this Act are to be, or may be, provided by the Statutes.

48. Statutes how made.

(1)The first Statutes shall be made by the Governing Board, with the prior approval of the Chancellor, within twelve months of the commencement of this Act, for the operation of the University.
(2)the Governing Board may, from time to time, make new or additional Statutes or may amend or repeat the Statutes referred to in sub-section (1):Provided that the Governing Board shall not make, amend or repeal any Statute affecting the status, powers or constitution of any authority of the University until such authority has been given a reasonable opportunity to express its opinion in writing on the proposed changes and any opinion so expressed has been considered by the Governing Board.
(3)Every new Statute or addition to the Statutes or any amendment or repeal thereof shall require the assent of the Chancellor, who may assent thereto or withhold assent or remit to the Governing Board for reconsideration in the light of the observations, if any, made by him.
(4)A new Statute or a Statute amending or repealing an existing Statute shall not be valid unless it has been given assent by the Chancellor.
(5)Notwithstanding anything contained in the forgoing sub-sections, the Chancellor may make new or additional (sic) or amend or repeal the Statutes referred to in sub-section (1).

49. Ordinances.

(1)Subject to, the provisions of this Act and the Statutes, the may provide for all or any of the following matters, namely:-
(a)the admission of students, the courses of study and the fees therefore, the qualifications pertaining to the award of degrees, diplomas, certificates and other academic distinctions, the conditions for the grant of fellowships and awards and the like;
(b)the conduct of examinations, including the terms and conditions of office and appointment of examiners;
(c)the conditions of residence of students and their general discipline;
(d)the management of colleges and institutions maintained by the University;
(e)the procedures for the settlement of disputes between the employees and the University, or between the students and the University;
(f)the procedures for the settlement of disputes between the employees or students of a college or an institution and its governing board;
(g)the procedure for any appeal by an aggrieved employee or a student of a college or, an institution;
(h)maintenance of discipline among the students of the University, colleges, and institutions;
(i)regulation of the conduct and duties of the employees of the University, colleges and institutions arid regulation of the conduct of the students of the University and of colleges and institutions;
(j)the categories of misconduct for which action may be taken under this Act or the Statutes or the Ordinances; and
(k)any other matter which, by or under this Act or the Statutes, is to be, or may be, provided for by the Ordinances.
(l)any other matter which by this Act or the Statutes is to be, or may be, provided for by the Ordinances.
(2)The first Ordinances shall be made by the Governing Board with the previous approval of the Chancellor and the Ordinances so made may be amended, repealed or added to at any time by the Governing Board, in the manner prescribed by the Statutes.
(3)Notwithstanding anything contained in the foregoing sub-sections, the Chancellor may make new or additional Ordinances or amend or repeal the Ordinances referred to in sub-section (2).

50. Regulations.

- The authorities of the University may make regulations consistent with this Act, the Statutes and the Ordinances for the conduct of their own business and that of the committees, if any, appointed by them and not provided.

51. Power to make rules.

- The Chancellor may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.

52. The University.

(1)The University shall establish a fund to be called as the University Fund.
(2)The following shall form part of, or be paid into, the University. Fund, namely; -
(a)all contributions or grants made including any contribution or grant made by any Government or any of its agencies-or any authority;
(b)all incomes or moneys from trusts, bequests, donations, endowments, subventions, and other grants made by anyone including private individuals or institutions or organizations;
(c)the income received by the University from any fees or charges, consultancy etcetera;
(d)any or all the income generated by any or various activities of the University;
(e)all such sums of money or other property, real or personal, as may be acquired, purchased or received by, or transferred to, the University, whether by way of gift, devise, bequest, purchase or otherwise howsoever;
(f)all such sums of money or other property, real or personal, es may accrue to the University in the exercise a its powers or the performance of its functions under this Act;
(g)all such sums of money or other property, real or personal, as may accrue to, or be received by, the University by way of fees, grants, subsidies, contributions, donations, subscriptions, rents, interest or royalties from any Government any authority, any organization or from any person;
(h)the amounts borrowed by the University; and
(i)any amounts received from any other source.
(3)The University Fund shall, at the discretion of the Governing Board, be kept in a Scheduled Bank as defined in the Reserve Bank of India Act 1934, or in a corresponding new bank constituted under, the Banking Companies (Acquition and transfer of Undertakings) Act, 1970, and the Banking Companies (Acquition and Transfer of Undertakings) Act, 1980, or may be invested in such securities authorized by the Indian Trusts Act, 1882.
(4)The University Fund may be expended for such purpose of the University and in such manner, as may be approved by the Governing Board. The Fund may also be employed for any of the purposes of the University in the manner prescribed or as, the Chancellor may find suitable for the fulfillment of its purposes and objectives.
(5)The Fund and accounts shall be operated by an officer of the University who has been duly authorized approved by the Governing Board.
(6)Where under the terms of any written instrument, any right, title or interest in real or personal property is expressed to be disposed, granted or conveyed to the University, the said instrument shall, subject to law, have effect as a disposition, grant or conveyance of such property to the University and shall vest such property in the University to the extent of the right, title or interest therein expressed to be so disposed, granted or conveyed.
(7)The University shall also have a fund called the Permanent Endowment Fund which it shall invest and keep invested in securities issued or guaranteed by the Central Government or by any State Government. Allocation, maintenance and usage of such fund shall be as per the discretion of the Governing Board and as per the Statutes.
(8)The University may have such other funds as may be prescribed by the Statutes.
(9)The property of the University shall be payable to, vested in, held, managed and controlled by the Chancellor, Under this Act. However, the Governing Board shall supervise arid exercise supreme authority over and above the Chancellor as and when required.

53. Annual Report.

(1)The Annual Report of the University shall be prepared under the direction of the Governing Board and shall be submitted to the Governing Board , for its approval.
(2)The Governing Board shall consider the Annual Report in its meeting and may approve the same with or without modification.
(3)A copy of the Annual report duly approved by the Governing Board shall be sent to the State Government on or before December 31 following close of the financial year in March 31 each year for information.

54. Annual Accounts.

(1)The Annual Accounts and Balance Sheet of the University shall be prepared by the Internal Auditor or Chief Accounts Officer of the University under the direction of the Governing Board and all the funds accruing to or received by the University froth whatever source and all amount disbursed or paid shall be entered in the accounts maintained by the University.
(2)The Annual Accounts of the University shall be audited every year by a Chartered Accountant, who is a member or a fellow of the Institute of Chartered Accountants of India, to be appointed by the Governing Board on mutually agreeable terms, every year.
(3)All cases of irregular, illegal or improper expenditure or of failure to recover moneys or other property due to the University or of any loss or waste of money or other property thereof caused by neglect or misconduct of the officers and authorities of the University shall be reported by the Chartered Accountant, in his Audit report, which has to be submitted to the Governing Board. He shall also report on any other matter relating to the accounts of the University as may be required by the Governing Board.
(4)The Governing Board shall forthwith remedy any defect or irregularity pointed out by the auditor and reports the action taken, to the Chancellor.
(5)A copy of the. Annual Accounts and the Balance Sheet together with the audit report shall be submitted to the Governing Board on or before November 30 following the close of the financial year on March 31 each year.
(6)The Annual Accounts, the Balance Sheet, and the Audit Report shall be considered by the Governing Board at its meeting and the Governing Board shall forward the same to the State Government along with its observation thereon on or before December 31 each year.

55. Budget.

- The Registrar, on behalf of the University and with, prior consultation and approval of the Founder and the Chancellor, shall prepare, in such form and at such time each year as may be prescribed, a budget in respect of the financial year next ensuing showing the estimated receipts and expenditure, and copies thereof shall be forwarded to the State Government after getting due approval from the Governing Board and the Chancellor.

56. Conditions of service of employees.

(1)The University shall enter into a written contract of service with every employee of the University appointed on regular basis or otherwise and the terms and conditions of the contract shall not be inconsistent with the provisions of this Act, the Statutes, and the Ordinances.
(2)A copy of the contract referred to in sub-section (1) shall be lodged with the University and a copy thereof shall also be furnished, to the employee concerned.

57. Tribunal Arbitration.

(1)Any dispute arising out of a contract of employment referred to in the previous of this Act between the University and the employee shall be referred to a Tribunal of Arbitration which shall solely consist of the General Counsel of the University or the sole member as may be nominated by the General Counsel.
(2)Every such reference shall be deemed to be a submission to arbitration on the terms of this section within the meaning of the Law of Arbitration as in force, and all the provisions of that Law.
(3)The procedure for regulating the work of the Tribunal of Arbitration shall be such g may be prescribed by the Statutes.
(4)The decision of the Tribunal of Arbitration shall be final and binding on the parties, and no suit shall lie in any civil court in respect of any matter decided by the Tribunal.

58. Procedure of appeal and arbitration in disciplinary cases against students.

(1)Any student or candidate for an examination whose name has been removed from the rolls of the University by the orders or resolution of the Chancellor, or by any other committee, as the case may be, and who has been debarred from appearing at the examinations of the University for more than one year, may, within ten days of the date of receipt of such orders or copy of such resolution by him, appeal to the Governing Board and the Governing Board may confirm, modify or reverse the decision of the Chancellor or the Committee, as the case may lie.
(2)Any dispute arising out of any disciplinary action taken by the University against a student shall, at the request of such student, be referred to a Tribunal of Arbitration and the provisions of sub-sections (1), (2), (3) and (4) of the previous section shall, as far as may be, apply to a reference made under this sub-section.

59. Right to Appeal.

- Every employee or student of the University or of a School or center or college or institution or school maintained by the University or admitted to its privileges shall, notwithstanding anything contained In this Act, have a right to appeal within such time as may be prescribed by the Statutes, to the Chancellor against the decision of any officer or authority of the University or of the Principal or the management of any Faculty, School, Cone& or Center or an Institution, as the case may be, and thereupon the Chancellor -may confirm, modify or reverse the decision appealed against and his decision shall be final and binding.

60. Filling Casual Vacancies.

(1)All casual vacancies among the members (other than ex-officio members) of any authority or another body of a University shall be filled, as soon as conveniently may be, by the persons or body who appointed, elected or co-opted the member whose place has become vacant, and the person appointed, elected or co-opted, to a casual vacancy, shall be a member of such authority er body for the residue of the term for which the person whose place he fills, would-have been a member.
(2)A person who is a member of an Authority of a University as a representative of another body whether of the University or outside, shall retain his seat on the University Authority, so long as he continues to be member of the body by which he was appointed or elected and thereafter till his successor is duly appointed.

61. Remuneration of Faculty, Officers, and Employees.

- No Faculty, Officer or Employee of University shall be offered nor shall he accept any remuneration for any work in the University save as may be provided for in the Statutes.

62. Mode of proof of University record.

- Notwithstanding anything contained in the Indian Evidence Act, 1872 or in any other law for the time being in force, a copy of any receipt, application, notice, order, proceeding or resolution deny authority or committee of the University or other documents in possession of the University or any entry in any register duly maintained by the University, if certified by the Chancellor or any person/officer authorized by him, shall be received as prima facie evidence of such receipt, application, notice, order, proceeding, resolution or document or the existence of the entry the register and shall be admitted as evidence of the matters and translation therein recorded where the original thereof would, if produced, haves-been-admissible in evidence-

63. Judicial notice of Statute, Ordinances, Rules or Regulations.

- The production of a verified copy of a Statute, Ordinances, Rules or Regulations and orders of the University or resolution of the Governing Board under the common seal of the University along with signature of the Chancellor or Officer/ person authorized by him shall be a sufficient evidence of its making and authenticity of University Statutes, Ordinances, Rules or Regulations made under this Act in all courts and tribunals; and before all persons acting judicially.

64. Authentication of orders and other instruments of the University.

- All orders and decisions of the University shall be authenticated by the signature of the Chancellor or any other officer of the University authorized by the Chancellor in this behalf and all other instruments issued by the university shall be authenticated by the signature of orders and other the University. instruments of of the Chancellor or any other officer of, the University authorized in like manner in this behalf.

65. Service of Notice and Documents.

(1)Any notice or document required, by or for the purposes of the Act, the Statutes, the Ordinances, Rules and Regulations, to be given or sent to anybody or any authority including to Acuity or student of the University, or a member of any Board / Committee may be given to him personally or may be sent to hint by post, to his last postal address- of which the Registrar has cognizance.
(2)Where a notice or other document is sent by post, pursuant to sub-section (1), service thereof shall be deemed to have been properly effected by property addressing and posting a letter containing the notice or other document, and shall be deemed to have been effected at the time at which the letter would be delivered in the ordinary course of post.

66. Sponsored schemes.

- Notwithstanding anything in this Act, whenever the University receives funds from any Government, any authority or any endowment any other agency including industry sponsoring a research scheme, a consultancy assignment, a teaching program or a chaired professorship or a scholarship, etcetera to be executed or endowed at the University;
(a)the amount received shall be kept by the University separately from the Fund of the University and utilized only for the purpose of the scheme; and
(b)the staff required to execute the same shall be recruited in accordance with the terms and conditions stipulated by the sponsoring organization/body or individual: Provided that any money remaining unutilized under clause, (a) shall be transferred to the endowment fund of the University created under this Act.

67. Transfer of (Sic) other Institution to the University.

(1)The University may take the control, ownership and/or management of any other college, institution, organization, school, trust or society on such terms and conditions as it may deem proper.
(2)The University may adopt any college, institution, school or village etcetera or to start any such adoption programme with the approval of the Governing Board.

68. Pension, Gratuity, Insurance and Provident Fund. (Central Act XIX of 1925).

(1)The University may institute for the benefit of University faculty, officers, teachers, staff and any of the servants of the University in such matters as pension, gratuity, and provident fund as it may deem fit in such manner and subject to such conditions as may be prescribed by Ordinances;
(2)The. University may also make provisions for the benefit of students in such matters as insurance etcetera as it may deem fit in such manner and subject to. such conditions as may be prescribed by Ordinances;
(3)Where the University has so instituted a provident fund under sub-section (1), the Government may declare that the provisions of the Provident Fund Act, 1925 shall apply to such fund as of the University were a local authority and the fund a Government provident fund.
(4)The University may invest the provident fund amount in such manner as it may determine or as determined by the Governing Board.

69. Terms and conditions of faculty and employees.

- The terms and conditions of service (including contract service) and the redressal of grievances relating thereto, of faculty, of teachers, officers and employees of the University shall be such as may be prescribed by the Regulations.

70. Deemed (sic) validity of appointments.

- Notwithstanding anything contained in any other law of instrument having the force of law for the time in force, the appointments made, to any post in the University in accordance with the Statutes and Regulations shall be deemed to be valid and in accordance with law.

71. Power of the State Government to obtain (sic) information and to cause inspection.

(1)The State Government shall have the power to cause an inspection of the University, its buildings, libraries, laboratories and equipment and of any College or Institution maintained by the University or admitted to its privileges; and also of the examinations, teaching and other work conducted or done by the University.
(2)Notwithstanding anything contained in this Act or any other law for the time being in force, the State may by order in writing call for any information from the University on any matter relating to the affairs of the University and the University shall, if such information is available with it; furnish the State with such information within a reasonable period.
(3)The University shall have the right to make such appeal/representations to the State Government, as and when it may consider necessary.

72. Grant of Degrees.

- Notwithstanding anything contained in the University Grants Commission Act, 1956 or in any other law for the time being in farce, the University-shall have the power to grant degrees and academic distinction and titles under this Act.

73. Withdrawal of Degrees.

- The Academic Council may, by a special resolution passed by a majority of not less than two-thirds of the members present and voting, withdraw any degree, title or academic distinction conferred on, or any certificate or diploma granted to, including an honorary degree of academic distinction granted to, or conferred upon, a student or an eminent person or any person by the University for good and sufficient cause:Provided that no such resolution shall be passed until a notice in writing has been given to that person calling upon him to show cause within such time as may be, specified in' the notice why such resolution should not be passed and until his objections, if any and any evidence he may produce in support of them, have been considered by the Academic Council.

74. Penalties.

(1)Whoever indulges or indulged in the forgery or impersonation or fraud or unauthorized duplication of any document of the. University or anybody / authority connected with the University or as any person, officer, faculty, staff, teacher without such authority to do so or unless authorized / without any permission by the Chancellor shall be a cognizable offence and shall on conviction be punishable with a minimum fine of rupees ten million which may extend to rupees hundred million or with an imprisonment for a term of six months which may extend to five years or with both.
(2)Whoever contravenes the provisions of this Act or the Statutes, the Ordinances, Rules, and Regulations made there under or any examination matters or in matters relating to award of degrees or in giving marks cards without such authority to do so or unless authorized / without any permission by the Chancellor shall be a cognizable offence and shall on conviction be punishable with a minimum tine of rupees ten million which may extend to rupees hundred million or with an imprisonment for a term of six months which may extend to five years or with both.
(3)Notwithstanding anything contained in this Act or in any other law, for the time being in force, no person or institution other than the University, shall confer, grant or issue or hold himself or itself out as entitled to confer, grant or issue any degree, diploma or certificate which is identical with or is a colorable imitation of any degree, diploma or certificate conferred, granted or issued by the University.
(4)Contravention of the provisions of sub-section (3), shall be a cognizable offense and shall on conviction be punishable with a minimum fine or rupees ten million which may extend to rupees hundred million or with an imprisonment for a term of six months which may extend to five years or with both.
(5)Where an offence under this section has been committed by a company, the company as well as every person in charge of, and responsible to, the company for the conduct of its business at the time of the commission of the offence shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly.
(6)Notwithstanding anything contained in this, section, where an offence under this section has been committed by a company and it is proved that the offence has been committed with the consent or connivance of; or that the commission of the offence is attributable to any neglect on the part of, any Part (Sic) Director, Manager, Secretary another officer of the company, such partner Director, manager Secretary or another officer shall also be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.Explanation. - For the purposes of this section,-
(a)"Company" means any body corporate and includes a firm or other association of individuals; and
(b)"Director" in relation to a firm is a partner in the firm:
Provided that nothing contained in this section shall render any such person liable to any punishment if he proves that the offense was committed without his knowledge or that he exercised all due diligence to prevent the commission of such offense.
(7)A penalty under this section may be imposed without prejudice to the penalty specified in any caber State or Central Act.

75. Dis-qualification.

(1)No person shall be qualified for election or member as a member of any of the authorities of the University, if, on the date of nomination or election, he is-
(a)of unsound mind;
(b)an applicant to be adjudicated insolvent or an undischarged insolvent; (c) sentenced by a criminal court to imprisonment for any offence involving moral turpitude.
(2)In the case of dispute or doubt, the Chancellor shall determine whether a person is disqualified under sub-section (1) and his decision shall be final and binding.

76. Constitution of committees.

- A1l the authorities of the University shall have the power to appoint committees / sub-committees and to delegate to them such of their powers as they deem fit; such committees shall, unless there be some special provision in this Act to the contrary, consist of such members of the authority concerned and of such other persons, if any, as the authority in each case may think fit.

77. Flaws in the constitution of Authorities.

- Where there is a flaw in the constitution of an Authority or Committee, as constituted by this Act, the Statutes, the Ordinances, the Rules or the Regulations on account of the abolition of a specified office under Government or because an organization, institution or another body outside the University has been dissolved or has ceased to function, or because of some other similar reason, such flaw shall be removed in such manner as the Governing Board or the Chancellor may direct.

78. Each document shall be a Public Record.

(1)All, the documents/certificate/letter issued, received or held by the University shall constitute to be a Public Record.
(2)A Citizen of India shall have the right to apply for the duplicate copies or certified true copies of any document/ certificate/ letter issued by the University by remitting such fees and by applying in such it way fixed as per its Statutes and Ordinances or as fixed by the Chancellor.
(3)Each document/certificate/letter issued by the University or its behalf or by anyone relating to the University in an official capacity shall carry a Unique Identification Number which shall be verified, sealed, certified, copied, scanned, stored/archived, numbered, and signed/digitally signed either by the Chancellor or by the Certification cum Verification Officers to be appointed by the Chancellor, specifically for the purpose. The rules regarding the same shall be as per the Rules and Regulations made by the Chancellor.
(4)The University may create a unique system for immediate verification of authenticity of any documents/ certificates / letters issued by the University through its Official Website with the help of Unique Identification Number already allotted to each-document. This may be the unique system to be started by the University as to avoid or nullify forgery of documents as well as easy verification of credentials by the concerned. However no one can ever demand this facility as a right as this all" only be a facility to help the general public and other or any of the Officials to check the authenticity of documents.
(5)However, the University shall follow a separate set of Rules and Regulations for the documents intended for the internal circulation or general official/administrative or academic communication/s between Officers/ Staff and Faculty of the University.
(6)The provisions of the RTI Act, 2005 shall apply to the University, as if it were a public authority as defined In clause (h) of section 2 of the RTI Act, 2005.
(7)The University shall compulsorily place in the public domain every information in relation to the University which would be of interest to students and other stake holder inter alia including the courses offered, the number of seats under different quotas, fees and other charges, facilities and amenities offered, faculty in place and such other relevant information.

79. University Gazette.

- There may be a UniVersity Gazette which shall be an Official Internal Newsletter of the University and it shall be published from time to time by the University. The University Gazette's mission shall be to build a sense of campus community by communicating information relevant and vital to faculty/ officers and staff and to advance the University's overall strength and messages. It shall be for purpose of internal records of the University, University archives and to keep the Officers/ Faculty and Staff updated with the activities of the University. The University Gazette may contain the recent information regarding Statutes, Ordinances, Rules, Regulations, resolutions, appointments, orders, administrative decisions, academic matters, publication of student results, details of certificates issued, details of the awards won/ given, new centers, new programs, research papers and everything which the Chancellor may deem fit to publish. However, there shall separate editorial board for the University Gazette which shall be constituted and supervised by the Chancellor or the person nominated by him.

80. Liability with respect to acts of students.

- Neither the University nor the Chancellor nor the Founder nor the Governing Board nor the Academic Council, nor any member of the Governing Board or Academic Council or any other committee, nor any appointee, faculty, officer or employee of the University, is liable by reason of any act or omission of them, or any of them, in respect of any activity of students or on account of any act or omission of any student or students, while not under the direction of the University or any officer or employee thereof.

81. Ban of certain things in the University and its centers.

(1)Drinking, smoking, using, selling, storing, serving, consuming, keeping or usage of any product or thing containing alcohol or tobacco or any narcotic drugs or psyehotropic substance in any manner is banned in the University, its campuses, or any of its centers, affiliated or associated colleges, schools etcetera except for the purpose of education, awareness campaigns, research or cleaning with prior written permission of the Chancellor.
(2)Any kind of ragging in the University Campus or in its affiliated / recognized institutions is totally banned and prohibited and anyone found doing/abetting ragging shall be suitably punished as per Rules and Regulations of the University.
(3)The University shall setup a committee on Sexual Harassment of Women at Workplace as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (Central Act 14 of 2013) and shall make subsequent rules regarding the same.
(4)Any kind apolitical activity either by the students or by the employees inside the University-campus or any of its related institutions either directly or indirectly is totally banned or prohibited and University shall make strict Rules and Regulations against the same.

82. Transitory Powers.

- Where any authority of the University is not constituted, the Chancellor with the approval of the Founder may discharge all or any of the functions of such authority and for that purpose, he shall/may exercise any power of such authority till such authority is constituted.

83. Transitory provisions.

(1)All Statutes, Ordinances and - Regulations made under this Act shall in so far as they are not inconsistent with the provision of this Act, be deemed to have been made under this Act and shall -continue to -be in forte until they are superseded or modified by the Statutes, Ordinances, Rules or Regulations made under this Act.
(2)All notices and orders, made or issued by any authority under this Act shall in so far as they are not inconsistent with the provisions of this Act, be deemed to have been made or issued by the 'corresponding authority under this Act and shall continue to be in force until they are superseded or modified under this Act.
(3)A person who holds any office in the University by virtue of his holding any other office of the University or, otherwise shall hold such office as long as he holds the other office and thereafter till his successor is duly nominated, appointed or elected.

84. Residuary provisions.

- The Governing Board shall have the authority to deal with any matter pertaining to the University and not specifically dealt with in this Act, the decision of the Governing Board on all such matter shall, subject to revision by the Chancellor, be final and shall not be liable to be challenged in (Sic) court or tribunal.

85.

(sic)Subject to provision of this Act, its Statutes, its Ordinances, Rules and Regulations, the Governing Board may, by resolution, constitute such Standing committees or appoint Ad-hoc Committees of such persons and for such purposes and with such powers as the Governing Board may think fit for exercising any power or discharging any function of the University or inquiring into, and reporting or advising upon, any Matter relating to the University.

86. Tripartite Mobility.

(1)Any Faculty, Officer, Teacher or other employees of the University shall, as the Chancellor may direct, serve in a Government department or an educational or research institution on deputation at the disposal of the University in the public interest: Provided that the terms and conditions offered to him shall not be less favorable than those admissible to him in the University and that full benefit of his previous service shall be allowed to him.
(2)The University may appoint persons working in any other University or academic institution or involved in research of significance in any industry or any practitioner as adjunct, guest or visiting teacher of the University on such terms and for such duration as the University may decide in consultation with the other University or institution.

87. Acts and Proceedings not to be invalidated by vacancies.

- No Act of the University or any of its Boards, Councils, Authorities or any other body set up under this Act or the Statutes, Ordinances, Rules, and Regulations made thereafter and under this Act, shall be invalid merely by reason of -
(a)any vacancy in, or defect in the constitution thereof; or
(b)any defect in the election nomination or appointment of a person acting as a member thereof;
(c)any irregularity in its, procedure not affecting the merits of the case.

88. Decisions of questions as to powers.

- Where any question arises respecting the powers of the Governing Board, Academic Council, any committee, or any officer or Staff of Faculty of the University, the question shall be settled by the Chancellor and his decision shall be final and binding.

89. Interpretation.

(1)In the event of a conflict of opinion with regards to the implementation of the Statute, Ordinances, Rules, and Regulations, the provisions of the Act shall prevail; the decision of the Chancellor of the University on interpretation shall be final and binding.
(2)If any question arise as to whether any person has been duly elected or appointed as, or is entitled to be a member of any authority or another body of the University, the matter shall be referred to the Chancellor whose decision shall be final and binding under all circumstances.

90. Provisions pertaining to Agenda Matters.

- No Agenda Matter shall be either included in the Agenda for or taken up for discussion and decided in the meeting of the Governing Board or the Academic Council or any Committees without obtaining the prior written approval of the Chancellor. In the event of breach, the Chancellor shall be entitled at all time to immediately take remedial action by reversing all decisions taken by any functionary or functionaries or body or bodies of the University in breach of the provisions of the Act and consequent upon the pursuit of such a remedial action all such actions taken by the functionary or functionaries or body or bodies of the University in breach of the provisions of the Act shall be deemed to .be null and void, ab initio and consequently the status quo ante shall prevail in respect of the matter or decision in breach.

91. Powers to depute other persons.

- Notwithstanding anything contained in any provision of 'this Act, the Founder -or the Chancellor, on the commencement of this Act, or at any time thereafter, appoint, on deputation or otherwise, any person in the vacancy of an officer / staff or faculty of the University for such period and with such terms and conditions as he may deem necessary.

92. Removal of persons involving in the immoral activities.

- The Governing Board with the due approval or recommendation of the Chancellor may remove any person not being an officer of the University from membership of any authority or body or any employee of the University on the ground that such person or the employee or the faculty has been convicted of an offence involving moral. turpitude or for taking part in subversive activities or for indulging in any act or, acts unbecoming to the prestige and reputation of the University:Provided that no such person or employee shall be removed under this section provided he has been afforded a reasonable opportunity by the Governing Board to show cause as to why he should not be so removed mid such cause has been considered.

93. Resignation from the University.

- Any member other than the ex-officio member of the Governing Board, or the Academic Board or any other authority of the University or Any Officer or staff (whether salaried or otherwise) of the University may resign from his office by a letter addressed to the Chancellor along with a clear reason for such resignation and the resignation shall take effect only from the date on which the same is approved and accepted by the Chancellor.

94. Alumni Association of the University.

(1)There shall be an Alumni Association of the University.
(2)The subscription for membership of the Alumni Association of the University and its constitution shall be as prescribed by the Ordinances.

95.

All acts and orders duly and in good faith done or passed by the University or any of its authorities, its faculty, bodies, directors, members or officers shall be final and no suit, prosecution or other legal proceedings shall lie against, and no damages shall be claimed from any director, officer, faculty, member or employee and other authorities of the University in respect of anything which is in good faith done or purported to have been done or intended to be done in pursuance any of the provisions of this Act, the Statutes, the Ordinances, the Rules, Bye-laws, Regulations or any orders made there under.

96. Removal of difficulties at the commencement of the Act.

- The Chancellor shall have the power to take any action necessary to remove any difficulty that may arise in first giving effect to the provisions of this Act.

97. Dissolution of the University.

(1)The Governing Board of the University, with prior approval of the State Government, the Proposing body, the Chancellor and the Founder, may dissolve the University by giving a notice to the effect in the prescribed manner to the State and the faculty, the employees and the students of the University at least three years in advance:Provided that dissolution of the University shall have effect only after the last batches of the students of the regular courses have completed their courses and they have been awarded degrees, diplomas or awards, as the case may be.
(2)In case of a dissolution, the movable and immovable properties shall be disposed of by the Governing Board in due consultation with the Founder and the Chancellor.
(3)In the unlikely event of dissolution of the University, it shall not be the responsibility of the State Government to run, finance and support the University.

98. Statutes, Ordinances, Rules, and Regulations to be published in the Official Gazette.

- Every Statutes, Ordinances, Rules or Regulations made under this Act shall be published in Official Gazette of the State and the Official Website of the University.

99. Delegation of Powers.

(1)The University may delegate such of its go -era, as it may deem expedient to any of its authorities or to any of his officers, and may, at any time, Withdraw at its discretion any power so delegated.
(2)Subject to the provisions, of this Act and the Statutes, any officer or authority of the University may delegate his or its powers to any other officer or authority or person under his or its respective control and subject to the condition that overall responsibility for the excise of the powers so delegated shall continue to vest in the officer or authority delegating such powers.

100. Savings.

- Anything done or any action taken under the Manipur International University Ordinance, 2018 (Ordinance No. 1 of 2018) shall be deemed to have been done or taken under the corresponding provisions of this Act.
